The Lebanese Center for Human Rights (CLDH) is a local non-profit, non-partisan Lebanese human rights organization in Beirut that was established by the Franco-Lebanese Movement SOLIDA (Support for Lebanese Detained Arbitrarily) in 2006. SOLIDA has been active since 1996 in the struggle against arbitrary detention, enforced disappearance and the impunity of those perpetrating gross human violations.

Journalists leave Somalia after 15-month hostage hell

MOGADISHU, Somalia: Two journalists from Canada and Australia flew out of Somalia on Thursday at the end of a 15-month hostage ordeal during which they were tortured and shackled in windowless rooms by their captors. Amanda Lindhout, her head covered with a black veil, and fellow freelancer Nigel Brennan boarded a private plane at Mogadishu airport after being escorted there by pro-government militia, witnesses said. It was not immediately clear where they were headed.

While the two were kept away from journalists, the Canadian Lindhout earlier told an interviewer how she had been beaten and tortured by her captors and acknowledged a $1 million ransom had been paid to secure their release.

One of Lindhout and Brennan’s kidnappers, who refused to identify himself, confirmed to AFP that a ransom of $1 million had been paid.

Lindhout told Canadian broadcaster CTV by telephone she spent her captivity “sitting in a corner on the floor 24 hours a day for the last 15 months. There were times that I was beaten, that I was tortured.”

“It was extremely oppressive,” she added. “I was kept by myself at all times. I had no one to speak to. I was normally kept in a room with a light, no window, I had nothing to write on or with. There was very little food.”

The kidnappers told her that they beat her, she said, because the money “wasn’t coming quickly enough.”

The Australian family of Brennan spoke of their “overwhelming” joy after his release.

An emotional Kellie Brennan, the photojournalist’s sister-in-law, fought back tears as she recounted the family’s harrowing emotional journey since his capture.

“It’s very hard to express the overwhelming sense of joy that we have today that we feel as a family at the news of Nigel and Amanda’s release,” she told reporters.

The two were kidnapped by unknown gunmen on August 23, 2008 on the road leading from Mogadishu to Afgoye, 25 kilometers to the west, where they intended to visit camps for people forced to flee fighting in the capital. A Somali journalist and two drivers were also taken hostage but freed after 177 days.

منظمة العفو الدولية تطالب الدولة بنبش المقابر الجماعيّة

انتقدت منظمة العفو الدولية عجز السلطات اللبنانية عن تحديد هويّة رفات الشخص الثاني الذي عُثر على جثته قرب جثة الصحافي البريطاني اليك كوليت الأسبوع الماضي، وذلك داخل موقع سابق لتنظيم حركة فتح ـــــ المجلس الثوري، قرب بلدة عيتا الفخار (قضاء راشيا).
أصدرت المنظمة بياناً أمس جاء فيه أن العثور على جثة كوليت يعدّ «تطورا يلقى الترحيب»، وأضافت إنّ جثة الشخص الآخر «لم تحدّد هويتها وأعيد دفنها، ما يشير إلى عدم كفاية الجهود المبذولة من جانب السلطات اللبنانية للكشف عن مصير وأماكن وجود آلاف اللبنانيين والفلسطينيين وغيرهم، من مواطني الدول الأخرى ممن اختُطفوا على أيدي الميليشيات المسلحة، وأُخضعوا للاختفاء القسري على أيدي القوات اللبنانية والسورية والإسرائيلية إبّان الحرب الأهلية". أشارت المنظمة إلى أن عجز السلطات اللبنانية «البيّن» عن تحديد هوية رفات الشخص الثاني «يسلّط الضوء على عدم بذل ما يكفي من الجهد من أجل إنشاء قاعدة للبيانات تتضمّن عيّنات من الحمض النووي لأفراد عائلات المفقودين أثناء الحرب».

انتقدت المنظمة بوضوح فشل الدولة في القيام بعمليات «استخراج لجثث من المقابر الجماعية»

لفت بيان المنظمة إلى أن اكتشاف جثتين في موقع سابق لفتح ـــــ المجلس الثوري، و«هي ميليشيا اشتهرت بصورة أكبر باسم منظمة أبو نضال، وأعلنت مسؤوليتها عن اختطاف الصحافي البريطاني وقتله سنة 1986 (...) يطرح احتمال أن يكون مفقودون آخرون قد دُفنوا في الموقع». وطالبت المنظمة السلطات اللبنانية بـ«فرض الحماية على الموقع»، وأن «تتّخذ تدابير للبحث عن بقايا بشريّة أخرى، وإذا ما عُثر على جثث أخرى، فإن على السلطات (اللبنانية) اتخاذ الخطوات اللازمة لتحديد هوية أصحابها، وتسليمها إلى عائلات الضحايا». داعيةً الدولة اللبنانية إلى «ضرورة القيام بعمل منسق للكشف عن مصير آلاف المفقودين، الذين اختُطفوا بين عامي 1975 و1990».
انتقدت المنظمة بوضوح «فشل» الدولة اللبنانية في القيام بعمليات «استخراج لجثث من المقابر الجماعية»، التي تعود إلى فترة الحرب الأهلية. لافتة إلى أن من بين المقابر الجماعية هذه «ثلاث موجودة في بيروت، وجرى الحديث عن معطياتها في ملخص من ثلاث صفحات توصّلت إليها الهيئة الرسمية، للتحقيق في مصير الأشخاص المختطَفين والمختفين وهي: مقبرة سانت ديمتريوس في الأشرفية، ومقبرة الشهداء في حرش بيروت، والمقبرة الإنكليزية في التحويطة. وفي هذا الإطار أشارت المنظمة إلى أنه يمكن السلطات اللبنانية أن تعوّل على القرار الأوّليّ الصادر عن القضاء اللبناني الشهر الماضي، بعد دعوى تقدّمت بها «لجنة أهالي المخطوفين والمفقودين في لبنان» و«جمعية دعم المعتقلين والمنفيّين (سوليد)»، وأن تعلن المعطيات التي خلصت إليها تحقيقات الهيئة الرسمية في مصير المفقودين، فذلك «يؤدّي إلى عمليات بحث عن الرفات في هذه المواقع (المقابر الثلاث) مستقبلاً».
ثمّنت منظمة العفو الدولية عمل الدولة اللبنانية على استخراج الجثث من المقبرة الجماعية المحاذية لوزارة الدفاع، وإجراء فحوص الحمض النووي على الجثث التي ضمّتها، حيث عثر على رفات 24 عسكرياً في تشرين الثاني سنة 2005.

اليك كوليت جثة "تاريخية" تكشف مقابر الحرب الجماعية

قصة المقابر الجماعية في لبنان تخبو ثم تعود إلى السطح مجدداً، ففي قصة البحث والتنقيب ومن ثم فحص الحمض النووي للصحافي البريطاني اليك كوليت، عادت قصة هذه المقابر لتظهر، قصص الموت والاختفاء القسري خلال الحرب، التي لم يستطع أحد حلّها طوال فترة السلم الأهلي الممتدة منذ العام 1991، لم تجد حتى الآن من ينهيها ويعيد للأهالي خبراً عن أبنائهم المفقودين في ذلك الزمان. بالقرب من مدفن كوليت هناك العديد من الحفر التي لم تدخل في جداول الأعمال، وكذلك غيرها الكثير من الحفر المنتشرة في كل الأراضي اللبنانية.
فقبل أيام حين عثر فريق بحث بريطاني على جثة الصحافي كوليت في قاعدة عسكرية سابقة لحركة فتح المجلس الثوري التابعة لـ"أبو نضال"، في منطقة عيتا الفخار في البقاع الغربي، فحوص الحمض النووي التي أجريت على الجثة أكدت تطابقها مع مواصفات الحمض النووي للصحافي كوليت. ولكن بالقرب من مدفن جثة كوليت وجد الباحثون قبراً لجثة أخرى لشاب في سن الثالثة والعشرين ، بقيت مدفونة في حفرتها وبالقرب منها أكثر من 16 حفرة توحي وكأنها قبور.
بعيداً حوالي الخمسين متراً عن الزنزانة، تقبع حفر حديثة، في واحدة منها كان مدفن كوليت، وبعيداً منه مدفن لشاب في الثالثة والعشرين من العمر، وجدته بعثة البحث البريطانية بثياب عسكرية وملفوفاً ببطانية، بعثة البحث أعادت دفنه في الحفرة نفسها التي وجدته فيها، فيما لم يقم أحد بفحص الحمض النووي لمعرفة صاحبها وظروف اختفائه ومقتله.
في المكان المشرف على السجن أيضاً يظهر عدد كبير من الحفر القديمة، عددها أكثر من 16 حفرة مبعثرة في المكان كأنها قبور مغلقة، وتنتظر تحركاً رسمياً لوضع حدّ لتساؤلات المواطنين الذي يرفضون التحدث إلى وسائل الإعلام خوفاً من التغيرات التي تطرأ على المنطقة، فحتى العام 1969 كانت المنطقة تحت سيطرة الجيش اللبناني بسبب وقوعها عند الحدود مع سوريا، وبعد ذلك جاء الوجود الفلسطيني، واحتلال "المجلس الثوري" الموقع منذ العام 1969 وصولاً إلى الاجتياح الإسرائيلي في العام 1982، حيث شهدت المنطقة معركة بيادر العدس - السلطان يعقوب واختفى فيها ثلاثة جنود إسرائيليين، لم تظهر أي معلومات عنهم حتى هذا الوقت. وبعد العام 1988، وما تلا إعدام كوليت من ضغوط تعرضت لها الدولة السورية من دول العالم، اضطرتها إلى إغلاق مراكز جماعة "أبو نضال" في منطقة البقاع، وتسلمت إدارتها أو سلمتها لحركة فتح الانتفاضة "أبو موسى".
في الزنزانة المعتمة والتي ينخفض سقفها عن بقية غرف الموقع العسكري، قضى الصحافي البريطاني كوليت أيامه الأخيرة قبل إعدامه من قبل فتح المجلس الثوري، عملية الإعدام ربطت يومها بعملية القصف الأميركي على موقع رئاسي في ليبيا أدى إلى مقتل ابنة الرئيس الليبي معمر القذافي.
كوليت الذي كان يعمل في تلك المرحلة مع الأمم المتحدة في متابعة ملفات المخيمات الفلسطينية في لبنان، تم خطفه ليعدم بعد فترة ويظهر في شريط فيديو يصور عملية القتل وينهي حياة الرجل الذي جرت تصفيته عام 1986 بعد نحو عام من خطفه في 25 آذار 1985 بينما كان عائداً من مخيم برج البراجنة في مهمة لـ"الأونروا"، وقد تبنت خطفه في حينها حركة فتح - المجلس الثوري التابعة لـ"أبو نضال".
زنزانة موقع جماعة "أبو نضال"، هي جزء من منطقة عسكرية كانت مغلقة وممنوعة على أهالي المنطقة والمدنيين، جدرانها فيها عدة ثقوب كأنها رصاص يوحي وكأن إحدى عمليات الإعدام تمت بداخلها، والنوافذ الصغيرة فيها لا يمكن منها إلا رؤية منطقة خلة الزيتي في خراج بلدة عيتا الفخار في قضاء راشيا، وهي منطقة صخرية عند أسفل الطريق المؤدية إلى مزار القديس جاورجيوس أعلى الجبل.
الأهالي يروون أن عناصر "المجلس الثوري" كانوا يقومون بعمليات إعدام للعناصر التي يشتبهون بعلاقتهم مع منظمات فلسطينية ثانية أو بعلاقتهم مع أجهزة مخابرات عربية أو دولية،أو مع العدو الإسرائيلي، حيث اختفى المئات من أعضاء التنظيم، ويقال إن خلافات داخلية كانت السبب الرئيسي لعمليات القتل التي سمت هذا التنظيم الأمني والسري، غاب الكثيرون من أعضاء "المجلس الثوري" من جنسيات عربية مختلفة، لبنانيين وعراقيين وفلسطينيين وسوريين، اختفوا منذ أعوام طويلة ولم يظهر منهم أحد.
الحفر المنتشرة بكثرة في المكان لا يمكن المرور بجانبها من دون الانتباه لها، ففي وسطها ينبت العشب بكثافة، وبعضها متقارب وبعضها الآخر بعيد جداً، فيما ترك الوفد البريطاني رايتين صغيرتين باللون الأحمر على قبر كوليت والقبر الآخر الذي تمت إعادة ردمه.
هل يمكن اعتبار هذه الحفر قبورا أخرى، أو هل يحتوي الموقع على مدافن لأشخاص اختفوا في الحرب، يعني هل يمكن القول إن مقبرة جماعية يحويها المكان ويمكن أن تكشف عن قصص كثيرة وحياة ناس ضاعت في غياهب الزنازين والحروب والاختطاف والموت وجدت طريقها للظهور، والإعلان عن مكانها؟.
قصة اختفاء الصحافي البريطاني كوليت كُشفت من خلال خرائط كانت مع فرقة البحث البريطانية، خرائط دقيقة لم يكن بحاجة "الفريق للبحث طويلاً ليجد الجثة التي أتى يبحث عنها. ولكن في لبنان قصص اختفاء كثيرة، آلاف منها لم يجد حتى الآن سبيلاً إلى الظهور.
في العام 2003 وقبل دخول الجيش الأميركي إلى بغداد، دخلت مجموعة مسلحة وقتلت "أبو نضال" في بيته في العاصمة العراقية، مات الرجل واختفت معه قصص كثيرة عن مآسي الحرب اللبنانية، وغيرها من القصص.
قصة موت معلن للصحافي كوليت الذي كان يعمل مع الأمم المتحدة واختطف منذ 23 عاماً ومن ثم سيدفن أيضا في احتفال معلن أيضاً وبتكريم من الأمم المتحدة ومن دولة صاحبة العرش، فيما أعيد دفن الشاب الآخر في خلة الزيتي في عيتا الفخار القرية المختلطة مسيحياً وإسلامياً، لتظل هويته مجهولة كما سر موته غير المعلن. مقبرة جماعية في الحفر التي تظهر بوضوح، أم أرض غير مستوية، أمر يستدعي تحركاً قضائياً لبنانياً لتوضيح حقائق ما كان يجري هناك، في تلك الأرض الجرداء التي لا تزال إلى اليوم من دون ناسها أصحابها الذين منعوا من دخولها لأعوام طويلة، بسبب الحرب، كأنهم حرموا منها الآن بسبب قصص الخوف منها.

فليتحرك المسؤولون قبل وفاة الباقين

كرر رئيس "جمعية المعتقلين اللبنانيين السياسيين في سوريا" علي ابو دهن مناشدته المسؤولين "التحرك لمعالجة ملف اللبنانيين المعتقلين في السجون السورية وكشف مصيرهم قبل ان يعودوا جثثاً الى ذويهم في لبنان".
وجاء في بيان وزعته الجمعية: "ايها الحكام استيقظوا. ان ارواح المعتقلين اللبنانيين في السجون السورية تناديكم، ولا سيما الاحياء منهم، قبل ان يصبحوا امواتاً لا يعرفون اين يدفنون. فماذا تنفعهم فحوص الحمض الريبي النووي؟ فهم لن يستطيعوا اخباركم بما حصل لهم او بما حل بهم من عذاب وألم وويلات، او ان يخبروكم من بقي منهم حياً في السجون السورية؟ او من قبض علهيم وما هي التهمة الموجهة اليهم؟ هم طبعا لن يروكم في استقبالهم ولا حتى في وداعهم لانكم غير قادرين على مواجهتهم، وخائفون من النظر اليهم (...)".
واضاف: "منذ فترة عاد الينا الموقوف اللبناني من السجون السورية عامر عاد ساطي من بلدة كامد اللوز شهيداً، فدفن من دون كشف اسباب موته، ولم يشارك احد من السلطات اللبنانية في دفنه. اما الشهيد الجندي في الجيش اللبناني جون ناصيف فقد حظي بدفن مشرّف تشكرون عليه. لكن ألم تسمعوا الصرخة المدوّية التي اطلقتها والدته اليكم والى المجتمع اللبناني والدولي، مؤكدة عبر وسائل الاعلام وفي اكثر من مناسبة انها رأت ابنها جوني في السجون السورية حياً؟ فمن قتله؟ وكيف وصل الى مدافن اليرزة؟".
وختم متوجهاً الى النواب: "نأمل ان توقعوا بسرعة المشروع المقدم من نواب كتلة "القوات اللبنانية" والنائب ابرهيم كنعان، المنسي في ادراج مكاتب البرلمان منذ نحو سنتين، لاعطاء المعتقلين السابقين في السجون السورية حقوقاً مادية ومعنوية اسوة بالمفرج عنهم من السجون الاسرائيلية ومن سجن الخيام، فيرفع عنا الظلم والضيم والغبن ونشعر بأننا سواسية في هذا الوطن (...)".

اللجنة النيابية لحقوق الإنسان تصر على كشف حقيقة اختفاء صادر

أكدت لجنة حقوق الإنسان النيابية إصرارها على جلاء ملابسات إخفاء الموظف في شركة طيران «الشرق الأوسط» جوزف صادر في منطقة طريق المطار في الضاحية الجنوبية لبيروت أوائل العام الجاري.

وأعلن رئيس اللجنة ميشال موسى بعد اجتماعها الأول أمس في المجلس النيابي، أن المجتمعين اتفقوا على «استكمال الخطة الوطنية لحقوق الإنسان، وفق المنهجية المعتمدة لا سيما مناقشة ما تبقى من ملفات هذه الخطة والبدء بالصياغة النهائية تمهيداً لوضعها للمناقشة بحسب الأصول، وتم تكليف رئيس اللجنة ومقررها مهمة متابعة كل الشؤون المتعلقة بتنفيذ الخطة والطلب من الحكومة ولا سيما وزارة الخارجية والوزارة المعنية الإسراع في وضع التقرير الوطني اللبناني عن واقع حقوق الإنسان تمهيداً لرفعه الى مجلس حقوق الإنسان لدى الأمم المتحدة في إطار المراجعة العالمية الدولية».

وأكد المجتمعون، بحسب موسى، أن «مواضيع حقوق الإنسان على أهميتها جميعها يتمتع بعضها بأولوية خاصة تستوجب عرضها للمناقشة على اللجنة عند الضرورة»، كما أعربوا عن إصرارهم «على جلاء ملابسات اختطاف واختفاء المواطن جوزف صادر منذ أكثر من عشرة أشهر من دون توافر أية معلومات جدية عن هذه الجريمة وستتابع اللجنة هذا الموضوع حتى انتهاء ملابسات هذه الجريمة».

بعد انعقاد أول جلسة لها برئاسة النائب الدكتور ميشال موسى، عرضت لجنة حقوق الإنسان النيابية لأبرز ما تم الاتفاق عليه لجهة استكمال الخطة الوطنية لحقوق الإنسان وفق المنهجية المعتمدة، إلى جانب الطلب من الحكومة الإسراع في وضع التقرير الوطني اللبناني عن واقع حقوق الإنسان تمهيداً لرفعه إلى مجلس حقوق الإنسان لدى الأمم المتحدة في إطار المراجعة العالمية الدولية.
إلى ذلك، أصرت اللجنة على جلاء ملابسات اختطاف واختفاء المواطن جوزف صادر منذ أكثر من عشر أشهر من دون توافر أي معلومات جدية عن هذه الجريمة. وأشارت إلى أنها ستتابع هذا الموضوع حتى انتهاء ملابسات هذه الجريمة.
من جهة أخرى، دعت اللجنة إلى إحياء اليوم العالمي لحقوق الإنسان في 10 كانون الأول المقبل، في مجلس النواب بالتعاون مع الأمم المتحدة

La dépouille mortelle du journaliste Alec Collett identifiée

Les analyses ADN ont confirmé que le corps retrouvé dans la plaine de la Békaa par une équipe de spécialistes britanniques était bien celui du journaliste Alec Collett, enlevé et tué pendant la guerre, a annoncé hier l'ambassade de Grande-Bretagne.
« Nous pouvons confirmer que les tests ADN montrent que la dépouille mortelle retrouvée la semaine dernière est celle d'Alec Collett », a déclaré à l'AFP une porte-parole, Nicola Davis.
Les Nations unies doivent se charger du rapatriement de la dépouille mortelle, a-t-elle ajouté, sans autre précision.
Le corps du journaliste a été retrouvé dans la plaine de la Békaa par une équipe de recherche composée de spécialistes militaires et du renseignement britannique dépêchée spécialement.
Alec Collett a disparu en 1985 alors qu'il avait 64 ans, et a été donné pour mort un an plus tard.
Il se trouvait en mission dans un camp de réfugiés géré par l'Agence des Nations unies pour l'aide aux réfugiés palestiniens (Unrwa), près de l'aéroport de Beyrouth, quand il a été enlevé.
L'organisation Fateh-Conseil révolutionnaire d'Abou Nidal avait revendiqué l'enlèvement et le meurtre de Collett, considérés comme une riposte aux raids américains contre la Libye.

L'ingénieur japonais qui avait été enlevé le 15 novembre au Yémen a été libéré hier, a annoncé le gouverneur de Sanaa, Nouman Douid. « L'otage a été libéré et se trouve actuellement en compagnie de chefs tribaux qui ont négocié son élargissement », a déclaré hier soir M. Douid à la presse. M. Douid n'a pas précisé quand l'otage serait rapatrié à Sanaa. Selon lui, la libération de ce Japonais, un coopérant, a été obtenue par des médiateurs tribaux contre la promesse de suivre l'affaire de l'un des proches des ravisseurs détenu sans jugement depuis deux ans par les autorités. Les ravisseurs voulaient échanger leur otage contre ce Yéménite présenté comme un extrémiste islamiste par des sources proches de sa tribu.

DNA tests confirm Bekaa body belongs to missing UK journalist Alec Collett

BEIRUT: Forensic tests have confirmed that remains found in eastern Lebanon are those of British reporter Alec Collett who was kidnapped during the country’s civil war, the British embassy said on Monday. “We can confirm that DNA tests show that the remains that were found last week are those of Alec Collett,” embassy spokeswoman Nicola Davis told AFP.

The United Nations was set to transport the reporter’s body home, she added, without giving further details.

British experts working in the Bekaa region of eastern Lebanon recovered the remains, which underwent DNA testing, a Lebanese security source said last week.

Collett, who was 64 at the time, went missing in 1985 and was reported to have been killed a year later.

He was on assignment in refugee camps for the United Nations Relief and Works Agency (UNRWA) when taken hostage near Beirut airport.

The Abu Nidal Organisation (ANO), a radical offshoot of the Palestinian movement Fatah, claimed responsibility for the abduction and killing, said to be in response to US air raids on Libya, a funder of the ANO.

In April 1986, a videotape showed the hanging of a hooded man said to be Collett. However, the victim was never officially identified.

أعرب رئيس الوزراء العراقي نوري المالكي خلال لقائه السفير المصري اشرف شاهين امس عن الرغبة في تطوير العلاقات مع القاهرة وتذليل المصاعب التي تعترض ذلك.
وأكد المالكي في بيان "حرصه على تطوير العلاقات"، مضيفا ان "الزيارة المقبلة ستدفع العلاقات الى الامام بين البلدين (...) ونسعى الى مد جسور قوية وسنعمل على الوصول بالعلاقات الى مستوى التكامل، وتذليل الصعوبات التي تقف في طريق تطويرها".
من جهته، قال شاهين "احمل لكم رسالة واضحة من فخامة رئيس الجمهورية حسني مبارك ورئيس الوزراء أحمد نظيف بأن مصر تفتح ذراعيها للعراق (...) وبناء علاقات تعاون استراتيجية فالمستقبل واعد".
ووصل سفير مصر الى بغداد قبل اسبوعين بعد غياب القاهرة عن العراق ديبلوماسيا منذ اغتيال القائم باعمالها ايهاب الشريف العام 2005.
وفي سياق آخر، اعرب المالكي عن استعداده للتعاون في ملف المفقودين الكويتيين ابان غزو النظام السابق للكويت في 1990، مؤكدا سعيه لانهاء هذا الملف "الانساني".
وقال المالكي خلال استقباله رئيس بعثة الصليب الاحمر الدولي الجديد ماكنا بارت، ان "قضية المفقودين الكويتيين قضية انسانية وليست سياسية ونحن على استعداد تام للتعاون مع الاخوة في دولة الكويت"، بحسب بيان حكومي.
واضاف "اكدنا التزامنا بالتعاون بخصوص المفقودين والاموال والممتلكات الكويتية في رسالتين بعثناهما سابقا الى الامم المتحدة والحكومة الكويتية، ونسعى لانهاء هذا الملف الانساني ولا مصلحة للعراق بحجز رفات المفقودين".
وكانت اللجنة الدولية للصليب الاحمر اعلنت ان اجتماعا رفيعا يضم ممثلين عن العراق والكويت سيعقد الخميس في الكويت لكشف مصير الاشخاص الذين فقدوا خلال حرب الخليج الثانية (1990-1991).
وانشئت اللجنة الثلاثية واللجنة الفنية الفرعية المنبثقة منها عامي 1991 و1994 على التوالي، بهدف كشف مصير المفقودين في هذه الحرب.
وساعدت هذه الآلية حتى الان في كشف مصير اكثر من 300 مفقود بينهم 215 كويتيا، و82 عراقيا، و12 سعوديا واخرين من مختلف الجنسيات.
وتؤكد الكويت انها لا تعرف مصير 605 اشخاص نقلوا الى العراق خلال فترة الاحتلال وهم 571 كويتيا و34 اجنبيا هم 14 سعوديا وخمسة مصريين وخمسة ايرانيين واربعة سوريين وثلاثة لبنانيين وبحريني وعماني وهندي.
واعترف النظام العراقي السابق من جهته بانه اخذ اسرى لكنه اكد فقدان اثرهم بعد انتفاضة الشيعة في جنوب العراق التي تلت حرب الخليج.
امنياً، لقي 3 اشخاص مصرعهم، بينهم رئيس بلدية الموصل، شمال العراق، وأصيب 10 بجروح مختلفة في سلسلة من التفجيرات وأعمال العنف في نينوى وبغداد وكركوك أمس.
فقد اغتالت مجموعة مسلحة مجهولة الهوية رئيس بلدية الموصل بعدما اقتحمت داره في حي الصديق أمس. فيما قتل شخصان وأصيب ثالث بانفجار عبوة ناسفة مزروعة قرب مدخل شارع الجمهورية بوسط المدينة.
وفي بغداد، قال مصدر امني إن عبوة ناسفة انفجرت قرب محطة موسى بن نصير في شارع النضال وسط المدينة، "أسفرت عن إصابة أربعة أشخاص بجروح وإلحاق أضرار مادية بعدد من المحال التجارية". واضاف المصدر "كما ادى انفجارعبوة ناسفة لدى مرور دورية أميركية في منطقة الحسينية، شرق بغداد، الى إصابة مدنيين اثنين بجروح من دون معرفة حجم الخسائر في صفوف القوات الأميركية"، مشيراً الى ان "إنفجارعبوة ناسفة ثالثة تحت جسر السنك في وسط بغداد اسفر عن إصابة مدني واحد بجروح".
وفي بغداد، ايضا أصيب اثنان من عناصر الشرطة بجروح بانفجارعبوة ناسفة استهدفت دوريتهم في تقاطع سبع قصور في منطقة الكرادة وسط المدينة.
من ناحية أخرى، نجا مدير التحقيقات الجنائية في كركوك العقيد اراس محمد من محاولة اغتيال استخدمت فيها عبوة ناسفة انفجرت اثناء مرور سيارته بالقرب من متنزه كركوك، الذي يقع على طريق بغداد، بينما اختطف مسلحون مجهولون مسيحيا يعمل في مديرية توزيع المنتجات النفطية من أمام منزله في حي الواسطي وسط المدينة نفسها.

الافراج عن الرهينة
الياباني في اليمن


اعلن محافظ صنعاء نعمان دويد مساء امس انه تم الافراج عن الرهينة الياباني الذي خطفت في اليمن قبل تسعة أيام.


وقال دويد للصحافيين (تم اطلاق سراح الرهينة وهو موجود حاليا مع زعماء قبليين قاموا بالتفاوض للافراج عنه).
واوضح انه تم الافراج عن الرهينة الذي قال الاعلام الياباني انه يدعى تاكيو ماشيمو (63 عاما)، بناء على وعد من السلطات اليمنية بمتابعة قضية شخص قريب من الخاطفين تعتقله السلطات اليمنية منذ عامين من دون محاكمة.
ولم يحدد دويد موعد تسليم الرهينة الى السلطات اليمنية.

وفد من «حماس» في القاهرة... ونتنياهو يقلّل من التفاؤل

تتسارع وتيرة الأنباء عن وضع اللمسات الأخيرة على صفقة تبادل الأسرى الشاملة بين «حماس» وإسرائيل. تقدُّم حاول رئيس الوزراء الإسرائيلي بنيامين نتنياهو التخفيف من وهجه، مؤكداً أن الصفقة لن تنتهي في ساعات قليلة

بعد ساعات على قمة الساعة والنصف التي جمعت الرئيس المصري حسني مبارك ونظيره الإسرائيلي شمعون بيريز في القاهرة أول من أمس، وصل وفد من حركة «حماس» بقيادة محمود الزهار إلى مصر لوضع الترتيبات الأخيرة لصفقة تبادل الأسرى مع إسرائيل.
بدأ الوفد، الذي يضمّ قياديّاً من «كتائب عز الدين القسام»، محادثات مع مساعدين لرئيس الاستخبارات المصرية عمر سليمان، وسط تعتيم إعلامي وإجراءات أمنية مشددة.
وعززت التكهنات الخاصة بقرب إبرام الصفقة المنتظرة، تصريحات لعدد من المسؤولين الفلسطينيين، أعلنوا في خلالها أن إسرائيل خفّفت من شروطها لإبرام صفقة تبادل الأسرى، ووافقت على أن يشمل الاتفاق الإفراج عن نحو 160 أسيراً رفضت إطلاق سراحهم من قبل، بينهم عدد من فلسطينيي 48. وقالت المصادر إن هناك أملاً في إبرام اتفاق بحلول عيد الأضحى نهاية الأسبوع الجاري. وكشفت عن أن «حماس» ستسلّم في الجزء الأول من الاتفاق الأسير الإسرائيلي جلعاد شاليط إلى مصر لتفرج إسرائيل بالتزامن عن 350 إلى 450 سجيناً، على أن يُفرَج عن مزيد من الأسرى بعد نقل شاليط من مصر إلى إسرائيل. وقالت مصادر إن «حماس وافقت على خروج البعض إلى المنفى بدلاً من العودة إلى الضفة الغربية أو قطاع غزة».
وفي سياق التصريحات الإيجابية، قال عضو المجلس التشريعي الفلسطيني عن حركة «حماس»، أحمد بحر، خلال اجتماع مع عائلات أسرى فلسطينيين محتجزين في إسرائيل، إن «فجر الحرية لاح وسنحتفي قريباً بأسرانا الأبطال».
وتزامنت تصريحات بحر مع نقل موقع «الرسالة نت»، المقرب من «حماس»، عن مصادر في الحركة قولها إن الصفقة الآن «متوقفة على اسم أسير واحد من بين قائمة الأسماء التي قدمتها حركة حماس». كذلك ترافقت أيضاً مع إعلان الإذاعة الإسرائيلية عقد اجتماع والدَي شاليط أمس مع المنسّق الإسرائيلي في هذه القضية حاجي هداس على مدى ساعتين، وتسرب أنباء عن بدء مصلحة السجون الإسرائيلية بتجميع أسرى فلسطينيين استعداداً للإفراج عنهم، وهو ما نفته مصلحة السجون لاحقاً.
كذلك أشارت صحيفة «يديعوت أحرونوت» إلى أن عدداً من الأسرى الفلسطينيين، ممن وصفتهم بأن أيديهم «تلطخت بدماء اليهود»، اتصلوا بأفراد عائلاتهم ليبلغوهم بأن أسماءهم مدرجة في قوائم السجناء التي قدمتها «حماس» وأنهم سيُحرَّرون قريباً.
وفي ضوء المعطيات الإيجابية، خرج رئيس الوزراء الإسرائيلي، بنيامين نتنياهو، للتقليل من التفاؤل، معلناً أنه «لم يجرِ حتى الآن التوصل إلى صفقة تبادل الأسرى مع حركة حماس». وأضاف أنه لا يعرف «إن كان سيُتفَق عليها»، مبرراً ذلك بأن «الأمر ليس مرتبطاً بنا فقط». وأشار إلى أنه «ستتخذ الحكومة قراراً بهذا الشأن، ثم يُناقَش في الكنيست».
وكان مكتب نتنياهو قد حاول التخفيف من التقارير التي تتحدث عن قرب التوصل إلى صفقة بالقول «إن جزءاً من التقارير لا يستند إلى وثائق، وجزءاً منها أيضاً مشوه عن عمد».
وفيما تتنامى الضغوط على الحكومة الإسرائيلية لإبداء مرونة في اتفاق التبادل، تتصاعد في الوقت نفسه معارضة اليمين الإسرائيلي للصفقة. تناقض دفع عدداً من المراقبين في إسرائيل للقول إنه يمكن الافتراض أن نتنياهو يوشك على اتخاذ أكثر القرارات دراماتيكية له بوصفه رئيساً للوزراء، الذي سيحدد «متى تستسلم دولة للارهاب»، بحسب تعبير المعلق السياسي لصحيفة «يديعوت أحرونوت»، شمعون شيفر.
وفي حال موافقة نتنياهو على الصفقة، ستبرز معضلة كيفية تصديق حكومته على القرار، في ضوء أصوات الاعتراض التي بدأت تظهر. ولتجاوز هذه المعضلة، يجري التداول بعدد من المخارج، أبرزها تأليف لجنة وزارية يمكن أعضاءها بلورة تأييد للصفقة أو بديل بلورة مشروع قرار تخول فيه الحكومة نتنياهو أن يقرر بنفسه. وبغية تسهيل إمرار القرار، في حال اتخاذه، يتوقع مراقبون أن يضم نتنياهو إلى القرار استنتاجات اللجنة برئاسة القاضي مئير شمغار التي تقضي بأنه في المستقبل لن تطلق إسرائيل سراح عدد كبير من المعتقلين في مقابل جندي واحد، وتعلن أنها ستطلق سراح معتقل واحد في مقابل كل جندي، وعدم مبادلة معتقلين أحياء بجنود أموات.
كذلك يتوقع بروز عدد من التداعيات السلبية، بالنسبة إلى إسرائيل والسلطة الفلسطينية فور تنفيذ صفقة تبادل الأسرى وإطلاق سراح شاليط. وبحسب مراقبين إسرائيليين، إن أحد التداعيات السلبية التي ستواجهها الدولة العبرية، يتمثل بتزايد الضغط الدولي على نتنياهو لوقف الحصار على قطاع غزة بدعوى أنه لم يعد هناك جندي أسير في غزة. ولن يأخذ أحد على محمل الجد ادعاءات نتنياهو بأنه لا يجب الحديث مع «حماس».
ووفقاً لشيفر، فإن «إطلاق سراح مئات المقاومين الفلسطينيين سيثبت حكم حماس في القطاع ويجبر في نهاية المطاف حكومة نتنياهو على التسليم بالطبخة التي أعدتها».
وفي موازاة تعزيز سلطة «حماس»، يشير المحللون الإسرائيليون إلى تداعيات سلبية للصفقة على السلطة الفلسطينية برئاسة محمود عباس. وفي السياق، يرى المراسل العسكري لصحيفة «يديعوت أحرونوت»، أليكس فيشمان، أن «بتنفيذ الصفقة، وفق ما يُنشر في وسائل الإعلام، تحكم حكومة إسرائيل بالإعدام على حكومة أبو مازن، الأمر الذي يمكنه أن يؤدي إلى فوضى في الضفة الغربية، وإلى نشوء التيارات المتطرفة في فتح التي تعتقد على أي حال بأن لا معنى للحديث مع إسرائيل وبأن العنف مجد».

Syrian Opposition Figure “Disappeared" Following Detention by Lebanon’s Military Intelligence

(Beirut, November 23, 2009) – Lebanese authorities should investigate the circumstances surrounding the detention and disappearance of Nawar `Abboud, Human Rights Watch and the Lebanese Center for Human Rights (CLDH) said today. A UN panel declared on November 10, 2009, that Lebanese authorities had arbitrarily detained him a year ago and then failed to provide convincing answers concerning his disappearance.

`Abboud, a Syrian who lived in Lebanon, is a member of the United National Alliance, a political group affiliated with Ref`at al-Asad, a Syrian opposition figure and uncle of the Syrian president, Bashar al-Asad. The Lebanese government acknowledges that Lebanese military intelligence detained `Abboud on December 24, 2008, but maintains that they freed him 24 hours later. `Abboud has not been seen since he was taken into custody. His family and lawyer fear that he may have been forcibly transferred to Syria.

“The UN has reminded Lebanon of its obligation to protect individuals detained by its security services,” said Marie Daunay, president of the Lebanese Center for Human Rights. “The only way to do that is to open a real and transparent investigation into the events surrounding `Abboud’s detention.”

On November 10, the UN Working Group on Arbitrary Detention (WGAD), the body mandated to investigate complaints of arbitrary deprivation of liberty, declared `Abboud’s detention by Lebanese military intelligence to have been arbitrary, and thus unlawful. The Working Group said the Lebanese government’s answer to its queries on `Abboud’s whereabouts had been “brief and imprecise” and urged the government to “show with precision the proof that he was liberated.”

On December 24, 2008, plain-clothes members of the Lebanese Military Intelligence came to Abboud’s office in Tripoli and took him, along with two Lebanese employees, to al-Qubbeh military base for interrogation. Lebanese Military Intelligence released the two Lebanese – one on December 24 and the other on December 26. They also said later that they had released Mr. `Abboud at 2:20 p.m. on December 25 and that they returned possessions of his that Military Intelligence had seized, including his two cars.

However, `Abboud’s family and colleagues have not seen him or located his cars despite extensive efforts to find him. According to a letter dated January 14, 2009 from General Security (the security agency responsible for foreigners and border crossings in Lebanon) to the Mount Lebanon public prosecutor’s office, there is no record of `Abboud leaving Lebanon through an official border crossing.

“Lebanon celebrated its independence yesterday, but it hasn’t been able to turn the page on the painful legacy of enforced disappearance,” said Nadim Houry, senior researcher at Human Rights Watch. “If people are going to regain faith that the government will protect them, security services need to operate in a transparent and accountable way.”

On March 5, Human Rights Watch sent a letter to the ministers of defense, interior and justice to request details about `Abboud’s whereabouts. No reply has been received.

BEIRUT: A body believed to be that of journalist Alec Collett, killed at the height of Lebanon’s 1975-90 Civil War was transferred to London on Thursday to conduct DNA tests. British experts working in eastern Lebanon have recovered a body believed to be that of Collett on Tuesday. The nine-member British team, comprising military and intelligence specialists, had found two bodies while searching in eastern Bekaa for the remains of the 64-year-old reporter but had reburied one deeming it too young to be Collett, a source had told AFP said.
The British diplomatic mission in Beirut confirmed to AFP that the search was under way but would not confirm that the team had found two bodies or that one was under DNA testing.

The search was conducted amid tight security at a site outside the town of Aita al-Fakhar, the security source said.

The site was a stronghold for armed Palestinian groups at the start of the war.

Collett went missing in 1985 and was reported to have been killed a year later.

He was on assignment in refugee camps for UNRWA when taken hostage near the Beirut airport.

The Abu Nidal Organization (ANO), an offshoot of the Palestinian Fatah Movement, claimed responsibility for the abduction and killing, said to be in response to US air raids on Libya, a funder of the ANO. – The Daily Star, with AFP

"وحقوق الإنسان" تطلب التحقيق

قضية التعرف الى رفات العريف الشهيد جوني ناصيف لم تنته فصولاً، فالتقرير الذي بثه برنامج "كلام الناس" عن الموضوع أعاد إلقاء الضوء على أمور كثيرة، وخصوصا الكلام الذي ورد على لسان مسعفي الصليب الاحمر عن عدد الجثث التي دفنت في الملعب – المقبرة في وزارة الدفاع. وعلى خلفية هذا الملف، طلبت "مؤسسة حقوق الانسان والحق الانساني" و"المؤسسة اللبنانية للديموقراطية وحقوق الانسان" من النيابة العامة التمييزية اعتبار ما ورد في حلقة برنامج "كلام الناس" على شاشة "المؤسسة اللبنانية للارسال" في حلقته الاخيرة في شأن قضية الشهيد ناصيف بمثابة اخبار يقتضي التحقيق فيه.
وأعلنت المؤسستان في بيان مشترك "ان ما شاهده اللبنانيون على التلفاز من شهادات لوالدة جوني، فيوليت ناصيف، والمعروفة بأنها كانت من الناشطات من اجل تحرير ابنها من السجون السورية، والتي كانت تملك تصريحاً من وزارة الداخلية السورية لزيارته، اضافة الى اعلانها مرات انها شاهدته في سوريا، وبيانات وزارة الدفاع اللبنانية المتكررة التي لم تعتبر جوني ناصيف شهيدا في معارك 13 تشرين الأول 1990، مضافة اليها شهادة مسعفي الصليب الاحمر الذين اكدوا أول من أمس انهم وضعوا 13 جثة لشهداء الجيش في حفرة في ملعب وزارة الدفاع وتساؤلهم عن مصدر الجثث الباقية، كلها تطرح اكثر من علامة استفهام امام الرأي العام واهالي الشهداء واسر المعتقلين في السجون السورية، وتستدعي فتح تحقيق جدي في هذه الادعاءات برمتها لتبيان حقيقة ما جرى".
كذلك طلبت المؤسستان من النيابة العامة التمييزية "تعيين فريق من الخبراء الجنائيين والاطباء الشرعيين وتكليف المختبرات الجنائية التحقيق في ملابسات الوفاة وتاريخها والتدقيق في افادة والدته وتصريح الزيارة الذي كانت تحمله وازالة كل التباس في شأنها، وخصوصا قضية الملفات والفيلم الذي تحدث عنه الصليب الاحمر، لمعرفة ما اذا كان عسكريو الجيش سقطوا اثناء المعارك ام تمت تصفيتهم لاحقا بما يتناقض مع اعلان جنيف الذي ينص على آلية التعامل مع الاسرى في حالة الحرب، اضافة الى ملابسات مقتل المعتقل اللبناني عارم عاد ساطي الذي نقلت جثته من سوريا الى لبنان قبل اسبوعين ودفنت في ظروف غامضة ولم يتم التحقيق في اسباب الوفاة". وخلصت المؤسستان الى "ان طمس الموضوع ومحاولة تجاوزه من دون اجراء تحقيق جدي لا يمثل عاملا ايجابيا في مسار الحياة العدلية في لبنان".

صفقة شاليت تقترب من نهاياتها بعد تراجع الخلاف على الأسماء والعدد

كشفت مصادر متطابقة لـ «الحياة» ان المفاوضات غير المباشرة بين اسرائيل وحركة «حماس» في شأن صفقة تبادل الاسرى لاطلاق الجندي الاسرائيلي الاسير غلعاد شاليت، تقترب من نهاياتها. وقالت ان الخلافات بين الجانبين تقلصت الى حد كبير، مشيرة الى موافقة اسرائيل مبدئياً على طلب «حماس» اطلاق 450 اسيراً من ذوي الاحكام العالية المتهمين في غالبيتهم بقتل او جرح اسرائيليين في الدفعة الاولى، لكنها قالت ان الخلاف ما زال قائماً في شأن المواصفات.

واوضحت المصادر ان اسرائيل ترفض حتى الآن ان تشمل الصفقة حَمَلة الهوية الزرقاء من فلسطينيي الداخل (العرب في اسرائيل) والمقدسيين، لكنها قبلت اطلاق جميع الاسرى الآخرين، مع ابعاد عدد منهم الى الخارج. وأشارت الى ان «حماس» وافقت على إبعاد عدد من الذين كانت اسرائيل ترفض اطلاقهم، كحل وسط لاتمام الصفقة.

وقال مصدر كبير في «حماس» ان الحركة ترى في اطلاق عدد من الاسرى الى الخارج حماية لهم من الاغتيال، موضحاً: «من الافضل لأسرى مثل ابراهيم حامد او عبدالله البرغوثي وغيرهم ممن تتهمهم اسرائيل بالوقوف وراء عمليات قُتل وجرح فيها مئات الاسرائيليين، ان يكونوا بعيدا عن ايدي الاسرائيليين». واشار الى ان امر اطلاق الاسرى الى الخارج تُرك الى الاسرى انفسهم ليقرروه وليس الى «حماس».

ويلعب عدد من أسرى «حماس» دوراً مهماً في مفاوضات التبادل الجارية عبر اعداد قوائم الاسرى ومواصفاتهم وصوغ المواقف الداخلية من كل ما يتصل بالصفقة. وتقول «حماس» ان الاولية اعطيت للاسرى القدامى والمرضى ولقادة الحركة الفصائل مثل مروان البرغوثي واحمد سعدات وغيرهم.

وكانت اسرائيل رفضت اطلاق 120 اسيرا ممن تسميهم بـ «الملطخة ايديهم بدماء اسرائيليين»، اي الذين نفذوا او خططوا عمليات عسكرية قُتل فيها عدد كبير من الاسرائيليين، ثم خفضت هذا العدد الى ثلاثين ثم الى اربعة، لكنها وافقت أخيرا على اطلاقهم جميعاً، لكن الى خارج الاراضي الفلسطينية.

وتقول هذه المصادر ان الوسيط الالماني يجري في هذه المرحلة مفاوضات مع الجانب الاسرائيلي في شأن القضايا المتبقية لاتمام الصفقة.

ويقول مسؤولون في «حماس» ان الصفقة جارية، وان الوسيط الالماني يتغلب على العقبات. وقال القيادي البارز في «حماس»، المسؤول عن الجانب الاعلامي في ملف مفاوضات تبادل الاسرى اسامة المزيني ان «المفاوضات جارية بوساطة المانية، وتتغلب على العقبات التي تواجهها». واضاف ان حركته قررت عدم كشف اي تفاصيل عن عملية تبادل الاسرى «حتى لا تؤثر سلباً على عملية التفاوض». وتابع: «تأخر انجاز هذه القضية ثلاث سنوات بسبب الاعلام، وحرصاً منا على نجاح هذا الامر ليرى اسرانا النور نفضل السكوت».

وكانت مصر تتولى الوساطة بين «حماس» واسرائيل، لكن عدم توصلها الى اتفاق شجّع المانيا على عرض المشاركة في الوساطة. وتقول مصادر مطلعة ان الوسيط الالماني صاحب الخبرة في اتمام صفقات تبادل الاسرى بين اسرائيل و«حزب الله»، استخدم تكتيكاً جديداً في المفاوضات يقوم على ابعاد كل الملفات ذات الصلة مثل المعابر والحصار، والتركيز على عملية تبادل اسرى بحتة.

وتقول مصادر اسرائيلية ان رئيس الورزاء بنيامين نتانياهو الذي يحظى بشعبية واسعة في الشارع الاسرائيلي يسعى الى تحقيق انجاز لافت في هذه المرحلة، وان اعادة شاليت الى بيته سيحسب انجازا كبيرا له. وترى هذه المصادر ان ابعاد عدد من الاسرى المتهمين بالوقوف وراء عمليات قُتل فيها عدد كبير من الاسرائيليين، سيقلل من شأن اعتراض بعض اوساط اليمين في اسرائيل على الصفقة.

وفي الرياض، صرح مصدر مسؤول بوزارة الخارجية السعودية أمس بأن المملكة «تابعت باستهجان واستنكار شديدين قرار سلطات الاحتلال الإسرائيلية بناء 900 وحدة استيطانية جديدة في القدس المحتلة».

وقال: «ترى المملكة أن هذا القرار يشكل تحدياً فاضحاً وصارخاً للمجتمع الدولي، الذي أقر بعدم شرعية أو قانونية بناء المستوطنات في الأراضي الفلسطينية المحتلة. كما أنه يشكل صفعة للجهود الدولية الرامية إلى إحياء عملية السلام في المنطقة».

وزاد المصدر أن المملكة تدعو المجتمع الدولي، خصوصاً الولايات المتحدة، إلى التصدي لهذه الممارسات الإسرائيلية غير المسؤولة التي تشكل عقبة كؤوداً أمام الجهود الدولية لإحياء عملية السلام، وتحقيق أهداف إقامة الدولة الفلسطينية المستقلة والمتصلة والقابلة للحياة».

اعلنت اجهزة الامن المصرية ومصدر طبي ان سائحين اسبانيين اختفيا في البحر أمس قبالة منتجع شرم الشيخ المصري على البحر الاحمر بعد غرق السفينة التي كانا على متنها.


وتمكنت اجهزة الاغاثة من انقاذ 14 سائحا اسبانيا اخرين بالاضافة الى اعضاء طاقم السفينة السبعة وهم مصريون. وكانت سفينتهم (كورال برنسس) تبحر الى منطقة رأس محمد التي تبعد حوالى الساعتين بالسفينة من شرم الشيخ عندما جنحت. وكان البحر هائجا عند حصول الحادث مع امواج بارتفاع اربعة امتار. ولا تزال عمليات البحث جارية عن السائحين الاسبانيين.

حلّ قضية المفقود البريطاني وإعادة دفن جثّة المجهول

أنهى الفريق البريطاني، الأمني والعلمي، بنجاح مهمة بحثه عن جثة الصحافي اليك كوليت، بعد عمل مضن وشاق استمر عدة أيام في موقع عسكري سابق لحركة فتح ـــــ المجلس الثوري، في جرود عيتا الفخار الشرقية، حيث غادر الفريق بمواكبة أمنية لبنانية المنطقة، مصطحباً جثة كوليت في سيارة مخصصة لنقل الموتى أحضرتها السفارة البريطانية من بيروت. وقال مصدر أمني لبناني لـ«الأخبار» إن الفريق البريطاني «غادر منطقة عيتا الفخار رسمياً بعد أن تمت كل الإجراءات القانونية والتوقيع البريطاني واللبناني على محضر العثور على جثة كوليت في موقع حركة فتح ـــــ المجلس الثوري». وأضاف أن الفريق «عمل باحتراف خلال بحثه عن الجثة، مستعيناً بمعدات وتقنيات متطورة، إضافة إلى قيامه بأعمال يدوية من حفر وردم وما شابه». وتابع المصدر الأمني المواكب لعملية البحث عن كوليت أن الفريق البريطاني «كان يملك معلومات أمنية جداً ساعدته في العثور السريع على جثة الصحافي كوليت، وهي معلومات لم نطّلع عليها أو نعرف مصدرها، لكنّها كانت كافية بالنسبة إليهم للعثور على الجثة»، موضحاً أن الفريق البريطاني «حفر في 12 نقطة كان يعتقد أن جثة كوليت مدفونة في إحداها، وقد نجح في الوصول إليها بعد عثوره على جثة أخرى أعيد دفنها بعدما تبيّن أنها تعود لمقاتل دفن بثيابه العسكرية». وتابع هذا المصدر أن أعمال البحث البريطاني «كشفت بعض الثياب والأغطية وأموراً أخرى من أكياس ونفايات، ولكن لم نعثر إلا على جثتين، مع اعتقادنا بوجود جثث أخرى لا يمكن تحديد عددها أو مكان دفنها في الموقع ومحيطه إلا بعد إجراء بحث يحتاج إلى قرار قضائي وحتى سياسي»، لافتة إلى أن الفريق وضع «عشرات العلامات الحمراء التي كانت تؤشر إلى وجود أعمال بشرية غيّرت معالم سطوح أمكنة العلامات الحمراء». وأشار المصدر إلى أن الفريق البريطاني استطلع المنطقة في أواسط شهر تشرين الأول الماضي، قبل أن يعود الأسبوع المنصرم ويباشر عمله الميداني في البحث عن جثة كوليت التي أعطت نتائج الحمض النووي تأكيدات أنها تعود إليه، و«الفريق البريطاني الذي يرافقه أعضاء عاملون مع الأمم المتحدة ينتظرون إشارة القضاء اللبناني المختص ليتسنّى لهم مغادرة الأراضي اللبنانية مع جثة كوليت الكاملة إلى بريطانيا، بعد أن نقلت اليوم (أمس) إلى مركز لدفن الموتى في الأشرفية برفقة الجيش عوض نقلها إلى الجامعة الأميركية كما كان مقرراً ليعود إلى مثواه الأخير».
وكشفت معلومات خاصة بـ«الأخبار» أن كوليت الذي أعدمه شنقاً عناصر فتح ـــــ المجلس الثوري في عام 1986، بعد اختطافه سنة 1985 قرب مطار بيروت، «أطلقت على رأسه رصاصة من مسدس حربي عيار 9 ملم من الأيسر إلى الأيمن بعد شنقه، إضافة إلى تعرّضه للضرب المبرح، ما سبّب له كسوراً في الأضلع، فيما كانت إصبعه الوسطى في اليد اليسرى مبتورة، وهذا الأمر حاصل معه قبل اختطافه في بيروت». وكشف مصدر قضائي لبناني لـ«الأخبار» أن تقريراً مفصّلاً «أصبح في عهدة القضاء الذي سيستكمل الملف خلال الساعات المقبلة، قبل السماح للبعثة البريطانية بمغادرة لبنان مع جثة اليك كوليت». وأضاف أن النيابة العامة الاستئنافية في البقاع «لديها كل المعطيات والتقارير الأمنية والعلمية التي ستنجز يوم غد (اليوم)، تمهيداً لإقفال الملف قانوناً»، رافضاً الإفصاح عن ماهية الإجراءات القضائية والقانونية والأمنية المقبلة التي تمهّد لإجراء مسح شامل لموقع فتح ـــــ المجلس الثوري والتأكد من عدم وجود جثث أو مدافن أخرى تضم رفات أشخاص مجهولين في الموقع وأطرافه. وأشار هذا المصدر القضائي إلى أن «تقريراً وضع بشأن الجثة الثانية التي عثر عليها قرب جثة كوليت، ولكن فُضّل دفنها في مكانها ريثما تنجز كل الإجراءات التي ستحدد هوية صاحب هذه الجثة».

DNA test results showed that the body that was recently recovered by a British team in eastern Lebanon was that of U.K. journalist Alec Collett, As-Safir newspaper said Friday.
It said the team left Aita al-Fukhar on Thursday after having concluded their mission to find remains of Collett.
Collett was kidnapped in Lebanon in 1985 during the peak of the civil war and was reported to have been killed a year later.
Sixty-four years old at the time, he was on assignment in refugee camps for the United Nations Relief and Works Agency (UNRWA) near Beirut airport when taken hostage.

SANAA: A Japanese engineer kidnapped near Sanaa is still being held by Yemeni tribesmen, a mediator said on Wednesday, while Japan’s prime minister expressed hope the 63-year-old’s release was “close.Sheikh Abdel-Jalil, a tribal leader in Arhab, northeast of Sanaa where the engineer was kidnapped on Sunday, announced late Tuesday that the engineer – identified in Japanese media as Takeo Mashimo, 63 – was free.

But on Tuesday he backtracked, saying the announcement had been a “mistake.”

“The abductors had said they would free the hostage and had left to get him but when they came back they said they had changed their minds,” said Abdel-Jalil.

According to him, the abductors had agreed to release the hostage in exchange for the release of their relative – who is being detained by police – within 15 days.

“But at the last minute, they came back saying they want him liberated in three days,” Abdel-Jalil said.

The kidnappers were distrustful because a previous promise by President Ali Abdullah Saleh to release a detainee was not fulfilled, according to sources close to the kidnappers.

Japan’s Prime Minister Yukio Hatoyama, meanwhile, said in Tokyo Wednesday that he was hopeful the hostage would be released soon.

“We are in a situation where he is not yet completely free,” Hatoyama said.

However, he added: “I am growing more hopeful that the release is close.”

بغداد - أ ف ب - أعلنت اللجنة الدولية للصليب الأحمر أن اجتماعا رفيعاً يضم ممثلين عن العراق والكويت سيعقد اليوم في الكويت لكشف مصير الأشخاص الذين فقدوا خلال حرب الخليج الثانية (1990-1991). وأكدت اللجنة أن الاجتماع الذي يعقد بمشاركة دول التحالف (الولايات المتحدة وبريطانيا وفرنسا والسعودية) هو الدورة الثانية والثلاثين لاجتماعات اللجنة الثلاثية.

ونقل بيان عن مندوبة اللجنة الدولية جميلة حمامي «لا تزال مئات العائلات تعيش في حيرة مؤلمة منذ اكثر من 18 سنة ولديها الحق في معرفة ما حدث لأقاربها المفقودين. لكن وحدها السلطات تستطيع الإجابة عن هذه التساؤلات». وكانت اللجنة الثلاثية واللجنة الفنية الفرعية المنبثقة منها قد انشئت في عامي 1991 و1994 على التوالي، بهدف الكشف عن مصير الاشخاص المفقودين لأسباب تتعلق بحرب الخليج (1990-1991).

وساعدت هذه الآلية حتى الآن، في كشف مصير اكثر من 300 مفقود بينهم 215 كويتياً، و82 عراقياً، و12 سعودياً وآخرين من مختلف الجنسيات.

وأضاف البيان «تم حديثاً في الكويت استخراج رفات جنود عراقيين ستتم إعادتها». وتابع أن اللجنة الدولية، من خلال توفير الخبرات التقنية و»دورها كوسيط محايد، ستواصل تقديم الدعم للسلطات لمعرفة مصير أكثر من الف شخص لا يزالون في عداد المفقودين». وهؤلاء هم من الكويتيين والعراقيين والبدون (بلا جنسية) وعرب آخرين.

وتؤكد الكويت انها لا تعرف مصير 605 اشخاص (571 كويتياً و34 أجنبًيا هم 14 سعودياً وخمسة مصريين وخمسة إيرانيين وأربعة سوريين وثلاثة لبنانيين وبحريني وعماني وهندي) نقلوا الى العراق خلال فترة الاحتلال. واعترف النظام العراقي السابق من جهته بأنه أخذ أسرى لكنه اكد فقدان أثرهم بعد الانتفاضة في جنوب العراق التي تلت حرب الخليج.

صفقة شاليط الأسبوع المقبل!

عائلات الأسرى تتوقع العيد مزدوجاً

رفضت إسرائيل، أمس، التعقيب على أنباء نشرتها قناة «الحرة» الأميركية، عن أن صفقة تبادل الأسرى مع حركة «حماس» ستنفذ عشية عيد الأضحى خلال الأسبوع المقبل. وأوضحت القناة أن رئيس الوزراء بنيامين نتنياهو أصدر تعليماته إلى فريق التفاوض والجهات الأمنية بأن تعمل كل ما في وسعها لإعادة جلعاد شاليط سليماً معافى.
في هذا السياق، التقى والدا الجندي شاليط، نوعام وافيفا، وزير الخارجية الفرنسي برنار كوشنير في القدس المحتلة، حيث أكد حصول بعض «التقدم» في مفاوضات تبادل الأسرى مع «حماس». وأوضح بقوله: «نعلم أن هناك بعض التقدم»، لافتاً إلى أن «الوساطة الألمانية إيجابية، ولا نريد القيام بشيء حتى لا نعرقلها». وتعليقاً على لقائه بوالدي شاليط، قال وزير الخارجية الفرنسي: «تبادلنا الآمال التي أعتقد أنها الآن أكثر صلابة من أي وقت مضى». أما نوعام شاليط فقد أشاد بـ«الجهود التي تبذلها فرنسا لإطلاق سراح» ابنه، موضحاً أن «الحوار مع فرنسا مستمر».
وعلى خلفية اللقاء نفسه، أوضح رئيس «هيئة الكفاح من أجل تحرير شاليط»، شمشون ليبمان، أنه «ليس لدى عائلة شاليط والهيئة أي تفاصيل جديدة في موضوع المفاوضات أكثر مما نشر في وسائل الإعلام». لكنه أضاف: «لا يكفي أن نرى، بل نحتاج إلى أن نلمس»، لافتاً إلى أنّ «الوسيط الألماني يعمل يومياً».
ونقلت صحيفة «هآرتس» عن مصدر ناشط وسط عائلات الأسرى من فلسطينيي 48 أنهم تلقوا تلميحات عن حصول تقدم نوعي في المفاوضات. ولفتت الصحيفة إلى أن الناشط «تحفظ وأكد ضرورة أن نكون حذرين بسبب إمكان حصول تغييرات في الدقيقة الأخيرة». وأضاف أن «عائلات الأسرى متفائلة، وشعورها هو أن العيد (في إشارة إلى عيد الأضحى) سيكون مزدوجاً»، معبّراً عن أمله أن «تكون التلميحات تعبّر عن انعطافة قريبة جداً في المفاوضات».
بدوره، وصف مسؤول الملف السياسي في صفقة تبادل الأسرى، القيادي في حركة «حماس» أسامة المزيني، محادثات صفقة التبادل بـ«الجيدة والنشطة». وقال: «إن المحادثات غير المباشرة التي يقودها الوسيط الألماني بمساعدة مصرية لم تصل إلى نهاية الطريق، لكنها تسير سيراً نشيطاً لإتمامها». وأقر المزيني بوجود عوائق وعقبات تحول دون إتمام صفقة تبادل الأسرى، أبرزها رفض دولة الاحتلال الإسرائيلي مطالب حركة «حماس» أن تتضمن الصفقة أسرى من داخل الأراضي المحتلة عام 1948. وشدد على إصرار حركة «حماس» وتمسكها بموقفها وشروطها «بغية إتمام وإنجاز صفقة تبادل أسرى مشرفة».

Un ingénieur japonais, membre d'une mission de coopération nippone et qui avait été enlevé dimanche près de Sanaa, a été libéré hier, grâce à une médiation tribale.
L'ingénieur a été libéré, « il est en route pour la capitale et il sera remis à l'ambassade de son pays par les responsables de la province de Sanaa », a déclaré au correspondant de l'AFP un médiateur tribal qui assure accompagner l'ex-otage. Selon ce médiateur, qui a requis l'anonymat, la libération du Japonais a été obtenue après que des chefs de tribus se furent engagés auprès des ravisseurs à agir en faveur de l'un des leurs, détenu sans jugement depuis deux ans.
Les ravisseurs avaient enlevé l'ingénieur japonais avec l'intention de l'échanger avec ce proche, soupçonné d'appartenance à un mouvement islamiste. La médiation tribale avait été engagée au lendemain de l'enlèvement.
« L'otage japonais se porte très bien et il est traité comme un hôte » par ses ravisseurs, qui l'ont enlevé pour « faire pression sur les autorités », avait précisé hier matin à l'AFP l'un des médiateurs, cheikh Abdel Jalil Sinan. L'ingénieur, dont le nom n'est pas précisé, avait été kidnappé dans la région d'Arhab, à 40 km au nord-est de Sanaa, par des hommes armés.
L'otage fait partie de la mission de coopérants d'un programme japonais d'aide au Yémen. Il avait été enlevé alors qu'il se rendait dans un village de la région d'Arhab pour y superviser la construction d'une école. À Tokyo, le Premier ministre Yukio Hatoyama avait déclaré que son gouvernement déployait tous ses efforts pour obtenir la libération de l'otage. « Nous faisons le maximum pour résoudre ce problème par la négociation, en partenariat avec le gouvernement yéménite. Nous voulons régler cela à n'importe quel prix », avait-il promis devant la presse.
Les tribus au Yémen ont l'habitude de recourir aux enlèvements d'étrangers pour faire pression sur les autorités. Plus de 200 étrangers ont été enlevés ces 15 dernières années, mais la grande majorité d'entre eux ont été libérés sains et saufs.

Les pirates auraient reçu une rançon de quatre millions de dollars.

Le thonier espagnol Alakrana et ses 36 membres d'équipage, capturés début octobre au large des côtes somaliennes, ont été libérés hier. « Je vais vous annoncer une très bonne nouvelle : l'Alakrana navigue librement vers des eaux plus sûres. Tous les membres d'équipage sont sains et saufs », a annoncé le chef du gouvernement espagnol José Luis Zapatero lors d'une conférence de presse à Madrid. M. Zapatero n'a ni confirmé ni démenti le paiement d'une rançon : « Le gouvernement a fait ce qu'il avait à faire dans le cadre de la légalité et en coopérant avec l'armateur » de l'Alakrana, s'est-il borné à déclarer à ce sujet.
Plus tôt, l'un des responsables du groupe de pirates ayant capturé le navire avait affirmé à l'AFP qu'une rançon avait été versée en échange de sa libération. « Quatre millions (de dollars) ont été versés pour la libération du navire espagnol et nous sommes sur le point de le libérer », avait déclaré par téléphone Saïd Abdulle depuis Harardhere, un village côtier où l'Alakrana était au mouillage, à 300 km au nord de Mogadiscio.
Intercepté le 2 octobre à plus de 550 km des côtes somaliennes, le thonier compte 36 membres d'équipage (16 Espagnols, 4 Ghanéens, 8 Indonésiens, 2 Ivoiriens, 2 Malgaches, 3 Sénégalais, 1 Sécheyllois), selon l'armateur du navire, Echebastar Fleet, basé à Bermeo (Pays basque espagnol).
Outre une rançon de quatre millions de dollars, les pirates réclamaient la libération de deux des leurs, détenus en Espagne. Ces derniers, Abdu Willy et Raageggesey Adji Haman, soupçonnés d'avoir participé à l'attaque de l'Alakrana et arrêtés par la marine espagnole deux jours après sa capture, ont été renvoyés lundi devant le tribunal de l'Audience nationale où ils devront répondre de 36 délits. Les autorités espagnoles n'ont pas caché ces derniers jours qu'elles cherchaient une solution juridique permettant l'expulsion rapide des deux pirates présumés vers la Somalie, où ils seraient censés purger leur peine. Interrogé sur leur sort, M. Zapatero a simplement déclaré : « Nous ne devons pas préjuger de la situation parce qu'elle est entre les mains de la justice. »
Leur devenir continue toutefois de faire l'objet d'une vive polémique sur l'opportunité de les avoir transférés en Espagne. Un pirate interrogé par le quotidien espagnol El Mundo a assuré avoir reçu la « garantie » du gouvernement espagnol que les deux hommes seraient rapatriés après leur procès en Espagne.
La capture de l'Alakrana avait relancé la polémique en Espagne sur la sécurité des thoniers senneurs espagnols travaillant dans la zone. Une cinquantaine de gardes privés, équipés de mitraillettes et de fusils à longue portée, ont depuis pris place à bord des thoniers espagnols.
Très actifs ces dernières semaines, les pirates somaliens ont par ailleurs ajouté une nouvelle prise à leur palmarès, en capturant lundi un chimiquier près des Seychelles, avec 28 marins nord-coréens à son bord.

Colloque à Paris sur Moussa Sadr, « imam du dialogue et de l’ouverture »

Un colloque-débat sur le thème « Moussa Sadr, imam du dialogue et de l'ouverture » a été organisé samedi dernier à l'Unesco par un comité de personnalités et d'intellectuels libanais et français, devant une salle comble où l'on remarquait la présence, au premier rang et à la tribune, du professeur Joseph Maïla, représentant le ministre des Affaires étrangères Bernard Kouchner, de l'ambassadeur du Liban, M. Boutros Assaker, de l'ambassadrice Sylvie Fadlallah, représentante du Liban auprès de l'Unesco, qui devait d'ailleurs prononcer l'allocution d'ouverture de cette manifestation.
Mme Fadlallah a évoqué l'action de l'illustre uléma libanais, « figure emblématique d'une grande communauté religieuse, partisan du dialogue et de l'ouverture, messager de paix, de tolérance et de concorde ».
« Je voudrais saisir cette occasion, a poursuivi l'ambassadrice, pour rendre hommage à l'œuvre d'un grand homme dont le message précurseur dès les années 70 reste en totale adéquation avec le message de l'Unesco, celui de l'importance du dialogue des cultures et des religions et de l'ouverture sur l'autre, thème toujours d'actualité et plus que jamais enjeu majeur à l'ère de la mondialisation. »
Après avoir énuméré les principales étapes de l'activité de l'imam Moussa Sadr au Liban dans les domaines communautaire, politique et social, et en particulier le dialogue interconfessionnel qui avait abouti en 1974 à la signature d'un mémorandum commun islamo-chrétien, Mme Fadlallah s'est adressée à Mme Rabab Sadr, également présente à la tribune, en ces termes : « Le message clair, visionnaire, universel et fédérateur de l'imam Moussa Sadr, vous en êtes aujourd'hui, par la fratrie, l'esprit et les fonctions à la tête de la fondation de l'imam, la principale dépositaire, et je voudrais à cette occasion, Madame, saluer votre dynamisme et votre action personnelle au service d'autrui. »
Avant le discours inaugural, M. Mohammad Nasreddine, président du comité d'organisation du colloque, a présenté les participants, à savoir M. Leonardo Alaeddine Clerici, philosophe, président de la Fondation Instituto Di Skriptura, le R.P. Michel Lelong, cofondateur du groupe d'amitié islamo-chrétienne, M. Djelloul Seddiki, vice-président de la Société des habous et des lieux saints de l'islam, M. Mahdi Firouzan, chercheur et directeur de l'Institut Moussa Sadr à Téhéran, M. Salah Stétié, ancien ambassadeur, écrivain et poète, M. Talal al-Sahili, ancien ministre qui représentait à la tribune le président Nabih Berry.
Chaque conférencier devait évoquer un aspect de la personnalité et de l'œuvre de l'imam Sadr, développant les idées de l'imam en matière politique, théologique, et social.
L'ambassadeur Salah Stétié s'est contenté d'évoquer l'imam Sadr tel qu'il l'a connu, dans les années 70, au moment où la communauté chiite manquait d'organisation et de structure et à une période où le feu couvait sous la cendre et où se préparait la crise sociale, le problème de la présence palestinienne et la guerre civile de 75.
M. Stétié a insisté sur le rôle unificateur de l'imam, affirmant qu'il était alors le précurseur et le premier à avoir établi un véritable dialogue islamo-chrétien.
Le colloque s'est poursuivi avec les exposés des différents participants et les interventions du public, dont celle de Mme Ihjeb Khoury, maire adjoint du 16e arrondissement de Paris, qui a rappelé l'action de l'imam en faveur de l'égalité de l'homme et de la femme, et la grande initiative de l'imam au niveau de la création du Mouvement des deshérités. Elle a rappelé par ailleurs les autres initiatives de l'imam qui organisait des prières dans les églises, auxquelles participaient de nombreux musulmans, ainsi que des réunions dont le but était d'établir les véritables fondements du dialogue interreligieux libanais.

November 17, 2009 - The Daily Star - Spain looks to win release of captive fishermen

MADRID: Spain moved Monday to win the release of 36 fishermen held hostage on a Spanish trawler off Somalia by indicting two captured pirates in a fast-track procedure so they can be returned to Somalia as demanded by the hijackers. The hijackers who have been holding the tuna boat Alakrana for six weeks are demanding a ransom and the release of the two colleagues in custody in Madrid as a condition for freeing the vessel and the sailors. They were captured October 2 in open waters of the Indian Ocean.

Judge Santiago Pedraz of the National Court indicted the two on Monday in response to an urgent request Saturday from prosecutors that he decide quickly whether to file charges, so as to speed up the case.

The idea is to resolve the status of the two in custody so the government can either expel them under immigration laws if they are convicted, or possibly have them serve their sentence in Somalia, and thus appease the pirates holding the ship.

Now that formal charges have been filed, a trial could begin in two to three weeks, the newspaper El Pais reported. The court said it could not confirm this.

The two men in custody – identified in the indictment as Cabdeweli Cabdullahi and Raageggesey Hassan Haji – were captured a day after the hijacking by Spanish naval forces as the men left the trawler in a skiff and headed ashore to Somalia.

The charges against them are kidnapping, armed robbery and use of weapons.

The men originally faced preliminary charges of criminal association, as well.

In the end, however, Pedraz has dropped that charge, and this might speed things up. Under Spanish immigration law, a foreigner who is charged with or convicted of a crime that carries a sentence of less than six years can be expelled from Spain. But the crime of criminal association is excluded from that clause.

Prime Minister Jose Luis Rodriguez Zapatero’s government has been fending off fierce criticism that it erred in bringing to Madrid the two Somali pirates caught the day after the hijacking.

Relatives of the sailors still held hostage on the Alakrana have said the government should have known this would delay the crisis by causing the pirates still in control of the ship to demand their release.

BEIRUT: The sister of disappeared Shiite religious leader Imam Mousa Sadr said on Monday an international court will be established to follow-up on his case. Rabab Sadr returned Monday from an international convention held in Paris to discuss the disappearance of her brother. The convention was held at the United Nations Educational Scientific and Cultural Organization (UNESCO) office in Paris and was dubbed “Mousa As-Sadr, the Imam of Dialogue and Tolerance.”

It was organized by the committee of the Lebanese Diaspora in France to honor the imam in collaboration with the Lebanese embassy in UNESCO.

Imam Sadr, an Iranian-Lebanese cleric, disappeared in 1978 with two of his colleagues during a visit to Libya. Libyan leader Moammar Gadhafi was suspected of holding the men hostage but the accusations were never confirmed.

Rabab Sadr, the imam’s sister, met during the gathering with French Foreign Minister Bernard Kouchner, Lebanon’s Ambassador to UNESCO Sylvie Fadlallah and an array of researchers ands academics.

Upon her arrival at Rafik Hariri International Airport, she described the convention as “very successful.” Sadr said Kouchner had expressed his willingness to contact the parties concerned in the case and mentioned that he would visit Leba­non next year. “Kouchner also delegated one of his consultants to stay in contact with the family of the imam,” she said.

Sadr added that the friends of the imam were willing to do anything they could to release him and his two colleagues. “We have started to demand the formation of an international tribunal to look into the case” she said.

As for the role of the new government in following up on the case, Sadr said she had complete faith that the government would not ignore this national cause. “We ask that the government includes the case again in its ministerial statement seeing how it is of great national importance,” she added.

Sadr also confirmed her faith in the judiciary but hoped that it would play a more efficient role in pursuing the case to the end and in chasing the criminals, including “the tyrant Moammar Gadhafi who knows no religion, no morals and no human values.”

Sadr then said that the convention played a positive role in conveying a united stance concerning the case to the international community. “The convention turned into a Lebanese and international protest,” she added. – The Daily Star

TEHRAN: An Iranian general who disappeared in Turkey two years ago amid media claims of defection is being held inside a jail in Israel, several newspapers reported on Monday citing a conservative website. Ali Reza Asgari, a deputy defense minister under the previous government of reformist President Mohammad Khatami, disappeared after checking into a hotel in Turkey in February 2007.

“Two years of investigations by relevant institutions show that Ali Reza Asgari is kept in Zionist regime’s prison,” Alef website said, without naming any sources.

“Asgari was kidnapped by Mossad, German and British intelligence agencies and taken to Israel,” the report said, renewing Iranian accusations that the former general was abducted by Western spies.

Asgari, a retired general who was a Revolutionary Guards commander, went missing while on a private visit to Istanbul amid media claims that he had voluntarily defected. The Israeli government denied any connection to Asgari’s disappearance at the time.

The Washington Post reported in March 2007 that Asgari had left Iran and was voluntarily cooperating with Western intelligence agencies with information on the Lebanese Shiite militia Hizbullah and Iran’s links to the group. – AFP

وقال مسؤول محلي في بلدة ارحاب، على مسافة 40 كيلومتراً شمال شرق صنعاء، طالبا عدم ذكر اسمه ان المهندس الياباني خطف بينما كان متوجها الى قرية تابعة لمنطقته للاشراف على بناء مدرسة.
ولم يكن المسؤول قادراً على تحديد هوية هذا المهندس العضو في بعثة يابانية للتعاون تشرف على تنفيذ برنامج مساعدات ياباني لليمن.

ذكرت صحف إيرانية عدة نقلاً عن موقع إيراني محافظ أمس أن جنرالاً إيرانياً فقد في تركيا منذ سنتين، مسجون في إسرائيل على ما يبدو.
وكان الجنرال علي رضا عسكري نائب وزير الدفاع في الحكومة السابقة التي كان يترأسها الرئيس الإصلاحي السابق محمد خاتمي فُقد في تركيا في شباط (فبراير) 2007.
وقال الموقع المحافظ "الف"، من دون أن يذكر مصدر معلوماته، إن "سنتين من التحقيقات من قبل الهيئات المختصة تدل على أن عسكري معتقل في سجون النظام الإسرائيلي". أضاف أن "عسكري خطف من قبل الموساد والاستخبارات البريطانية والألمانية ونقل الى إسرائيل".
وكان الجنرال المتقاعد في الماضي من قادة "حرس الثورة"، وقد فقد بينما كان يقوم بزيارة خاصة الى تركيا.
وذكرت وسائل إعلام أجنبية حينذاك أنه فر بينما نفت الحكومة الإسرائيلية أي علاقة لها باختفائه.
وذكرت صحيفة واشنطن بوست الأميركية في آذار (مارس) 2007 أن عسكرياً غادر إيران طوعاً ويتعاون مع أجهزة الاستخبارات الغربية خصوصاً بإعطاء معلومات عن العلاقات بين إيران و"حزب الله" اللبناني.
واتهمت زوجته سيما أحمدي الحكومة التركية بتسليمه الى إسرائيل، حسبما أفادت وكالة الأنباء الطالبية الإيرانية "ايسنا" في حينه

الاهمال والمعلومات الخاطئـــة

أكد رئيس لجنة المفقودين والمعتقلين اللبنانيين في السجون السورية <سوليد> غازي عاد

ان والدة الشهيد جوني ناصيف السيدة فيوليت ناصيف تسلمت بعد شهرين من معركة 13 تشرين برقية من قيادة الجيش تؤكد ان ابنها مفقود وليس متوفي، لافتاً الى أن وفداً من الضباط كان يزورها سنوياً في عيد الجيش ويؤكد لها ان الجيش يسعى الى معرفة مصير ابنها وباقي العسكريين الذين ما زال مصيرهم مجهولاً·

واذ أشار الى أنّ عائلة جوني ناصيف عاشت العذاب لمدة تسعة عشر عاماً بحثاً عن مصير ابنها بسبب الاهمال وعدم تزويدها بمعلومات دقيقة، حمّل عاد في مداخلة تلفزيونية، المسؤولية لكل الذين كانوا في تلك الفترة في الحكم والحكومات المتعاقبة الذين كانوا ينفون وجودهم وخصوصاً قيادة الجيش التي كان يجب ان تبلغ أهالي المفقودين عن مصيرهم وكانت تنكر وجود مقبرة جماعية سرية في وزارة الدفاع·

وأشار عاد إلى أنّ والدة جوني، قامت بالعديد من الزيارات الى سوريا وقابلت العديد من المسؤولين السوريين بهدف معرفة مصير ابنها وقد حصلت عام 1991 على بطاقة زيارة الى السجن لترى ولدها وهي تقول انها رأته انما عن بعد لذا لا نعلم ما اذا رأته فعلاً او تعرضت للخداع·

من جهته، اعرب رئيس جمعية المعتقلين اللبنانيين في السجون السورية علي ابو دهن عن اسفه للفاجعة التي المت بالسيدة فيوليت ناصيف لدى معرفتها بمصير ابنها جوني، واكد لـوكالة الانباء <المركزية> انه لم يلتقِ جوني ناصيف في السجون السورية طوال فترة اعتقاله· ودعا ابو دهن الى الفصل بين المخفيين قسرا والمفقودين والمخطوفين البالغ عددهم نحو 17 الفا، والمعتقلين في السجون السورية وأكد وجودهم، قائلاً <لقد عايشناهم وتركناهم احياء لدى خروجنا من السجن>، لافتا الى ان العديد من اللبنانيين توفوا في السجون السورية ودفنوا في جوارها في مقابر جماعية· وعدد ابو دهن اسماء بعض المعتقلين الذين يؤكد وجودهم في السجن مثل علي سعيد الحاج وعلم الدين مهنا حسام فهؤلاء بقوا في السجن في حين اخلي سبيلي·وعن تفسيره لتأكيد السيدة ناصيف انها رأت ابنها في سوريا ثم وجدت جثته في مقبرة وزارة الدفاع، لم يستبعد ابو دهن ان يكون جوني قتل في السجون السورية واودع في مقبرة وزارة الدفاع ولا احد يمكن ان يؤكد العكس·

ودعا ابو دهن الى الكشف عن مصير كل المفقودين واعادتهم الى ذويهم ودفن المتوفين منهم بطريقة تليق بهم، وتاليا طمأنة ذويهم·

عادت الى بيروت رئيسة مؤسسات الصدر السيدة رباب الصدر شرف الدين آتية من باريس حيث شاركت في مؤتمر <موسى الصدر: إمام الحوار والانفتاح>، الذي نظمته لجنة تكريم الإمام الصدر المنبثقة عن الجالية اللبنانية في فرنسا بالتعاون مع سفارة لبنان في مقر منظمة اليونسكو في العاصمة باريس•
وشارك في حضور هذا المؤتمر سفيرة لبنان في اليونسكو سيلفي فضل الله وحشد كبير من الباحثين من مختلف دول العالم•
والتقت الصدر شرف الدين في باريس وزير الخارجية الفرنسية برنارد كوشنير وكان عرض للملف القضائي لقضية الإمام موسى الصدرورفيقيه•
وفي المطار تحدثت الصدر عن نتائج الزيارة، فاعربت عن املها <ان تكون اللقاءات التي اجرتها في العاصمة الفرنسية قد اثمرت وضوحا بالنسبة لمتابعة قضية الامام موسى الصدر وأخويه وصولا الى تحريرهم، اما بالنسبة للقاء بالوزير كوشنير فبإمكاني القول انه أعرب عن تبنيه لهذا الملف من خلال اتصالات سيجريها مع المعنيين لوضع تصور محدد لتفعيل متابعة القضية، وأكد انه سيزور لبنان مطلع العام المقبل، وسيزور مؤسسة الامام الصدر على أمل ان تكون تبلورت لديه صورة واضحة من خلال الاتصالات التي سيجريها على الصعيد الدولي وكلف احد مستشاريه للتواصل مع عائلة الامام الصدر في هذا الموضوع>•
وردا على سؤال حول امكانية تحويل قضية الامام الصدر الى محكمة دولية يتم إنشاؤها بناء على معطيات معينة قالت السيدة الصدر: <ان كل ما يساهم ويساعد في إطلاق سراح الإمام وأخويه في هذه القضية سنقوم به، ولن اخفي سراً إن قلت اننا قد بدأنا فعليا التحضيرات لمثل هذا الاجراء>•

Le corps de l'ancien jeune soldat de l'armée libanaise Johnny Nassif, porté disparu à Yarzé après l'entrée des troupes syriennes dans la zone est du pays le 13 octobre 1990, a été restitué à sa famille et enterré hier dans son village natal de Debl.

Hier matin, l'armée libanaise a restitué à Violette Nassif le corps de son fils Johnny, porté disparu à Yarzé le 13 octobre 1990 après l'entrée des troupes syriennes dans les régions est du pays. Violette, qui avait déclaré à plusieurs reprises avoir vu son fils dans une prison syrienne en 1991, a lutté sans relâche pendant des années dans les rangs de Solide et avec les familles des détenus libanais dans les geôles syriennes afin de défendre la cause des Libanais détenus en Syrie.

La famille de Johnny, qui était soldat dans l'armée en 1990 et qui était alors âgé de moins de 20 ans, s'est rendue hier à Debl pour l'enterrement du garçon dont elle a attendu le retour durant 19 ans.

Le corps de Johnny Nassif avait été retrouvé avec une vingtaine d'autres dans une fosse commune de Yarzé en 2005. À l'époque, la mère de Johnny, Violette, avait refusé de faire le test ADN pour l'identification du cadavre, car elle était certaine d'avoir vu son fils en 1991 dans une prison de Damas alors qu'il était toujours sous interrogatoire. Hier, après avoir reçu le cadavre de son fils, Violette s'en tenait toujours à sa version : elle était, et elle est toujours, sûre d'avoir vu son Johnny en Syrie.

Depuis 2005, deux des 24 cadavres retrouvés dans la fosse commune du ministère de la Défense étaient toujours non identifiés. Il y a deux mois, Violette a décidé d'effectuer les tests ADN. L'un des deux corps s'est avéré être celui de Johnny Nassif.

Initialement treize cadavres à Yarzé...

Interrogé au téléphone par L'Orient-Le Jour, Ghazi Aad, l'un des responsables de Solide, a indiqué qu'il « est très possible que Violette aie vu son fils vivant en Syrie et que le corps de Johnny ait été transféré plus tard à la fosse commune du ministère de la Défense ». Il a appelé à « la mise en place d'un Comité national qui œuvrerait à clore le dossier des détenus libanais dans les geôles syriennes et faire la lumière sur les circonstances et la date de leur décès ».

Ghazi Aad a également souligné qu'un « responsable de la Croix-Rouge l'avait informé il y a une dizaine d'années que le nombre de cadavres enterrés dans la fosse commune du ministère de la Défense s'élevait à treize. Or, en 2005, 24 corps avaient été retrouvés », martèle-t-il.

Les tests ayant été effectués par l'armée libanaise sur les corps des militaires retrouvés à Yarzé servent à identifier les militaires tués. Ils ne donnent ni la date du décès ni la façon avec laquelle les personnes ont péri. Dans ce cadre, Ghazi Aad prône « une expertise médico-légale qui donnerait des réponses à toutes les questions soulevées par les familles des détenus libanais dans les geôles syriennes ».

En 2005, quand les corps des militaires retrouvés dans la fosse commune de Yarzé avaient été identifiés, la famille de Joseph Khalil, militaire disparu également le 13 octobre 1990, était en état de choc. La famille avait entendu plusieurs témoignages d'anciens détenus dans les prisons syriennes racontant qu'ils avaient été les compagnons de cellule de Joseph. Les témoignages étaient précis et donnaient des détails sur Joseph que seule sa famille connaissaient.

En tout état de cause, le rebondissement de ce dossier, avec l'affaire Johnny Nassif, remet une nouvelle fois sur le tapis les zones d'ombre qui ont marqué les circonstances de la disparition et de la liquidation de plusieurs militaires à la suite de l'offensive syrienne du 13 octobre 1990, et l'une des questions qui reste à élucider sur ce plan est le rôle assumé par le commandement de l'armée au début des années 90 pour ce qui a trait à la fosse commune découverte à Yarzé en 2005.

تاسست بتاريخ 15/10/1995 وقدمت بيان الإعلام إلى وزارة الداخلية بتاريخ 23/11/1995






يدين كل من المركز اللبناني لحقوق الإنسان وجمعية الدفاع عن الحقوق والحريات بشدة التعميم التالي الصادر عن وزارة العدل بتاريخ 16 تشرين الثاني 2009 :
"يطلب من جميع القضاة والموظفين في وزارة العدل الامتثال لما يلي :
1 - الامتناع عن الإدلاء بأي تصريح خاص أو عام، وإجراء أية مقابلة مع وسائل الإعلام والإجابة عن الأسئلة وإلقاء الخطب أو نشر مقالات أو كتب دون إذن كتابي مسبق من وزارة العدل.
2 - الإمتناع عن مغادرة الأراضي اللبنانية من دون إذن، على أن تقدم الطلبات للحصول على إذن إلى الجهة الإدارية المختصة قبل 10 أيام من المغادرة. "
وتذكر المنظمات على أن حرية التعبير وحرية التنقل هما من القيم الأساسية التي يضمنها الإعلان العالمي لحقوق الإنسان الذي التزم به لبنان في دستوره، ونص عليها صراحة الدستور اللبناني وحماها العهد الدولي الخاص بالحقوق المدنية والسياسية الذي صادق عليه لبنان .
وتشكل هذه التعليمات في صيغتها الحالية سابقة خطيرة لانتهاك حرية التعبير، الذي تكفلها المادة 13 من الدستور اللبناني والمادة 19 من العهد الدولي الخاص المذكور أعلاه لجميع اللبنانيين وكرسته كافة المعايير الدولية المتعلقة بالسلطة القضائية.
وتذكر الجمعيتان بأن فرض إذن إداري مسبق على القضاة وموظفي وزارة العدل لمغادرة الأراضي اللبنانية يعد انتهاكاً للمادة 12 من العهد الدولي الخاص بالحقوق المدنية والسياسية الذي يضمن حرية التنقل.
ولم يحدد هذا التعميم، و الذي يحظر الإدلاء بـ "أي تصريح " نطاق التقييد. و في أي حال من الأحوال، فإن أي تقييد لا يمكن أن يشمل سوى المعلومات المتعلقة حصريا بموجب التحفظ الملقى على عاتق القضاة وموظفي الوزارة.
إضافة الى ما سبق، إن اشتراط الحصول على إذن مسبق من وزارة العدل يشكل أيضاً خرقا لمبدأ فصل السلطات، ويمهد لمزيد من الانتهاكات لمبدأ استقلالية القضاة في ممارستهم لمهامهم.
بناءً عليه، يطالب المركز اللبناني لحقوق الإنسان وجمعية الدفاع عن الحقوق والحريات وزارة العدل:
1- ضمان حرية التعبير في لبنان لجميع المواطنين دون استثناء، بما فيهم القضاة وموظفي و وزارة العدل، دون المساس بواجب التحفظ التي يتوجب عليهم لمصلحة إحقاق العدل.
2- الانخراط في عملية تحديث التشريعات، بما في ذلك إلغاء التعميم المذكور وإعادة الحق بالتعبير وبالتنقل للقضاة وموظفي الوزارة

LONDON: The crew of a Royal Navy vessel watched as a British couple was abducted by Somali pirates, unable to rescue them without endangering their lives, the British military said Friday.
As armed pirates boarded Paul and Rachel Chandler’s yacht on October 23, the Royal Fleet Auxiliary replenishment tanker Wave Knight was within view, carrying light arms and a crew of 75 merchant seamen and 25 navy sailors in the Indian Ocean, the Defense Ministry said.

But the crew could not intervene without putting the Chandlers at further risk, and could only watch as the pirates forced the couple off their yacht, the Lynn Rival, and onto an open skiff.

The ministry refused to give further information, saying it could not comment on operational details. It said in a statement that the Wave Knight “did very well under the circumstances.” Authorities believe the Chandlers, who are in their 50s, are now being held on land in Somalia. Pirates have demanded $7 million for their release – ransom the British government says it will not pay.

The Chandlers have been sailing around the world since retiring several years ago.

The waters off Somalia are teeming with pirates who have hijacked dozens of ships for multi-million-dollar ransoms in the past two years.

The Wave Knight is part of an international anti-piracy mission off Somalia’s 3,000-kilometer coast. US, NATO and EU ships patrol the pirate-infested area and escort aid shipments and merchant marines vessels through the Gulf of Aden.

France said Friday that its navy had seized three boats off Somalia’s coast and detained 12 suspected pirates. – AP

ودّعت بلدة دبل (قضاء بنت جبيل)، أمس الجندي في الجيش اللبناني، جوني ناصيف، الذي فقد في 13 تشرين الأول 1990، وتبيّن بعدما وافقت والدته قبل نحو شهرين على تقديم عيّنة من الحمض النووي أن إحدى الجثث التي وجدت في المقبرة الجماعية في ملعب وزارة الدفاع في اليرزة عام 2005 تعود إليه، بحسب البلاغ الرسمي الصادر عن قيادة الجيش.
جوني الذي لم يكن قد بلغ السادسة عشرة من عمره حين تطوع في أنصار الجيش ربما يكون مجرد تفصيل، مقارنة مع والدته فيوليت. هذه السيدة التي ربت بناتها وابنها الثاني فعلت كل شيء لتعرف مصير ابنها، فبدأت التحرك بمبادرة شخصية إثر الهجوم السوري على قصر بعبدا في 13 تشرين، وفقدانها الاتصال بابنها، متنقلة من مستشفى إلى آخر ومن مركز حزبي إلى آخر ومن ضابط سوري إلى آخر.
فيوليت لم تصدق أن جوني الذي انقطعت أخباره في 13 تشرين الأول قد قتل أو أعدم، وساعدها في ذلك حصولها بعد أسبوعين من فقدان جوني على برقية رسمية من قيادة الجيش اللبناني تفيد بأن جوني ناصيف ليس في عداد المتوفّين، في تاريخ 13/10/1990.
ومن هناك بدأ مشوار من الآلام والتمسك بحبال الهواء، استمر 19 عاماً. فهي كانت تقول: «أنا كأمّ لا أصدّق شيئاً» و«لن أتوقف عند المتشككين»، راويةً أنها رأت جوني مرتين، مرة عام 1991 في فرع التحقيق في دمشق بعدما توسّط لها بعض النافذين في سوريا من آل الأسد، ومرة عام 1994. وكانت تذكر تفاصيل رحلاتها إلى القرداحة و«بطاقة الزيارة الرسمية». وإذا بردت همتها أو ضعفت عزيمتها قليلاً كان يزورها أحد المعتقلين السابقين في سوريا ليؤكد لها رؤيته لابنها.
وتنقلت فيوليت من منبر إلى آخر، ومن خيمة اعتصام إلى أخرى، لاحقتها الاستخبارات اللبنانية وأوقفتها الاستخبارات السورية 6 ساعات في عنجر، بعدما «تجاوزت الحدود»، ولم تترك ضابطاً سورياً فاعلاً في لبنان إلا زارته، عارضة عليه المال لقاء تعاونه للإفراج عن صغيرها.
فيوليت التي لم تثق أبداً بوعود المسؤولين اللبنانيين شاركت مع غازي عاد في تأسيس «سوليد» لمعرفة مصير المفقودين في السجون السورية. وهي تمسّكت برفضها الخضوع لفحص الـ DNA عام 2005 بعد اكتشاف المقبرة الجماعية في ملعب وزارة الدفاع في اليرزة ليقينها أن جوني لم يستشهد في 13 تشرين ولم يدفن.
لكن، في الفترة الماضية تفاقمت ضغوط المقربين من فيوليت عليها لتجري الفحوص، فقبلت. ولما تبين تطابق في الحمض النووي بين فيوليت وإحدى الجثتين اللتين لم يتم التعرف إلى صاحبيهما بعد، طلبت قيادة الجيش إجراء المزيد من الفحوص قبل أن تبلّغها أمس بالقرار: لم تكن الشهادة في مبادئنا العسكرية إلا طريقاً إلى المجد والخلود، يسلكه الأبطال المؤمنون برسالتهم، والأوفياءُ لقسَمهم، وعلى هذا الطريق مضى الشهيد جوني ملبّياً نداء الواجب.
فيوليت رقصت صباح أمس حاملة صورة جوني أمام نعشه الذي حمله عسكريون عمرهم من عمر مأساتها، وسكتت أمام النعش تستمع إلى تساؤلات الأب يوسف نداف في وداعه. بعد يوم طويل، يقول رئيس جمعية «سوليد»، غازي عاد، إن جوني قد دفع ثمن معركة أكبر منه، لكن فيوليت دفعت ثمن إهمال السلطات اللبنانية ولاإنسانية المسؤولين.


جثث في وزارة الدفاع

في 13 تشرين 1990، كان جوني ناصيف (مواليد 1974) في بلدة عاريا ـــــ ضهر الوحش مع الملازم أول جورج أبو هلون وميلاد العلم. وقد أفاد بعض الشهود أنهم رأوا الجيش السوري يقبض عليهما.
لاحقاً، تبيّن أن جثة ميلاد العلم كانت بين الجثث التي وجدت في وزارة الدفاع اللبنانية، وأمس ثبت أن جثة جوني ناصيف إحدى تلك الجثث أيضاً، علماً بأن ثمة جثة لم يتم التعرف إليها بعد، في وقت ترفض فيه عائلة الملازم أول جورج أبو هلون إجراء فحوص الحمض النووي.

يدين كل من المركز اللبناني لحقوق الإنسان وجمعية الدفاع عن الحقوق والحريات بشدة التعميم التالي الصادر عن وزارة العدل بتاريخ 16 تشرين الثاني 2009 :
"يطلب من جميع القضاة والموظفين في وزارة العدل الامتثال لما يلي :
1 - الامتناع عن الإدلاء بأي تصريح خاص أو عام، وإجراء أية مقابلة مع وسائل الإعلام والإجابة عن الأسئلة وإلقاء الخطب أو نشر مقالات أو كتب دون إذن كتابي مسبق من وزارة العدل.
2 - الإمتناع عن مغادرة الأراضي اللبنانية من دون إذن، على أن تقدم الطلبات للحصول على إذن إلى الجهة الإدارية المختصة قبل 10 أيام من المغادرة. "
وتذكر المنظمات على أن حرية التعبير وحرية التنقل هما من القيم الأساسية التي يضمنها الإعلان العالمي لحقوق الإنسان الذي التزم به لبنان في دستوره، ونص عليها صراحة الدستور اللبناني وحماها العهد الدولي الخاص بالحقوق المدنية والسياسية الذي صادق عليه لبنان .
وتشكل هذه التعليمات في صيغتها الحالية سابقة خطيرة لانتهاك حرية التعبير، الذي تكفلها المادة 13 من الدستور اللبناني والمادة 19 من العهد الدولي الخاص المذكور أعلاه لجميع اللبنانيين وكرسته كافة المعايير الدولية المتعلقة بالسلطة القضائية.
وتذكر الجمعيتان بأن فرض إذن إداري مسبق على القضاة وموظفي وزارة العدل لمغادرة الأراضي اللبنانية يعد انتهاكاً للمادة 12 من العهد الدولي الخاص بالحقوق المدنية والسياسية الذي يضمن حرية التنقل.
ولم يحدد هذا التعميم، و الذي يحظر الإدلاء بـ "أي تصريح " نطاق التقييد. و في أي حال من الأحوال، فإن أي تقييد لا يمكن أن يشمل سوى المعلومات المتعلقة حصريا بموجب التحفظ الملقى على عاتق القضاة وموظفي الوزارة.
إضافة الى ما سبق، إن اشتراط الحصول على إذن مسبق من وزارة العدل يشكل أيضاً خرقا لمبدأ فصل السلطات، ويمهد لمزيد من الانتهاكات لمبدأ استقلالية القضاة في ممارستهم لمهامهم.
بناءً عليه، يطالب المركز اللبناني لحقوق الإنسان وجمعية الدفاع عن الحقوق والحريات وزارة العدل:
1- ضمان حرية التعبير في لبنان لجميع المواطنين دون استثناء، بما فيهم القضاة وموظفي و وزارة العدل، دون المساس بواجب التحفظ التي يتوجب عليهم لمصلحة إحقاق العدل.
2- الانخراط في عملية تحديث التشريعات، بما في ذلك إلغاء التعميم المذكور وإعادة الحق بالتعبير وبالتنقل للقضاة وموظفي الوزارة

اختفاء مواطنة اميركية اثناء توجهها من القدس الى اريحا

اعلنت الشرطة الفلسطينية امس اختفاء مواطنة اميركية منذ اول من امس على الطريق بين القدس واريحا في الضفة الغربية.
وقال المكتب الاعلامي للشرطة في بيان "تم الابلاغ عن اختفاء المواطنة الاميركية تيريز تمبل وتبلغ من العمر خمسة وخمسين عاما"، موضحا ان "اصدقاء لتمبل ابلغوا الشرطة باختفائها منذ امس بعد انقطاع الاتصال بها حيث كانت في الطريق بين القدس واريحا".
ودعت الشرطة المواطنين الفلسطينيين الى الابلاغ عن اي معلومات عنها. وقال البيان انه "تم اتخاذ اجراءات للبحث عن المفقودة".

BEIRUT: A recent decision by Lebanese judicial authorities to make public the results of an investigation into disappeared persons is an encouraging first step toward recognizing the right of families of victims of enforced disappearances during the 1975-90 Civil War, five leading international human-rights groups said Wednesday.

On October 23, the Judge of Summary Procedures of Beirut issued a decision calling on theCabinet’ secretariat to provide the court with the unpublished full report and results of the investigations conducted by the Official Commission of Investigation into the Fate of the Abducted and Disappeared Persons in 2000.

A lawyer for the families of the disappeared said the families will be able to see the report when it is handed to the court.

In a statement, the International Center for Transitional Justice, Human Rights Watch, Amnesty International, the International Federation for Human Rights, and the Euro-Mediterranean’s Federation against Forced Disappearances called on the council’s secretariat to comply with the order by providing copies of the report and its records to the court and then publishing both. So far, the Lebanese authorities have only made public a three-page summary of the commission’s work.

“Thousands of Lebanese have waited for more than a generation to find out what happened to their loved ones during the turmoil in their country. This decision may finally allow the families to identify and seek official protection for mass graves sites,” the groups said. “It paves the way for exhumations that could finally reveal the fate of missing loved ones.”

The preliminary court decision came as part of a lawsuit filed on April 29 by two Lebanese NGOs, the Committee of the Families of the Kidnapped and Disappeared in Lebanon (CFKDL) and Support of Lebanese in Detention and Exile (SOLIDE). The lawsuit aims at locating and protecting the three mass graves mentioned in the summary of the commission’s findings, released in July 2000. The October 23 decision pertains to one of these sites: the St. Demetrius Cemetery in Beirut, also known as Mar Mitr.

“The Cabinet’ secretariat should comply with this court order and show the families that the state of Lebanon is ready to assist them in bringing an end to their long search for information about their missing relatives,” the rights groups said.

The government established the commission for a six-month term in January 2000 to investigate the fate of those who disappeared during the 15-year Civil War.

It received some 2,046 applications from families of victims. Its summary report said “bodies were discarded in different places in Beirut, Mount Lebanon, the North, Bekaa and the South; and some were buried in mass graves.”

It mentioned three burial sites specifically – the St. Demetrius Cemetery in Beirut’s Achrafieh neighborhood, the Martyrs’ Cemetery in Horsh Beirut, and the English Cemetery in Beirut’s Tahwita neighborhood – and reported some bodies were dumped in the Mediterranean.

The report concluded that all those missing for more than four years should be considered dead, and instructed the families to apply to the judicial authorities to register the death of their relatives. No measures have been taken to protect the sites of mass graves.

It is thought 17,000 persons disappeared in Lebanon between 1975 and 1990. Families of the victims have been struggling to find out the fate of relatives since the 1970s, in the absence of any concrete action by the Lebanese authorities.

Lebanon has signed the International Convention for the Protection of All Persons from Enforced Disappearance but has yet to ratify it.

في خطوة من شأنها ان تشكل دفعاً دولياً لملف المفقودين والمعتقلين اللبنانيين في السجون السورية، اعتبرت خمس منظمات حقوق إنسان دولية الحُكم الصادر من السلطات القضائية اللبنانية والذي يطالب الأمانة العامة لمجلس الوزراء بإمداد المحكمة بالتقرير الكامل غير المنشور والنتائج الخاصة بالتحقيقات التي أجرتها لجنة التحقيق الرسمية للاستقصاء عن مصير جميع المخطوفين والمفقودين في عام 2000، بمثابة <خطوة أولى مُشجّعة على الطريق الصحيح نحو الإقرار بحق أهالي ضحايا الاختفاءات القسرية أثناء عهد الحرب من 1975 إلى 1990 في معرفة ما حدث للمفقودين>، وطالبت <الأمانة العامة لمجلس الوزراء بالالتزام بالحُكم وتوفير نسخ من التقرير وسجلات اللجنة إلى المحكمة، ثم نشر الاثنين وحتى الآن لم تُصدِر الحكومة عن عمل اللجنة سوى ملخص في ثلاث صفحات·>

وقالت المنظمات الخمس وهي المركز الدولي للعدالة الانتقالية، هيومن رايتس ووتش، منظمة العفو الدولية، الفدرالية الدولية لحقوق الانسان والفدرالية الأورومتوسطية لمناهضة الاختفاءات القسرية، في بيان أمس: <انتظر آلاف اللبنانيين لعقود من الزمن كي يعرفوا ما حدث لأحبائهم أثناء فترة الحرب في لبنان· وهذا القرار قد يسمح أخيراً لعائلات المختفين بالتعرف إلى مواقع المقابر الجماعية والتماس الحماية الرسمية للمقابر>· وقال محامٍ يمثل أسر المختفين <إن الأسر سيتسنى لها الاطلاع على التقرير لدى تسليمه إلى المحكمة>· وأضافت المنظمات الحقوقية: <على الأمانة العامة لمجلس الوزراء الالتزام بحكم المحكمة وأن تُظهر للأهالي المعنيين أن الدولة اللبنانية مستعدة لمعاونتهم على وضع حد لبحثهم الذي طال أجله التماساً لمعلومات عن أقاربهم المفقودين>·

الحكم: وذكّرت هذه المنظمات أن حكم المحكمة التمهيدي صدر ضمن دعوى رُفعت في 29 نيسان 2009 من منظمتين لبنانيتين غير حكوميتين، هما لجنة أهالي المخطوفين والمفقودين في لبنان، ولجنة دعم المعتقلين والمنفيين اللبنانيين· وتهدف القضية إلى تحديد أماكن ثلاث مقابر جماعية وحمايتها، وكانت المقابر قد ذُكرت في الملخص الذي جاء في ثلاث صفحات الصادر بشأن نتائج عمل اللجنة، وتم نشره في تموز 2000· حُكم 23 تشرين الأول التمهيدي متعلق بأحد هذه المواقع، في مقبرة سانت ديميتريوس في بيروت، المعروفة أيضاً باسم مار متر·

للمرة الاولى في اوروبا ادان القضاء الايطالي امس عناصر سابقين في وكالة الاستخبارات المركزية الاميركية (سي·اي· ايه) والاستخبارات الايطالية في قضية خطف الامام المصري ابو عمر من ايطاليا عام 2003·

لكن القضاء الايطالي اسقط الدعوى عن عناصر اميركيين وايطاليين بينهم الرئيس السابق للسي·اي·ايه في ايطاليا والرئيس السابق للمخابرات الايطالية سواء لانهم محميون ببند <اسرار الدولة> او لديهم حصانة دبلوماسية·

وعلى الاثر اعربت الولايات المتحدة عن <خيبة املها> لهذه الاحكام التي صدرت في اول قضية تتناول عمليات النقل السرية التي قامت بها السي·اي·ايه في اطار <الحرب على الارهاب> عقب احداث 11 ايلول 2001·

وقال يان كيلي المتحدث باسم وزارة الخارجية الاميركية للصحافيين <لقد خاب املنا للاحكام التي صدرت على الاميركيين والايطاليين الذين ادينوا في ميلانو>· وجرت محاكمة 26 اميركيا غيابيا وسبعة ايطاليين في قضية خطف الامام المصري من احد شوارع ميلانو (شمال) في شباط 2003·

والاميركيون الذين ادينوا هم المسؤول السابق عن السي·اي·ايه في ميلانو روبرت سيلدون لادي الذي حكم عليه بالسجن ثماني سنوات و22 عنصرا سابقا حكم عليهم بالسجن خمس سنوات·

كما حكم على عنصرين في الاستخبارات العسكرية الايطالية بالسجن ثلاث سنوات وهما بيو بومبا ولوتشيانو سينو· في المقابل تخلت محكمة ميلانو عن ملاحقة الرئيس السابق للسي·اي·ايه في ايطاليا جيفري كاستللي وعنصرين اخرين في السي·اي·ايه هما بيتني ماديرو ورالف روسوماندو بسبب <حصانتهم الدبلوماسية> كموظفين اميركيين في روما· كما قررت المحكمة اسقاط الدعوى عن الرئيس السابق للمخابرات العسكرية الايطالية نيكولو بولاري ومساعده السابق ماركو مانسيني وثلاثة مسؤولين اخرين في المخابرات· وفي حين بدت السعادة على وجه مانسيني الذي احاط به محاموه طالبين منه عدم الادلاء باي تصريحات وصف الكولونيل لوتشيانو سينو، الذي حكم عليه بالسجن ثلاث سنوات، الحكم ب>الجنوني> وقال <كيف يمكن اخلاء سبيلهم وادانتي انا؟>·

واشاد مساعد المدعي ارماندو سباتارو الذي طالب بالسجن 13 عاما لبولاري والسجن 12 و11 عاما لجميع المتهمين الاخرين بهذا الحكم الذي ينهي قضية <صعبة> بدات في حزيران 2007، معتبرا انه نجح في <كشف حقيقة الوقائع>·

وقد اوضح القاضي اوسكار مادجي ان المسؤولين الايطاليين السابقين الخمسة يحظون بحماية بند <اسرار الدولة> ومن ثم لا يمكن محاكمتهم· وكان محاموهم تذرعوا باستحالة اثبات براءتهم بسبب سرية تفاصيل القضية· ولم يستبعد المدعي استئناف الحكم بالنسبة للمتهمين الايطاليين منتقدا التذرع ببند <اسرار الدولة الذي دافعت عنه حكومتان> هما حكومة وسط اليسار برئاسة رومانو برودي ثم الحكومة اليمنية بزعامة سيلفيو برلسكني· وتأجلت هذه المحاكمة عدة مرات مع تذرع الحكومتين بضرورة عدم الكشف عن بعض العناصر التي يمكن ان تشكل تهديدا للامن القومي· وقد اعربت منظمة هيومن رايتس ووتش عن ارتياحها للحكم رغم افلات اكبر المسؤولين من الادانة وقالت جوان مارينر المسؤولة في المنظمة <لا احد اعتبر بريئا> واضافت ان <الحكومة الايطالية اعتبرت مسؤولة عن التعاون مع السي·اي· ايه ما يعد حكما شجاعا لمحكمة ايطالية>·

L'Association des détenus libanais en Syrie a annoncé hier que les autorités syriennes ont remis lundi soir le corps d'un jeune homme libanais, Amer Aad Safi, à ses parents suite à son décès dans l'une des prisons syriennes. Les causes de la mort restent, jusqu'à l'heure, inconnues, personne n'ayant pu encore déterminer s'il s'agit d'une mort naturelle ou si le jeune homme a succombé sous l'effet de la torture. Des informations ont d'ailleurs laissé entendre qu'il serait mort il y a quinze jours environ.
Hier, des funérailles ont été organisées dans son village natal, à Kamed el-Loz dans la Békaa-Ouest, le père du défunt ayant été notifié de la mort de son fils par les FSI. Des informations recueillies auprès de ses proches indiquent que la famille du détenu se rendait régulièrement à la prison, « branche de la Palestine », pour le voir.
Amer Aad Safi avait été arrêté pour des « raisons politiques » il y a de cela un an et demi alors qu'il était étudiant dans une université syrienne, précise l'information qui a circulé hier soir. Il lui a été demandé de renoncer à ses engagements politiques en contrepartie de sa liberté, ce qu'il a refusé de faire. L'ancien ministre Abdel Rahim Mrad avait tenté d'intervenir en sa faveur à la veille des élections.
Commentant l'annonce du décès, le président de l'Association des détenus libanais en Syrie, Ali Abou Dehn, s'est demandé « si les autorités syriennes ne pouvaient remettre les prisonniers à leurs familles qu'une fois morts ». Il a appelé les Syriens à libérer les détenus libanais emprisonnés dans les geôles syriennes entre les années 1980 et 2000, et les a pressés d'informer leurs proches de l'endroit où ils se trouvent pour qu'ils puissent leur rendre visite au cas où ils seraient encore en vie, ou réclamer leur corps pour les enterrer s'ils sont déjà décédés.
Interrogé par L'Orient-Le Jour, le président de Solide, Ghazi Aad, a dénoncé « le manque de transparence totale qui entoure le dossier des détenus en Syrie. Ni le gouvernement libanais, ni le ministère de l'Intérieur, ni même le comité conjoint libano-syrien ne sont au courant de ce qui se passe avec les détenus », a-t-il commenté.
« Les libérations de certains détenus se font dans le secret le plus total. Il en va de même des décès qui ont lieu dans les geôles syriennes et dont les informations nous parviennent par voie de presse », a-t-il dit.

November 4, 2009 - Press Release - Italy/US: Italian Court Rebukes CIA Rendition Practice (Human Rights Watch)

(Milan) - An Italian court's conviction of 23 agents of the US Central Intelligence Agency (CIA) for kidnapping is an historic repudiation of the CIA's crimes, Human Rights Watch said today. The Milan court also found that two Italian officials illegally collaborated in CIA abuses.

The judge said he could not pronounce any verdict against five of the seven Italians on trial for the 2003 abduction of an Egyptian imam because they were protected by the state secrecy doctrine. Of the 26 Americans who were on trial, all of them in absentia, the court found that three were protected by diplomatic immunity guarantees.

Robert Seldon Lady, alleged to be the CIA station chief in Milan at the time of the kidnapping, received an eight-year sentence, the most serious penalty that the court handed down in the case.

"The Milan court sent a powerful message: the CIA can't just abduct people off the streets. It's illegal, unacceptable, and unjustified," said Joanne Mariner, terrorism and counterterrorism program director at Human Rights Watch. "Both the Italian and US governments should now be on notice that justice authorities will not ignore crimes committed under the guise of fighting terrorism."

In a disappointing development, the court ruled that it could not pronounce a verdict for five Italian defendants, all current or former officials with SISMI, Italy's military intelligence agency, because the evidence in the case against them was protected by state secrecy. The court apparently felt constrained by a March 2009 ruling of Italy's Constitutional Court, which set out an overbroad reading of state secrecy protections.

The court did, however, reject even broader interpretations of state secrecy protections asserted by numerous other defendants, which could have completely prevented the court from examining evidence of CIA/SISMI joint criminal activity. Had the court adopted the defendants' sweeping position, the bulk of the evidence in the case might have been excluded.

"Just as in the United States, government officials in Italy are relying on state secrecy to shield their illegal acts from judicial scrutiny," Mariner said. "This is incompatible with the principle that government officials should be treated equally before the law and held accountable for their crimes."

Human Rights Watch also disagreed with the court's reading of diplomatic immunity protections, arguing that such immunity should not be interpreted to protect officials responsible for grave human rights crimes.

Human Rights Watch emphasized that the vigorous efforts of the Italian criminal justice system to prosecute CIA operatives for abusive rendition operations underscore the relative inactivity of the US Department of Justice. Although the Obama administration has opened a preliminary investigation of CIA interrogation abuses, the review is narrowly focused and does not cover CIA renditions.

The verdicts today also stand in stark contrast to a disappointing decision issued on November 2 by a US federal appellate court in New York, which dismissed the suit brought by Canadian rendition victim Maher Arar. Arar was detained while in transit at John F. Kennedy airport in September 2002, then rendered by the CIA to Jordan and Syria, where he was brutally tortured for nearly a year.

Hassan Mustafa Osama Nasr, better known as Abu Omar, was kidnapped as he was walking down the street in Milan on February 17, 2003. The abduction is believed to have been a joint operation between the CIA and Italian military intelligence.

After being driven by his captors to Aviano Air Base in northeastern Italy, Abu Omar was allegedly put on a plane and flown to Ramstein Air Base in Germany, and from there to Egypt. He claims that he was tortured repeatedly during the nearly four years he was held in Egyptian custody without charge.

"I was brutally tortured," he told Human Rights Watch in a 2007 interview, "and I could hear the screams of others who were tortured, too."

An Italian court issued indictments against those believed responsible for the cleric's abduction in June 2005, but the case moved forward slowly, in part because successive Italian governments viewed the prosecution as a hindrance to Italian-US relations. Notably, both the Berlusconi and Prodi governments refused to seek the extradition of the 26 Americans being prosecuted in the case.

The Italian government also tried to block the case by challenging much of the evidence that implicated the defendants in the case, claiming that its use could endanger national security. In March 2009 , in an important setback for the prosecution, Italy's Constitutional Court barred much of this evidence from being admitted at trial, ruling that it was protected by the state secrets doctrine.

In his final argument before the court, lead prosecutor Armando Spataro made a powerful argument for holding government officials accountable for grave human rights abuses, including those committed in fighting terrorism. Referencing the reasoning of the post-World War II Nuremberg Tribunal, he rejected the claim made by certain CIA defendants that because they were following orders their actions were legitimate.

The Italian defendants included Gen. Nicolò Pollari, the former head of SISMI, Italy's military intelligence service, who was forced to resign over Abu Omar's abduction and rendition, and Pollari's former deputy, Marco Mancini.

The American defendants consisted of 25 alleged CIA operatives - including former Milan CIA station chief Robert Seldon Lady and former Rome CIA station chief Jeffrey Castelli - as well as US Air Force Lt. Col. Joseph Romano, who was stationed at the Aviano military base in northeastern Italy at the time the events occurred.

The seven Italian defendants in the case were tried in person, while the 26 American defendants were tried in absentia. The Italian government provided legal representation for the American defendants, but two of them hired private counsel. Human Rights Watch is concerned that trials in absentia do not afford defendants an adequate opportunity to present a defense as required under the International Covenant on Civil and Political Rights. Should Italian law enforcement authorities ever gain custody over the defendants, Human Rights Watch believes that the men should be granted a retrial.

During the Bush administration, responsibility for the CIA's rendition program lay at the highest levels of government. In the immediate wake of the September 11 attacks, President George W. Bush signed a classified presidential directive giving the CIA expanded authority to arrest, interrogate, detain, and render terrorist suspects arrested abroad. During his two terms in office, the US is believed to have rendered terrorism suspects to the custody of Egypt, Jordan, Morocco, Libya, and Syria, among other countries.

The exact number of people rendered by the CIA to foreign custody since 2001 is unknown. Then CIA Director Michael Hayden claimed in a 2007 speech before the Council on Foreign Relations that fewer than 100 people had been rendered abroad since the September 11 attacks: "mid-range two figures," he said.

"The CIA's rendition program should be on trial in the United States," Mariner said. "But since the US Department of Justice has utterly failed in its responsibility to investigate and prosecute these serious crimes, it was left to Italy to bring this important case to trial."
