SOLIDA has been active since 1996 in the struggle against arbitrary detention, enforced disappearance and the impunity of those perpetrating gross human violations.

The Daily Star- UNHCR clarifies work permit issue after ministry meeting, March 08 , 2017

BEIRUT: Syrian refugees in Lebanon who have work permits are not prioritized for humanitarian assistance, the United Nation’s refugee agency in Lebanon said Tuesday, adding that such individuals still remain eligible of other kinds of aid. UNHCR’s clarification came a day after Lebanon’s Labor Ministry reported that an agreement had been reached to withhold assistance from Syrian refugees in possession of a work permit.
“Since our assistance is based on needs and targets the most economically vulnerable, refugees who are working and getting steady incomes normally do not receive livelihood support as they already have a source of livelihood, contrary to others,” UNHCR’s Assistant Communications and Public Information Officer Lisa Abou Khaled told The Daily Star.
“That said, they still have access to legal aid, access to education for their children, like all other children in Lebanon, regardless of their nationality,” Abou Khaled added.
Labor Minister Mohammad Kabbara and UNHCR Representative for Lebanon Mireille Girard held a meeting Monday, during which it was agreed that work permits would be granted to Syrian refugees in Lebanon in the sectors of environment, agriculture and construction. The permits will be given based on certain applicable conditions and regulations, in order to protect the Lebanese labor force.
“The only thing we are asking them [Syrian workers] to do is to respect the law. The most important thing is to create jobs for the Lebanese,” Kabbara told The Daily Star. “We want an inspection team to monitor the situation, and this will create thousands of jobs.”
The discussion surrounding work permits for Syrian nationals comes as protests against Syrian labor – and rhetoric blaming the refugees for undercutting businesses – have flared up across the country.
“Because of limited resources, UNHCR and other agencies, including the World Food Programme, target only the most vulnerable with monthly assistance programs,” Abou Khaled said.
She acknowledged Lebanon’s troubling economic situation but underscored that the employment of Syrian nationals in certain work sectors has had little impact on the local labor force.
“Lebanon is going through a difficult period economically and we understand the sensitivities around the issue of job scarcity. That said, Syrians have traditionally worked in sectors where they don’t compete with Lebanese workers, in particular, daily labor in agriculture and construction,” she said.
“We have been advocating for Syrian refugees to be able to contribute to the economy while working in sectors open to them under Lebanese law, which are essentially agriculture, construction and the environment.”

The Daily Star- Companies sacked more than 100 employees: Lebanon Labor Ministry, December 02 , 2016

BEIRUT: The Labor Ministry Friday said that around 100 employees working at Lebanon-based companies were at risk of losing their jobs due to the deteriorating financial situation.
The ministry said six companies informed the ministry of their intentions to lay off 38 employees, citing deteriorating financial and economic circumstances.
The Danish Refugee Council also told the ministry that it planned to terminate the contracts of 60 employees, including 45 Lebanese, 14 Palestinians and a Syrian.
Another company said its financial situation had forced it to fire four of its employees, all of whom had been working there for more than 10 years. The company refused to enter a compromise with the ministry that guarantees the rights of its fired employees, the ministry statement said.
According to Article 50, section C of the Labor Law, employers are required to give one month's notice before firing an employee if they have worked for three years. Employers are required to give two months' notice if the employee has worked between three and six years, three months if their employment lasted between six and 12 years and four months if they have been employed for more than 12 years.
The ministry reiterated a warning to companies and institutions in Lebanon from firing Lebanese employees in favor of foreign workers, in particular Syrians.
Refugees and foreign workers tend to accept significantly lower wages than Lebanese citizens.
In August, the Labor Ministry announced that it would take stricter measures against forced layoffs to replace Lebanese with foreigners.
The ministry previously announced that violating companies will be fined up to LL2,500,000 ($1,659), up from the previous LL250,000 penalty. They must pay the fine within 15 days or face additional charges.
Around 10,000 Lebanese nationals have been forced from their jobs and were replaced with "foreigners" over the past year, according to caretaker Labor Minister Sejaan Azzi

تقوم الممارسات المعمارية المعتمدة في لبنان على أساس عنصري، يتجلى ذلك بوضوح في تصميم غرف عاملات المنازل بشكل لا يؤثر على المساحة المستغلة للشقة، إذ إن متوسط مساحة الغرفة لا يتجاوز 5 أمتار مربعة، وغالباً لا تكون هذه الغرفة صالحة للسكن ولا تتوافر فيها المرافق اللازمة أو النوافذ! هكذا يتم تجسيد الميول العنصرية والتمييزية بشكل حرفي عبر البناء فتوضع العاملات في «كهوف» معزولة داخل المنازل

5 أمتار مربعة هي متوسط المساحة التي يظن المهندسون المعماريون والعائلات اللبنانية أنها تكفي لتقطن فيها عاملة في الخدمة المنزلية. هكذا، يترجم هؤلاء عنصريتهم الهندسية تجاه العمال الأجانب، وتحديداً العاملات في الخدمة المنزلية، بحيث يتم "رميهنّ" في غرف منعزلة، ضيقة وخالية من النوافذ كانت بالأساس مخصصة لأن تكون غرف تخزين أو غرف غسيل، وبالتالي غير مؤهلة للسكن.
التصميم الهندسي لغرف العاملات في المشاريع التي تُبنى حالياً، ينطوي على عنصرية مخيفة تعكس معاني جدية في تعزيز نبذ هذه الفئة، وهذه الهندسة العنصرية ترتكز على قانون البناء اللبناني الذي يجسّد، عبر ممارسات معينة في مجال العمارة اللبنانية المعاصرة، مظاهر ملموسة من العنصرية المؤسساتية ضد عاملات المنازل الأجنبيات.

التصميم الهندسي لغرف العاملات ينطوي على عنصرية مخيفة
فإقصاء عاملات المنازل من قانون العمل ينعكس بإقصائهنّ أيضاً من الحصول على مساحات سكنية لائقة ضمن فئة واسعة من المباني المخصصة للسكن، وفق ما ينطلق منه المهندس المعماري باسم سعد في دراسة له بعنوان "5 أمتار مربعة لغرفة عاملة المنزل: العنصرية اللبنانية والنوع الاجتماعي في العمارة ــ فشل الهندسة المعمارية". تتعمق دراسة سعد بالحالة اللبنانية لسببين أساسيين هما: أولاً أن حصة الفرد من المساحة تعتبر من أدنى المعدلات في العالم، وثانياً قانون البناء النيوليبرالي الذي يتعمد تغليب المصلحة المادية للمطور العقاري على حساب نوعية بيئة البناء. فالمباني السكنية الخاصة و"الفيلات" البورجوازية هي "مواقع أساسية لمزيج واقعي من الذوق المحلي والحد الأقصى من استغلال مساحة الأرض، مع خلفية من قانون عنصري، ينتج منها مساحات سكن للعمال والعاملات تكون في أحسن الأحوال دون المستوى المطلوب، وغالباً ما تكون ظالمة".
تظهر الخرائط التي أخذها سعد من مشروعين سكنيين لا يزالان قيد البناء، نموذجين متباعدين من الممارسات. الأول يمثل النموذج "السخي" الذي يعدّ، للأسف، أفضل سيناريو حالي يمكن للعاملة أن تتطلع إليه في المشاريع المشيدة حديثاً، حيث قام المهندس بتوفير غرفة بمساحة 5.2 أمتار مربعة مع نافذة لائقة، من أصل 187 متراً مربعاً أي ما يقارب 2.87% فقط من مساحة الشقة.أمّا الحالة الثانية فتشكل أفضل مثال توضيحي للتصميم غير الإنساني الذي "يتفنن" بإخفاء غرف العمال عن الأنظار قدر الإمكان. نتحدث هنا عن ممر مؤدّ إلى غرفة العاملة، مغلق بأبواب عند طرفيه، يصل إلى غرفة الغسيل ويليها غرفة العاملة، أي ليس إلى غرفة العاملة مباشرة. جدار غرفة الغسيل ينحرف الى الداخل من أجل إفساح المجال لنافذة غير مباشرة لغرفة العاملة بمساحة تقل عن 50 سنتمتراً. تبلغ مساحة الغرفة 5.2 أمتار مربعة من أصل 531 متراً مربعاً أي أقل من 1% من مساحة البناء! هذه الحالة بالذات هي، بأي شكل من الأشكال، وضع شاذ، لكنها تلتزم بالاتفاقيات اللبنانية الرسمية الحالية، وفق الدراسة.
فالمعماريون والمطورون والعملاء يرون أن المساحات السكنية المخصصة لعاملات المنازل تنتمي الى "فئة العناصر ذات صلة الخدمة غير الجمالية في التصميم التي يجب أن تكون مخبأة بذكاء وراء عدة طبقات من الهندسة المعمارية لضمان أن يتم تقديمها على أنها غير واضحة ومعزولة قدر الإمكان". وعليه، انطلاقاً من مفهوم فوكو لـ"الهيتيروتوبيا" أو النبذ، تثبت هذه الدراسة أن غرف عاملات المنازل تعتبر مجموعة فرعية من "النبذ المنحرف"، أو بمعنى أكثر تبسيطاً، تعتبر المساحات السكنية المخصصة لعمال المنازل مساحات منبوذة للأفراد الذين ينحرف سلوكهم عن السلوك المتعارف عليه في الوحدة التي يوجدون فيها، وفي هذه الحالة نتحدث عن الأسر اللبنانية التي تنتمي إلى الطبقة المتوسطة.
يصف سعد في دراسته كيف أن العاملة "توضع في هذا الموقع الهش، ما يعطيها بشكل تلقائي وضعية منحرفة بمجرد تحديد معايير ثقافية مختلفة. ثم يوضع هذا "الجسم الغريب" في غرف مخصصة له، صُمّمت بعد الأخذ بالاعتبار هوية وطبقة الشخص الذي سيعيش فيها. المسار المعقد الذي يقود الى غرف العاملات عبر المطبخ وغرف الغسيل، والممرات الضيقة، يفصلهنّ بشكل لا لبس فيه عن الحالة العامة للسكان وعن كونهنّ أشخاصاً كاملين، ويرفقهنّ كملاحق لمناطق الخدمة".
قانون بناء عنصري
الإطار القانوني للعنصرية الهندسية يتجسّد وفق سعد في قانون البناء الذي يحتوي على عدة بنود تتعلق بسكن عاملات المنازل، أولها أن القانون "يشير إلى مساكن عاملات المنازل بتسمية "غرف للخدم" ويذهب أبعد من ذلك عبر التحدث عن "الخدم" بصفة المؤنث".

كذلك تندرج غرف عاملات المنازل في القانون مع مجموعة من النصوص التي تتحدث عن غرف التخزين وغرف الغسيل التي هي في المقام الأول غير مصممة لاحتواء الناس لفترات طويلة من الزمن. الغرض الأساسي من هذا الجمع، كما تشرح الدراسة، هو ترسيم الخطوط الدقيقة لأنواع الغرف التي لا تؤثر في النسبة العامة للاستثمار وذلك للسماح للمطورين بزيادة مساحات الغرف التي تضيف القيمة السوقية. ونتيجة لذلك، يوجد بند في القانون يحدد المساحة القصوى لغرف العمال ولكل هذه الأنواع من الغرف (التخزين، الغسيل..) بـ 8 أمتار مربعة.
تحدد الدراسة هدفاً آخر لهذا الجمع، وهو إعفاء هذه الغرف من موجب وجود نوافذ مفتوحة أي لا عوائق أمامها، وهنا يصبح القانون مشكلة فاقعة عندما ينص صراحة على أن الغرف المصممة للسكن البشري يجب أن يكون فيها نوافذ من دون عوائق، بعدما كان قد استثنى في الفقرة السابقة غرف عمال وعاملات المنازل من هذه الفئة!
هذه الاتجاهات المعمارية يصعب مواجهتها بسبب الممارسات الراسخة، والطبيعة المحددة من الفعل المعماري، والعمر الطبيعي للمباني. وعليه، يجب الاعتراف بآليات القهر التي يخلقها المطورون والعملاء والمهندسون المعماريون وإدراجها ضمن الجهود المبذولة لمكافحة العنصرية وإصلاح القوانين. التوصيف الدقيق لغرف العاملات يستنتجه سعد في ختام دراسته: كهوف داخل المنازل!

The Daily Star- Ministry crackdown shuts 171 domestic worker agencies, November 30 , 2016

BEIRUT: The licenses of 171 domestic worker recruitment agencies were revoked Tuesday after Lebanon’s Labor Ministry launched a nationwide crackdown, investigating the methods and practices of agencies.
A further 23 agencies were temporarily suspended as a result of the ongoing investigation.
“This profession deals with humans and not the trade of items,” caretaker Labor Minister Sejaan Azzi said in a statement Tuesday.
The move comes as part of a campaign by Azzi to raise the quality of Lebanon’s agencies to meet international standards.
The 23 temporarily suspended agencies have been given three months to meet legal requirements.
The ministry called on the Union of Domestic Worker Recruitment Agencies to abide by the law and deal with domestic workers in a humanitarian manner, holding it responsible for any violations.
It also called on employers to treat domestic workers in a respectful manner, and to fully safeguard their rights.
“The problems are mainly with the illegal agencies that do not belong to the syndicate,” the statement said.
The ministry has received many complaints from domestic workers about how they are treated by their employers, as well as from households employing domestic workers.
Due to the high number of complaints, Azzi formed an advisory body to study the situation of the agencies. Following case studies and supervision, the advisory body presented the report to Azzi with a number of recommendations.
Lebanon has more than 700 licensed domestic worker recruitment agencies, but a Labor Ministry statement Tuesday said that just 441 meet legal standards.
Suicide among domestic worker is common with around one death a week reported in Lebanon, some countries have banned their citizens from working in Lebanon.
Recruitment offices have come under increased scrutiny in recent years for violating labor laws and exploiting the ‘kafala’ system that governs the status of foreign domestic workers who are brought into the country under the sponsorship of a Lebanese employer.

L'orient le jour- La municipalité de Zghorta-Ehden se défend de tout racisme, October 26 , 2016

Une banderole prêtant à équivoque a dû être remplacée à la hâte. Le président du conseil municipal s'explique.
Vers la fin du mois d'octobre, Ehden, qui grouille de monde en été, est quasi désert. Les estivants ferment les portes de leurs maisons à double tour et rentrent chez eux... à Zghorta. Cette année, à l'occasion de la transhumance annuelle, la municipalité de Zghorta-Ehden a accroché sur la place de l'Église Saints-Pierre-et-Paul une banderole adressée à tous les travailleurs syriens, leur demandant de quitter le village avant la fin du mois d'octobre.
La photo de la banderole a été partagée et commentée par les internautes. Certains ont jugé le contenu raciste, alors que d'autres l'ont défendu sous prétexte que le village, vidé de ses estivants, ne devrait pas être habité en leur absence, pour des raisons de sécurité. Ehden présente une particularité unique au Liban, en ce qu'elle forme avec Zghorta, pourtant éloignée, une même entité municipale et démographique.
Joint au téléphone par L'Orient-Le Jour, le président de la municipalité de Zghorta-Ehden, César Bassim, annonce que la banderole incriminée a été retirée et remplacée par une autre qui précise l'appel de la municipalité. « L'appel lancé ne concerne, en fait, que les travailleurs étrangers qui ne possèdent pas de papiers officiels », a-t-il dit.

Selon M. Bassim, des travailleurs étrangers, essentiellement des Syriens, sont embauchés à Ehden par les agriculteurs en cette période de l'année. Ils se rendent au village et dressent des tentes le temps de la récolte des pommes. C'est à ces personnes en particulier que la nouvelle banderole s'adresse. « S'ils désirent rester à Ehden, ils seront les bienvenus à condition qu'ils régularisent leur statut et démontent leurs tentes », affirme le président de la municipalité.
Bien que le village soit presque complètement déserté en hiver, une certaine activité économique y est préservée, surtout durant les week-ends. Des restaurants restent ouverts durant la saison, de même que les hôtels. Et le café Aayrout, sur la fameuse place du Midane, continue de servir le « sahlab » 24 heures sur 24 et sept jours sur sept.
« La main-d'œuvre étrangère est très demandée à Ehden, en hiver autant qu'en été », explique M. Bassim qui indique qu'environ 40 à 50 familles étrangères, inscrites aux registres de la municipalité, résident à Ehden tout au long de l'année. « La municipalité assure à leurs enfants l'éducation dans des écoles à Zghorta », ajoute-t-il.
Quant à la question de la sécurité, le président de la municipalité souligne qu'il ne s'inquiète guère de la présence étrangère au village, d'autant que quinze fonctionnaires de la municipalité sont chargés de ce dossier. Il en est de même à Zghorta, où la présence des réfugiés est réglementée. « Nous sommes loin d'être racistes », assure, en guise de conclusion, M. Bassim.

The Daily Star- General Security warns employers over firing locals for foreigners, October 25 , 2016

BEIRUT: General Security Monday warned business owners against illegally replacing local employees with foreign or Arab nationals. “Individuals, companies and institutions are warned against employing foreign or Arab workers illegally ... the General Security will begin issuing violations and fines to Lebanese [businesses] who have workers employed against the law,” said a statement released by General Security Monday.
The security force warned violators could face up to three months in prison and fines of between $66 and $400.
Commenting on the matter, Labor Minister Sejaan Azzi told The Daily Star that General Security has always been cooperative with the Labor Ministry on its workforce policy.
“We welcome the General Security’s recent stance on the labor laws, which will help to protect the Lebanese workforce,” Azzi said.
The minister also praised General Security chief Abbas Ibrahim.
“Ibrahim has always been supportive of the ministry’s stance on protecting the Lebanese and their right to work,” Azzi added.
Last August, the Labor Ministry announced that it would enforce stricter measures against companies and institutions that lay off Lebanese employees to hire foreigners working without proper documentation.
In a statement [at the time] the ministry said that companies found in violation would be fined up to $1,659, and increase from the previous $166.66 penalty. The fines must be paid within 15 days or the violators will face additional charges.
The minister claimed that around 10,000 Lebanese nationals have been forced out of their jobs and replaced with non-Lebanese workers over the past year.
He explained that refugees and foreign workers tend to accept significantly lower wages than Lebanese citizens.

كثرت في الآونة الأخيرة الدراسات حول الانتهاكات التي يتعرّض لها العمّال الأجانب في أماكن العمل، من عدم دفع الأجور إلى حجز وثائق السفر وفرض قيود على الحركة والتنقل والحياة الشخصية وصولاً إلى العنف الجسدي والمعنوي والتخويف والخداع. لم تكن التقارير والمعلومات التي فاضت بها الدراسات يوماً من نسج الخيال، إلا أنه كان ولا يزال من الصعب تصديقها، أو الإقرار بأنها تحدث فعلاً.
بالأمس، رفعت منظمة العمل الدولية الستار عن دراسة جديدة في هذا الإطار قدّمتها في «معهد عصام فارس» في الجامعة الأميركية في بيروت. حملت الدراسة عنوان «حقوق العمال المنزليين المهاجرين واقتصاد الرعاية في لبنان»، وجاءت ضمن برنامج «العمل بحريّة» الذي يتبنى نهجاً متكاملاً يهدف إلى الحدّ من ضعف النساء والفتيات الأجانب وحمايتهن من الوقوع ضحايا الاتجار بالبشر.
أقرّت الدراسة التي انطوت نتائجها على معطيات خطيرة، بوجود نوع من السخرة والاستعباد في نظام العمل في الدول العربية ولاسيما الأردن ولبنان.
كشفت منظمة العمل الدولية أن 12.3 مليوناً مما يقارب الـ21 مليون شخصٍ ضحايا العمل القسري والاتجار بالبشر موجودون في بلدان آسيا، مشيرةً إلى أن حوالي 55 في المئة من هؤلاء هم من النساء والفتيات. وأوضحت الدراسة أن العمّال الأجانب يتوزعون بكثافة في لبنان بين بيروت (50 في المئة) وجونية وجبيل (25 في المئة) وصيدا (25 في المئة)، وتتراوح أعمار النسبة الأكبر منهم ما بين 31 و40 عاماً (24.7 في المئة) وما بين 41 و50 عاماً (24.5 في المئة)، كما أن نسبة الإناث من بينهم تفوق نسبة الذكور (1.019 عاملة مقابل 181 عاملاً).
يأتي العمّال المهاجرون إلى لبنان من إثيوبيا بالدرجة الأولى بنسبة 42.1 في المئة، تليها 26.8 في المئة من بنغلادش و11.5 في المئة من الفيليبين. إلا أنهم يخضعون لظروف عمل قاسية ونظام كفالة مهين، يُجرّدهم من كافة حقوقهم ويجعل من عملهم أقرب إلى الاستعباد، وذلك في ظلّ مباركةٍ رسمية تُعفي أرباب العمل من أنواع المساءلة كافة.
وكشفت الدراسة أن 78.3 في المئة من أصحاب العمل يحصلون على نسخة من عقد العمل الذي يوقّع مع مكتب استقدام العمّال الأجانب، في حين أن 18.2 في المئة فقط من عمّال يحصلون عليه أو يطلعون على تفاصيله. فضلاً عن الفهم الخاطئ لمجمل بنود «نظام الكفالة» المجحف بحق العمّال، والذي اعتبره 57.5 من أصحاب العمل يدافع عن حقوقهم مقابل 29.9 في المئة وجدوا أنه يُلقي اللوم والمسؤولية الكاملة في الحفاظ على حياة العامل/ة على عاتقهم.
ويعتقد 43.6 في المئة من أصحاب العمل أن العقد يُجيز لهم «الاحتفاظ» بالعاملة لمدة ثلاث سنوات، في حين أن العمل به يتوقف بعد مرور عامٍ على بدء عمل العامل/ة.
وبحسب الدراسة فإن أكثر ما يُعاني منه العمّال هو غياب الجهة الضامنة والمدافعة عن حقوقهم، ما يجعلهم عرضة للاستغلال والعبودية بالأشكال كافة. كما أن 24 في المئة من أصحاب العمل لا يدفعون الراتب الشهري للعاملة داخل المنزل إلا عند سؤالها عنه، و14 في المئة يمتنعون عن الدفع نهائياً إلى حين انتهاء مدّة العقد معها. أما عن قيمة الراتب الشهري فحدّث ولا حرج. إذ أظهرت الدراسة أن 36 في المئة من العاملات يحصلن على أجرٍ لا تتعدّى قيمته 150 و199 دولاراً، و42 في المئة يتراوح أجرهن ما بين 200 و299 دولاراً، و14 في المئة يتراوح أجرهن بين 300 و399 دولاراً.
تلك الدراسة التي وجد فيها المحامي نزار صاغية من «المفكرة القانوينة» باباً لتقديم إخبارات متتالية إلى النيابات العامة ومطالبتها التحرك لإنصاف العاملات والعمال الأجانب، معتبراً أنها «دليلٌ قاطع على وجود نظام استعباد وسخرة في لبنان»، دفعت ممثلة وزارة العمل جومانة حيمور إلى الانسحاب من القاعة. اعترفت الأخيرة بكل خفة واستهتار بأن «الوزراة غير معنية بما يتم عرضه»، متذرعةً بأن «في البلاد أولويات، والحاضر على طاولة الوزارة الآن هو همّ النزوح السوري».
ما أدلت به ممثلة وزير العمل ربما يُثير امتعاض وزير الخارجية جبران باسيل، إذ هناك من بدأ يُنافسه في العنصرية والفوقيّة!
أرقام مهينة
أظهرت دراسة «حقوق العمال المنزليين المهاجرين واقتصاد الرعاية في لبنان» الصادرة عن منظمة العمل الدولية أنه يجري إلزام العاملات والعمال بالعمل ساعات إضافية من دون أي بدلٍ مادي يُذكر.
ووفق الدراسة، فإن 42 في المئة من العاملات يعملن 8 ساعات يومياً، مقابل 37 في المئة يعملن ما بين 8 و10 ساعات يومياً، و8 في المئة يعملن ما بين 10 و12 ساعة يومياً، و14 في المئة يعملن من 12 إلى 14 ساعة يومياً.
يُضاف إلى ذلك أن جزءاً كبيراً من أصحاب العمل يرفض الاعتراف بحق العاملة في الحصول على يوم عطلة، إذ وفق الدراسة فإن 57.3 في المئة من العاملات يعملن سبعة أيام متواصلة في الأسبوع. وفي حال سمح لها صاحب العمل بيوم راحة يمنعها من الخروج من المنزل (25 في المئة من العاملات ممنوعات من قضاء العطلة خارج منازل مخدوميهم)، بالإضافة إلى أن بعض أصحاب العمل يُقيّدن حريّة العاملة لدرجة اللجوء إلى إقفال الأبواب عليهن عند خروج العائلة من المنزل.
وحتى داخل المنزل لا تحظى العاملة بمعاملة لائقة، إذ إن 14 في المئة منهن يُرغَمن على النوم في غرفة الجلوس، و5 في المئة يخلدن إلى النوم داخل المطبخ، و4 في المئة ينمن في غرفة نوم الأطفال و4 في المئة على الشرفة.

Al Balad - بالارقام: العلاقة بين الشعب اللبناني والعاملة الاجنبية - February 3, 2016

تظهر الكثير من الأرقام نسبة "انفصام " الشعب اللبناني نحو العلاقة مع العاملات الاجنبيات في المنازل حيث تظهر احدى الدراسات ان %51 من الشعب اللبناني يعتبر ان العاملة المنزلية لا يوثق بها، مع انها تهتم بأطفالهم... 41 % من اللبنانيين يعتبرون ان العاملة المنزلية لديها مشاكل نفسية، مع انها تهتم بأهلهم... 36% من اللبنانيين يعتبرون ان العاملة "غبية" مع انها تستلم تدبير امور المنزل، فيما 27 % يعتبرون ان العاملة غير نظيفة، بالرغم من انها تقوم بالطبخ وتنظيف المنزل... تلك الارقام تنعكس سلباً وممارسات غير انسانية على عاملات جّل ذنبهن انهن يبحثن عن لقمة عيشهن في "المكان الغلط".

عشرات حالات الانتحار التي تسجل سنوياً والتي تنتهي بحضور القوى الأمنية وتفتح تحقيقا ينتهي بالخلاصة التالية "انتحار عاملة" لتقفل القضية هنا دون الرجوع الى الاسباب التي دفعتها الى انهاء حياتها من على شرفة المنزل.
تبدأ رحلة العاملة الاجنبية الى لبنان عبر المكاتب المرخصة المنتشرة على الاراضي اللبنانية والتي يفوق عددها 455 مكتبا والكفيلة بحسب احد اصحاب تلك المكاتب بتغطية عاملات لدولة مثل الصين، فكيف ببلد مثل لبنان والذي لا يفوق عدد سكانه الملايين الخمسة. رحلة الاشغال الشاقة تبدأ في لبنان بعقد عمل لا يعرفن عنه الا القليل، منها ساعات دوام العمل والحق بالإجازة الأسبوعية والحق بالخصوصية وقيمة الراتب المتفق عليه والحق بالاحتفاظ بأوراقها الثبوتية.

رغم ان استقدام عاملة منزل اصبح من الضروريات في ظل المتطلبات المعيشية، ولكن لقدوم العاملة والدخول الى الاسرة سيف ذو حدين. فالواجب اعتبار العاملة موظفة تتقاضى راتبها آخر الشهر، ولكن هذا لا يسمح بأن تحول بعض العائلات العاملة الى (عبدة)، كما يحلو للبعض تسميتها. فبعض العائلات تقوم باصطحاب العاملة في زيارتها الى العائلة لتقوم ايضاً بالعمل في بيوت الاقارب، وفي حال اعترضت يكون عقابها الضرب، او الاهانة. وهنا تبدأ المشاكل مع العائلة.

قوانين خاطئة
وبحسب دراسة وطنية أجرتها الجامعة الأميركية في بيروت بالتعاون مع منظمة "كفى" و"الجمعية الدولية لمكافحة الرقّ"، وبدعم من منظمة العمل الدولية. شملت الدراسة أصحاب العمل في لبنان وتوقّفت عند درجة معرفتهم بالقوانين والنظم الراعية لعلاقة العمل مع عاملات المنازل، وكشفت أيضاً بعض ممارساتهم ومواقفهم تجاههنّ. حيث اظهرت الدراسة ان :
50 % من اللبنانيين/ات يعطون العاملة يوم راحة (وهو من حقّ العاملة بحسب عقد العمل)، و24% منهم فقط يسمحون لها بمغادرة المنزل في يوم العطلة؛ 40% لا يعطون العاملة راتبها الشهري بشكل منتظم (وهو من حقّ العاملة بحسب العقد)، و41% قالوا إنهم دفعوا رواتب الأشهر الثلاثة الأولى لمكتب الاستقدام؛ 50% من أصحاب العمل لا يعرفون تحديداً ماذا تغطّي تكاليف الاستقدام التي يدفعونها للمكاتب الخاصّة (وهم يدفعون أموالاً طائلة في الكثير من الأحيان)؛ 94% منهم يحتجزون جواز سفر العاملة (54% من هؤلاء يعتقدون أنّ ذلك مسموح بحسب عقد العمل، مع العلم أن لا إشارة لهذا الأمر في العقد)؛ و44% من أصحاب العمل يعتقدون أن مدّة العقد 3 سنوات، فيما هي سنة واحدة فقط.

كفى عنفا واستغلالا
استندت الحملة الإعلامية ضمن حملة "كفى عنفا واستغلالا" التي أُطلقت مطلع شهر شباط 2016، إلى أبرز ما ورد في الدراسة من مواقف لأصحاب العمل تجاه عاملات المنازل، خاصّة لجهة ضعف الثقة داخل علاقة العمل (أكثر من نصف أصحاب العمل يعتقدون بدرجات مختلفة أنه لا يمكن الثقة بالعاملة).
ولا يقتصر شكّ أصحاب العمل بالعاملة على الحذر منها وحسب، بل يصل إلى حدّ التشكيك "بنظافتها" (أكثر من ربع أصحاب العمل)، و"ذكائها" و"سلامتها العقلية" (أكثر من ثلث أصحاب العمل).
تُثبت هذه المعطيات مرّة جديدة أن عدداً لافتاً من أصحاب العمل لا يزال يتطلّع إلى العاملات انطلاقاً من أحكام مسبقة وتصوّرات تشوبها العنصريّة والفوقيّة والطبقيّة، مع العلم أنه يتمّ توظيفهنّ بشكل مستمرّ وتسليمهنّ اعمالا كثيرة تتطلّب مسؤولية كبيرة. فأتى الجزء الثاني من كلّ من شعارات الحملة الأربعة ليبيّن التناقض الواضح بين نظرة صاحب العمل اجاه العاملة وما يتوقّعه منها في المقابل.

"ما تناقض حالك"
تلك المعطيات تطرح عددا من الأسئلة، اهمها كيف يمكن لصاحب عمل ان يطلب من شخص لا يثق به، أن يهتمّ بأولاده؟ وشخص يَفترِض أن لديه "مشاكل نفسية"، أن يعتني بأهله؟ وشخص "غير نظيف"، أن يحضّر له الطعام؟ وشخص لا يمتلك درجة كافية من الذكاء، أن يدير شؤون منزله؟ اسئلة طرحتها الحملة الاعلامية لتبيان التناقضات ختمتها برسالة "ما تناقض/ي حالك، راجع/ي حالك"، دعت اصحاب العمل الى مراجعة تصوّراتهم وممارساتهم، وتحدّي الموروثات العنصرية والطبقيّة الكامنة وراء الكثير منها، وتصويب بعض من معلوماتهم حول النظم المرعيّة الإجراء التي بيّنت الدراسة أنّ قسماً منهم غير مطّلع على مضامنيها بالدقّة اللازمة. كما أنتجت "كفى" في المرحلة الأولى من الحملة فيلماً توعوياً قصيراً يُظهر بعض الأرقام المتعلّقة بمعلومات أصحاب العمل حول عقد العمل وممارساتهم مع عاملات المنازل، فمثلاً: "ما تناقض/ي حالك. راجع/ي حالك".

يتفشى الرق الحديث لظاهرة مقنّعة ومقبولة اجتماعياً للعبودية السابقة. ولم يعد لبنان مقتصراً على طوائفه المتعددة اذ تجاوز عدد الخادمات الاجنبيات الوافدات، من القارة الافريقية وجنوب شرق آسيا خصوصاً، ما يقارب 200,000 ألف خادمة بما يسمح باحتسابهم طائفة جديدة دخلت في ديموغرافيا البلد المكتظة.
ورغم التشريعات التي أقرها مجلس حقوق الانسان بحظر استعمال الاساليب العنصرية، والموافقة اللبنانية في هذا الاطار، يظهر أن التمييز العنصري مغروس في بعض عقول اللبنانيين. فهل يتقبل اللبناني فكرة الارتباط. 
 لا يتزوجون خادماتهم
عندما تسأل اللبناني رأيه في هذا المجال، يطلق سفارات عن الحق والمساواة والاخوة، منتقداً من تناقض تصرفاتهم هذه المبادئ. لوهلة تعتقد أن هذا الشخص صاحب ثقافة القبول بالآخر حتى القمة، ولكن ما ان تسأله ما اذا كان ممكناً أن يقع في غرام خادمة أجنبية حتى تصاب بالذهول، اذ تحتد نبرة صوته، يرفع حاجبيه، ويطلق كلمة "لا" تحت تأثير الغضب، متناسياً رأيه السابق.
يقول وليد: "أنا لا أتزوج بخادمة فالفروق يأتين الطبقية تمنعني من التفكير في الامر، والاختلاف الثقافي يعيد انتاج هذه الفجوة، من يأتين الى بلادنا لسن من الدول النامية وانما بقايا الدول المتخلفة". ويشاطره سليم الرأي قائلاً: "لقد أتت هذه الخادمة للعمل في البيوت، وهذا يعكس حال الفقر التي تعيشها في بلادها، ومستواها العلمي وبالطبع لا يناسبني كشاب حاصل على شهادة الماجستير".
ويرد البعض هذا الرفض الى الخوف من مواجهة المجتمع، فيعتبر أنطوان أن قرار الزواج ليس قراراً شخصياً وانما قرار عائلي أيضاً، واعتراض الأهل على الزواج يشكل وحده عقبة حاسمة، كما أن الانتقادات التي يطلقها أفراد المجتمع قد تؤدي لاحقاً الى تدمير العلاقة اذا وجدت.
تقول السيدة غالية في تعليقها على هذا الموضوع باللغة العامية: "ليش ابني شو ناقصو ليتزوج وحدة مش معروف أصلها؟".
في الحب تسقط الهوية
رغم انقطاع الغالبية عن ربط أفكارهم بواقعهم، يبقى القليل ممن يؤمنون بالحب، بغض النظر عن الجنسية، اللون والوضع الاقتصادي. تحدثنا مع كارم، شاب متزوج باثيوبية كانت تعمل في منزل والديه. كارم المتخصص في الهندسة الزراعية عبّر عن حياته الزوجية السعيدة  التي مر عليها عامان، قائلاً: "إن الحب ليس له معايير والشعور بالانجذاب لشخص معين هو شعور غير مفسّر". وتابع: "التفاهم بيني وبين زوجتي مابيلا ألغى كل الحواجز الاجتماعية الموجودة. تعلمت اللغة العربية، وترافقني في كل الاحتفالات والسهرات، هي المرأة التي حلمت بها". وتصل حساسية البعض في هذا الموضوع الى الاعتراض على كلمة خادمة.
يجد طارق أن السؤال وحده يغذي العنصرية، واقترح أن ندعوها موظفة، فهي برأيه تعمل بشرف وضمن ضوابط القانون، وهي انسانة وامرأة، ومن الطبيعي أن نشعر حيالها بما نسميه الحب، وقال ضاحكاً: "كم من رب عمل ربطته علاقة حب مع احدى موظفاته انتهت بالزواج؟!".
من جهة أخرى، قد لا يكون الزواج بدافع الحب وتحدي الحواجز الاجتماعية، وانما سعياً وراء الاستغلال المادي. هنا تروي أدانش، عاملة أثيوبية متزوجة بشاب لبناني يعمل في كاراج ميكانيك للسيارات، طريقة اساءة زوجها لها، بحيث كان يشتمها ويذمّها اذا لم تعطه المال الذي تجنيه، وأحياناً يتعرض لها بالضرب. وتقول: "يعود في الليل متأخراً ولا تفارقه قنينة البيرة. صرت اليوم أخاف منه وأتمنى لو أستطيع الهروب".
الثمن الباهظ جداً
في ضوء ذلك، يرى الدكتور وفيق ابرهيم أستاذ مادة علم الاجتماع في كلية الاعلام بالجامعة اللبنانية ان "النظرة الدونية للعاملة الاجنبية أمر واضح، بحيث يسعى مجمل العالم، واللبنانيون في شكل خاص، الى الاهتمام بالمظاهر الاجتماعية والتبهور المادي، فيرفضون زواج الخادمة التي هي في نظرهم تنتمي الى الطبقة الدونية الفقيرة، مع العلم أن الارتباط في الحالات العادية هو ارتباط طبقي مع فروق بسيطة في الحال الاقتصادية والاجتماعية". 
 ويصف ابرهيم "النرجسية اللبنانية" بقولة: "باعتقاد اللبنانيين أنهم أهم من الدول العربية الاخرى، تبعاً للسباق الديموقراطي الذي أنجزوه والانفتاح العام، لكن في الوقت عينه يكون اللبناني في مرتبة أدنى من دول أوروبية وغربية، والدليل الاصدق والاكثر شيوعاً اليوم
تفاخر اللبناني بزواجه من امرأة غربية، حتى لو لم تكن متعلمة. أما بالنسبة للأفكار الرجعية فهي نتيجة الجهل المستشري في عقول الفئات المنعزلة عن التطور الثقافي، وهذا الجهل يفضي الى التعميم القاتم. فالبعض يرى الاميركيين كلهم عظماء بمن فيهم المنحرفون، والسريلانكيين كلهم بسطاء وفقراء بمن فيهم المتعلمون والمثقفون. كذلك تسيطر القوة العرفية على حياة الافراد في لبنان بحيث تكسح بأشواط القوة القانونية، وحتى اليوم لم يتمكن العلم من اختراق هذه القوة، لأن التمسك بالعادات والتقاليد هو سمة اجتماعية، في حال فقدانها يهمش الشاب ويحرم حريته، وهو الذي مهما سعى لكي يكون مواطناً عصرياً تأتي العائلة بالدرجة الاولى للتأثير على خياراته. فكل من يتجرأ، أو تجرأ، على الزواج من عاملة أجنبية يدفع ثمناً اجتماعياً باهظاً، هو رفض المجتمع له فيضطر الى المغادرة خشيةً الشماتة والسخرية".    
شقراء وسمراء
تسأل الشاب اللبناني "هل تتزوج بسوداء؟" فإذا لم يبادر الى الرفض مباشرة، يحتار في الاجابة ويبدأ بتدوير الزوايا واختيار الكلمات المبهمة.
لكن الشاب نفسه يقبل الزواج بروسية ام اوكرانية او اي واحدة اجنبية شقراء اللون من دون ان يسأل عن ماضيها وأهلها وفصلها ومستواها الاجتماعي...
انه تمييز عنصري لم يلغ من النفوس.
هل تتزوجين بشاب لبناني؟
"نهار الشباب" سأل خادمات في شارع الدورة، عن آرائهن بالزواج بشاب لبناني. ماذا قلن؟
1- نعم أقبل الزواج به إذا كان يملك الكثير من المال فيشتري لي شقة وسيارة ويجعلني أسافر كل سنة الى الفيليبين.
2- لا أرفض الزواج بلبناني أو عربي لأنه يستغل عملي ليأخذ مالي.
3- اقبل الزواج بشرط ان يكون مستعداً للسفر الى اثيوبيا كل سنة وان يكون مسيحياً ارثوذكسياً.
4- No No No ابداً. لا أريد ان اتزوج في لبنان. 
اريد ان اجمع الكثير من المال وأسافر الى الهند.
5- لا اختي تزوجت بمصري فسرق مالها وغادر الى بلاده. لا أريد. 
وماذا عن اللبناني؟ كلن متل بعض.

Alani Silvoi, une employée de maison de nationalité éthiopienne, a trouvé la mort hier lors d’une tentative d’évasion de l’appartement de son employeur, L.S.R. La jeune fille, âgée de 24 ans, a sauté du douzième étage de l’immeuble situé à la rue Maguy el-Hajj, à Sed el-Bauchrieh. La malheureuse a atterri au premier étage et a été tuée sur le coup. Une enquête est en cours.

Les employées de maison étrangères devraient bénéficier de congés hebdomadaires et annuels, d’horaires de travail limités, d’un salaire payé à la banque, d’une liberté de circulation, du droit de résilier leur contrat...

Le contrat de travail des employées de maison étrangères au Liban était au cœur hier d’une réunion de « discussion tripartite ». La rencontre a réuni, à l’hôtel Holiday Inn-Dune, à Verdun, l’Organisation internationale du travail (OIT), le ministère du Travail, la Sûreté générale, la CGTL, le Haut-Commissariat aux droits de l’homme (OHCHR), les bureaux de placement et la société civile.
 
Elle a été l’occasion pour l’OIT, sa directrice régionale, Nada al-Nashif, et son expert international, Martin Oelz, de soumettre aux différentes parties, avec le concours du conseiller légal, Me Nizar Saghyeh, une ébauche de contrat de travail unifié. Une sorte de contrat idéal entre l’employée de maison étrangère et son employeur libanais, qui respecte les normes internationales, dans l’attente d’une loi réglementant le travail domestique au Liban. Et ce dans l’objectif de protéger cette catégorie de travailleuses très vulnérables et de promouvoir les droits de la main-d’œuvre domestique migrante, conformément au programme d’action d’un projet financé par l’Union européenne. À plus long terme, ce contrat devrait revaloriser la profession d’employée de maison et la rendre attrayante à la main-d’œuvre locale.

Sensibiliser la population et les autorités
La discussion était donc animée hier. Principalement axée sur les articles du contrat de travail, elle a divisé l’assistance. D’une part, les sceptiques, qui ont fait part de leurs doutes et de leurs interrogations sur l’applicabilité du projet. D’autre part, les militants, défenseurs des droits des employées de maison, soutenus par l’OIT, qui ont insisté sur la nécessité de mettre en place un texte modèle, afin de hausser les standards appliqués au pays du Cèdre. Le Liban n’est pas signataire de la Convention 189 de l’OIT mise en place en 2011, intitulée « Travail décent pour les travailleurs domestiques », mais il est signataire de la Convention internationale contre le trafic humain. La discussion a donc mis en exergue la nécessité de sensibiliser la population, mais aussi les autorités, aux failles et aux dérives du travail domestique, tel qu’appliqué au Liban. Des dérives telles, qu’on pourrait leur attribuer les termes de travail forcé, d’esclavage ou de trafic humain.
Si de manière générale, les participants ont reconnu la nécessité de mettre en place un contrat pour pallier l’absence de législation, le directeur général du ministère du Travail p.i., Abdallah Razzouk, s’exprimant au nom du ministre Sélim Jreissati, n’a pas trouvé mieux que de s’attaquer à la presse, qui, selon lui, est à l’origine du problème, « car elle exagère les cas de maltraitance ». M. Razzouk n’a pas non plus épargné les pays exportateurs de main-d’œuvre étrangère domestique, dénonçant l’interdiction faite à leurs ressortissantes de venir travailler au Liban. « Une interdiction qui n’est pas justifiée et qui encourage le trafic humain », a-t-il assuré, devant une assistance médusée.

Vivre ou non au domicile de l’employeur
Place à l’ébauche de contrat de travail, avec ses 21 articles, « qui permet de combler une importante partie des failles dans la relation entre l’employée et son employeur », observe Me Saghyeh, présentant le projet. L’employée de maison bénéficie de droits, mais aussi de devoirs. Son temps de travail est limité à huit heures par jour, sauf exception. Elle jouit d’un congé hebdomadaire de 24 heures et d’un congé annuel, « qu’elle peut passer là où elle le souhaite ». Libre de circuler et de conserver ses papiers personnels, « elle devrait pouvoir, si elle le souhaite, vivre au domicile de son employeur ou avoir son propre logement ». L’avocat ne manque pas d’évoquer le salaire, qui devrait selon sa proposition « représenter au moins 80 % du salaire minimum, si l’employée réside au domicile de son employeur ». Quant au paiement du salaire, « il devrait se faire par le biais de la banque », afin d’empêcher les mauvais payeurs, nombreux semble-t-il.
 
Nizar Saghyeh voudrait idéalement que la relation entre les deux parties « ne soit pas liée à la caution payée par l’employeur au bureau de placement », afin d’éviter les abus envers l’employée de maison, « comme la confiscation de son passeport pour l’empêcher de quitter le domicile de son employeur ». « Séparer entre le travail et la vie privée de l’employée de maison est aussi important », note-t-il.
De part et d’autre de l’assistance, des propositions fusent, des remarques aussi, concernant tel ou tel article. On évoque les résiliations de contrat de part et d’autre, les assurances, les suicides, les discriminations. Le président du syndicat des bureaux de placement, Hicham el-Bourji, s’inquiète pour les intérêts de la profession. « Nous ne pouvons pas assumer les coûts d’un contrat qui n’aboutit pas », lance-t-il. Et d’ajouter à mi-mot : « Nous connaissons bien certaines raisons invoquées par les employeurs libanais. »
 
Le débat est lancé. Interrompu pour des impératifs horaires, il devrait bientôt reprendre jusqu’à la finalisation du projet. Une chose est certaine : soucieuse des droits des travailleuses, l’OIT place la barre très haut. Même si elle avoue tolérer une certaine flexibilité dans l’application.

L'orient le jour - Jreissati assure suivre de près l’affaire de la mort d’une travailleuse bangladaise, June 14 2012


Le bureau de presse du ministre du Travail, Sélim Jreissati, a annoncé hier que le ministère suit l’affaire de la mort d’une ressortissante du Bangladesh, Seana Gholam Mustafa Akhtar, avec attention.
Le corps sans vie de la jeune femme de 27 ans a été retrouvé hier, pendu aux rideaux d’un bureau de recrutement de travailleuses domestiques à Byblos.
Le ministre Jreissati a également contacté le ministre de la Justice, Chakib Cortbaoui, qui lui aurait affirmé que les autorités judiciaires ont ouvert une enquête. Cortbaoui a annoncé que la jeune femme se serait probablement suicidée.
D’après le ministre du Travail, la jeune femme était arrivée au Liban « il y a quelques jours ».

BEIRUT: A Bangladeshi domestic worker was found dead Wednesday at an employment agency in Jbeil, north of Beirut, in what appears to be a suicide.
The woman, 27, was found hanged. The office curtains, apparently used as a noose, were around her neck. The woman was identified as Seana Gholam Mustafa Akhtar.
Police launched an investigation into the case and began questioning employees at the agency. The official cause of death will be announced following a planned autopsy.
Hours after the news of the incident surfaced, Labor Minister Salim Jreissati contacted Justice Minister Shakib Qortbawi and the prosecutor’s office.
According to Jreissati's office, the woman might have committed suicide and the Labor Ministry is following up on the investigation.
The office added that the woman had arrived in Lebanon just days ago.

BEIRUT: Over 150 people attended a rock concert over the weekend at the recently reopened T-Marbouta cafe in Hamra organized by the American University of Beirut (Human Rights Club in collaboration with the Migrant Workers Task Force.Attendees paid an entrance fee of LL10,000 with proceeds going toward the purchase of supplies for English and Computer courses offered free to migrant workers at Zico House, Sanayeh and the Migrant Community Center in Nabaa.
Performances came from Mohammad Hodeib, Entity, The 80’s Revolution, Resonance, and EEE’s.
Prior to the music, a buffet of Ethiopian food was served which included: “Doro Wat,” a spicy chicken dish; “Enjera,” Ethiopian bread, lentils; and “Alchamote,” a salad made from carrots, potatoes and beans.
The highlight of the night’s music came following the scheduled performances, when Eddouard Abbas, from Lebanese hip-hop group Fareeq al-Atrash, was joined on stage by an Irish guitar virtuoso known endearingly as “Irish Don,” in an impromptu collaboration that no one expected. Following their performance, the event developed a certain spontaneous open-mic feel, with Edd exclaiming at one point: “Welcome to T-Marbouta has talent.”
On each table, small cards written by migrant workers were placed detailing the difficulties and discrimination they have faced living and working in Lebanon both from employers and Lebanese society in general.
One such card, whose author was anonymous, read: “Some employers treat us as though they own us ... We came here as employees not as slaves, and we should be treated as such.”
Speaking to The Daily Star, Janie Shen, one of the founding members of MWTF, described the event as a positive way to spread awareness of migrant workers’ issues and recruit new volunteers to help the organization’s initiatives at Zico House and The Migrant Community Center.
Chen commented that while there has been an increase in advocacy and campaigning for the rights of domestic workers in Lebanon following the tragic death of Ethiopian Alem Dechasa-Desisa in March of this year there is still a long way to go.
“Human Rights Groups and NGOs have become more active and migrant communities themselves have become more mobilized,” said Chen. “However, for real, concrete change to occur, we need to change attitudes and perceptions both in society at large and on a legal level.”

BEIRUT: A six-member gang wanted by the Lebanese Army for assaulting and blackmailing foreign workers has been arrested, a military communiqué said Friday.
“As part of its fight against organized crime, and as a result of investigations and follow-ups, Lebanese Army Intelligence in Beirut managed this week to arrest a gang of six people for attacking and blackmailing foreign workers,” the statement said.
Separately, it said eight other individuals were apprehended for robbery, smuggling of money as well as drug abuse and drug trafficking All the detainees have been referred to the military police for interrogation, the communiqué added.

L'orient Le Jour - L’ONU demande une enquête au Liban après le suicide d’une employée de maison éthiopienne, Mercredi, Avril 4, 2012


La rapporteure spéciale des Nations unies sur les formes modernes d’esclavagisme, Gulnara Shahinian, a demandé instamment hier au gouvernement du Liban de mener une enquête sur la mort d’Alem Dechasa, une employée de maison éthiopienne de 34 ans, qui s’est suicidée le 14 mars, quelques jours après avoir été battue en pleine rue, à Beyrouth.
Selon un communiqué du Haut-Commissariat des Nations unies pour les droits de l’homme, les faits sont documentés par une vidéo postée sur YouTube. Cette vidéo montre la victime en train de crier et de se débattre face à un homme qui la tire dans une voiture en l’attrapant par les cheveux.
« Comme beaucoup de gens dans le monde, j’ai regardé la vidéo montrant les violences physiques imposées à Alem Dechasa dans une rue de Beyrouth, a déclaré Mme Shahinian. Je demande instamment aux autorités libanaises de mener une enquête exhaustive sur les circonstances qui ont conduit à sa mort », a-t-elle ajouté.
« Ces images cruelles sur Internet me font penser aux nombreuses femmes migrantes que j’ai rencontrées au Liban lors de ma visite dans ce pays l’année dernière, a-t-elle ajouté. Des femmes qui ont été victimes d’esclavagisme domestique m’ont raconté être sous le contrôle absolu de leur employeur » et « souffrir d’abus physiques, psychologiques et sexuels ».
À la fin de sa visite au Liban en octobre 2011, Mme Shahinian avait demandé au gouvernement libanais de légiférer en faveur de la protection des quelque 200 000 travailleurs domestiques que compte le Liban.
« Les travailleurs migrants domestiques, dont la plupart sont des femmes, sont légalement invisibles », avait-elle déclaré lors de cette visite et « cela les rend particulièrement vulnérables ».
D’autres experts indépendants de l’ONU pour les droits de l’homme se sont joints à l’appel de Mme Shahinian et ont exprimé leur condamnation des violences physiques imposées à Alem Dechasa. Il s’agit de François Crépeau (Migrants), Rashida Manjoo (Violences faites aux femmes), Juan E. Mendez (Torture et traitement dégradants, cruels et inhumains), et Kamala Chandrakirana (Groupe de travail sur la discrimination faite aux femmes).
Le 15 mars dernier, des défenseurs des droits de l’homme à Beyrouth avaient déjà exprimé leur indignation au lendemain du suicide d’Alem Dechasa, frappée par un homme, son recruteur, selon la presse.
Alem Dechasa, 34 ans, s’était pendue le 14 mars avec un drap dans un hôpital psychiatrique où elle avait été amenée par la police.

BEIRUT: The United Nations Special Rapporteur on contemporary forms of slavery urged Lebanon’s government Tuesday to carry out a full investigation into the death of Alem Dechasa-Desisa, the Ethiopian domestic worker who apparently committed suicide last month after widely publicized abuse outside her consulate.
“Like many people around the world I watched the video of the physical abuse of Alem Dechasa on a Beirut street,” Gulnara Shahinian said in a statement. LBCI TV posted a video of two men, one of whom has since been charged with causing and contributing to her suicide, beating and dragging Dechasa-Desisa, 33, into a car outside the Ethiopian consulate. Doctors said she later committed suicide while in hospital.
“I strongly urge the Lebanese authorities to carry out a full investigation into the circumstances leading to her death,” Shahinian said. “The cruel image on the website reminded me of the many migrant workers I met in Lebanon during my official visit to the country last year ... women who had been victims of domestic servitude told me they had been under the absolute control of their employers through economic exploitation and suffered physical, psychological and sexual abuse.”
There are approximately 200,000 migrant domestic workers in Lebanon, and Dechasa-Desisa’s case has shed light on the problems they face. Various NGOs have condemned her abuse and urged investigation.
“There are a number of reports circulating about the human rights violations Alem Dechasa experienced ... and the facts surrounding her death,” Shahinian said. “States are under an obligation to ensure the realization of the right to truth about violations in order to end impunity and promote and protect human rights and provide redress to victims and their families.”

Daily Star - Twin rallies held in Beirut for women’s nationality rights, professors’ benefits, April 04, 2012


BEIRUT: Two separate rallies took place in Downtown Beirut Tuesday, one demanding Lebanese women be granted the right to pass their nationality to their husbands and children, and the other calling for full-time contracts to be given to deserving Lebanese University professors.
A sit-in of about 80 people took place in Riad Solh Square to protest the current Lebanese nationality law.
The group, named Jinsiyyati (My Nationality), took aim at the committee assembled by Parliament to discuss amending the standing law.
The current committee has repeatedly stated that it is working toward promulgating a law that would allow Lebanese women to pass on their nationality to their children, so long as their husbands are not Palestinian.
The campaigners took issue with such a tack and called on the committee to reconsider the principles of the law, asking that Lebanese women be allowed to pass on their nationality not only to their children but to their husbands as well, with “no exceptions.”
Lama Naja, Jinsiyyati’s coordinator, told The Daily Star that if husbands of Lebanese women are not granted Lebanese nationality, some might be forced to abandon their children. With “no social security, no medical assistance and no insurance” in Lebanon, such men might well move elsewhere, she claimed.
Khaldoun Sharif, an adviser to Prime Minister Najib Mikati, said that the current situation is “unbelievable and unacceptable” but spoke of support for change among certain politicians, including the prime minister. “[Mikati] supports [the campaign] 100 percent. This campaign is right,” he insisted.
Another man in the crowd was Thomas Hornig, an American saxophonist who has lived in Lebanon since 1994.
“I fell in love with a Lebanese woman at university in Paris,” Hornig said. “After university she wanted to go back to her country.”
Hornig was hired as a musician at the National Conservatory and has since been a Professor of Saxophone in addition to performing with the Lebanese Philharmonic Orchestra.
“I work or play or teach almost 24 hours a day and I still can’t make ends meet. I’ve paid my own residency and insurance for 14 years,” he complained.
Hornig argued that he’s done his part for his newly adopted country and deserves citizenship. “When the Israelis left in 2000, I performed with Julia Boutros, and in 2006 I was in Kuwait with Charbel Rouhana at a benefit for victims of the war [with Israel].”
With so many people in the country unable to claim Lebanese nationality because they were born to Lebanese mothers and foreign fathers, Hornig feels Lebanon faces an increasing “brain drain.”
Also Tuesday, a small group of professors from the Lebanese University gathered in the same area to demand full-time contracts.
The group of around 50 professors congregated in Riad al-Solh Square to bemoan their ineligibility for benefits, including transportation allowance, health care and a pension plan.
“We have no benefits at all,” said Rania Majzoub Sabra, adding that every professor in attendance held a doctorate but was still being manipulated by the state institution.
Majzoub Sabra rued the fact that although part-time teachers have the same workload as their full-time counterparts and are members of the same committees at the university, they are still paid on an hourly basis because it’s cheaper for the university.
She added that the current problem stemmed from sectarian politics in Lebanon, saying that the hiring of full-time teachers was based on unofficial quotas for the representation of political parties among the teaching staff.
“We want academic standards,” Sabra said.

U.N. human rights experts on Tuesday urged the Lebanese government to investigate the death of an Ethiopian housemaid, who committed suicide a few days after she was beaten by a man in Beirut.
Alem Dechasa, 34, hung herself with a bed sheet on March 14 at a psychiatric hospital east of Beirut, where she had been taken by police after the February beating that was aired on Lebanese television.
"Like many people around the world I watched the video of the physical abuse of Alem Dechasa," said Gulnara Shahinian, the U.N. expert on contemporary forms of slavery, in a statement.
"I strongly urge the Lebanese authorities to carry out a full investigation into the circumstances leading to her death," she added.
U.N. officials including anti-torture rapporteur Juan Mendez, migrant expert Francois Crepeau, rapporteur on violence against women Rashida Manjoo as well as a member of the working group on discrimination against women Kamala Chandrakirana echoed the call.
They also demanded that results of the investigation be made public.
The video footage showing a man dragging Dechasa by the hair and kicking her outside Ethiopia's consulate had sparked national outrage.
The man owned the employment agency that recruited the Ethiopian woman, according to local news reports.
Shahinian said the footage "reminded me of the many migrant women workers I met in Lebanon during my official visit to the country" in October 2011.
"Women who had been victims of domestic servitude told me they had been under the absolute control of their employers through economic exploitation and suffered physical, psychological and sexual abuse," she said, calling on the Lebanese government to enact legislation to protect the 200,000 domestic workers in the country.

BEIRUT: A crowd of Ethiopians gathered outside the Ethiopian Consulate in Badaro Sunday afternoon to protest its neglect of their community in Lebanon.
Following a Sunday church service nearby, a few dozen women and one man walked to the consulate and demonstrated outside.
The assembled expressed their frustration with consular officials' perceived callousness, saying that when Ethiopians contact their consulate in Lebanon via telephone they are often ignored or hung up on.
"We are living here," said a woman named Berti, adding that "the [consulate] should help us, but they only want money."
Another woman, named Sarah, told The Daily Star that many Ethiopians travel to Lebanon illegally through Sudan. She said that if such an Ethiopian encounters trouble in Lebanon, the consulate will absolve itself of responsibility and refuse assistance, but if the same person should want to renew her passport, the consulate would help in the interest of making a profit.
The Ethiopian Consulate was unavailable for comment.
Another driving point of the protest was the consulate's recent mishandling of the situation involving Alem Dechasa-Desisa, an Ethiopian domestic worker who was videotaped outside the building being physically abused by a man later identified as Ali Mahfouz. Dechasa-Desisa was later taken to Deir al-Salib where doctors said she hanged herself on March 14, using strips of her bed sheets.
"Nobody helped her," said another woman named Sarah, who wore a blue keffiyeh: "How did she die? She didn't kill herself. She's not crazy."
She added that the group was angry that officials at the consulate saw Dechasa-Desisa being beaten, thrown on the ground and forced into Mahfouz's care, but failed to take action, instead remaining inside the consulate walls and watching the abuse.
Several protesters told The Daily Star that their group would have been larger had it not been for the consulate trying to prevent the demonstration.
"At church, the [consulate's] workers told us not to come here and said they called the police," said Sarah with the blue keffiyeh, "but the police are here and they are keeping the peace. They aren't harming us."
"We have no problem with the Lebanese government," added another protestor named Lina. "We like them, but we have a problem with the consulate."
"We don't have an embassy here," said Sarah in the blue keffiyeh, "we only have our community."
The group chanted slogans expressing their disdain for the consulate and their suspicion that it wanted Ethiopians out of the country.
The chants were followed by a short prayer before the group dispersed. A few people from the group expressed dismay that even though Sunday is their day off, their employers only give them a few hours in the morning before they must return to work.
A woman named Makdees said, "I come [to protest], I pray, now back to work."
Before leaving the scene she added, "Please, from every country to Lebanon, help us."
