SOLIDA has been active since 1996 in the struggle against arbitrary detention, enforced disappearance and the impunity of those perpetrating gross human violations.

L'orient le jour - Ziad Doueiri à « L’OLJ » : Le Liban vous donne beaucoup de déceptions, mais en même temps beaucoup d’espoir, September 12, 2017

Il a tenu à être présent aux rendez-vous avec la presse malgré un petit retard. Un retard en dehors de sa volonté, puisqu'il était retenu par les autorités. Après avoir été ovationné durant cinq minutes et demie (un record) au Festival de Venise, après que l'un de ses acteurs, Kamel el-Basha, eut remporté le prix d'interprétation masculine, le cinéaste libanais Ziad Doueiri est revenu avant-hier au Liban pour présenter son film L'Insulte qui sort dans les salles jeudi soir. Pas de réception glorieuse pour le cinéaste talentueux qui hisse haut le nom du Liban à chacun de ses films (West Beyrouth, Lila dit ça, L'Attaque), mais un accueil des plus décevants, et c'est peu dire, puisque le réalisateur franco-libanais a été retenu par la Sûreté générale et s'est vu retirer ses deux passeports. De plus, il fallait qu'il comparaisse devant le tribunal militaire alors qu'il se faisait une joie de rencontrer la presse et de s'assurer des dernières finitions pour l'avant-première. Une idée qui le hantait même devant le tribunal.

Êtres humains
Lavé, lessivé, l'œil un peu hagard, voire triste, il nous a pourtant accueillis avec la plus grande gentillesse. « Malgré le comportement impeccable des autorités, que ce soit la Sûreté générale ou le tribunal militaire, cette histoire nous met dans une situation très fragilisante, a confié le cinéaste à L'Orient-Le Jour. Nous sommes des artistes et des êtres humains capables de tout absorber, mais quand les attaques deviennent tellement sales, et que nous savons d'avance que nous sommes innocents (NDLR, Ziad Doueiri a bénéficié d'un non-lieu), nous ne pouvons qu'en être affectés. »
Et de poursuivre : « De plus, L'Attentat (2013) a été interdit au Liban et les attaquants avaient eu gain de cause. S'ils ont adressé, à l'heure actuelle, non pas une plainte, mais une dénonciation, c'est simplement dans le seul but d'empêcher la sortie de mon film, L'Insulte. Sinon comment expliquez-vous autrement le timing ? L'Insulte ou al-Qadiyyé 23 est un film qui touche des points sensibles que certaines personnes n'ont envie ni de voir ni d'entendre, parce que cela constitue une menace à ce en quoi ils croient. »
Une telle réaction serait en réalité une insulte à l'art ? « Non, c'est une insulte au peuple libanais, parce qu'on le bâillonne, on le prive de sa liberté de parole. Je n'ai aucun souci qu'on déteste mon film après l'avoir vu, parce que le spectateur a acheté son billet et son droit de critiquer. Ces gens-là, par contre, sont simplement des jaloux et des haineux. Leur force n'est pas dans leur autorité morale, mais dans le volume de leur voix. Le peuple libanais a besoin de montrer qu'il est plus grand que cela. »

Surenchères
Pour le cinéaste, ces gens ne sont qu'un fond sonore, « ils se complaisent dans des mots de guerre, pas de paix ». Il estime que « ces gens-là n'ont rien compris au film, car L'Insulte parle de rédemption, de pardon et de réconciliation ». Effectivement, « coincés dans les mythes et des théories des années 70 », les contempteurs de Doueiri font de la surenchère. De la surenchère contre un réalisateur libanais qui, en 2008, s'est vu refuser le financement du scénario par Universal Studios sous prétexte que « le film est trop palestinien ». Mais aussi de la surenchère contre quelqu'un qui a perdu des proches dans le combat pour la cause palestinienne ! Contre un réalisateur qui a réussi à catapulter son acteur principal (un Palestinien sorti des geôles israéliennes) sur le podium du festival le plus prestigieux du monde.
Mais rien ne fait baisser les bras à ce combattant, qui a pour seules armes sa caméra et son mot. Et même s'il va de déception en déception dans ce Liban qui l'a vu naître, il assure que « le Liban vous donne beaucoup de déceptions mais en même temps beaucoup d'espoir ».
Ziad Doueiri, qui s'est vu refuser la sortie de L'Attentat au Liban, a continué à croire en son pays et n'a cessé de revenir pour y tourner un film, bien que des engagements internationaux le retenaient en France. « En interdisant L'Attentat, ont-ils libéré la Palestine ? » s'interroge-t-il. « Si oui, alors je me joins à leur cause. Tout ce qu'ils ont fait, c'est interdire un film qui peut améliorer le système, montrer au monde qu'on a un bon cinéma, doper l'économie cinématographique en assurant des rentrées et en encourageant les acteurs. Tout ce qu'ils ont fait, c'est nuire au Liban à travers moi », martèle-t-il.

Avec Joëlle Touma
La passion du cinéma dévore Ziad Doueiri depuis sa jeunesse. Il lui semble qu'il n'a jamais rien pu faire d'autre à part tenir une caméra. Ce lien physique et mental, organique même, qu'il a avec le cinéma, se traduit par une fusion totale avec sa coscénariste et ex-compagne, Joëlle Touma, avec laquelle il travaille toujours. Et puis, il faut le voir sur un plateau, son énergie, sa manière de ne pas rater un détail, de tout contrôler. « Ma façon de filmer est en effet très organique, mais je ne veux pas en faire une philosophie.
Tout a été fait au cinéma. De temps en temps, on invente quelque chose de nouveau. Moi, j'aime fondamentalement ce métier. Depuis que j'ai fait mes études de cinéma à Los Angeles en 1983 jusqu'à aujourd'hui, je n'ai rien fait d'autre. Joëlle et moi avons vécu entre 2008 et 2011 dans une pauvreté totale. J'ai alors enseigné neuf mois à l'USJ. Des cours de cinéma. C'est la seule chose que j'ai faite qui n'était pas du cinéma », confesse-t-il.


« Wajdi Wehbé, c'est moi... »
Le film, qui tourne autour d'une insulte qui dégénère en un conflit jusqu'à mener aux tribunaux, est porté par un casting d'acteurs « très talentueux, au potentiel énorme, pourvu qu'on leur donne l'occasion de l'exploiter », dit Doueiri. Dans ce film, il ne s'agit pas de lutte entre bons et méchants, mais de combat contre soi-même. Contre les blessures non cicatrisées de la vie ou contre la méfiance d'un homme issu d'un peuple opprimé et qui ne croit plus dans la justice. « Si Joëlle et moi avons écrit ce scénario avec de l'empathie pour les deux acteurs, pour moi, le noyau de l'histoire, c'est l'avocat Wajdi Wehbé, incarné par Camille Salamé. Son texte, que j'ai écrit moi-même, est inspiré des paroles de mes attaquants dans la presse au sujet de L'Attentat. Wajdi Wehbé, c'est moi... »
Ziad Doueiri est certainement sorti vainqueur de cette bataille, mais combien de batailles aura-t-il encore à faire pour que la voix du cinéma libanais soit entendue ? « Mon cinéma ne doit pas être un combat continu. Les gens qui travaillent dans ce milieu connaissent assez les difficultés d'écrire, de financer, de tourner, de monter et de vendre un film. On n'a pas besoin d'en rajouter. Les cinéastes de cette partie du monde ont assez de difficultés à réaliser un film et n'ont pas des George Clooney ou des Matt Damon qui leur permettent de vendre leur film », sourit-il. Et en s'adressant à ses détracteurs, il conclut : « Nous ne vous demandons pas de nous aimer ou de nous appuyer, mais de grâce, laissez-nous montrer au monde notre potentiel et nos talents, et ne salissez pas notre travail. »

Lebanese journalist Fidaa Itani was released Tuesday following an interrogation at the Internal Security Forces Cybercrimes Bureau and overnight detention at a police station.
Itani told The Daily Star that he was released 2 p.m., and revealed that the legal complaint was over a Facebook post.
"They wanted me to make a formal apology to the post," he added. "But eventually all I had to do was take down the post, which I was fine with.”
The Facebook post written on June 30, in Arabic condemned the Lebanese Army's treatment of Syrian refugees.
"Running over a child. Raids...Detaining hundreds. Forcefully returning people to Syria...The dump of Michel Aoun and armed forces following Hezbollah's fascism...," part of his post read.
The journalist added that several other accusations were made against him which he "vehemently denied."
Itani also claimed that the head of the bureau made accusations against him based on other social media posts, which were not covered in the initial legal complaint, including one post on a Syrian who died in military custody in Arsal last week.
However, "no action was taken because the legal complaint was only made regarding the initial post."
Head of the Cybercrime and Intellectual Property Bureau Maj. Suzan Hajj Hobeish was not available for comments.
Itani added that he spent the night in an "overcrowded" cell at an unnamed police station "because the prisons were full."
Hours before his interrogation on Monday, Itani shared a blog post announcing that he was set to be interrogated “for a case that has not officially been disclosed to me yet.”
His brother, Houssam, told The Daily Star that he was summoned following a legal complaint filed by Foreign Minister Gebran Bassil.
The Foreign Ministry declined to comment when contacted Monday.
The journalist has been outspoken over the recent incident in which four Syrian refugees died in military custody after an attack on a military raid on refugee camps in northeast Lebanon’s Arsal.
In the post he criticized the Lebanese Army, President Michel Aoun, Foreign Minister Gebran Bassil, among other Lebanese officials and politicians for being complicit in corruption and dereliction of duty allowing the deaths in custody to take place.
In response to a series of attacks from militants on June 30, the Lebanese Army arrested 355 refugees in Arsal. The Army said that four refugees died in custody due to pre-existing health conditions that were exacerbated by the weather conditions.
Prime Minister Saad Hariri said during last week’s Cabinet session that a military investigation would take place.
Hariri reiterated the news Monday following a meeting with Defense Minister Yaacoub Sarraf and Army head Gen. Joseph Aoun.
Hariri added that he would receive the results of the investigation within “two or three days.”

L'orient le jour - Décès de quatre détenus syriens des ONG des droits de l’homme réclament une enquête officielle, July 06, 2017

Des associations de défense des droits de l'homme ont appelé hier à l'ouverture d'une enquête indépendante sur la mort de quatre Syriens arrêtés la semaine dernière lors des raids menés par l'armée libanaise dans des camp de réfugiés d'al-Nour et d'al-Qariya, à Ersal, au cours desquels cinq kamikazes s'étaient fait exploser.
Selon l'armée libanaise, les quatre hommes, décédés mardi, souffraient de problèmes de santé chroniques qui se sont aggravés « en raison des conditions météorologiques ».
Selon le communiqué de l'institution militaire, les examens médicaux entrepris sur les personnes en état d'arrestation depuis vendredi ont révélé que plusieurs d'entre elles souffrent de maladies chroniques. Elles ont alors été soignées avant d'être interrogées, selon la troupe.
Les médecins légistes ont remis leurs rapports sur les raisons des décès et l'institution militaire a décidé de « faire examiner les autres détenus pour s'assurer qu'aucun cas similaire n'existe ».
L'armée a également publié un communiqué hier dans lequel elle annonce avoir libéré 15 détenus tandis que les 85 autres, sans papiers, ont été déférés à la direction générale de la Sûreté générale.
« Nous demandons urgemment une enquête officielle, transparente et indépendante », a indiqué Lama Fakih, la directrice adjointe de Human Rights Watch (HRW) pour le Moyen-Orient et l'Afrique du Nord, soulignant que l'ONG avait dans le passé « documenté des cas d'abus ou de torture durant des détentions effectuées par l'armée » libanaise.
L'avocat Nabil Halabi, à la tête de l'Institut libanais pour la démocratie et les droits de l'homme (LIFE), a également appelé les autorités libanaises à mener une « enquête sérieuse basée sur des autopsies ». Selon lui, il y a des indications sur la mort d'une dizaine de réfugiés sous la torture.
De son côté, le Centre libanais des droits de l'homme (CLDH) a dénoncé dans un communiqué « la diffusion d'images dégradantes qui documentent les arrestations, la torture des détenus et la campagne systématique d'intimidation contre toute personne ou organisation ayant élevé la voix pour critiquer les procédures illégales utilisées par les forces armées ».
Quant au représentant régional au Moyen-Orient et l'Afrique du Nord du haut-commissaire des Nations unies pour les droits de l'homme, Abdel Salam Sidahmed, il a lui aussi exprimé son inquiétude quant au décès des quatre détenus, appelant les autorités libanaises à « mener une enquête rapide, transparente et indépendante » et à prendre les mesures légales nécessaires à la lumière de cette enquête. Il a par ailleurs mis en exergue la nécessité pour le Liban de respecter ses engagements internationaux au niveau des droits de l'homme.
La coordonnatrice spéciale de l'ONU au Liban, Sigrid Kaag, s'est également attardée hier sur cette affaire lors d'une conférence de presse conjointe avec le coordonnateur spécial adjoint des Nations unies pour le Liban, Philippe Lazzarini. « Nous sommes entrés en contact avec l'armée libanaise pour nous assurer des conditions des arrestations ainsi que pour nous enquérir du décès des quatre détenus », a-t-elle déclaré, avant d'ajouter : « Nous ne possédons pas de données précises sur ce sujet. »
Mme Kaag a tenu à rappeler que « l'ONU dénonce tout acte terroriste », et qu'il « est crucial de différencier entre les personnes armées et les civils et de continuer à respecter les droits de l'homme ».
Mme Kaag a en outre été reçue hier par le responsable des affaires extérieures au sein du Hezbollah, Ammar Moussaoui.

Extremist cleric Sheikh Khaled Hoblos Saturday declared a mass hunger strike at Lebanese prisons to press for general amnesty to be granted to all prisoners.
"We, the inmates in Lebanese prisons, announce a hunger strike to demand a general amnesty," Hoblos said in an audio clip carried out by local TV channel LBCI.
Hoblos, in a 4.27 minute audio clip, urged prison administrations not to force inmates to back down on their hunger strike, deeming it "a right guaranteed by the law."
The extremist cleric, who was arrested in 2015 during a police operation in the northern city of Tripoli, called on the families of the inmates in north, south, east Lebanon and the capital Beirut to "intensify their acts in parallel with the strike."
The notorious Islamist militant Osama Mansour, who was wanted on terrorism charges, was killed in the operation in which Hoblos was apprehended.
Hoblos also urged politicians to work "on granting prisoners an amnesty away from any political" motives.
He called on Prime Minister Saad Hariri to prioritize Lebanon's "national interest."
"To all inmates ... we don't want chaos, riots or [acts] that breach the security of prisons. Cooperate and unite to achieve a better tomorrow," Hoblos said, addressing prisoners.
He also expressed hope that they would be granted general amnesty in time for the Eid al-Fitr, which is the celebration of the end of the month of Ramadan for Muslims.
Arab Tawhid Party leader Wiam Wahhab openly expressed support of a general amnesty in a Tweet Saturday.
"Let us show solidarity with the prisoners ... A general amnesty law has become an urgent necessity," he said.
A general amnesty request must be put forward by the interior and justice ministers, and would also require approval by President Michel Aoun.
Protests are routinely held by the families of Islamist inmates throughout Lebanon.
From the Bekaa Valley to Sidon and all the way to Tripoli, Lebanese have been demonstrating for a general amnesty law that would forgive hundreds of thousands of crimes.
A number of prisoners have been held without a trial.
"This is a message to everyone who has a conscience," Hoblos said in his opening statement.
"It's the right of all prisoners to be granted freedom .... Prisons became crowded with all kinds [of people] who we never thought would be imprisoned."
He criticized security forces for arresting children, women and elderly "on the pretext of pre-emptive security."
"Thousands of arrest warrants have been issued against people in deprived areas, who were forced due to [hard] conditions and lack of official care to use drugs or deal with it."
"It's the right of those who live in Lebanon to get the chance similar to the warlords."
Hoblos blamed the political "division" for the security incidents that occurred in Lebanon.
"Just as the parties that engaged in [Lebanon's 15-year Civil War] had the right to turn a new page and reach reconciliation which paved the way for them to assume control and power ... don't the prisoners, who were betrayed and were the victims of political and security rifts, have the right to be granted [the chance] to open a new page?" he asked.
Roads Blocked
Simultaneously with the hunger strike the families of inmates in the northern district of Akkar blocked the roads.

The Daily Star- Court to forge ahead despite Assir’s refusal to cooperate, April 26 , 2017

BEIRUT: The trial of radical Islamic Sheikh Ahmad al-Assir will press on at the next session scheduled for May 16, after a court hearing Tuesday was postponed due to the lead defendant refusing to address the court. A judicial source told The Daily Star Tuesday that despite Assir refusing to address the court and both his lawyers and those representing many of the 71 other co-defendants boycotting the session, authorities will press ahead with the prosecution’s case regardless of Assir’s level of cooperation.
Tuesday’s session began with seven military lawyers being appointed to represent those without legal representation in attendance.
During the questioning, Assir, who is on trial for his role in the 2013 Abra clashes, refused to answer questions, claiming that the court session was against his rights.
“I will refuse to answer any question the court asks me,” Assir was quoted as saying.
When Judge Hani al-Hajjar asked the defendant who had fired the first shots that led to the clashes, Assir remained silent.
The extremist preacher claimed the judicial proceedings were a war on him and the Bilal bin Rabah Mosque – the mosque in the south Lebanon city of Sidon in which Assir held his popular sermons.
Another defendant, Mohammad Salah, told the court that Hezbollah and the Resistance Brigades were involved in the Abra clashes “and I demand their presence [in court], including Hassan Nasrallah.”
“Why is this happening to us, because we’re Sunni?” another defendant, Adnan al-Baba, was quoted as asking the court. “Everyone knows that the Lebanese Resistance Brigades are part of this case.”
An earlier trial session scheduled for April 4 was derailed by Assir’s defense team’s decision to withdraw, accompanied by the attorneys of other defendants.
Lebanese authorities arrested the Salafist Assir at Beirut’s Rafik Hariri International Airport in 2015, after he had spent more than two years on the run.
Assir is on trial alongside 71 loyalists – including 24 fugitives – on charges of involvement in the June 2013 clashes with the Lebanese Army in Sidon’s Abra neighborhood.
The two-day battle led to the deaths of about 40 Assir loyalists and 18 soldiers. Assir’s lawyers claim Hezbollah linked forces began the battles and call for authorities to investigate this theory before beginning the case against their client.
Assir had been relatively unknown prior to the outbreak of the Syrian war in 2011, but quickly grew to notoriety over his fiery anti-Hezbollah rhetoric.
Family members of the defendants gathered outside the court in Beirut calling for the suspects to be granted amnesty.

Al Mustaqbal- Court to forge ahead despite Assir’s refusal to cooperate, April 26 , 2017

فعلها رئيس المحكمة العسكرية الدائمة العميد الركن حسين عبدالله، ومضى أمس في محاكمة الشيخ أحمد الأسير ومَن معه من الموقوفين في ملف «أحداث عبرا»، منهياً بذلك مرحلة مهمة من المحاكمة، مرحلة الاستجوابات التي تعثرت منذ توقيف الأسير في 15 آب من العام 2015 الذي أعقبه تعطيل للجلسات بفعل استنكاف وكلائه عن الحضور لعدم البت بإخبارات تقدموا بها حول «مَن أطلق الرصاصة الأولى في تلك الأحداث»، محّدداً السادس عشر من أيار المقبل جلسة للمرافعات والنطق بالحكم في حادثة «حصلت على مستوى الوطن»، وفق تعبيره.

كل شيء في قاعة المحكمة العسكرية الدائمة أمس كان يدّل على أن المحكمة مصممّة على إنفاذ قرارها السابق بالسير بالمحاكمة بعد تعيين محامٍ عسكري للدفاع عن الأسير، فاصطف سبعة ضباط من المحامين العسكريين برتبتي نقيب ورائد (ستة من الجيش وواحد من قوى الأمن الداخلي) في المقاعد الأمامية المخصصة للمحامين مزوّدين، كلٌ واحد منهم، بنسخة عن القرار الاتهامي في «أحداث عبرا». وأُحضر الأسير الى المقعد «المخصص له» والموقوفين التسعة عشر الى قفص الاتهام. ومثّلت ثلاث محاميات فقط هن عليا شلحة وهتاف وهبي وهالة حمزة موكليهم بعد انسحاب المحامية زينة المصري لرفض المحكمة استئخار المحاكمة لحين البت بالإخبار الذي تقدمت به بمعزل عن إخبار وكلاء الأسير، والمحامي محمد الدهيبي بعد رفض طلبه الاستمهال للاطلاع على الملف.

وبدءاً من الأسير قررت المحكمة تعيين محامٍ عسكري عنه برتبة رائد رغم رفض الأخير توكيل أي محام أعقبه التزامه بالصمت على 22 واقعة تتضمن أبرز ما ورد في اعترافاته الأولية، بدءاً من نشأته وصولاً الى دعمه الثورة السورية فأحداث عبرا الى انتقاله الى بحنين، لتكر من بعده «سبحة» تعيين المحامين العسكريين عن كل من الموقوفين الذين لم يحضر وكلاؤهم وهم المتهمون ابراهيم سليمان، حسان تابت، خالد عامر، عدنان البابا، محمد وهبي، محمد صلاح، فضل مصطفى، أحمد قبلاوي، محمد الأسدي، محمد علاء المغربي، حسن بلال الزعتري وربيع النقوزي الذي طالب في نهاية الجلسة بـ«استرجاع دراجته الهوائية التي ضبطها الجيش أثناء توقيفه» واصفاً نفسه بأنه«مجنون». وتولى «الدفاع» عن هؤلاء أربعة ضباط بتكليف من الرئاسة.

ومع إعلان المحكمة تكليف محامٍ عسكري للدفاع عنه، بادر الأخير الى رفض تعيين أي محامٍ بمعزل عن وكلائه الأصليين وقال: «اعتبر قراركم ضد حقوقي واستمرار حرب الإلغاء التي شنّت علي بمؤامرة كبيرة وأرفض أن يدافع عني أي محام لأن المنطق غير موجود في ذلك». وتوجه الى رئيس المحكمة قائلاً: «أنت المحامي وأنت المدعي وأنت القاضي». 

وردّ رئيس المحكمة بأن أربع سنوات مرت على هذه القضية و«لن ننتظر أي محام للسير بها فهي حادثة على مستوى الوطن»، موضحاً أن المحكمة لا علاقة لها بالإخبار، ليعود الأسير ويعتبر أن «عدم البت بالإخبار هو أكبر دليل ساطع على أن هناك مؤامرة ضدي». 

وقبل الشروع باستجواب الأسير، سجّل نقاش بين المحامية زينة المصري قبل انسحابها وممثل النيابة العامة القاضي هاني حلمي الحجار الذي اعتبر أن الإخبارات باتت «كإبريق الزيت»، مشيراً الى »«أن ثمة جزءاً من الاستعراضات في هذه المحاكمة تحت عنوان التلازم بالإخبارات والمحاكمة وطلبات الاستئخار». وأوضح الحجار أنه لا يوجد تلازم بين الخبارات والمحاكمة لافتاً الى أنه بحسب المادة 79 من قانون أصول المحاكمات الجزائية فإنه في حال وجود شبهة على أشخاص فإن ذلك لا ينفي التهمة عن الأشخاص الماثلين أمام المحكمة، طالباً بالنتيجة رد أي ادلاءات بهذا الخصوص لعدم توافر الشروط القانونية ومتابعة التحقيقات.

وبعد تلاوة القرار الاتهامي سئل الأسير عما ورد في إفادته الأولية التي اعتبرتها المحكمة شاملة وواضحة ودقيقة فردّ: «اعتبر هذه المحاكمة سياسية والتزم الصمت». وبالفعل لم يجب الأسير أو يعلق على ما ورد في تلك الإفادة التي أعاد رئيس المحكمة على مدى ساعة تلاوتها على مسمعه، إنما اكتفى تارة بالابتسام خصوصاً عندما سئل عن التخطيط للمشروع الإرهابي، وطوراً بفرك يديه والالتفات نحو «موكله» الذي كان ينظر اليه بنوع من الاستهزاء.

حتى أن الأسير لم يجب لدى سؤال الرئاسة عما إذا كان لديه ما يقوله، وجاء الصمت نفسه لدى سؤال ممثل النيابة العامة، حول من الذي أطلق الرصاصة الأولى موضوع الإخبار، لكن أصواتاً علت من قفص الاتهام قائلة: هم سرايا المقاومة.

بعدها استكملت المحكمة استجواب باقي الموقوفين فالتزم كل من محمد علاء المغربي ومحمد وهبي وفضل مصطفى وأحمد قبلاوي ومحمد صلاح الصمت علماً أنه جرى استجوابهم من قبل الهيئة السابقة قبل توقيف الأسير، وذهب المتهم محمد صطيف الى اعتبار أن «أصحاب العلاقة برّا» قاصداً بذلك حزب الله وسرايا المقاومة، فيما صرح محمد صلاح قائلاً: «قبل توقيف الشيخ (الأسير) كنت أقول إن من شارك في المعركة هم سرايا المقاومة وحزب الله والآن ما زلت أقول وسأبقى أقول إنهم هم من شاركوا الى حين إحضارهم وعلى رأسهم حسن نصر الله (الأمين العام لحزب الله)».

يُذكر أن الجلسة التي حضرها وكيل أهالي شهداء عبرا المحامي زياد البيطار وعدد من الأهالي، تزامنت مع اعتصام نفذته عائلات الموقوفين أمام المحكمة العسكرية.

BEIRUT: Leftist Lebanese prisoner Georges Abdallah Monday announced he will go on a three-day hunger strike in solidarity with roughly 1,000 Palestinian prisoners who have done the same for over a week
Joseph Abdallah, a member of the International Campaign to Free Georges Abdallah, added in a Facebook post that several of his inmates in France, where he is serving a life sentence, will join the three-day solidarity hunger strike.
Georges Abdallah last went on hunger strike for three days in August 2016, also in support of Palestinian prisoners.
Abdallah was arrested in Lyon in October 1984 and convicted three years later to life in prison for his alleged involvement in the killing of an Israeli diplomat and an American military attache in Paris in 1982.
Abdallah has maintained his innocence. He was up for parole in 1999 by virtue of France's penal code, but Paris has rejected nine appeals for his release.
Under the French judicial system, a life sentence means that after 15 years in prison, a prisoner has the right to demand his or her release.
In 2013, French courts accepted a request to release Abdallah, and within the 24-hour deadline, no appeals were made. His supporters in Lebanon were preparing for his reception and the date of his return was set. But then-Interior Minister of France Manuel Valls denied his return to Lebanon under U.S. pressure.

The Daily Star- Activist Ahmad Amhaz released on bail, will still stand trial, March 29 , 2017

BEIRUT: Lebanese activist Ahmad Amhaz was released Thursday on a 500,000LL ($330) bail, following nine days in prison over a Facebook post that insulted political officials.
The court decision was made by Judge Pierre Francis.
Amhaz still faces trial for the Facebook post which criticized President Michel Aoun, Prime Minister Saad Hariri, and Speaker of Parliament Nabih Berri.
He can face up to two years in prison if convicted.
“It’s a positive sign that the judge finally released him nine days after he was detained, but he never should have been held in jail for this type of offense in the first place,” Human Rights Watch Lebanon Researcher Bassam Khawaja told The Daily Star.
“We hope he will not be convicted,” he added.
No trial date has been set for Amhaz yet.
Prime Minister Saad Hariri said in a Twitter post Wednesday that “his Excellency the President [Aoun] and I decided to let go of our personal rights regarding the case with the young man Ahmad Amhaz, and we let the prosecutor know.”
Ahmad Amhaz was detained on March 21 over the February Facebook post.
He criticized President Aoun, Prime Minister Hariri, and Speaker Berri in the post. “There are three animals currently ruling the country: A crocodile ... a donkey ... and one that hasn’t been revealed yet,” the post read, ending with the hashtag #republicofthejungle.
His lawyer, Wassef al-Harakeh, told local media following the arrest that Amhaz did not intend to insult anyone, but was facing financial and health problems in the family.
Under article 582 of Lebanon’s Penal Code, those charged with slander or defamation can face up to three months in jail and a fine ranging from 50,000LL ($33) to 400,000LL ($264.5).

Al Akhbar- The case of Activist Ahmad Amhaz, March 28 , 2017

أصدر قاضي التحقيق في بعبدا، القاضي بيار فرنسيس، أمس، مذكرة توقيف وجاهية بحق أحمد أمهز بتهمة تحقير رئيس الجمهورية وكل من رئيسي مجلس النواب والحكومة، وذلك على خلفية منشور كتبه أمهز على صفحته الخاصة على موقع التواصل الاجتماعي «فايسبوك». وبذلك، يكون القاضي فرنسيس قد أبقى على توقيف أمهز مدة إضافية الى حين بتّ محاكمته.
وكان عناصر من شعبة فرع المعلومات قد أوقفوا أمهز، يوم الثلاثاء الماضي، بعد تعقّبه، وأُحيل الى مكتب مكافحة جرائم المعلوماتية وحماية الملكية الفكرية للتحقيق معه، ومن ثم أُحيل الى قاضي التحقيق في بعبدا.
بحسب رواية والدة أمهز التي نقلها مركز «سكايز»، فإن القوى الأمنية أوقفت أمهز أثناء وجوده في برج حمود، وطلبوا منه التوجه معهم الى المخفر بسبب ضبط سير مُستحق، «ليتبيّن لاحقاً أن هناك مذكرة توقيف بحقه على خلفية كتابته منشوراً يذمّ فيه كلاً من رئيس الجمهورية ورئيس الحكومة ورئيس مجلس النواب».
عقب إصدار القاضي فرنسيس قراره بإبقاء التوقيف، عمد وكيل أمهز المحامي واصف حركة الى استئناف القرار لدى الهيئة الاتهامية وتقديم طلب إخلاء سبيل، إلّا أن الهيئة رفضت طلبه وبقي أمهز موقوفاً، وحُدّد يوم الاربعاء المُقبل موعداً لجلسة محاكمته.
هذا الأمر يطرح تساؤلاً حول تشدّد القضاء في القضايا المُتعلّقة بالرأي «الفايسبوكي»، لتأخذ مسألة الحزم في الإبقاء على الاعتقال طابعاً «تأديبياً» للناشطين على مواقع التواصل الاجتماعي، خصوصاً أن الأعراف القانونية سبق أن قضت بإمكانية إخلاء سبيل المُدّعى عليهم، نظراً الى نوعية التهم الموجهة اليهم، الى حين بتّ محاكمتهم. فلماذا يتم الإبقاء على اعتقال الناشطين إذا لم يكن الهدف «تأديبياً» لغرض سياسي؟
ثمة من يطرح مُقاربة أخرى تتعلّق بـ«استنسابية» سلوك القضاء إزاء هذا النوع من القضايا، حسب الناشطين والأشخاص ومستوى «نُفوذهم» ودعمهم السياسي.

رفضت الهيئة الاتهامية طلب استئناف قرار
إخلاء السبيل

من الناحية القانونية الإجرائية، يوضّح مصدر قانوني لـ»الأخبار» أن النيابة العامة تدّعي على الشخص وتُوعز عادة إلى مكتب جرائم المعلومات بوصفه ضابطة عدلية لإجراء التحقيقات الأولية، ويقوم المكتب بدوره بمخابرة النيابة العامة التي توعز بعدها الى قاضي التحقيق لإجراء المحاكمات.
يقول المصدر إنه يحق لوكيل الشخص المُدّعى عليه من قبل النيابة العامة طلب إخلاء السبيل الى حين بتّ محاكمته. ويُركّز على مسألة ضرورة تعديل قانون العقوبات الذي «يُتخذ ذريعة لتوسيع مروحة اتهام الأشخاص بجرائم الرأي». ينطلق المصدر من هذه النقطة ليُشير الى أهمية تعديل القانون، لافتاً الى المرسوم الاشتراعي الذي كان يسمح بتوقيف الصحافي احتياطاً أمام محكمة المطبوعات، والذي تم تعديله عام 1994، وتم إلغاء حكم توقيف الصحافي والاكتفاء بتغريمه. من هنا، يرى المصدر ضرورة إعادة النظر في العقوبات المُتعلقة بـ»جرائم الرأي». ويُشير في هذا الصدد الى ضرورة الفصل بين جرم القدح والذم وجرم التحقير، لافتاً الى التوسع في الأدلة التي يُقدّمها المدّعى عليه لإثبات ما قد يُعدّ ذماً وقدحاً، سعياً الى عدم تجريمه، فيما يبقى جرم التحقير الذي يمس شخص الأفراد مستقلاً عن بقية الجرائم، مع ضرورة إعادة النظر في العقوبات التي تترتب على ارتكابه. ولكن لماذا يجب تعديل قانون العقوبات في هذه القضايا؟
يشرح المحامي ماجد فياض في هذا الصدد، في اتصال مع «الأخبار»، أن جرائم القدح والذم على «فايسبوك» تختلف عن جرائم المطبوعات، لافتاً الى تبدّل اجتهاد محكمة التمييز التي كانت ترى أن القدح والذم على مواقع التواصل الاجتماعي يندرجان ضمن جرائم المطبوعات، وأصبحت ترى أن القدح «الفايسبوكي» يخضع لقانون العقوبات وليس لقانون المطبوعات. اللافت هو تساؤل فياض حول مدى قانونية إجراء مكتب جرائم المعلوماتية التحقيقات الأولية للمتهمين بجرائم القدح والذم أو التحقير، مُشيراً الى الاجتهادات التي لم تحسم هذا الأمر بعد.

BEIRUT: Families of detained Islamists in the northern city of Tripoli staged a brief protest outside Tripoli’s Serail Monday, demanding a general amnesty for all prisoners. Security forces deployed in Abdel-Hamid Karami Square as protesters blocked the road to press their demands, the state-run National News Agency reported. The group marched from the square before stopping by the Tripoli’s Serail to block traffic. They called on Prime Minister Saad Hariri to take action to grant the prisoners a general amnesty. A general amnesty request must be put forward by the interior and justice ministers and would also require approval by President Michel Aoun, who has the authority to accept or reject the proposal. In February, the families gathered in Tripoli outside Labor Minister Mohammad Kabbara’s office, calling for the detainees to be released. Similar protests have taken place in south and east Lebanon.

L'orient le jour- Après seize mois de détention, Nizar Zakka reçoit la visite de l’ambassadeur libanais à Téhéran, February 16 , 2016

Nizar Zakka, prisonnier libanais en Iran, a reçu la visite, pour la première fois, hier, et cela depuis sa détention il y a seize mois, de l'ambassadeur du Liban à Téhéran, Fady Hajehli. Cette rencontre a été qualifiée de « très bonne » par la famille de Zakka, qui a publié un communiqué.
« L'ambassade du Liban à Téhéran avait reçu un document de la chancellerie libanaise à Washington stipulant que la fondation International and Relief Development (IRD) n'est pas une institution américaine », souligne le texte. Nizar Zakka avait été accusé lors de son procès en juillet dernier de travailler pour une institution américaine.
Récemment, Nizar Zakka a reçu la visite du vice-procureur général iranien qui l'a informé que la situation serait favorable pour présenter une demande de remise en liberté. Depuis quelque temps, le prisonnier libanais a le droit également de téléphoner tous les jours à sa famille à Beyrouth, laquelle espère qu'il sera libéré prochainement.
Quand il a été arrêté en septembre 2015 à Téhéran, Nizar Zakka effectuait son cinquième séjour en Iran. Il avait été invité à Téhéran par la vice-présidente iranienne pour les Affaires de la femme et de la famille, Shahindokht Molaverdi, afin qu'il prenne part à une conférence sur le développement et l'emploi des femmes.
Nizar Zakka a perdu sa mère, il y a quelques mois, alors qu'il était en détention.

BEIRUT: Families of dozens of Islamist prisoners staged a protest Monday in the northern city of Tripoli, demanding general amnesty for their incarcerated relatives. The families demonstrated outside Labor Minister Mohammad Kabbara’s office amid heavy security, according to the state-run National News Agency.
The demonstration comes after numerous protests in several areas of the country to demand clemency for those Islamists in prison. Many were arrested on suspicion of joining outlawed Islamist groups, taking up arms against the state or undermining the Army. Many have been in detention awaiting trial for years.
Last Monday, detainees at the Roumieh Prison staged a small protest that may have been linked to the calls for release. Concurrently families in east Bekaa and south Beirut protested on the streets and closed roads with burning tires.
At Monday’s protest, demonstrators held banners calling on state authorities to pardon the detainees, while blocking the main road to the prominent Nour Square.
Following the demonstration, protesters moved on to rally in front Tripoli’s Serail.
Several demonstrators urged Lebanon’s political leaders to take up the case and grant the amnesty.
The delegation from the families met with North Lebanon Gov. Ramzi Nohra to urge him to relay their message and demands to President Michel Aoun and other authorities, saying that their loved ones were suffering in prison.
“The thorny issue ... is being followed up by the relevant authorities,” Nohra said.
“More than 70 percent of the detainees from Tripoli are victims of political rifts and tensions,” the delegation said following the meeting.
In south Lebanon, families of supporters of radical Sheikh Ahmad al-Assir who have been detained have also been pushing for a similar request.
A general amnesty would have to be put forward by the Interior and Justice ministers and be approved by President Michel Aoun.

Al Mustaqbal- Case of murder of George El Rif, February 08 , 2017

ثلاثة اطباء نفسيين شخّصوا الحالة النفسية للمتهم طارق يتيم قاتل جورج الريف، هم اجمعوا على انه «رجل مضطرب» و«سريع الانفعال»، وحده الطبيب النفسي احمد عياش»تميّز «عن زميليه الطبيبين رامي بو خليل الذي عاين المتهم قبل ايام من الحادثة وايلي كرم الذي كشف عليه بعدها،فـ«أشعل» اجواء جلسة المحاكمة التي انعقدت امس امام محكمة الجنايات في بيروت برئاسة القاضية اسكندر.

فبعد ان اكد الطبيبان بو خليل وكرم ان يتيم«يتمتع بكامل قواه ومدرك لأفعاله»، جاء الطبيب عياش ليناقض زميليه ويعتبر ان المتهم «شخصية غير متزنة وردات فعله محبطة بسبب طفولته المعذّبة وبالتالي فان ردات فعله تكون مفرطة ولا يقيم وزنا لافعاله ما يدفعه الى الاقدام على خطوات معينة». 

وما كاد عياش ينهي كلامه حتى اعلن وكيل الادعاء المحامي زياد بيطار بانه سيدعي على الشاهد بالادلاء بافادة كاذبة واصفا اياه بأنه «شاهد مأجور».

نقاش حاد دار بين جهتي الادعاء والدفاع الممثلة بالمحامي انطوان طوبيا استخدمت خلاله عبارات خرجت عن المألوف بين المحاميين ما استدعى تدخل الرئاسة، ودفع الشاهد عياش الى القول ان «ما تعرض له المتهم من احداث اليمة في طفولته لا تؤثر على وعيه وادراكه».

وكان اعتراض من جهة الدفاع على إرجاء الجلسة للمرافعة التي رفعتها المحكمة الى الحادي عشر من نيسان المقبل، على اعتبار ان ثمة شهودا يطلب الدفاع الاستماع الى افاداتهم، لكن رئيسة المحكمة امهلته لتقديم لائحة بشهوده لعرضها على الفرقاء قبل بتها» وإرجاء الجلسة للمرافعة».

وبعد احضار المتهم يتيم وحضور الظنينة لينا حيدر وزوجة المغدور المدعية رولا بوصالح، استمعت المحكمة في البدء الى افادة الطبيب النفسي بو خليل الذي افاد ان المتهم قصده في اوائل تموز من العام 2015 اي قبل الحادثة التي وقعت في 15 منه بأيام، لمعاينته بهدف مساعدته على خلو جسمه من المخدرات إذ كان يتعاطى الحشيشة وابلغه المتهم انه قد امتنع عن التعاطي قبل اربعة ايام من معاينته وكان يريد اجراء فحص مخبري لابرازه للسلطات، كما اعلمه المتهم انه منزعج جدا.

وبسؤال الشاهد عما اذا كان المتهم يعاني مرضا نفسيا قال ان اللقاء معه دام نحو ثلاثين دقيقة فقط ولم يعاينه سوى مرة واحدة لم يتبين خلالها انه لا يتمتع بقدراته العقلية ولم يتبين له انه يعاني انفصاما في الشخصية او امراضا نفسية انما كانت لديه اضطرابات في الشخصية.

وهل يؤثر ذلك في وعيه اجاب: «اذا كان بحالة كبيرة من التعصيب ومع تناوله مواد كالكحول او المخدرات او المنشطات، فان ذلك يؤثر في الدماغ ويؤدي تاليا الى مرحلة يفقد فيها ادراكه.

واوضح الشاهد بانه وصف للمتهم نوعين من الادوية لتعديل مزاجه والتخفيف من فورة العصبية، ولم يتبين له انه عصبي اثناء معاينته له انما اخبره بانه كان يمر بلحظات يفقد فيها السيطرة على نفسه، وكان عليه ان يتابع علاجه باشراف طبيب انما هو اخبر السكرتيرة بانه سيعود ولم يفعل.

واكد الشاهد بانه طلب من المتهم ان يدخل الى المستشفى لمتابعة علاجه والتوقف عن تعاطي المخدرات لكنه لم يوافق وهذا امر طبيعي من شخص يقصد لاول مرة طبيبا نفسيا.كما اكد الشاهد بانه وصف للمتهم دواء اخر هو مضاد للاكتئاب ولتخفيف انفعالاته، موضحا ان المريض يستطيع تناول الدواءين معا «وانا طلبت منه الامتناع عن تناول الكحول».

وما هي نتيجة تناول الدواءين والكحول معا اجاب الشاهد:«ان الكحول وحدها تفقد الوعي والادراك وبيولوجيا يختلف الامر من شخص الى اخر، وفي بعض الاوقات فان الكحول تخفف من مفعول الادوية وفي الاساس لا يجب مزج الدواء مع اي مواد اخرى».

وفي رده على اسئلة جهة الادعاء قال الشاهد انه لا يمكن اعتبار ان مزج الكحول مع الادوية يزيد عداء الانسان انما من المعروف ان الكحول وحدها تفقد الانسان القدرة.

وردا على اسئلة جهة الدفاع قال الشاهد انه يصف الدواء عادة بعيارات خفيفة في البدء لمعرفة مدى تفاعل المريض معه، وان لدى الادوية ردود فعل انما لا يمكن ان تفقد متناولها الوعي والادراك. واضاف ان المتهم كان مكتئبا لانه كان قد امتنع عن تناول الحشيشة.

وعلق المتهم على افادة الشاهد فقال إنه قصد الطبيب لانه كان يشكو اضطرابا عصبيا وللتخلص من عصبيته بعدما وصل الى مرحلة الذروة.

وعاد الشاهد ليقول بان المتهم لم يخبره عن اصابته بداء الصرع في طفولته انما اخبره عن«طفولته المعذّبة» كونه ترعرع بعيدا عن والديه، كما لم يخبره انه تعرض لعملية ذبح على يد السوريين اثناء وجودهم في لبنان.

ثم استمعت المحكمة الى افادة الطبيب النفسي ايلي كرم الذي عاين المتهم اثناء توقيفه على مدى ساعتين او اكثر، موضحا بانه كان واعيا ومدركا انما لم يكن واعيا لقتل المغدور كما قال له، لانه كان يريد إسكاته وليس قتله كما فعل في حالات مماثلة مع اشخاص اخرين.

واكد الشاهد ان المتهم اخبره بان الحشيشة تؤدي الى تهدئته وان الطبيب بو خليل اعطاه دواء ليحل محل الحشيشة ولتهدئته، موضحا بان الدواء هو لتهدئة الاعصاب فيما الدواء الاخر هو للاكتئاب او الوسواس وكان من المحتمل ان يصاب المتهم بذلك انما لم يره الطبيب بهذه الحال اثناء معاينته.

واعتبر الشاهد بان تناول الدواء مع الكحول يؤثر على الانفعالات وسأل المتهم عما اذا كان الدواء قد بدّل فيه شيئا فنفى ذلك، وابلغه بانه احتسى الكحول قبل الحادثة بكمية كبيرة وهذا قد يؤدي الى اصابة الشخص بالدوران. واضاف الشاهد انه في هذه الحالة فان القوة البيولوجية تخف حدتها او يقدم الشخص على رد فعل غير متوقع منه.

وافاد الشخص انه بسؤاله للمتهم اثناء المعاينة ابلغه بانه كان لديه هلوسات آنية انما لا يؤثر ذلك في قدرته الجسدية، وقد ذكر له انه عندما كان طفلا تعذب كثيرا. وتابع الشاهد يقول بان المتهم كان يدرك بان جورج الريف لا يشكل خطرا عليه ونزل من السيارة وهو اعزل فقرر ان يُسكته وليس قتله بعد ان اصطدم المغدور بالسيارة عدة مرات الامر الذي زاد انفعاله. وقال بان المتهم هو شخص سوي ويتمتع بكامل وعيه وادراكه كما بدا له من خلال المعاينة انما كان لديه طبع بسرعة الغضب والانفعال وكشخص مثله وبعد ان توقف عن تعاطي الحشيشة فان ذلك سوف يزيد من انفعاله، ويزداد اكثر اذا كان تناول زجاجتي فودكا كما اخبره. واعتبر الشاهد ان المتهم كان مدركا لضرب انسان وكان واعيا لذلك، موضحا بانه لم يلاحظ بان المتهم كان مكتئبا، كاشفا عن ان المتهم اخبره بانه لديه وشم ذئب على يده وهو رسمه لاعتقاده انه يحميه.

وعلق المتهم على افادة الشاهد فقال كيف يمكن لشخص اوقف بجريمة قتل الا يكون مكتئبا.

واخيرا استمعت المحكمة الى الطبيب عياش الذي كان يتحدث بالعموم فطلبت ممثلة النيابة العامة القاضية رندة يقظان ان يحصر الشاهد كلامه بحالة المتهم النفسية، فقال بانه عاينه بعد الحادثة حيث ظهر له بان المتهم يعاني من شخصية غير متزنة تعود لاسباب نفسية ولطفولته القاسية حيث ترعرع في دار للايتام ما جعله ناقما على المجتمع ما يدفعه الى ان تكون ردود فعله عند اي استهداف مفرطة انما هو مدرك لوعيه، واشار الى ان ردود الفعل تختلف باختلاف الاشخاص وان المتهم هو من الاشخاص الذين يتلقون الانفعالات الخارجية بعدوانية. وقال ان المتهم اخبره انه كان يعاني الصرع، مشيرا الى ان تناول الادوية مع الكحول يرفع من مزاج الانسان وبالتالي لا يقيم وزنا لافعاله ويدفعه الى الاقدام على خطوات معينة ويصاب بانفعال شديد.

وفي تعليقه على افادة الشاهد قال المتهم ان كلام الطبيب صحيح «وانا وثقت به عندما كشف علي».

BEIRUT: A Lebanese judge issued an arrest warrant Monday against Hannibal Gadhafi, saying the detained son of Libya's late leader made threats of violence during an interrogation, state media reported.
Judge Zaher Hamadeh said Gadhafi made direct, personal threats against him during an interrogation over the disappearance of a prominent Lebanese cleric, the National News Agency reported.
Lebanese authorities arrested Gadhafi, a son of late Libyan leader Moammar Gadhafi, on Dec. 15, 2015.
Gadhafi was detained as part of an investigation into the 1978 disappearance of Imam Musa Sadr.
Sadr, the founder of Lebanon's Amal movement, went missing along with two of his companions during a visit to Libya in August 1978.
The three were visiting Libya at the invitation of Moammar Gadhafi.
Judge Hamadeh was interrogating Gadhafi Monday in the presence of Sadr's family and friends when the alleged threats were made, the NNA said.
The judge referred the case to the military prosecutor.
Gadhafi's last court session earlier this month was postponed after the defendant refused to appear in without a lawyer.
Gadhafi's former lawyer, Akram Azouri, had quit the case in Nobember, accusing Lebanese authorities of conspiring against the judiciary.

The Daily Star- Student released on bail for online post, trial still on, December 13 , 2016

BEIRUT: A Lebanese journalism student detained for criticizing the state, president and symbols of the country in a Facebook post was released on bail Monday but his case continues. Investigative Judge Pierre Francis ordered the release of Bassel al-Amin on a bond of LL500,000 ($333), the state-run National News Agency reported Monday evening.
The case was referred to the Baabda penal investigating magistrate who will declare the charges against Amin at a yet to be set hearing.
However, Amin will not remain in custody during the hearing process and won’t return to prison unless found guilty and given a longer jail sentence than already served.
During investigations led by Francis, Amin apologized for his comments, expressed regret and said that he had been misunderstood, a security source told The Daily Star.
During an investigative hearing, Judge Francis told the student that he was still a young and reckless boy and asked him his political leanings, the source said. Amin then replied that, “I am against the right-wing, but I am a journalist.”
Amin was arrested a week ago after writing – and later deleting a Facebook post criticizing Lebanon that was deemed slander by Public Prosecutor Randa Yakzan.
The post in question was reportedly made after Amin saw a television segment he found insulting to Syrian refugees.
He posted a status on Facebook saying “The shoes of a Syrian refugee, worker and national are worth more than your republic, Cedars, your Lebanon, your right wing, independence, government, history, revolution and presidents. What did we understand?”
The student was then detained after being asked to report to the Internal Security Force’s Anti-Cybercrime and Intellectual Property Rights Bureau.
Dozens of journalists, friends and rights activists criticized his detention claiming that he has a right to free speech.
The Anti-Cybercrime and Intellectual Property Rights Bureau is a branch of the ISF that deals with online security, cases of online defamation, libel and slander.
Suspects will then be tried in a criminal court.

Assafir- The death of a prisoner triggers the anger of families of detainees, November 16 , 2016

أعاد خبر وفاة السجين محمد ابراهيم الكيال قبل يومين إثر تعرضه لأزمة قلبية داخل سجن القبة تسليط الضوء على المشاكل الصحية التي يعاني منها عدد من المحكومين والموقوفين ممن يحتاج بعضهم، وفق شهادات أهاليهم، الى متابعة صحية بسبب أمراض مزمنة يعانون منها ولا يتلقون العلاج المطلوب لها.
وقد شُيِّع الكيال الذي كان موقوفاً بتهمة المشاركة بأحداث طرابلس، في مسقط رأسه باب التبانة في طرابلس، في أجواء من الحداد والغضب الشديد، رافقها اشتعال مواقع التواصل الاجتماعي بسيل من المطالبات بمحاكمة المقصّرين والمسؤولين عن تردّي أوضاع المساجين، خصوصاً أن هذه الحادثة ليست الاولى، حيث سُجّلت حالتا وفاة خلال العام المنصرم بسبب مشاكل صحية.
وبدأ اهالي السجناء بإعداد لائحة بأسماء الموقوفين الذين يعانون من أمراض صحية وبحاجة الى علاج دائم أو متابعة من أطباء، وهم بصدد رفعها الى الجهات المعنية، بالتزامن مع سلسلة من التحركات المزمع القيام بها لمرجعيات سياسية ودينية من أجل توحيد الرؤية حول مطلب العفو العام، والذي أعيد طرحه غداة انتخاب العماد ميشال عون رئيساً للجمهورية.
وأفادت المعلومات أن اتصالات جرت مؤخراً بعد وفاة الكيال مع بعض الأهالي لثنيهم عن القيام بأية تحركات ميدانية، وإعطاء مزيد من الوقت للمعالجات السياسية التي تعمل على خط إصدار عفو عام، او الإسراع في محاكمة الموقوفين والإفراج عن الأبرياء منهم، فضلاً عن مطلب إلغاء العمل بوثائق الاتصال والتي تشمل آلاف الاشخاص.

Fatmé Hamzé, une Libanaise de confession chiite, a été libérée hier après-midi après avoir passé quatre jours en prison pour avoir refusé d'abandonner la tutelle de son fils de 3 ans et demi, selon un mouvement de soutien formé autour d'elle.
Hier, les soutiens de Fatmé Hamzé se sont rendus au poste de police de Ghobeiri, dans la banlieue sud de Beyrouth, où la mère était incarcérée. « C'est maintenant que commence la révolution contre l'injustice faite aux femmes », a déclaré Fatmé Hamzé à sa sortie de la prison. « Je défendrais la cause de la femme, parce que toute mère a le droit de garder ses enfants », a-t-elle ajouté.
Rappelons que la semaine dernière, le tribunal jaafarite avait retiré à Fatmé Hamzé la garde de son fils qui devait être remis au père de l'enfant. Des mères et des associations s'étaient alors mobilisées pour exprimer leur opposition à cette décision de justice. Le juge religieux Jaafar Kawtharani avait alors rappelé dans un communiqué que la justice jaafarite libanaise faisait partie des instances judiciaires reconnues par l'État libanais.

أصدر القاضي الشرعي في المحكمة الجعفرية، جعفر كوثراني، أمس، قراراً يقضي بوقف تنفيذ حُكم منح حضانة ابن فاطمة حمزة إلى زوجها. وعليه، أُطلق سراح الأم التي تم توقيفها منذ نحو ستة أيام بسبب رفضها التخلي عن ابنها

خمس ليال مكثتها فاطمة حمزة في سجن مخفر الغبيري، بسبب رفضها التخلي عن ضناها بموجب قرار جائر صادر عن المحكمة الجعفرية.
أمس، أُطلق سراح الأم، بعدما أصدر قاضي الشرع في المحكمة الجعفرية جعفر كوثراني قراراً يقضي بوقف تنفيذ الحكم الصادر عنه بتاريخ 13/4/2016 والقاضي بمنح حضانة الطفل البالغ من العمر 3 سنوات ونصف سنة الى الزوج، وذلك "حتى إشعار آخر، تمكيناً للطرفين من الحضور أمام المحكمة". كذلك نص القرار على دعوة الطرفين لاستجوابهما وعرض الصلح بينهما مُجدّداً.
في اتصال مع "الأخبار"، يقول القاضي كوثراني إن قرار وقف تنفيذ الحُكم جاء بعدما "سلك أصحاب القضية المسار القانوني الصحيح، الذي كان من الأساس مطلباً للمحكمة"، في إشارة الى تقدّم الوكيلة القانونية للأم باعتراض مع ادّعاء مُقابل على قرار منح الحضانة الى الزوج. وبحسب نص القرار، فقد تضمّن الاعتراض طلب وقف تنفيذ الحكم وإبلاغ دائرة تنفيذ بعبدا مضمون قرار وقف التنفيذ.

نافذة تدخلت بهدف «لفلفة» القضية

قرابة الرابعة عصراً، خرجت فاطمة من مخفر الغبيري وعانقت ابنها علي الذي كان ينتظرها. أدلت بتصريح مُقتضب أمام وسائل الإعلام، مفاده أنها لن تتراجع عن حقها في أمومتها، مُشيرة الى وجود حالات كثيرة من الأمهات المُضطهدات بفعل القوانين "اللي لازم تتعدّل". ولفتت الأم الى الخوف الذي ينتاب الكثير من الأمهات ويمنعهن من إعلاء أصواتهن ضدّ هذه القوانين. وكان الاعتصام الذي نُظّم يوم السبت الماضي، تضامناً مع حمزة، قد فضح الكثير من القصص المُشابهة التي تسببت بها أحكام قُضاة الشرع الذكورية.
لم تنسَ فاطمة شُكر رئيس مجلس النواب نبيه بري ونائب رئيس المجلس الإسلامي الشيعي الأعلى الشيخ عبد الأمير قبلان، ما أوحى بتدخّل هذه الجهات لدى المحكمة الجعفرية ودفعها نحو التراجع عن قرارها. يُعلّق القاضي كوثراني على هذا الأمر بالقول إن هناك العديد من الأطراف "استفسرت عن الموضوع الذي بات قضية رأي عام"، مؤكداً أن تراجعه عن القرار جاء بعدما سلك أصحاب القضية الطرق القانونية.
من جهتها، أصدرت "الحملة الوطنية لرفع سن الحضانة لدى الطائفة الشيعية"، بياناً اعتبرت فيه أن إطلاق سراح فاطمة ليس انتصاراً، بل هو "نتيجة طبيعية للضغط الشعبي الذي مورس"، مُشيرةً الى أن الانتصار هو عندما يُحقّق مطلب رفع سنّ الحضانة لدى الطائفة الشيعية كي لا يتكرّر ما حصل مع فاطمة. وأضاف البيان أن الأخيرة واجهت واستطاعت أن تفرض قضيتها، إلا أن "هناك الكثير من الأمهات اللواتي لا يزلن ينتظرن أن ينلن حقوقهن في الحضانة". ووعدت الحملة بتحرّك قريب، لمواكبة الضغط سعياً الى تحرير الكثير من الأمهات المقهورات.
بيان الحملة أشار الى أن الضغط الشعبي عرّى ممارسات المحاكم الجعفرية أمام الرأي العام، ولفت الى "الأطراف النافذة التي تدخلت في القضية" (ويُقصد برئيس مجلس النواب نبيه بري ونائب رئيس المجلس الإسلامي الشيعي الأعلى الشيخ عبد الأمير قبلان) بهدف "لفلفة" الموضوع. تقول الناشطة في الحملة نادين جوني إن الجهود التي مارستها "الأطراف النافذة" يجب أن تُترجم واقعاً عبر السعي الجدي إلى رفع سن الحضانة لدى الطائفة الشيعية، مُشيرة الى أن تحركات الحملة في هذا الصدد مُستمرة. أول هذه التحركات سيكون يوم السبت المُقبل أمام المجلس الإسلامي الشيعي الأعلى عند الرابعة عصراً. تقول جوني: "صحيح أن فاطمة خرجت، لكن القضية لم تنتهِ".

BEIRUT: A Lebanese woman detained for refusing a religious court's order to hand her child over to his father has declared a "revolution against oppression" of Shiite custody laws following her release from jail Monday.
Speaking to reporters outside the Ghobeiri police station near Beirut following her release, Fatima Hamzeh called on all women not to be silent over what many consider to be unjust religious codes.
"I have started a revolution against oppression of women. ... It is the natural right of a woman to be a mother, and I'm going to continue with this revolution," she told reporters.
She said from the moment she was taken into custody last week she knew she would fight a battle to keep her 3-1/2-year-old son, even if it meant prison.
"It is forbidden for a woman to shut up. A woman is afraid to talk about oppression. People told me 'give your child up so you don't go to jail.' I said 'no, I will keep my child and go to jail'."
The Protecting Lebanese Women campaign had announced the decision by the Jaafari Court to "suspend the ruling in Fatima Hamzeh case" earlier in the day.
The court order to detain Hamzeh sparked protests by activists last week.
The whereabouts of her son, Ali, had been unknown. But when the case against Hamzeh was dropped the smiling boy was brought to greet his mother outside the the police station.
Hamzeh’s sister and lawyer Fadia had previously said Hamzeh's estranged husband had kicked her out of their their marital home and married another woman, leaving her to raise the toddler alone.
In its Facebook post Monday, the Protecting Lebanese Women campaign wrote that the matter "hadn't ended yet as Fatima's release wasn't a victory. ... It was merely the result of pressure."
"Our victory will be achieved when we raise the age of custody for the Shiite sect, to prevent the re-occurrence of Fatima's case," the post added.
The Jaafari council currently gives fathers custody of male children once they turn 2, and female children once they turn 7, unless significant evidence shows the farther is unfit to raise the child.
Zeina Ibrahim, a member of the women's group, told reporters outside the Ghobeiri police station Monday that they would hold a fresh protest on Saturday to keep up pressure on the Jaafari council to revise their custody codes.
"We've now begun the work to apply pressure on the Shiite council ...," she said. "They are not admitting that there is a problem. They consider that they are doing their duty."
She added: "What is more important than Fatima's case is the case of all women."
Friends and sympathizers of Hamzeh had gathered in front of the Higher Shiite Council in Haret Hreik last Saturday to denounce her detention.
Members of local women’s rights groups have previously attempted – so far unsuccessfully – to persuade the vice-president of the Higher Shiite Council Sheikh Abdel-Amir Qabalan to make the age when a father is granted custody the same as other Muslim and Christian authorities.
In a related incident, a Lebanese widow identified as Aida Nassredine allegedly collected her three children Monday from their school bus outside their school in east Lebanon to prevent them from returning to their father-in-law, local television station Al-Jadeed TV reported.
The mother had won custody rights in the Shiite religious court in Hermel, east Lebanon, however, her late husband's family were inciting hatred against the mother after throwing her out of her marital home, Aida's brother said to Al-Jadeed.

The Daily Star- Hamzeh custody case draws Berri’s attention, November 07 , 2016

BEIRUT: Work to secure the release of jailed child-custody battle mother Fatima Hamzeh is progressing and saw an intervention by one of the country’s most powerful politicians, her lawyer said Sunday following protests against the arrest over the weekend.
Hamzeh was jailed last week after refusing to abide by a religious court order giving custody of her child to her estranged husband. The news was met with dismay from women’s rights activists and campaigners who organized protests Saturday.
“There is serious effort and work [underway] to release Fatima,” Fadia Hamzeh, her sister and lawyer, told The Daily Star. Fadia refused to give additional details of the settlement, but said they were hoping to secure her release from the Ghobeiri prison Monday.
Fadia also disclosed that Speaker Nabih Berri had intervened to try to have Hamzeh released.
Hamzeh was arrested Wednesday outside her home in Haret Hreik after refusing to hand over her 3-1/2-year-old son, Ali to her husband. Ali’s whereabouts are still unknown.
Hamzeh’s case sparked protests, organized the Protecting Lebanese Women campaign Saturday. Friends and sympathizers of Hamzeh gathered in front of the Higher Shiite Council in Haret Hreik to denounce her imprisonment.
The protesters blocked the entrance to the area, south of Beirut, and chanted slogans in condemnation of Hamzeh’s detention.
One slogan read, “Your turban is soaked with the tears of mothers and children.”
The demonstrators also voiced calls for an amendment to the current civil status laws that do not grant women equal rights as men in many areas of the law.
They then marched toward the nearby Ghobeiri Police Station where Hamzeh is being held, and staged a rally there.
The hashtag “With Fatima against the Jaafari Court” (translated from the Arabic original) has been trending on Twitter and Facebook in reference to the Jaafari religious court that sentenced Hamzeh. Many users shared their own experiences of domestic violence and suffering due to the loss of custody of their children.
The Shiite Jaafari religious court had granted Hamzeh’s husband custody over their toddler following a near three-year judicial battle with her husband Mohammad Jezzini.
Fadia claimed her sister’s husband had forced her out of their marital home and married another woman, leaving her to raise the toddler alone.
The mandate to preside over civil status cases, like marriage, divorce and inheritance, is the prerogative of religious courts under Lebanese law. With no single overarching civil status law, each sect’s court systems have their own laws, heads and rulings.
The Jaafari council currently gives custody of boys to their father once they turn 2 and 7 to girls, unless significant evidence shows the farther is unfit to raise the child.
Members of local women’s rights groups have previously attempted – so far unsuccessfully – to persuade the vice-president of the Higher Shiite Council Sheikh Abdel-Amir Qabalan to make the age when a father is granted custody the same as other Muslim and Christian authorities.
Nadyn Jouny, a coordinator at the Protecting Lebanese Women campaign, said that the Saturday’s protest was a positive move in the struggle to up the age of custody in the Shiite sect. It is an issue the campaign has been fighting to achieve for three years.
“Fatima’s case was the first spark [but] it won’t be the last,” Jouny told The Daily Star Sunday. “There are thousands of women that are in a similar position to Fatima.” She said that Saturday’s protest in front of a body like the Higher Shiite Council was a reflection that people are starting to break the barrier surrounding the religious authority.
Jouny, who herself lost her now 6-year-old son in a custody battle, vowed that the fight to achieve fairness for women in the issue of custody will continue.
“We will continue. Fatima’s case isn’t the only one, in the protest there were over 15 women who were crying [because they are in a similar case].”
