SOLIDA has been active since 1996 in the struggle against arbitrary detention, enforced disappearance and the impunity of those perpetrating gross human violations.

Another year and the battle against gender-based violence is still being hard-fought in Lebanon. To mark the 26th global “16 days of activism against gender-based violence” campaign, local and international organizations rallied to bring the issue further to the fore.

“Based on our work ... I would say that 2017 compared to 2007 there is definitely an increase in the public awareness toward issues related to GBV,” Roula Masri, director of programs at local NGO ABAAD, told The Daily Star, pointing to increased media, social and governmental attention paid to the issue.

“Of course it’s not enough,” she added. “But it is definitely a start.”

ABAAD, which works on issues surrounding gender equality, was one of the organizations celebrating the successful results of years of campaigning to repeal of Article 522 of the Penal Code – known as the “rape law” – that allowed a rapist to escape prosecution if they married their victim. Parliament voted to abolish the controversial law in April.

Winning the battle has only spurred on women’s rights groups to keep pushing for reform. During the 16-day campaign, ABAAD launched the LifeForLife campaign in collaboration with the government’s National Commission for Lebanese Women and U.N. Women.

This new campaign takes aim at the whole of Chapter 7 of the Penal Code, which deals with everything pertaining to sexual assault, and calls for a life sentence for perpetrators of incest rape. Masri noted that most of sexual assault cases where the survivor is a minor involve a relative, making it less likely that the crime will be reported. “We wanted to go further and have the whole Chapter [7] reviewed and women really protected from sexual and GBV inside the household not only just ... in the public sphere,” Masri said.

While Masri said that ABAAD’s work shows there is an increase in reporting incidents, “women are still hesitant and don’t believe ... that reporting would guarantee them full justice.” Another aim of the campaign is to raise awareness of the necessity of reporting sexual abuse.

Raising awareness is the aim of this focused period of activism around GBV that has taken place annually since 1991 between Nov. 25, the International Day for the Elimination of Violence Against Women, and International Human Rights Day on Dec. 10.

The Arab Foundation for Freedoms and Equality released a short video in late November about the importance of consent in sex that grabbed attention through its simple, but effective message. In the video, a seemingly well-meaning aunt-type figure cajoles and eventually force feeds a young woman cake. “I won’t take no for an answer,” she insists. “Once you have your first bite, you will start wanting more.”

Leila Awada, a lawyer at KAFA (enough) Violence and Exploitation emphasized to The Daily Star that the 16 days of activism is just another way of highlighting the ongoing work of the organization. “We gathered all issues we have previously worked on and shed more light on them,” she said. This included working with the Internal Security Forces to distribute pamphlets highlighting the ISF’s duties and laws that women should be aware of.

They drew attention as well to a stalled law criminalizing sexual harassment they had worked on with Minister of State for Women’s Affairs Jean Ogasapian and other women’s rights organizations. “It was passed by the Cabinet a year ago,” Awada said, “but the Justice Department is still working on it.”

Ogasapian is pushing ahead with other projects, announcing Monday the launch of a project to estimate the economic cost in Lebanon of violence against women. The project aims to introduce a reform plan regarding the status of women and to establish a scientific foundation aimed to reduce the incidence of gender-based violence in line with international conventions. U.N. Women and United Nations Economic and Social Commission for Western Asia launched a regional project to estimate the cost of violence from Beirut in October.

Several international governments showed their support for the campaign in Lebanon as well.

Since Prime Minister Justin Trudeau took office in Canada, the country has implemented what it calls a feminist foreign policy, that aims to place human and women’s rights at its heart.

As part of this, newly minted Canadian Ambassador Emmanuelle Lamoureux brought the White Ribbon campaign – also started in 1991 by a group of Canadian men to inspire other men and boys to take a stand on violence against women – to Lebanon. Lamoureux discussed this approach to foreign policy at a regional conference held Tuesday and Wednesday at the Lebanese American University on legislations on violence against women in the MENA region. Organized by the Norwegian People’s Aid, the Sweden Development Partner and Diakonia, the conference highlighted legislative successes in Lebanon, Jordan and Tunisia but emphasized the challenges of implementation.

It was aimed at offering an opportunity to celebrate successes and sharing best practices – a valuable exercise in a region that the World Economic Forum said in 2016 “as a whole is the least gender equal in the world.” The ranking is not going unchallenged though, as demonstrated by a number of actions and events, as well as social media support that is taking place during the 16-day global campaign in Lebanon and beyond.

The Beirut Bar Association Thursday unveiled a draft law that if adopted would make civil marriage possible in Lebanon. Lebanon does not have a single personal status code. Laws covering marriage, divorce, child custody and inheritance are administered by more than a dozen religious courts of the subjects’ sects, leaving couples that wish to wed in a civil ceremony just one option – get married abroad and register the marriage with their respective religious authority upon returning to Lebanon.
“Getting married abroad in a civil way, then having the marriage recognized in Lebanon – it’s ridiculous,” lawyer Zeina Obeid told The Daily Star. “At least [with this law] they can avoid traveling to other countries and conclude a civil marriage in Lebanon.”
Obeid led the Beirut Bar Association committee that drafted the law.
“Our law is about optional civil marriage,” Obeid added. “It’s to give the Lebanese people a choice – either you have a civil marriage or a religious marriage. It doesn’t attack religious marriage.”
Lebanon does have a law permitting civil marriage that dates back to 1936. The legislation, however, does not have a regulatory framework, prompting Interior Minister Nouhad Machnouk in 2015 to issue a statement saying that the government will no longer recognize such marriages.
There have been other attempts to get a civil marriage law on the books, all unsuccessful.
The draft law has not yet been presented to Parliament, and there is no guarantee that it will be taken any further. Additionally, religious bodies that oversee civil status laws will want to weigh in on the matter.
But the Bar Association’s proposal has a few things going for it.
It borrows aspects from civil marriage laws of other countries, said Jennifer Farhat, a lawyer on the team that drafted the law.
“One of the main things that we established is equality between females and males by giving parental authority to both,” Farhat said. “Other things that we innovated with is to impose mediation in case of conflict at any point in time. You [would] have to go through mediation before going through divorce.”
And the committee itself reflects Lebanon’s multi-sectarian nature.
“What characterizes this committee is that we are lawyers from different political parties, different backgrounds, different confessions, and we were able to discuss ... and agree on a civil law that is a small scale of the Lebanese community,” Obeid said.
Maronite Bishop Semaan Abou Abdo told The Daily Star that, “The patriarch has said that he supports civil marriage, but we need a civil law that applies for all.”
“The Catholic Church believes marriage is a holy sacrament between man and woman, forever, with no divorce, no conditions. But why should I force [a person] to get married in church? Either he believes or doesn’t.” The Daily Star reached out to Sunni religious leadership at Dar al-Fatwa for comment but did not receive a response before publication.

L'orient le jour - Chiffrer les violences contre les femmes... pour y mettre un point final ?, October 06, 2017

L'idée peut surprendre, même déstabiliser certains : comment estimer le coût d'un drame intime, celui de milliers de femmes subissant la violence d'un compagnon au sein même de la famille ? Et pourtant il y a de quoi faire, parce que le coût économique pour la société est plus que conséquent, d'une part, et parce que l'argument peut s'avérer décisif auprès des autorités qui seraient encore réticentes à agir, d'autre part. Pour exemple, selon une étude effectuée par le bureau Fear and Hoeffler, citée dans le Rapport 2017 de l'ONU sur le statut des femmes arabes, le chiffre mondial estimé des pertes accumulées en raison des violences contre les femmes et les enfants est d'environ 8,1 trillions de dollars par an, soit près de 7,4 % du PIB mondial !
Dans les pays arabes, comme on peut s'y attendre, il n'y a encore aucune estimation à ce propos. Mercredi, depuis Beyrouth, l'Escwa a lancé, en partenariat avec le bureau régional de l'agence ONU Femmes, l'Institut suédois en Alexandrie et l'Institut d'études sur les femmes dans le monde arabe de la LAU, la première phase du projet sur l'estimation des coûts de la violence conjugale dans la région arabe. Une initiative qui devrait pousser plusieurs pays arabes à effectuer de telles études d'estimation des coûts, dans une région où, ainsi que l'ont noté nombre d'interventions au cours du lancement, la violence conjugale contre les femmes est particulièrement commune et étendue.
Mais que signifie d'estimer le coût de cette violence et sur base de quels critères ? Selon le document de l'Escwa, la méthodologie passe en revue les domaines suivants : la justice (coûts de procès...), la santé mentale et physique (infrastructure, personnel...), les services sociaux aux survivantes (lignes vertes, centres d'accueil et centres d'information), l'éducation (services spécialisés pour les enfants traumatisés), le revenu perdu (jours d'absence, travail non rémunéré...), pertes financières pour la famille (dépenses imprévues pour des services incluant l'achat de médicaments, le transport ou encore les thérapies).


Huit trillions de dollars
Selon les concepteurs du projet, une telle estimation de coût est un « outil de réforme » pour un changement en profondeur. Prié par L'Orient-Le Jour de donner plus de détails, Mohammad el-Nassiri, directeur régional d'ONU Femmes dans le monde arabe, estime d'emblée que « mettre fin à la violence contre les femmes est leur droit ». « Mais d'un autre côté, la violence a des conséquences financières, poursuit-il. Les hommes politiques et les législateurs comprennent la langue des chiffres. Ils doivent savoir combien coûte à la société ce statu quo dans la violence contre les femmes, combien cela coûte aux hôpitaux, aux postes de police, aux tribunaux, à combien se chiffrent les jours de travail perdus... Il est estimé que le total de tous ces coûts atteindrait des millions de dollars pour chaque pays. » Il ajoute : « Si nous travaillons à créer un système complet pour protéger les femmes, appliquer la loi et assurer des centres d'accueil à l'intention des survivantes de violence conjugale, cela aura des bénéfices aussi pour les finances de l'État. »
La première étude se fera en Palestine, ainsi que cela a été annoncé. Qu'arrivera-t-il ensuite ? « Nous prendrons en compte les chiffres qui résulteront de cette étude, après sa durée estimée à huit mois, et nous transmettrons ces résultats aux différents responsables afin de les convaincre, par exemple, de créer des centres d'accueil dans chaque région, répond-il. Il faudra aussi procéder à la formation des policiers qui accueillent les victimes, afin qu'ils sachent comment gérer ces cas de manière appropriée. Il faudra également assurer à la survivante de violence des institutions qui peuvent la recueillir, la soigner et traiter son cas en justice. » Il souligne que les différentes agences onusiennes concernées aideront dans ce cas les pays à effectuer ces réformes.
Interrogé sur la possibilité d'une étude générale pour les pays arabes, M. Nassiri estime que des efforts seront prodigués en ce sens. Il fait cependant remarquer que des études significatives dans plusieurs pays arabes, sinon tous, suffiront à dégager des recommandations en vue de réformes dans tous les autres pays, notamment en ce qui concerne la mise en place d'un système complet de protection.
Sur les bénéfices à long terme d'une telle démarche, M. Nassiri, se basant sur le chiffre mondial exorbitant de huit trillions de dollars, affirme qu'« avec une politique de lutte contre la violence, il y aura non seulement une résorption des déficits, mais un retour de prospérité en raison d'une reprise de productivité de nombreuses femmes ».


Le Liban, prochainement
La première étude a donc commencé dans les territoires palestiniens. Au Liban, qui a connu ces dernières années des cas très médiatisés de femmes violentées et parfois assassinées par leurs maris, cela ne saurait tarder non plus. Selon M. Nassiri, l'étude des coûts de la violence au Liban suivra immédiatement celle de Palestine. Il ajoute que « le soutien du gouvernement libanais à un tel projet est total ».
Présent au lancement de l'étude, le ministre d'État aux Droits de la femme, Jean Oghassabian, s'est dit enthousiaste par rapport à ce projet. « Il est très important de faire des statistiques, dit-il à L'OLJ. Même si la question de la violence contre la femme est surtout humanitaire, des chiffres sur le coût de cette violence pourraient être importants à connaître. » Le ministre affirme avoir déjà effectué des contacts avec l'ONU pour entamer une telle étude au Liban, soulignant que son ministère devrait en être le point focal.
Dans l'auditoire, des responsables officiels de plusieurs pays arabes prenaient part à ce lancement.
Rencontré sur place, Yehia ibn Badr al-Maawaly, responsable ministériel à Oman, assure que son pays a fait d'énormes progrès en matière de droits des femmes et de lutte contre la violence. Interrogé sur son opinion concernant l'utilité de l'estimation des coûts de cette violence conjugale, il se dit convaincu « qu'une telle démarche pourrait régler beaucoup de problèmes en montrant la réelle ampleur de cette question et son impact sur la société ». « Les acteurs politiques et économiques seront davantage convaincus de la nécessité d'agir et d'instaurer une réelle coopération », ajoute-t-il.
Les interventions au cours de la cérémonie de lancement ont insisté sur les taux de violence bien trop élevés dans les pays arabes – selon les chiffres avancés dans un documentaire sur la violence visionné sur place, une femme mariée ou divorcée sur trois est victime de violence. Beaucoup ont insisté sur le cercle vicieux des mentalités favorisant de tels comportements, sur la sensibilisation nécessaire afin de briser le silence – le coût économique étant l'un des outils de changement possibles – ainsi que l'impact à long terme sur les générations d'hommes et de femmes qui vivent leur enfance dans de telles conditions.

In an initiative to further women’s rights in the Arab world, the United Nations Economic and Social Commission for Western Asia and partner institutions called on Arab nations to calculate the economic cost of violence against women. “We’re looking at the economic costs [of violence] because it has been shown when money is involved, everyone takes more interest,” Wassim Shahin, professor of economics at the Lebanese American University – one of the partner organizations in the new project – said in a speech at Wednesday evening’s launch at the Sursock Museum in Beirut’s Ashrafieh.
He reiterated that achieving women’s rights in the Arab World remained an ongoing battle, as very few Arab states have laws specifically tackling violence against women.
By calculating the negative effect of violence against women on Arab economies as a whole, Shahin said, a greater number of actors will involve themselves to tackle the issue.
The first phase of the project, called “Estimating the Cost of Violence Against Women,” focused on domestic violence and was presented by representatives of the various partner institutions: ESCWA, LAU, U.N. Women and the Swedish Institute of Alexandria.
“The first phase of the project is analytical,” ESCWA’s Center for Women deputy director Mehrinaz el-Awady, told The Daily Star. “We’ve done two studies to look at the situation of violence against women and the relationship between marital violence and certain elements of the economy,” she said. The result was an economic model that estimates the cost of violence against women.
The economic model estimates the amount of money lost at the individual household, societal and governmental levels. In creating such a model, partner institutions have researched the medical, criminal justice, legal and social costs incurred as a result of this violence within marriages.
While the financial impacts on the nuclear family are noted, the U.N. report equally emphasizes violence’s ripple effect to workplaces and broader communities. Economies are directly impacted by decreased productivity of women affected by spousal abuse, the report found.
Mohamed Ali Alhakim, executive secretary of ESCWA, announced that the model was already undergoing initial tests in Palestine. While it is still in its preliminary phases, he said, “the economic cost on women and families, households and societies could reach millions of dollars yearly.”
Egypt used a model recommended by the U.N. to estimate that in 2015 gender-based violence cost it 2.17 billion Egyptian pounds ($123 million) a year.
Despite the achievements of the project’s initial phase, the report noted that data on violence against women and girls in the region – particularly marital violence – remains “fragmented and unreliable.”
This is in part because the success of the models is dependent upon the participation of individual women. To fill this gap, the U.N. report also lays out an action plan to raise awareness on the issue and create partnerships to collect primary data.
“Change is happening, but we’re still at the beginning,” Mohammad Naciri, U.N. Women’s regional director for Arab States said.
Officials, including Lebanese State Minister for Women’s Affairs Jean Ogasapian and various members of civil society, attended the launch.
According to Awady, each partner organization is working on different aspects of the ongoing project under the leadership of ESCWA.
“This report shows that violence against women is not a private issue that should be handled only within the family. It also shows that it has nothing to do with culture or religion. Violence against women is a social issue, it’s a societal responsibility,” Peter Weiderud, director of the Swedish Institute Alexandria said.

عقد المكتب التنفيذي لـ«الهيئة الوطنية لشؤون المرأة اللبناينة» اجتماعه الدوري برئاسة رئيسة الهيئة كلودين عون روكز. واستكمل المكتب تشكيل اللجان في مختلف الميادين التي تعني المرأة في لبنان، وأقر بمبدأ الاستعانة بمستشارين متطوعين عند الحاجة. وعرض ما آلت إليه المبادرات المتصلة بإلغاء المادة 522 من قانون العقوبات والمواد 505 - 518، مؤكدا قرار الهيئة الوطنية القاضي بتقديم مشروع قانون متكامل يطال كل المواد التي تتصل بحقوق القاصرات وبضرورة حمايتهن. وقد بدأت الهيئة الوطنية بإعداد هذا المشروع بالتشاور مع العديد من المنظمات المدنية والمؤسسات الحكومية ذات الصلة.

وتداول المكتب التنفيذي أيضا آلية التعاون مع وزارة الدولة لشؤون المرأة «بما يخدم قضية المرأة ويحقق إنجازات ملموسة في المجالات الحية التي ما زالت المرأة في لبنان تعاني فيها».

Al Mustaqbal - Activists Repeal of ‘rape law’ only one of needed reforms, August 17, 2017

لأن «الأبيض ما بيغطي الاغتصاب»، كان لا بدّ أن ينتصر مجلس النواب أمس، لنساء لبنان في نضالهن الطويل ضد المادة 522 من قانون العقوبات، والتي تعفي المغتصب من العقوبة في حال زواجه من الضحية، وتنص على: «إذا عقد زواج صحيح بين مرتكب إحدى الجرائم الواردة في هذا الفصل وبين المعتدى عليها أوقفت الملاحقة. وإذا كان صدر الحكم بالقضية عُلق تنفيذ العقاب الذي فرض عليه»، ليصبح التعديل: «ألا يعفى المغتصب من العقوبة حتى في حال تمّ الزواج». أما الجرائم فهي، الاغتصاب والخطف وفض البكارة والتحرش والإكراه على الجماع واستغلال ضعف الضحية وعدم قدرتها على المقاومة.

وإذ انتصر أخيراً أبيض القانون على أسود الواقع الذي يشير الى ثلاث حالات اغتصاب في الأسبوع، بحسب إحصاءات مكتب الآداب في قوى الأمن الداخلي، مع معطيات وفيرة عن ارتفاع مؤشر العنف والتحرش الجنسي، والتغطية على حوالى 40 في المئة من حالات الاغتصاب التي يتم التعاطي معها وفق «يا عين ما شافت شر»، فإن الـ«مبروك» الحقيقية التي تناقلتها مؤسسات المجتمع المدني وحملة «أبعاد» والناشطات أمس ممن سعين لإقرار قانون الإلغاء في تدرجه من الأدراج الى المؤسسات الرسمية ومن ثم الى الاعتراف به بعد 68 عاماً من إقراره، تترجم في عيني كل امرأة ذاقت وجع الانتهاك الجسدي. ومع ذلك ظلت حريصة على أن تكون الصوت الذي أثمر منعاً رسمياً وزوداً وتحصيناً لكل النساء اللواتي هن في الأصل معرضات، ولا سيما أن غالبية نساء لبنان هن من العاملات اللواتي يغادرن منازلهن يومياً، ولا يدرين ماذا تخبئ لهن الزواريب السوداء ولحظات الغفلة والإجرام.

وفي وداع المادة 522، تحضر كثيرات في البال، منهن تلك التي كانت طفلة تلعب في زقاق الحي قبل أن تتبدل حياتها الى صراخ وجحيم ومن ثم تصير مسؤولة عن طفل مثلها، ولد في الظلمة يبحث عن اسم ونسب وهوية أب، إن اعترف به يبقى في الأساس معتدٍ وسارق طفولة وأحلام مبتورة. وتحضر استغاثات اللواتي وضعهن القدر في اختبار شهوات زوج الأم، الأب، الخال، العم، ومن ثمّ جرى التعامل معهن بجرائم شرف مدبرة وكفيلة في أن تنهي «وجع الرأس» برصاصة أو سلاح أبيض وبالكثير من نزف الدماء. وتحضر أيضاً حكايا موجعة كيف أن فتيات في عمر الورد سجنّ في غرفهن، ضربن بالكرباج وأحرقت أصابعهن ببقايا السجائر، وكان على أمهاتهن أن يصمتن ويتواطأن مع أزواجهن المعتدين نصرة لـ«معيل العائلة الوحيد».. وعلى المنوال تكر سبحة الاعتداءات على الرغم من كل حملات التوعية والإعلام والاعتصامات في ظل صعوبة الإفصاح عن العنف الجنسي باعتباره مسألة تجلب العار للأسرة بأسرها.

وإذ أصبح القانون في خلفية المشهد الأليم، بعد طول إلحاح من لجنة «سيداو» التابعة للأمم المتحدة والتي تراقب مدى تقدم لبنان في التقرير الدوري لتطبيق اتفاقية إلغاء كافة أشكال التمييز ضد المرأة، تبقى الطريق طويلة في تعقب آثار الاعتداءات الجنسية، ولا سيما النفسية والاجتماعية منها، مع ما تتركه من تدمير لآدمية المرأة وإنسانيتها وخوفها في ذلك السجن الكبير الذي لن تنجح بعده ببناء علاقات مع المحيط، ويوماً لن تثق برجل، أو تستكين لقرار.

وإذ أقر القانون، ماذا بعد من تحصينات لا بدّ منها، ومن يعيد فتح ملف مقاربة العنف الجنسي برمته لجهة تعديل التشريعات على أساس تأمين العدالة للنساء؟. أسئلة مفتوحة.. ويبقى الأهم أن التغيير بدأ.

وأكّد النائب إيلي كيروز الذي حضر المؤتمر أنّ «هذه المادة لها 70 سنة وطالبت الحركة النسائية في لبنان بإلغائها، لأنها تشرّع الاغتصاب وتُعطي حلاً للمجرم». وأضاف: «نحن باسم القوات اللبنانية تقدّمنا باقتراح قانون في العام 2016 لإلغاء هذه المادة كاملة، وقد تمّ النقاش في هذا الموضوع في لجنة الإدارة والعدل ولم نتوصّل الى تفاهم على إلغائها كاملة، علماً أنه في الجلسة المقبلة للمجلس سنطالب بإلغاء المادة بالكامل».



حويك

وأثنت المحامية دانيال حويك، من منظمة «أبعاد»، على «التعاون مع الإعلاميين، وثمّنت دورهم الحاسم في توعية أغلبية كبيرة من المواطنين بشأن المادة 522، ما شكّل ولا يزال عاملاً أساسياً في التأثير على صانعي القرار لاتخاذ الخطوة النهائية».

وأضافت: «نحن في انتظار تصديق المجلس النيابي اللبناني على إلغاء المادة 522 من قانون العقوبات اللبناني رسمياً. لكنّ نضالنا لا يقتصر على إلغاء هذه المادة، فما بين المطالبة بتعديل قانون العنف الأسري الذي كان قد تعرّض لبعض التغييرات غير العادلة تماماً كما حصل مع المواد 505 و518 من قانون العقوبات، وبين اقتراح قانون رفع سن الحد الأدنى للزواج وغيرها من المطالب، يبقى طريق النضال طويلاً، وسنبقى متمسّكين بموقفنا الرافض لأية مساومات أو مزايدات على حقوق النساء في بلدنا».

The National Commission for Lebanese Women blasted the new vote law on Wednesday, saying it marginalizes women, and called for equal representation in Parliament.
The commission condemned the new electoral law’s absence of a minimum quota for women in Lebanon’s Parliament, and highlighted a Ministerial statement that called for a female quota in the new vote law, in line with the Constitution and international agreements.
The statement acknowledged Prime Minister Saad Hariri’s commitment for a quota of women on all Future Movement ballots, and called on all political parties to adopt a similar position in order to ensure fair representation.
With women representing more than 50 percent of Lebanese voters, the commission called on Lebanese women to fight marginalization, and invited them to play their role as candidates and legislators.
Women's rights activists have long lobbied for a 30-percent quota for female representation to be included in a new electoral law. Currently, four out of 128 MPs are women. Prime Minister Saad Hariri's 30-member government includes one female minister, the Minister of State for Administrative Development Inaya Ezzeddine.

With talk of an electoral law agreement in the making, the issue of a women’s quota is back in the limelight as several lawmakers rallied behind a demand for a set minimum for women’s representation. After several delays, a new proportional vote law reached by the country’s leadership last week is under discussion, and rival factions are reportedly working to sort out last minute details.
But is a quota for seats held by women on the table?
“The issue is being seriously discussed. Of course there is no final agreement on the percentages,” Minister of State for Women’s Affairs Jean Ogasapian told The Daily Star.
Ogasapian said Monday, via Twitter, that it is the duty of the various political factions to commit to a women’s quota, which had been mentioned in the government’s policy statement in December.
“This is a necessary thing that has to exist alongside citizenship and justice. This is a right,” Ogasapian said, underscoring that such a quota should only be required for a transitional period.
Ogasapian said that he is hoping for the best, despite noting that political will on this issue isn’t entirely there.
“Political will is present among some of the factions and not all of the groups, while awaiting agreements.”
Several rights groups and organizations have long lobbied for a quota arguing that a minimum 30 percent of seats should be filled by women in parliamentary elections.
Their request stipulates that this quota should be focused on parliamentary seats and not merely on electoral lists.
In the current sitting Parliament there are four female MPs out of 125 elected officials. Prime Minister Saad Hariri’s 30-member government includes one female minister, Minister of State for Administrative Development Inaya Ezzeddine.
Hariri previously expressed support for women’s representation – a stance that was reflected in the government’s policy statement when he formed his Cabinet in December – and for the introduction of a women’s quota.
Change and Reform bloc MP Ghassan Moukheiber expressed optimism Monday, stressing that political decisions were key factors that might prevent a women’s quota from being adopted.
Moukheiber explained that the subcommittee – part of Parliament’s Administration and Justice Committee – that is studying the draft legislation designed to amend the electoral law has been focusing on the women’s quota issue.
“And they are waiting for an agreement on an electoral law because the quota system differs from one electoral system to another,” Moukheiber told The Daily Star. “I think we need to have the quota system, but the public discussion hasn’t reached an agreement.”
The discussion over implementing a quota, however, includes both supports and opponents.
Some believe that having a quota wouldn’t be good for women.
But a UNDP circular on the matter, released ahead of the May 2016 municipal elections, suggested that quotas shouldn’t be perceived as a negative move, or a means of discriminating against women.
Rather, a quota should be seen as a means of introducing women’s participation into political life and decision-making positions.
The U.N. circular also pointed out that, according to international consensus, quotas should be temporary measures designed to boost and embed women’s participation.
Despite some optimism, Future Movement MP Mohammad Qabbani dismissed the idea that a woman’s quota was being considered as part of the new vote law talks.
“It doesn’t seem so,” Qabbani said. “This doesn’t mean that some electoral lists won’t include women’s quotas, but now it is a new system ... and so it doesn’t seem that there is a quota for women or [members of] the diaspora,” he told The Daily Star.
Foreign Affairs Minister Gebran Bassil had been calling for the Lebanese diaspora to be assigned six MPs to represent them in the parliamentary elections.
Democratic Gathering bloc MP Akram Chehayeb told The Daily Star that recent discussions among politicians have been focusing on the new electoral system and not much on the reform aspects of the law.
“At this stage, all political thinking was concentrated on the shape of the electoral law, how to [agree] on electoral districts and ... how we are going to elect [representatives],” he said. “And I don’t think that anyone was talking about the quota.”
Lebanese Forces Secretary-General Chantal Sarkis also said that current discussions were not focused on women’s quotas. But she did not deny that the issue is on the agenda.
Sarkis said that discussions have been focused on three main things: the electoral districts, preferential vote and ranking of candidates.
“I think once discussion on these points has ended, they will discuss the quota issue,” Sarkis told The Daily Star. “It’s on the agenda.”
She admitted that some are for the quota and others are against.
“In general, there is no agreement,” Sarkis concluded.

L'orient le jour - Les différents aspects de la violence sexuelle exercée contre la femme au Liban, May 31, 2017

Sandy (son nom d'emprunt) avait 5 ans lorsque son oncle paternel a commencé à abuser d'elle sexuellement. « J'étais petite, je ne comprenais rien, confie la jeune femme. Mon père était un important architecte d'intérieur et voyageait beaucoup. Durant son absence, ma mère a entamé une relation avec mon oncle. J'avais 5 ans lorsqu'il m'a touchée la première fois. Il me fouettait, me brûlait avec un briquet. Je criais, mais personne ne m'entendait. »
Lorsque la petite fille allait passer la nuit chez sa cousine paternelle, l'oncle trouvait toujours un moyen de « venir me chercher du lit ». « Il me menaçait en me disant que si je racontais à quiconque ce qui se passait, il allait nous tuer, mes parents et moi », ajoute Sandy.
La jeune femme, cachée derrière un isoloir, partageait son expérience de victime de violence sexuelle avec un public hétéroclite au cours d'une conférence de presse organisée hier par le Rassemblement démocratique de la femme au Liban (RDFL), à l'hôtel Crowne Plaza, pour lancer son rapport sur la violence sexuelle exercée contre les femmes au Liban. L'étude a été réalisée par le Dr Fayçal el-Kak, gynécologue-obstétricien et chercheur en santé reproductive, et Caroline Succar Slaiby, chercheuse et vice-présidente du RDFL.
Pendant une dizaine de minutes, Sandy brosse un tableau – sombre – de ce qu'elle a subi avant de trouver une aide : son père qui décède alors qu'elle n'avait que 13 ans, sa mère qui lui demande d'être gentille avec son oncle parce que « c'est lui qui soutenait financièrement la famille », des études universitaires inachevées, un époux toxicomane qui la violait et la frappait, un divorce, un mari qui menace de lui prendre sa fille, le retour à la maison parentale parce que l'oncle l'exigeait au risque de couper le budget de la famille, le décès de sa mère, les harcèlements sexuels de l'oncle qui voulait l'épouser, un deuxième mariage raté avec un homme souffrant d'une bipolarité qui harcelait sa fille...


Le déni de soi
Le cas de Sandy n'est pas isolé. Selon des études internationales, une femme sur trois dans le monde continue à être victime d'une quelconque forme de violence domestique ou sexuelle. On estime que 35 % des femmes dans le monde ont déjà été victimes, à une étape de leur vie, d'une violence sexuelle ou physique.
Au Liban, les chiffres concernant la violence sexuelle exercée contre les femmes font défaut, cette violence n'étant pas documentée. En effet, selon le rapport, « la famille reste le principal lieu où la violence sexuelle est exercée contre les femmes ». De ce fait, elle reste impunie, puisqu'aucune plainte n'est déposée dans ce sens, les familles estimant qu'il s'agit d'une affaire interne et que personne n'a le droit d'y interférer.
Intitulé « Violence sexuelle contre les femmes : témoignages dans le noir », le rapport étudie le cas de cinquante femmes. Il met l'accent sur les facteurs qui favorisent cette violence, les raisons qui poussent les femmes à rester dans cet environnement et l'attitude des survivantes. Il émet aussi des recommandations permettant de lutter contre cette violence.
Selon l'étude, « l'agresseur n'a pas une identité communautaire, géographique ou sociale spécifique ». Dans la majorité des cas, il s'agit d'un des membres de la famille, principalement le mari.
La recherche montre que les femmes étaient, dans leur majorité, conscientes du fait qu'il s'agissait d'une violence sexuelle, mais elles se taisaient pour des « raisons familiales ». Elles ont qualifié leur agresseur de « vil », d'« animal », de « malade psychique ». Concernant le viol, elles confient que « c'est l'une des pires formes de torture, parce que la femme sent que son corps est une marchandise ». À cela s'ajoute le fait que dans de nombreux cas, on « blâmait » la femme pour la violence dont elle avait été victime. Souvent on l'accusait d'avoir « encouragé » son agresseur.
En ce qui concerne les facteurs facilitant la violence sexuelle, l'étude met l'accent sur des facteurs personnels relatifs à la victime (niveau d'éducation, l'éducation familiale, les traditions, le fait que l'agresseur soit un membre de la famille...). À cela s'ajoute des facteurs sociaux (la société est sévère envers la victime), relationnels et environnementaux, notamment pour ce qui a trait aux politiques en vigueur.
Comment les femmes ont-elles réagi à cette violence ? Dans la majorité des cas, elles se sont tues surtout lorsqu'elles étaient à un âge très jeune puisqu'elles « ne comprenaient pas ce qui se passait ». Elles confient qu'elles n'ont pas non plus réagi, parce que l'agresseur les menaçait. Les femmes mariées disent qu'elles vivaient dans le « déni », qu'elles restaient avec leur mari « pour les enfants » ou parce qu'il les soutenait financièrement ou encore parce que la religion l'exigeait, etc. Dans certaines situations, elles essayaient de fuir leur agresseur...
Si une minorité des femmes a réussi à obtenir un soutien de la famille, nombre d'entre elles ont été blâmées, voire menacées et délogées. On leur conseillait de « prendre leur mal en patience pour le bien des enfants ».
Les retombées psychiques de cette violence sur les femmes sont profondes. Les victimes parlent ainsi de désespoir, tristesse, dépression, choc, d'impureté du corps, d'horreur... Des sentiments qui persistent même chez celles qui ont bénéficié d'un suivi psychologique. Au niveau social également, les victimes de violence sexuelle dans leur majorité ont été rejetées.
Le rapport propose en conclusion de nombreuses mesures à prendre au niveau personnel, familial, institutionnel et social, ainsi que des stratégies pour lutter contre la violence sexuelle.

Lebanon's Minister of State for Women's Affairs Jean Ogasapian Thursday said that a women's quota for Parliament is a "national right."
Ogasapian made these remarks at a meeting with civil society and women's groups aimed at promoting political participation of Lebanese women.
He said that women in Lebanon have "achieved great success in all fields and reached the highest positions [in their careers]."
"[I call on] women's associations to do more work and [add] pressure because Lebanese women deserve this legitimate right which they have been demanding for years," the minister added.
In March, Ogasapian insisted that a women’s quota in upcoming elections should be set for parliamentary seats rather than candidacies.

L'orient le jour- Femmes violées : tout sauf un poisson d’avril...*, April 01 , 2017

Cela pourrait avoir l'air d'un poisson d'avril. Mais cela ne l'est absolument pas. C'est la loi qui l'impose, et plus exactement l'article 522 du code pénal, qui exonère le violeur de son crime s'il épouse sa victime. Ainsi, la victime épousera son mari violeur et vivra dans une espèce de prison dorée à perpétuité – une sorte de dolce vita en enfer... Parce qu'il faut le dire : dans notre pays, horreur rime avec honneur, avec une exigence de mâle qui fait bien mal, validée par une loi ancestrale et barbare : il faut sacrifier le bonheur de sa fille pour laver l'honneur de la famille...

Rappelons les faits : la commission parlementaire de l'Administration et de la Justice avait abrogé il y a quelques semaines cet article 522 (qui stipule, entre autres, qu'un violeur peut échapper à la condamnation s'il reconnaît son crime et épouse sa victime). L'abrogation de cet article vivement contesté était dans l'air depuis des mois, voire des années, et plusieurs ONG, dont Abaad, avaient activement milité pour cette abrogation. Sauf que pour qu'elle entre en vigueur, elle devait être soumise à un vote du Parlement. Qui ne semble pas pressé d'abolir ce sinistre article 522.

En effet, cela fait plus d'un mois que la loi est en suspens sur l'agenda de l'hémicycle et que ce vote est repoussé. L'ONG Abaad fait appel à la société civile pour qu'elle exerce une pression et fasse entendre sa voix. Pour cela, il faut signer la pétition sur www.undress522.com visant à accélérer le vote au Parlement.
La 522 doit être abolie. Pour toutes celles qui vivent l'horreur et pour éviter à toutes les autres d'avoir l'honneur de vivre l'horreur...

L'orient le jour- « On m’appelle Madame Quota », March 08 , 2017


Femme non conventionnelle et persévérante. C'est ainsi que se présente à « L'Orient-Le Jour » Joëlle Abou Farhat Rizkallah, cofondatrice de « Women in Front » et militante pour une participation de la Libanaise à la vie politique et pour l'adoption du quota féminin.

Sur le mur rouge de son bureau, une phrase, « Faites-le avec passion ou ne le faites pas », qui en dit long sur son caractère. Et sur sa table de réunion, des marguerites offertes par un collègue pour la Journée internationale des droits de la femme. Joëlle Abou Farhat Rizkallah n'est pas femme à baisser les bras. Militante féministe, chef d'entreprise, épouse et mère de famille, elle ne fait rien à moitié. Mais se donne à fond pour chacune de ses tâches.
En cette veille d'élections législatives, l'objectif de cette ancienne ceinture noire de judo est « de faire arriver 38 femmes libanaises au Parlement ». Elle milite ferme dans ce but au sein de l'association Women in Front qu'elle a cofondée avec ses deux partenaires, Nada Anid et Paola Majdalani, pour un quota de 30 % de participation féminine au Parlement. Avec pour credo « la persévérance ». Une cause qu'elle a faite sienne depuis cinq ans. Et qui lui colle désormais à la peau.
« On m'appelle aujourd'hui Madame Quota », lance-t-elle. Car elle tient à « faire bouger les choses », à « changer les stéréotypes » surtout, afin que la Libanaise s'engage de plus en plus dans la vie publique et dans les postes de décision, pas seulement dans la mode, l'esthétique ou l'art. Sera-t-elle candidate aux prochaines législatives ? Pas tant qu'elle n'aura pas atteint ce « lourd » objectif. « Je ne peux à la fois travailler pour un groupe de femmes et m'engager dans la vie politique », explique-t-elle.

Offrir quelque chose à la société

Mme Abou Farhat n'a pas choisi la facilité. Mais rien n'est impossible pour cette journaliste de formation, qui a été élevée « comme une fille, dans la conviction qu'elle pouvait tout faire ». Après avoir aidé son époux à monter son affaire, voilà qu'elle lance la sienne, en 2010. Naît alors Jô Branding Ad, une agence qui porte le nom de la jeune quadra. Entre temps, elle a tâté du journalisme, fourbi ses armes dans la publicité. Mais c'est dans la création d'image personnelle que se spécialise cette « vendeuse hors pair », « passionnée » par son métier, qui avoue donner un coup de pouce « aux femmes tentées de créer leur propre start-up ».
Porter plusieurs casquettes n'est pas toujours évident pour une mère de famille. Joëlle Abou Farhat Rizkallah travaille pourtant « depuis l'âge de 15-16 ans ». Soutenue par les siens, elle n'a jamais envisagé de s'arrêter. Malgré la fatigue qui s'impose parfois, son côté battante l'emporte, haut la main, armée de ce sourire qui ne la quitte pas, de cette élégance sobre et féminine, jusqu'au bout des ongles et du brushing. « Je suis ainsi faite, une non-conventionnelle, qui aime être occupée à plein temps et offrir quelque chose à la société libanaise », dit-elle. « Il faut m'accepter telle que je suis. »
C'est au hasard d'une discussion sur Facebook que s'est dessinée l'idée de militer pour une représentation féminine meilleure en politique. D'autant que la jeune femme suit de près l'actualité : avec le sport et la danse, la lecture est son loisir favori. La rencontre avec Nada Anid mettra le projet à exécution. Paola Majdalani, l'amie de toujours, viendra compléter le trio. Women in Front est créée en 2012. Reste à convaincre la société libanaise, classe politique en tête, que « sans quota, en guise de solution temporaire, il sera difficile pour les femmes d'avancer dans la vie politique ».
« Dans les 128 pays où il a été appliqué, le quota féminin a été une réussite », insiste-t-elle, citant à titre d'exemple quelques pays arabes où la représentation féminine a grimpé au Parlement depuis l'application des quotas féminins : 32 % en Algérie, 31 % en Tunisie, 27 % en Irak, 19,9 % en Arabie saoudite, 15 % en Jordanie... Face à ces avancées sensibles, le Liban fait figure de mauvais élève. Au niveau de la participation parlementaire de la femme, il occupe la 180e place sur 187 pays. « C'est inadmissible », déplore-t-elle.

« Nous avons fait le travail des parlementaires »
Mme Abou Farhat met alors son savoir-faire et son entreprise au service de la cause féminine. Avec méthode, l'association multiplie les initiatives, formations, projets et campagnes de sensibilisation auprès de la classe politique, des municipalités, des médias, des femmes elles-mêmes.
Elle bénéficie désormais du soutien des Nations unies et des ambassades occidentales. Elle récolte même ses « premiers succès ». « Women in Front compte aujourd'hui 500 adhérentes et 44 candidates potentielles. » Au niveau national, le changement est aussi amorcé. « En 2009, 12 femmes seulement se sont présentées aux législatives. Aux dernières élections municipales, 70 femmes se sont présentées et 35 ont été élues », assure la militante.
Mais les prochaines législatives sont décisives. Et la loi électorale se fait attendre. Pas question pour Joëlle Abou Farhat et Women in Front de rester les bras croisés. « Nous avons présenté à la classe politique et aux décideurs une étude méticuleuse d'application du quota féminin, en fonction des différents scénarios de loi possibles », affirme-t-elle, reconnaissant avoir « fait le travail des parlementaires ». Approuvée par la Commission nationale de la femme libanaise et validée par une bonne partie de la classe politique, cette proposition n'attend plus que son adoption.
Alors, à l'occasion de la Journée internationale des droits de la femme, elle transmet à toute la classe politique, et avec le PNUD, le cri du cœur des femmes libanaises : « Adoptez le quota ! »

The idea of an international day for women was first tabled in 1910 by a German female political activist whose views on gender equality were ahead of her time.
In the vision proposed by Clara Zetkin at the 1910 International Conference of Working Women in Copenhagen, women around the world would gather on the same day in solidarity to further amplify their demands.
The United Nations proclaimed March 8 International Women’s Day in 1977, a date that had already long since been marked by women around the world. Over a century since Zetkin’s call, women have won many battles but many are still to be fought.
Four women from different walks of life in Lebanese society spoke to The Daily Star about future and past challenges, what it means to them to be a woman and whether International Women’s Day plays a role in their struggle for gender equality.
I was born in the Nabatieh refugee camp in 1958 and was the oldest of six siblings. When I was 16, the camp was bombed by Israel. Like my parents in 1948, we were forced to move from the second place we called home. Women go through many hardships in life, but Palestinian women in particular face mountains of issues. Living during the war as a Palestinian woman was difficult, to say the least. There were rumors that girls were being kidnapped when moving between camps, but for my family it was my father who was taken. He disappeared and never came back. We never heard what his fate was.
This happened to so many of us that women became the center of the community. In many ways, this made us stronger, it made me stronger.
I was forced to stay strong or my family would fall apart. In our Palestinian society in Lebanon women are the foundation. Our contributions are not only financial, but spiritual. In many ways my childhood was short.
I had to work and I felt that this made me equal to men in many ways, but I was always reminded what it meant to be a woman when I was forced to confront culture and traditions. It forces you to question what your role is in society.
One time, I had planned to go on a trip with some friends. I had already paid and returned home to tell my brother. Even though I was older, he refused to let me go. He didn’t say it explicitly, but he was angry I had decided to go without asking his permission. International Women’s Day is good, but it shouldn’t just be one day of the year.
Women should be appreciated for all our work, sacrifices and the inequality we face. We contribute a lot to society. Sometimes people come up to me on the street and thank me for helping them to learn and that’s a big source of happiness. I feel accomplished that I have helped create change.

حيا حزب الخضر في بيان المرأة في عيدها،وقال:«في لبنان تناضل النساء كسائر نساء العالم من أجل تحقيق المساواة والمشاركة في الحياة السياسية والعامة ولمناهضة العنف، واستطاعت نساء لبنان في نضالهن الطويل والمستمر تحقيق بعض الانجازات أهمها الوصول الى قانون لمناهضة العنف والسعي ما زال مستمرا لتحقيق العدالة والمساواة والمشاركة».

وأوضح «أن مشاركة نساء لبنان بالحياة السياسية يتطلب تضمين أي قانون انتخابي كوتا بصورة موقتة وتشجيع القوى السياسية والاحزاب أعضاءها من النساء الى احتلال المناصب القيادية والأختيار من بينهن مرشحات الى الانتخابات البلدية والنيابية وللمشاركة بالحكومات بشكل أوسع وأشمل».

ودعا الحزب «المجلس النيابي الى إقرار القوانين التي تحقق المساواة والعدالة والحماية لنساء لبنان والى اعتماد الثامن من آذار اليوم العالمي للمرأه كيوم عطلة رسمية».

استذكرت منظمة «كفى» مناسبة «اليوم العالمي للمرأة»، في بيان ما اقترفته أيدي الوصاية الطائفية، ممزوجة بالعقلية الذكورية في السنوات القليلة الماضية. وصاية الطوائف منعت تجريم الاغتصاب الزوجي، وصاية الطوائف منعت حماية الأطفال مع ضحية العنف الأسري في حال لم يكونوا في سن حضانتها، وصاية الطوائف احتكرت تنظيم شؤون الأسرة وكرست السلطة الذكورية في عائلاتنا، وصاية الطوائف تحرم النساء من حقهن في إعطاء الجنسية لأسرهن، وصاية الطوائف شجعت تكريس تزويج القاصرات عبر إدخال مفاعيل المادة 522 على بعض بنود قانون العقوبات. وأخيرا، وصاية الطوائف تعرقل حاليا تحديد سن أدنى للزواج، وها قد كلفت لجنة المرأة والطفل النيابية مندوبين عنها للوقوف عند رأي الطوائف في مشروع قانون يهدف إلى الحد من التزويج المبكر، تماما كما فعلت لجنة وزارية كانت قد تشكلت لدراسة مشروع قانون حماية النساء من العنف الأسري في العام 2009، ودارت على المراجع الدينية للوقوف عند رأيها في المشروع آنذاك».

وقالت: «هنا بيت القصيد والعصا في الدولاب والكمين في الطريق الذي يمكن اختصاره بجملة لا يرضى النواب إلا وأن نسمعها» ضرورة الوقوف عند آراء المراجع الدينية كمدخل لأي تغيير». لكننا اليوم نطالبكم بأن تعودوا لممارسة صلاحياتكم التشريعية التي يفترض أن تكون محصورة بكم وحدكم كونكم نوابا منتخبين من الشعب اللبناني. قفوا عند آرائنا كنساء وجهات تعرف خير المعرفة قضاياها وحقوقها. قفوا عند واجباتكم التشريعية بسن القوانين العادلة وإزالة القوانين الجائرة والتمييزية. قفوا عند التزاماتكم الدولية التي تفتخرون بها وبالمساهمة في نصها. ما نطالب به اليوم هو تحرير التشريع من وصاية داخلية إسمها الوصاية الطائفية. عادة، يوجه النضال إلى مرجع واضح، لكن في لبنان ابتلينا بمحنة التعامل مع 18 جبهة، وقد حان الوقت لوضع حد لهذه الوصاية كمدخل لأي تغيير».

واعلنت «في يوم المرأة العالمي، استكمال النضال حتى تحرير التشريع من وصاية الطوائف».

في اليوم العالمي للمرأة تنتفض البشرية في دول العالم انتصارا لحقوق سيدات يعانين الامرين في الكثير من الدول التي تنزف حروبا ونزاعات او قمعا للحريات... ناهيك عن بعض الانظمة والقوانين التي مازالت تضع المرأة في مكانة لا تليق بدورها في تكوين مجتمعات افضل.
في مثل هذا اليوم العظيم لا بد من الانتقاضة على واقع ابعد ما يكون من تصور الحقيقة المرة... نساء يعاملن كسبايا ويبعن في سوق نخاسة يغتصبن ويجبرن على الاجهاض... نساء اجبرن على العمل اجيرات للجنس والمتعة دون اي وجه حق...
تحت عنوان "تمكين المرأة هو تمكين الأمم: الجرأة للتغيير"، افتتح وزير الدولة لشؤون المرأة جان أوغاسابيان احتفال يوم المرأة العالمي الذي نظمه بيت الأمم المتحدة في بيروت فلفت الى أنّ "ما نشهده من مسائل إنسانية لها بعد سياسي واقتصادي، وترتبط بالمأساة التي نشهدها يومياً في زمن التحولات الكبرى في المنطقة".
ولأنها امرأة اسرت العالم العربي بسندان كلماتها التي غالبا ما تصوب وتصيب الحق وتناصر المرأة ككيان وجودي قادر ان يغير العالم بأسره،  أطلقت الفنانة ماجدة الرومي صرخة من مقر الأمم المتّحدة في بيروت "الإسكوا"، لمناسبة يوم المرأة العالمي، طالبت فيها بجرأة بتغيير الظروف الحياتيّة الصعبة المستحيلة، التي تعانيها ملايين السيّدات العربيّات على امتداد الأرض العربية كلّها  .
وقالت خلال الاحتفال الذي أقامه مقر "الإسكوا"، تحت عنوان "تمكين المرأة هو تمكين الأمم على الجرأة للتغيير" وبحضور وزير الدولة لشؤون المرأة جان أوغاسبيان: "أعتِقوا المرأة وأطفالها وعائلتها من بؤر الفقر والجهل والأميّة، تكونوا بذلك تخططون لقيام دول أقلّ إجراماً وحروبا"، وتنزعون فتيل القنابل الموقوتة من بيوت وقلوب مقهورة ومنكسرة، وتحولونها إلى سنابل بركة ومواسم خير  .
فماجدة التي اطربت العالم العربي تدرك ان لكلامها وقع وتأثير كبير وهي مدركة ان تلك الصرخة المدوية التي اطلقتها بعدما عاينت ان الفقر والجهل سبب دمار المجتمعات ولان الام هي العنصر الاهم في معادلة التربية، لا بد من تحريرها من نبال وسهام الجهل المرير والعمل على تثقيفها لبناء مجتمعات متحررة من لغة الدمار والحرب.
الرومي دعت في كلمتها إلى تثقيف المرأة وتشريع أبواب المدارس والجامعات لها، لأنّ ذلك يؤدي الى نشوء مجتمعات أكثر تمدّناً وإيجابية وانفتاحاً ومعرفة، وأكثر تحيزاً للحياة والحق والخير والجمال. كما دعت إلى وضع قوانين تحمي المرأة نفسيّاً وجسديّاً من كل عنف وذلّ  .
وقبل أن تُنهي الرومي كلمتها رفعت صوتها مجدداً وقالت: "أريد أن ألفت النظر إلى مأساة ملايين السيدات المكبّلات بالضيق، على امتداد الأرض العربيّة، ولأقول معهُنّ: "أيُجنى من الشوك عنب، ومن العوسج تين؟
مما لا شك فيه ان ماجدة على بينة وادراك لما تعانيه المرأة العربية على وجه الخصوص في الدول العربية التي تعاني نزاعات وحروب. لذلك جاءت كلمتها في يوم المرأة بمثابة الصرخة المدوية التي تئن من واقع حال مرير يحول دون تقدم المرأة وتطورها في عالمنا العربي.

ربّما يملّ المتملّقون من الحملات والبرامج واللقاءات التي تأتي في إطار تمكين المرأة ودعمها، والتي تكثر بشكلٍ ملحوظ في شهر المرأة (آذار) ولكن يجب التذكير بأن هذه المؤتمرات وغيرها من الحملات ليست من باب المزايدات بل من باب الواقع المر، الذي يسلط الضوء على تمييز جندري صارخ وممارسات عنفٍ فاضح يُترجم عبر أرقامٍ صادمة تعكس واقع الحال في لبنان بشتى القطاعات المعنية.

"ليس احتفالاً بيوم المرأة وحسب، وإنما إلتزام تجاه المرأة من القطاعات المتعددة الفاعلة في مجال القضاء على العنف ضد النساء لتعزيز حمايتها من العنف القائم على النوع الإجتماعي" عقدت منظمة أبعاد مؤتمراً وطنياً بالشراكة مع منظمة الأمم المتحدة للمرأة وبرعاية وزير شؤون المرأة اللبناني جان أوغاسبيان تحت عنوان "الإستجابة المتعددة القطاعات لحماية النساء والفتيات من العنف في لبنان"، على أن يتم إدراج توصياته في الإستراتجية الخاصة بوزارة المرأة. وذلك بحضور نائب المنسق الخاص للأمين العام في لبنان والمنسق المقيم للأمم المتحدة فيليب لازاريني، مارييز ريبيكا غيموند مستشارة الشؤون السياسية في منظمة الأمم المتحدة، وممثلين عن "UN Women" وعدد من الناشطات النسوية، والجمعيات المهتمة بقضايا المرأة.

من أجل التقدّم
وعن المؤتمر، أكدت المحامية في منظمة أبعاد دانيال الحويك، أنه يعقد للحديث عن التحديات والعقبات والحواجز وطبعاً لاستعراض المنجزات والتطورات. "وإن كان النظر إلى الخلف إنما من أجل التقدم بخطوات ثابتة وواضحة، ولوضع أهداف محددة والعمل على تحقيقها في إطار التنسيق الفعال بين مختلف القطاعات، ولإدراج التوصيات في خط التوجهات الإستراتيجية الوطنية الخاصة بوزارة شؤون المرأة".

أهمية التعاون
بمحطات تفكير وتأمل في المشهد اللبناني، المدني منه والحكومي، يأتي يوم المرأة العالمي هذا العام "بلوحةٍ مختلفة" على حدّ تعبير مديرة منظمة أبعاد غيدا عناني "إذ باتت قضايا النساء بتحدياتها المختلفة جزءا لا ينفصل عن نبع قضايا المواطنة ولو ما زال الإعتراف بحق توارث الجنسية بين الأم وأبنائها مطلباً بل حقا يدفع أثمان المهاترات السياسية والأنانية السلطوية بغير حق".
فإن الوعي حول أهمية التعاون، وتضافر الجهود، فعلا عملا وليس شعاراً، ما بين الهيئات النّسائية، حقيقة محتمة لأي مُنجز تسعى نحوه هذه الهيئات. "إذ كفانا شخصنة، وتفّردا، و إنفصاما في الحركة النسائية لم يولدّ غير إضعاف للحقوق ومتاجرة في قضايا أصحاب هذه الحقوق وتأخر في إحقاق المكاسب".

خطوات عملية
وبدوره، أكد وزير الدولة لشؤون المرأة جان أوغاسبيان،أن المرأة اللبنانية "ثروة" أظهرت مقدرة قوية وإنجازات كبيرة وعنفوانًا ونجاحات في القطاع الخاص، ما يخوّلها لأن تكون موجودة في القطاع العام، نظرًا للحاجة إليها وليس كبادرة شكلية فقط. فـ"إن مطلبنا إقرار كوتا للمرأة لمرحلة إنتقالية يعود إلى القناعة بأن وجود المرأة ضروري في داخل المؤسسات التي تحتاج إلى هذه القدرات لإعطائها قوة ودفعًا فتكون أكثر فاعلية وإنتاجًا وإنصافًا وأكثر إطلاعًا بشؤون الناس وشجون المجتمع".
ورأى أوغاسبيان أن تحقيق هذا الهدف يتطلب إحداث تغيير في الثقافة وطريقة التفكير التقليدية السائدة. منوّها بما تقوم به منظمة أبعاد وغيرها من المنظمات النسائية لتحديث التشريعات والقوانين وتعزيز حماية المرأة من العنف. كاشفاً عن أنه تقدم إلى مجلس الوزراء بمشروع قانون له علاقة بالتحرش الجنسي وقد تم إدراجه على جدول أعمال مجلس الوزراء اليوم. داعيًا الناشطات والناشطين في مجال حقوق المرأة إلى عدم اقتصار الأهداف الموضوعة على الدفاع عن حقوق المرأة فقط، "بل يجب الإنتقال إلى مرحلة تتم فيها مشاركة السيدات في صنع القرار في لبنان، ويكون للسيدات دور في المساءلة والمحاسبة". وشدد الوزير أوغاسبيان على عدم حصر القدرات بما له علاقة فقط بالسيدات بل لفت إلى ضرورة توسيع الأفق لشمول القضايا الوطنية الكبرى. وذكر بأنه رفع إلى رئيس الحكومة سعد الحريري توصية بأن تعمد الحكومة إلى تطبيق نظام الكوتا النسائية بنسبة ثلاثين في المئة في كل مجلس إدارة يتم تعيينه. وأبدى أمله الكبير في تحقيق خطوات إيجابية متقدمة تظهر القدرات الكبيرة التي تتمتع بها سيدات لبنان ما يتيح إحداث تغيير حقيقي في المجتمع.

أهمية المؤتمر
وعن أهمية المؤتمر أشار فيليب لازاريني- نائب المنسق الخاص للأمين العام في لبنان والمنسق المقيم للأمم المتحدة، إلى أن المشاركة في هذا المؤتمر "مهمة جداً" وهو ليس فقط لعرض المنجزات بل أيضاً لتسليط الضوء على ضرورة اعتماد مقاربة متعددة القطاعات في ما يخص العنف القائم على النوع الاجتماعي . فـ"بالرغم من الجهود المبذولة حتى الآن من قبل مختلف الجهات لتحسين وضع المرأة، ما زالت المرأة في لبنان تواجه التمييز وعدم المساواة ، وبالتالي على لبنان مواجهة العديد من التحديات المتعلقة بمشاركة المرأة الإجتماعية، الإقتصادية والسياسية. مؤكداً أنه على الجميع توحيد الجهود والعمل كمؤسسات حكومية (شؤون صحية، تربوية، عدل، داخلية وإجتماعية)، مجتمع محلي وشركاء في التطوير لضمان الوصول إلى المساواة وإنهاء العنف.
ومن جهتها لفتت مارييز ريبيكا غيموند مستشارة الشؤون السياسية في منظمة الأمم المتحدة، إلى أن منظمة الأمم المتحدة للمرأة تأسست لتعزز هدف المنظمة في تحقيق المساواة بين الجنسين وتمكين المرأة، مشيرة إلى أن منظمة الأمم المتحدة للمرأة تسلط الضوء على الأصعدة ذات الأولوية لتحقيق المساواة بين الجنسين وتمكين المرأة، وهذه الأصعدة تتضمن التمكين الاقتصادي القيادة والمشاركة السياسية، إنهاء العنف ضد المرأة وتعزيز دور المرأة في السياق الإنساني للسلام والأمان. وشددت غيموند على ضرورة تعزيز جهود الحكومات والمنظمات العالمية والمجتمع المدني لتعزيز المساواة بين الجنسين وإنهاء جميع أنواع التمييز والعنف ضد المرأة.

أهم التوصيات
وبعد كلمات الجلسة الإفتتاحية، تم تقسيم جلسات المؤتمر إلى خمس جلسات، تناولت العمل ضمن قطاعات الصحة، الأمن، القضاء والعدل، الخدمات الإجتماعية، التربية والوقاية الأولية. وصدر عن الجلسات عدد من التوصيات التي سيتم إدراجها ضمن إستراتجية المرأة الخاصة بوزارة المرأة. ومن أبرز التوصيات نذكر:
1-تفعيل التنسيق بين مختلف القطاعات العاملة والمؤثرة على قضايا النساء وحقوقهن ووضع قوانين للحماية في الحقوق والصحة الجنسية والإنجابية، وتأمين المعلومات وسهولة الحصول عليها.
2-تكريس وجود منسق واحد بين جميع الجهات التي تعمل على قضايا المرأة في لبنان بين جميع القطاعات.
3-تطوير السياسات الصحية والخدمات الصحية لتشمل الصحة النفسية للنساء.
4-تقديم حزمة من خدمات الرعاية الشاملة للنساء في مكان ومركز واحد.
5-مناصرة الإصلاح القانوني في مختلف القطاعات.
6-وضع برامج لتطوير خبرات المستمعات ومديرات الحالات، كونهن الخط الأول الذي تصل السيدة إليه للإخبار والحديث عن حالاتها.
7-تقييم عمل المنظمات النسائية مع الناجيات من العنف بمقارباتها الثلاث: سياق العمل، المسار، التأهيل الإستماع والعلاج بهدف تحويل الناجيات إلى مناصرات لحقوق النساء.
8-تقييم الموارد المنتجة لتعزيز القدرات في مجال تقديم الخدمات.
9-وضع آليات للإستجابة إلى إقتراحات وشكاوى الناجيات وصاحبات/أصحاب الحقوق بهدف تحسين الخدمات المقدمة في مختلف القطاعات.
10-تفعيل الشراكة وتطوير برامج التدريب المتخصصة لعناصر قوى الأمن الداخلي.
تطوير الإجراءات التشغيلية الموحدة الناظمة لدور عناصر قوى الأمن الداخلي في العمل مع الناجيات من العنف الأسري والجنسي ومرتكبي العنف بالتشبيك مع الجهات المعنية الأخرى.
11-تفعيل دور وزارة التربية في مراجعة المناهج التربوية وتنزيهها من أوجه التمييز الجندري وإدماج برامج الوقاية والحماية الأولية في المدارس الرسمية.
على أمل أن تتم ترجمة هذه التوصيات بعد إدراجها في إستراتجية المرأة الخاصة بوزارة شؤون المرأة، خطوات جدية وفعلية، وألا تأخذ قيلولة قسرية في أدراج الوزارة الأم التي تعلّق عليها الجمعيات النسائية آمالا كبيرة...!

لا بشاعة الجريمة ولا هوية مرتكبيها عزّزت من مكانة قضايا قتل النساء في ميزان القضاء. صحيح أنّ بعض القرارات القضائية حملت معها أملاً، إلا أنّها لم تجعل ذلك التوجّه، الذي كان في الغالب يحمل بصمات قاضٍ بعينه، مساراً عاماً يمكن البناء عليه. لا يزال الطريق طويلاً... إذا ما أخذنا في الاعتبار «ذكورية» المشرعين والقضاة الممسوسين بعادات العشائر وتقاليدها

مطلع العام الحالي، ردّ قاضي محكمة التمييز، جوزف سماحة، «طلب التمييز المقدّم من زوج الضحية رولا يعقوب إلى محكمة الجنايات في الشمال بجناية التسبّب بالموت».
جاء ذلك بعد أربع سنوات على مقتل رولا، أي بعد مسار طويل تخللته تبرئة زوجها (ك.ب.) المشتبه فيه بالقتل ومنع المحاكمة عنه وثم إعادة اتهامه وفتح المحاكمة من جديد. مسار مضنٍ يوضح نقص «العدالة» في قضايا قتل النساء من قبل ذكور عائلاتهن.
رد طلب الزوج فتح كوة الأمل من جديد أمام النساء المقهورات، ولكنه يبقى رداً ناقصاً، في انتظار القرار الذي ستصدره محكمة الجنايات، التي يفترض أن تستمع إلى «المتهم» في منتصف أيار (مايو) المقبل.
رولا، الأم التي سبحت بدمها على مرأى من بناتها الخمس، بقي دمها حتى الآن في رقبة القضاء. برغم بشاعة الجريمة التي أودت بعمرها وصارت معها قضيّة رأي عام، إلا أن ذلك لم يغيّر الكثير. فملفّ رولا القضائي بقي مبعثراً بين ملفات محكمة الجنايات في الشمال أشهراً، و«الذكورية» التي طبعت تعامل القضاء مع هذا الملف، كانت الشرارة التي أطلقت حراكاً نسائياً أدى إلى إقرار قانون «العنف الأسري» المبتور.
هي ليست قضيّة رولا فقط. فجلّ جرائم العنف الأسري لا تزال في ميزان القضاء شأناً عائلياً. ورغم تسجيل 14 جريمة قتل لنساء من قبل ازواجهن، في غضون عامين، لم تحظ هذه القضايا بـ «الأولوية». وحتى مع تحوّل بعضها إلى قضايا رأي عام، لم يحدث ما يمكن اعتباره مساراً يحتذى به: منال العاصي التي أخرج محمد النحيلي روحها بيده، كادت تفقد «العدالة» روحها بقرار ذكوري من محكمة جنايات بيروت يمنح القاتل عذراً مخففاً «لأنّ الضحية ارتكبت عملاً غير محق وعلى جانب من الخطورة هو الخيانة الزوجية». كاد يمرّ كل ذلك لو لم يستدرك قاضٍ آخر فداحة الخطأ، مستغلاً الهامش الممنوح له في القانون. ونسرين روحانا التي كاد القضاء يقتلها مرّة ثانية بمنحه عذراً تخفيفياً للزوج في بداية الأمر بحجة «إقرارها الخطي بالخيانة»، وغيرهما كثيرات.
اليوم، يحلّ يوم المرأة العالمي في ظلّ المطلب الذي لم يتغيّر: «أسرعوا في محاكمة قتلة النساء». إلى الآن، لا تعديلات على الشعار، خصوصاً في ظلّ وجود قضايا عالقة منذ سنوات بلا نهايات. يعيد هذا اليوم الذي يحمل هذا العام شعار «الجرأة للتغيير» التذكير بما يتجاوز الستين حكاية عن نساءٍ قضين نتيجة العنف الأسري (56 ضحية ما بين العامين 2010 ومنتصف 2016 بحسب منظمة كفى عنف واستغلال)، فيما لا يزال السؤال واحداً: متى تصبح قضايا قتل النساء أولوية في القضاء؟
برغم صدور قانون «حماية النساء وسائر أفراد الأسرة من العنف» منتصف 2014، وصدور المئات من القرارات الحمائية للنساء المعنفات وأطفالهن، إلا أن القانون الذي كان يفترض أن يحمي النساء، ظهرت شوائبه عند التطبيق. في هذا الإطار، أقامت جمعية «كفى عنف واستغلال» «جردة حساب» بعد عامين من دخول القانون حيز التنفيذ، واضعة جملة من التعديلات المفترضة، وقدّرتها بـ14 تعديلاً قابلة للإضافة، لعلّ أهمّها ثلاثة: التعريف الضيّق للعنف الذي جاء محصوراً في مادته الثانية بـ«الإيذاء والضرب والتسبّب في الأذى (...)»، من دون أن يشمل مثلاً أنواعاً أخرى من العنف منها المعنوي على سبيل المثال، وهنا أيضاً تعميم العنف على سائر أفراد الأسرة من دون تخصيص الحماية للنساء، وثالثهما تخصيص محكمة للنظر في قضايا تعنيف النساء، التي كان يُفترض أن تحمل اسم المحكمة الأسرية.

جلّ جرائم العنف
الأسري لا تزال في ميزان القضاء جريمة كغيرها

ثلاثة تعديلات ليست هي النهاية، ولكنها بداية المعركة الطويلة أصلاً. أما المطلوب، فهو «الإرادة»، تقول المحامية ليلى عواضة من منظمة «كفى عنف واستغلال». من دون هذه الإدارة، «ستبقى قضايا العنف وقتل النساء مثلها مثل أي قضية أخرى»، وفي أحيانٍ كثيرة قضيّة ثانوية في مواجهة قضايا كالإرهاب والسرقة وغيرها.
هذه ليست مسؤولية القضاة وحدهم، فهؤلاء يتذرعون بنصوص القوانين، وإن كان البعض منهم يغوص في روحية القانون وضمن الهامش المسموحة لهم لإصدار أحكامٍ منصفة. فإن نفّذوا القانون، فهم «غير ملومين»، تتابع عواضة. أو بالأحرى، هم ملزمون بتنفيذه. أما المسؤولية الأكبر، فتقع على عاتق المشرّع الذي من المفترض أن يضع قانوناً يستجيب للتطورات وروحية المجتمعات. وهذه نقطة بديهية. أما هنا، في البلد الذي تقضي فيه امرأة كل شهرٍ على يد زوجها أو أخيها أو أبيها، فالمشرّع لا ينفكّ يدسّ في نصوصه تقاليد المجتمع وأعرافه وعاداته. في البلد، الذي كلما تقتل فيه امرأة، يأتي التعليق القاتل «بتكون عاملتلها شي عملة». والنماذج كثيرة هنا، منها على سبيل المثال إلغاء المادة 522 من قانون العقوبات التي كانت «تعفي المغتصب من العقوبة في حال تزوج الضحية»، ودسّها في مواد أخرى، وإن بطريقة غير مباشرة (الأخبار 8/12/2016)، ولعلّ كلام رئيس لجنة الإدارة والعدل النيابية في الجلسة الأخيرة لدرس المادة «502 إلى 522» من قانون العقوبات ومناقشتها وتعديلها هو أبلغ وصف لعقلية المشرّع التي لا تزال تحمل في طياتها عبارات كـ «السترة» و«الشرف». من ينسى كلام غانم عن الأخذ في الاعتبار في أثناء النظر في التعديلات «العادات اللبنانية وكل الامور التي يتميز بها المجتمع اللبناني عن غيرنا من البلدان، بحيث لا يزال لدينا عشائر وقبائل وعادات تختلف تماماً عن الاخرين (...)؟». وكذلك الأمر بالنسبة إلى قضية تزويج القاصرات، حيث خرج النائب غسان مخيبر، وهو مشرّع للأمانة، متأبطاً مشروع قانون يهدف إلى «تنظيم زواج القاصرات».
هنا، تقع المسؤولية المضاعفة على المشرّع الذي يكرّس ذهنية العادات والتقاليد في روحية نصوصه، ولم يستطع إلى الآن تنزيه نصوصه منها، ما انعكس على القضاة في قرارات «الأحكام التخفيفية» التي شاركت في القتل. أما المسؤولية التالية، فهي على المجتمع الذكوري الذي لا يزال يعتبر موت النساء قضية ثانوية. هذا كله انعكس في القانون «المبتور». لكن، للإنصاف، أخيراً، ساعد القانون في أمرٍ واحد: توصيف جريمة القتل بعدما كانت بلا توصيف. وهذا انتصار، ولو طفيفاً.

مسيرة من الأشرفية إلى قصقص
في مناسبة يوم المرأة العالمي، قررت مجموعات نسوية وطلابية ونسائية ومدنية أن تمشي معاً في مسيرة تجوب أحياء بيروت. تأتي هذه المسيرة تأكيداً لـ «تضامننا مع قضايا كل النساء المتعددة، احتفالاً بنضالات النساء اليومية ومعاركهنّ وقدرتهن على الانتصار الدائم، ومن أجل التأكيد أنه لا مساومة على أنَّ المساواة الكاملة الشاملة قابلة للتحقيق» وفق ما جاء في الدعوة. تنطلق المسيرة من ساحة ساسين في الأشرفية، وصولاً إلى حديقة قصقص عند ظهر يوم السبت ١١ آذار (مارس).

قوانين الاحوال الشخصية: استعباد المرأة باسم الدين

ينأى المشترع والقضاء المدني بنفسيهما عن كلّ ما له علاقة بالأحوال الشخصيّة للمواطنين والمواطنات تاركين الفصل فيها للمحاكم الدينيّة. عوض الحكم باسم الشعب اللبناني، تصدر الأحكام باسم الطوائف، ويكرّس الغبن باعتباره مُنزلاً من الله.
المرأة هي الأضعف في هذه المنظومة الذكوريّة.
منذ أشهر، سُجنت فاطمة حمزة لأنها رفضت التخلّي عن ابنها الذي حُرمت منه بموجب حكم شرعي. ولولا التحرّكات والضجة الإعلاميّة التي رافقت سجنها، لربّما كانت لا تزال في سجنها حتى اليوم، باعتباره أمراً إلهياً مُنزلاً لا يجوز التصدّي له. وقبلها، حرمت «قوانين الطائفة» جوسلين يحيى من رؤية ولديها، رغم تعرّضهما للتعنيف من والدهما، فقط لأنها تجرأت على طلب الطلاق. والأمر نفسه ينطبق على ريتا شقير المحرومة من رؤية ابنها منذ ثلاثة أشهر، لابتزازها للتراجع عن دعوى إثبات طلاق وتسليم مهر.
ولم ير قاضي الأمور المُستعجلة في النبطية حقاً لامومتها يتجاوز رؤية ابنها آدم (4 سنوات) أكثر من مرة أسبوعياً، يوم السبت، لمدّة 3 ساعات فقط!
فاطمة وجوسلين وريتا واجهن منظومة غسل الدماغ المصبوغة بالقدسيّة، التي تعتبر الرجل رأس المرأة في الكنيسة وقوّاماً عليها في الإسلام. كسرن أصعب المحرّمات، وهن عيّنة عن آلاف النساء اللواتي يُحرمن يومياً من أبسط حقوقهن أمام «عدالة» رجال الدين الذكور، وتُنتهك كرامتهن بموجب قوانين الأحوال الشخصيّة التمييزيّة.
قوانين ظلم المرأة
في تقرير صادر عن منظّمة «هيومن رايتس ووتش» عام 2015، بعنوان «لا حماية ولا مساواة: حقوق المرأة في قوانين الأحوال الشخصيّة اللبنانيّة»، وصفت هذه القوانين القائمة على الديانة بالتمييزيّة ضدّ المرأة، وفي كلّ الطوائف الدينيّة البالغ عددها 18 من دون استثناء. واعتبر التقرير أن هذه القوانين لا تضمن حقوق المرأة الأساسيّة، وتنصب حواجز أمام السيّدات الراغبات في إنهاء زيجات تعيسة أو مسيئة، أو في بدء إجراءات الطلاق، أو ضمان حقوقهن المتعلّقة بالأطفال بعد الطلاق، أو تأمين حقوقهن الماليّة من زوج سابق، فضلاً عن مسائل الارث والملكية وغيرها.
عملياً يوجد في لبنان 15 قانوناً منفصلاً للأحوال الشخصيّة للطوائف المُعترف بها، في ظل غياب قانون مدني يساوي بين الجميع. علماً أنّ المحاكم التي تطبق هذه القوانين مستقلّة ولا تخضع لأي إشراف حكومي، وتصدر أحكامها، التي غالباً ما تكون مشمولة بانتهاكات لحقوق المرأة الإنسانيّة. حلّلت «هيومن رايتس ووتش» نحو 447 حكماً قضائياً صدر عن المحاكم الدينيّة الإسلاميّة والمسيحيّة في قضايا الطلاق والحضانة والنفقة الزوجيّة ونفقة الأطفال. ووجدت أنّ «مراجعة 243 حكماً قضائياً في ملفات طلاق تثبت التمييز المُمنهج ضدّ المرأة، ويشتمل على قصور في توصلها إلى الطلاق، والأعباء الماليّة المترتبة على إجراءات المحاكم، والتي تنصب أمامها حواجز عند إنهاء الزواج، تضاف إلى عدم الاعتراف بالحضانة المشتركة ومنحها للأم حتى سنّ معيّنة، مع بقاء الأب الولي الشرعي على الأولاد، والتي تنتقل إلى أقاربه من الذكور في حال وفاته». كما أن مراجعة 101 قرار يبيّن أن «المحاكم نادراً ما كانت تنظر في سلوك الأب عند الفصل في قضايا الحضانة، بينما كانت تدقّق في سلوك المرأة بطريق تعكس تحيزات أو تنميطات إجتماعيّة، وهو ما رفع احتمالات إسقاط الحضانة عن المرأة أكثر منها عن الأب».
تشريع الإضطهاد لدى المحاكم الاسلامية
تشكّل قضية الحضانة لدى الطائفة الشيعية التعسّف الأكبر في قضايا الاحوال الشخصية الطائفية، اذ تحدد المحكمة الشرعية سن الحضانة للأم بسنتين فقط للذكر و7 سنوات للأنثى.
دعاوى الحضانة يتقدّم فيها الأب أو الأم من أجل حقّ حضانة الأولاد في حال وصل الخلاف بينهما إلى مرحلة الانفصال. يحدَّد سن حضانة الأم للطفل لدى الطائفة السنية بـ 12 عاماً للذكر والأُنثى. هذه السنّ من حق الأم فقط، فإذا انتقلت الحضانة الى أم الأم بسبب وفاة الأم، تكون سنّ الحضانة لأهل الأم 7 سنوات للذكر و9 سنوات للأنثى. أمّا عند طائفة الموحدين الدروز، فتُحدد السن بـ7 سنوات للذكر و 9 سنوات للانثى.
تفقد المرأة حضانة أطفالها لدى الطائفة الشيعية إذا كانت على غير دين الأب أو في حال تزوّجت بمحرم الصغير أو بغير محرم. كذلك، تسقط حضانة الأم لدى الطائفة السنية بإتمام الطفل 5 سنوات في حال كانت الأم على غير دين الأب، أو إذا تزوجت من غير محرم الصغير. بالنسبة إلى الطائفة الدرزية، تسقط حق الحضانة للأم في حال تزوجت الأم من غير محرم الصغير أيضاً.

ينطوي موضوع منحها الحضانة على شروط تمييزيّة كـ «حسن السلوك» و«عدم الزواج»

تجدر الإشارة الى أن الحضانة تختلف عن مفهوم «الولاية». الأخير يعني الولاية على النفس (حق التربية والتأديب والتعليم والتزويج والحفظ)، فضلاً عن الولاية على المال (العناية بمال القاصر/ة وحفظ إدارته وتدخل فيها الوصاية والقيمومة). عند الطوائف الإسلامية الثلاث، لا ولاية للأم على أولادها.
في حال الطلاق، يحقّ للزوج لدى الطائفتين السنية والشيعية إرجاع زوجته لعصمته من دون رضاها أو علمها أثناء عدّة الطلاق الرجعي. والزوج غير مُلزم بتسجيل هذه الرجعة أمام المحكمة، ويحق للزوجة لدى الطائفة السنية فقط مراجعة القضاء وطلب تطليقها من زوجها. وتتفرّد الطائفة السنية بالطلاق الخلعي الذي يحصل بتراضي الزوجين حين تتنازل الزوجة عن حقوقها في المهر ليوقّع الرجل الطلاق ويُشترط موافقته (الزوج).
بحسب قوانين الأحوال الشخصية الإسلامية، يحق للزوج أن يتقدّم بدعوى المُساكنة في حال غادرت الزوجة المنزل الزوجي بدون إذنه أو من دون عذر مشروع. وفي حال رفضت الزوجة تنفيذ حكم يلزمها بمساكنة الزوج، تُعتبر «ناشزاً» وبالتالي تسقط عنها النفقة. ولا يحق للزوجة ترك المنزل الزوجي، إلا إذا أصبحت المعيشة المشتركة بين الزوجين مُستحيلة أو في حال كان بقاؤها في المنزل يُعرّض حياتها للخطر أو حياة أولادها.
بإمكان القاضي الشرعي لدى الطائفة السنية، أن يأذن بزواج القاصر الذي أتمّت الـ 12 سنة والقاصرة التي أتمّت الـ 9 سنوات في حال بلوغها وبعد إذن ولي الأمر. أما معيار التزويج لدى الطائفة الشيعية، فهو إثبات البلوغ الشرعي ويُتوقع بلوغ الذكر الـ15 سنة والأنثى الـ 9 سنوات. بالنسبة إلى طائفة الموحدين الدروز، بإمكان قاضي المذهب أو شيخ العقل أن يأذن بزواج القاصر الذي أكمل عمر الـ 16 سنة والقاصرة التي أكملت الـ15 سنة بعد إذن وليّها.
تُظهر دراسة «التزويج المُبكر للفتيات: انتهاك للطفولة وتناسل الفقر» المُعدة عام 2015 من قبل الأستاذ الجامعي والباحث الإجتماعي زهير حطب بالتعاون مع «التجمّع النسائي الديموقراطي اللبناني»، أن أكثر من 90% من حالات تزويج القاصرات حصلت بـ «سهولة تامة» وبـ «إجراءات بسيطة» في المحاكم الشرعية في لبنان. يلفت حطب في دراسته الى «الصمت المُتمادي للمؤسسات الدينية تجاه تزويج القاصرات»، مُشيراً الى أن التزويج المُبكر يُجسّد حجم انتشار ثقافة إجتماعية وإيديولوجية ذات بعد ديني بين الناس، «وبموجب هذه الثقافة يُفضّل الرجال اختيار قريناتهم الصغيرات في السن وبمواصفات تُسهّل عليهم بسط سلطتهم باسم الدين». اللافت هو ما يُشير اليه حطب، بأن التزويج المُبكر للفتيات «يكشف عن المفهوم السائد للزواج الذي يستبعد عملياً فكرة التواصل بين زوجين ناضجين يتفاعلان عاطفياً واجتماعياً، انطلاقاً من بنية الزواج بين طرفين ينتمي أحدهما الى مرحلة الرشد واكتمال النمو فيما ينتمي الطرف الثاني، أي الزوجة، الى مرحلة الطفولة ونقصان النضج».
يقول مصدر قضائي في هذا الصدد، إنّ موضوع حماية القاصرات من الزواج المُبكر في لبنان هو موضوع شائك «نظراً الى طبيعة النظام الطائفي في لبنان والاختلاف الكبير في تحديد سن الزواج بين الطوائف والمذاهب وعدم وجود رقابة موحدة من أي سلطة على هذا الأمر».
تمييز جندري لدى المحاكم المسيحية
يصبّ القسم الأكبر من المعضلات التي تواجهها المرأة في المحاكم المسيحية في طول فترة حصولها على بطلان الزواج الذي تنطبق شروطه على الطرفين والحصول على النفقة. أما حرمانها من الأطفال، فمحدد في الحالات المنصوص عليها في القانون. وينطوي موضوع منحها الحضانة على شروط تمييزيّة لا تُطبق على الرجل مثل اشتراط «حسن السلوك» و«عدم الزواج». وكذلك، تعاني المرأة الخاضعة لقوانين الاحوال الشخصية المسيحية من تشريع زواج القاصرات واجبارها على الخضوع للرجل.
تختلف سنّ الزواج بين الطوائف المسيحيّة، إلا أنّ القاسم المشترك بينها هو تشريع زواج القاصرات؛ إذ تحدّده الطوائف الكاثوليكيّة بـ16 سنة للذكر و14 سنة للأنثى، فيما تحدّده طائفة الأرمن الأرثوذكس بـ 18 سنة للذكر و15 سنة للأنثى مع إمكانيّة الحصول على إذن خاصّ من المرجع الروحي لسبب مهمّ جداً يتيح للذكر الزواج في سن الـ16 والأنثى في سن الـ14 سنة. في المقابل، حدّدت طائفة الروم الأرثوذكس سن الزواج للذكر والأنثى بـ18 سنة، على أن يسمح بحالات خاصّة بزواج الذكر في سن 17 عاماً والأنثى في سن الـ15 عاماً بعد موافقة كلّ من ولي الأمر وراعي الأبرشية. أمّا طائفتا السريان الأرثوذكس والأشوريين، فقد سمحتا بالزواج للذكر في سن الـ18 والأنثى في سن الـ14.
التمييز في المحاكم المسيحية يطاول حقوق الزوجة وواجباتها، فطائفة الأرمن الأرثوذكس تُلزم الزوجة باتخاذ شهرة زوجها وعدم السماح لها بالعمل من دون موافقته، على أن يعود حقّ الولاية (أي السلطة الوالديّة الممنوحة للأهل على القاصر حتى بلوغه سنّ الرشد وتشمل إدارة الأموال والتربية) في كلّ الطوائف المسيحيّة، باستثناء طائفة الأرمن الأرثوذكس، إلى الأب بمفرده، إلا في حال منحها للأم أو سقطت عنه ومُنحت للمرأة مع اشتراط تمتعها بـ«أخلاق حسنة». أمّا بالنسبة للحضانة، فقد اخضعت كلّ الطوائف المسيحيّة الام لمجموعة من الشروط للحصول على هذا الحقّ الطبيعي المكرّس لها، مثل أن لا تعقد زواجاً جديداً، وأن لا تكون «سيئة السلوك»، فيما حصرت الحضانة لدى الطوائف الكاثوليكيّة في سنّ الرضاعة أي سنتين، على أن يكون للمحكمة الروحيّة سلطة استنسابيّة في تقرير هوية الحاضن وفقاً لما تقتضيه مصلحة الطفل. في المقابل حصرتها طائفة الأرثوذكس بسن الـ14 عاماً للذكر و15 عاماً للأنثى، وحدّدتها الطائفة الإنجيليّة بسن الـ12 للذكر والأنثى، فيما حدّدت بسن الـ7 للذكر والـ9 للأنثى لدى طوائف الأرمن الأرثوذكس والسريان الأرثوذكس والآشوريين.
تضاف إلى ذلك، مجموعة من المواد التمييزيّة بحق المرأة، مثل إجبارها على مساكنة زوجها والعودة إلى المنزل الزوجي، تحت طائلة حرمانها من النفقة والحضانة. ولدى طائفة السريان الأرثوذكس، تُحكم بدفع نفقة شهريّة للزوج توازي راتب عاملة في الخدمة المنزليّة في حالة «النشوز»، في مقابل حقّها برفع دعوى فسخ زواج بعد مضي خمس سنوات على ترك الزوج للمنزل، إضافة إلى تحديد مدّة العدّة بعشرة أشهر للمرأة و40 يوماً للرجل لدى السريان الأرثوذكس، واعتماد مدّة متساوية لدى الطوائف الأخرى (الطوائف الكاثوليكيّة لا تفرض العدّة)، وعدم اعتبار المحاكم الكاثوليكيّة الإساءة الزوجيّة سبباً كافياً لبطلان الزواج، مقابل إثبات المرأة أمام المحاكم الأرثوذكسية والإنجيليّة أن العنف يوازي محاولة القتل لإنهاء الزواج.

لحرب على الهيمنة الذكورية: هل يجب «تنقية» التيارات النسوية؟

أن يسمّي أحد ما نفسه «نسوياً» يختلف تماماً عن أن يكون «نسوياً». و«النسوية»، بمعزل عن أي شرح «ايتيمولوجي»، قبل الغرق في العرض والتأويل التاريخيين، ليست مرادفاً لـ«جمعية نسوية». للتيار نشأته وروافده وقدرته على الجرف وعلى التغيير والاقتلاع، وللجمعية دورها ووظيفتها التي تقرأ بتأنٍ، من دون أن تسبغ صفة «النسوية» على كل من يدّعي الاسم بإنجازات التيار أو بجِلدته. هذه البديهيات ليست مدخلاً لمحاسبة «الجمعية النسوية»، إنما مدخل لنقاشٍ هادئ

ليس سهلاً أن تُقرأ التجربة النسوية في بلادنا، أو أن تُجترح محاولات لقراءتها «خارج المكان»، على منهج إدوار سعيد. أي محاولة من هذا النوع، قد تؤدي ــ بسبب سوء نية البعض ــ إلى الخلط بين هذا المنهج، وبين الخطاب الذكوري المهيمن الذي يستعين بدورهِ بأدوات الماضي للحفاظ على المكتسب القميء: السُلطة.
لكن، هل هناك «ذكورية» تعمل تحت غطاء الخطاب الما بعد كولونيالي أو تتأثر بهِ؟ نتحدث عن خطورة أي خطاب يرسخ البنية الاجتماعية ويمدها بالقوة والقدرة على مقاومة التغيير. سؤال أكثر وضوحاً: هل هناك «نسوية» لا تنتبه إلى هذا الخطاب، أو تخضع إليه خضوعاً تاماً، فترتدي ثوباً نسوياً ظاهرياً أو «ظواهرياً»، بينما يكون أهمُّ نتائجِ أفعالها هو إسقاط نظام هيمنة تحت ذريعة وجود نظام آخر؟ (أحلام مستغانمي في الأدب، جمانة حداد في المسرح) آنيا لومبا، ربما لديها الإجابة. فلنقل، الطريق إلى الإجابة. تحذّر الكاتبة الهندية من أنه أثناء البحث عن المرجعيات الفكرية المستخدمة لتأسيس خطاب ما بعد الكولونيالية، وخلال محاولة تفسير مدى تشابك هذه المرجعيات واتصالها على مستويين أساسيين (التأويل والتحليل)، يجب الانتباه إلى أن «رصف» هذه المرجعيات على قاعدة واحدة ــ رغم تعارضها فكرياً وابستمولوجياً ــ قد يؤدي إلى تشتت منهجي.
لماذا يبقى الباحثون الأوروبيون الذين اشتغلوا خلال فترة الاستعمار هم المسؤولين عن إنتاج معرفة تتماشى مع الصورة التي رسمتها المجتمعات الغربية عن الشعوب التي سيطرت عليها؟ يركّز الاستشراق على أن هذه الأمم، المُستَعمرة، ظلت في هامش الحداثة الغربية. وعندما يُقال في لبنان مثلاً، بخِفة، إن «الكوتا ضرورية»، في البرلمان وفي الحكومة، لأنه «في السويد هكذا هو الوضع» وفي «فرنسا هكذا هو الوضع»، فإن قياس الهيمنة الذكورية في هذه الحالة هو قياس «ما بعد كولونيالي». للنساء العربيات أدوارهن ونضالاتهن في المجتمع وفي المقاومة، وهي من ضمن النضال النسوي لا خارجه. وهذه الأدوار والنضالات التي تبقى في العتمة لأنها لا تؤاتي «العقل الغربي» وتصوراته، لا تلغي حق المرأة في الوصول، أو في تجاوز المواقع التي تصلها المرأة الأوروبية، وضرورة استمرار النضال النسوي وزيادة وتيرته. لكن في المنهج، وفي القياس، يجب إعادة الاعتبار للأنتروبولوجيا، ولنبذ العنصرية والفوقية الغربية، لأن الخطاب سرعان ما يتحول إلى سُلطة.

سُلطة فوق سُلطة، ويعيد النظام البطريركي إعادة إنتاج قوته مستغلاً «سوء الفهم» الكبير. أبسط مثال على ذلك، افتقار (معظم) الجمعيات، ويمكن القول «التيارات» النسوية، في لبنان، إلى فهم «ابتسمولوجي» للدين، خارج الإنتاج الغربي الاستشراقي لهذا الدين، وعدم إيلاء هذا الأمر أي أهمية. لقد أبرز ميشال فوكو كيفية تحوّل الخطاب إلى ُسلطة عبر مجموعة من القنوات التي تبثها الدولة في مختلف مؤسساتها لتشكيل الذات وفق ايديولوجيتها المسبقة، وتثبيت سيطرتها، لكن إدوار سعيد استلهم بدوره هذا الإبدال المعرفي الفوكوي، واستثمره في توصيف كيفية تحوّل الخطاب الاستشراقي الغربي المتدثر بالتعالي والإقصاء للآخر إلى تقاليد ناجزة، ومسلمات قبلية يلتهمها كل غارق في الثقافة الأوروبية من دون أي تشكيك أو مساءلة.

أدوار ونضالات تبقى في العتمة لأنها لا تؤاتي «العقل الغربي»

لا يعني ذلك اتهام «التيارات النسوية» بأنها لا تسائِل «الثقافة الأوروبية»، أو القول إن الثقافة الأوروبية هي التي أنتجت الوعي النسوي. فذلك لا يكون إلا تطبيقاً حرفياً للاستشراق. وفي نهاية الأمر، الثقافات متداخلة في ما بينها، ومساراتها هجينة على نحوٍ معقد، ومتلاقحة بين بعضها البعض، إلى درجة أنه لا يمكن الفصل في ما بينها. لكن المرأة (العربية) التي خضعت للاستعمار وللاحتلال، قاومت وقاتلت، مِثلها مِثل المرأة التي تعمل، من دون أن يكون هذا محصوراً بتمثيلات جغرافية على النمط الاستعماري. وكلما جُرد الشرق من تاريخيته، وتحول مجموعة نصوص متخيّلة تتغذى بتقاليد تتكدس لتشكّل تمثيلاً خاطئاً له، حظي الخطاب الغربي الاستعماري بالمنافذ لاستعباده، تحت ذريعة «الحضارة»، حاملاً مشعل «المدنية الحديثة».
في الحرب على الهيمنة الذكورية، هل يجب «تنقية» التيارات النسوية؟ ربما. في كتاب شولاميث فايرستون «العجيب» (جدلية الجنس)، إشارة (واحدة) مفيدة إلى كارل ماركس، وإشارته إلى «العائلة» التي تضم كل بذور التناقضات القابلة للاتساع والتمدد في الدولة وفي المجتمع. «ثوري»، ويجب على الثورة أن تأكل في طريقها البنى الاجتماعية للنظام الأبوي، وتجنب إعادة إنتاج هذه البنى في أشكال متعددة للاستغلال، وربما العودة إلى «مفهوم غرامشي» عن الهيمنة. يشدد المفكر الإيطالي على ضرورة كشف الاستراتيجيات التي تعتمدها الدولة في إيهام الطبقات الاجتماعية، وخاصةً منها المهمشة، بأن مصالحها هي مصالح الجميع، مستثمرة بذلك قوة ضمنية أكثر نظاماً وشمولية تتجاوز الاقتصاد وأجهزة الدولة المباشرة، ويقصد التعليم والإعلام. وفي العصر «النيوليبرالي»، الما بعد غرامشي، يمكن أن نضيف... «المجتمع المدني».

افتتحت «مؤسسة مي شدياق» مؤتمرها السنوي، بعنوان «نساء على خطوط المواجهة»، في فندق «فينيسيا»، برعاية رئيس مجلس الوزراء سعد الحريري ممثلاً بوزير الدولة لشؤون المرأة جان أوغاسابيان، وحضور الرئيس أمين الجميل، وزير الصحة غسان حاصباني ممثلاً رئيس حزب القوات اللبنانية سمير جعجع، وزير التربية والتعليم العالي مروان حمادة، وزير الشؤون الاجتماعية بيار بو عاصي، السفيرة الأميركية اليزابيت ريتشارد، السفير البريطاني هيوغو شورتر، النائبين عاطف مجدلاني ورياض رحال، ممثل النائب سامي الجميل الوزير السابق آلان حكيم، الوزيرة السابقة وفاء الضيقة حمزة، نائب رئيس «مؤسسة الوليد بن طلال الإنسانية» الوزيرة السابقة ليلى الصلح حمادة، السيدة منى الهراوي، السيدة نورا جنبلاط، وفاعليات.

شدياق

وأشارت رئيسة المؤسسة مي شدياق الى «أننا نتغنى بأننا أعطينا المرأة حقها في التصويت والاقتراع بحرية في الانتخابات خلال عام 1952، فهل يعقل أن يحل لبنان عالمياً بالمراتب العشر الأخيرة في الـ2017 لناحية تمثيل المرأة في البرلمان بمشاركة لا تتعدى 3 في المئة؟ لكن شكوى المرأة في لبنان لا تقتصر على مستوى التمثيل السياسي، فبعد مرور 70 عاماً على النصوص والمعاهدات، يبقى قانون الأحوال الشخصية التابع لأهواء المراجع الدينية علة العلل»، داعية الى «تطبيق معاهدة CEDAW التي صدق عليها لبنان في عام 1996 وكل الاتفاقيات الدولية التي تهدف الى إلغاء كل أشكال التمييز ضد المرأة».

الصلح حمادة

وقالت الصلح حمادة: «المرأة قوية في لبنان انتخبت قبل المرأة الأوروبية واليوم نائب، قاضية، طبيبة، حطمت قيود وطنها، عندما تظاهرت وأسفرت سنة 1943 في سبيل استقلاله، فحطم لها قيودها لكننا نطالبها بالتريث بالنسبة للجنسية لأولادها فلبنان وضعه السياسي صعب فلا هو دولة ولا اللبناني مواطن، ونحن نرفض التوطين من أي نوع هو، ومن أي باب أتى، خصوصاً بعد اجتياح مليوني نازح سوري لأرضه ولا مطالب سياسي باسترجاعهم ولا راغب في إرسالهم، وقوى أممية تسعى لإبقائهم، فالاستقرار الموقت الذي ننعم فيه يعود الى وجودهم. هذه هي المعادلة القاتلة».

أوغاسابيان

وأشار أوغاسابيان الى أن «المرأة ثروة وقد تمكنت من تحقيق النجاحات في القطاعين العام والخاص، فلماذا هذه الثروة لا تُستغل؟ إن القطاع العام في حاجة الى هذه النجاحات، والمرأة بمقدورها أن تساهم في تقدم لبنان وازدهاره سواء في مجلس الوزراء أو مجلس النواب أو المؤسسات الأخرى، ونحن بحاجة الى هذه الطاقات ليس بهدف الترف السياسي وإنما هذه هي الحقيقة، فمن هنا مطالبتنا بالكوتا كمرحلة انتقالية».

ريتشارد

واعتبرت ريتشارد أن «عنوان المؤتمر يأتي في وقت مهم، ولبنان تمكن من انتخاب رئيس بعد سنتين ونصف من الشغور الرئاسي واليوم لديه حكومة جديدة وسوف يجري انتخابات برلمانية قريباً»، لافتة الى أنه «في يوم المرأة العالمي، نتطلع الى الإنجازات التي تحققت. المرأة تجسد الالتزام والشجاعة»، مشددة على «أهمية التغيير الذي يأتي من الأسفل الى الأعلى وعليه كانت المرأة هي عنصر فعال في هذا التغيير».

وتوالت على الكلام كل من: رئيسة الاتحاد التونسي للصناعة والتجارة والحرف اليدوية ويداد بوشماوي الحاصلة على جائزة نوبل للسلام عام 2015، النائب ديبورا بيرغاميني العضو في الجمعية البرلمانية لمجلس أوروبا المتحدثة باسم فورزا إيطاليا، الوزيرة السابقة ومستشارة رئيس الحكومة السريلانكية روزي سيناناياكي، وزيرة التضامن الاجتماعي في مصر غادة والي، وزيرة مصر السابقة لشؤون البيئة ليلى إسكندر، النائب السابق دوريس باك، رئيسة مجلس الأمناء لمركز سرطان الأطفال ورئيسة مؤسسة كياني نورا جنبلاط، رئيسة مؤسسة الملك حسين للسرطان الأميرة غيدا طلال، المرشحة السابقة لرئاسة الجمهورية الصومالية فلدومو دايب وسوكي فولير مؤسسة Miribure، ورئيسة مجلس الإدارة والرئيسة التنفيذية لـFrance Medias Monde ماري كريستين ساراغوس.

حلقات نقاش

تمحورت الحلقة الأولى حول «النساء في السياسة» حيث أشار شورتر، إلى أن «هذا النقاش يأتي في وقت مهم، إذ ينتظر لبنان ارتفاع عدد النساء في مواقع القرار، لا سيما مع وجود وزير يؤمن بالكوتا النسائية».

كما تحدثت فيها سيناناياكي والسياسية الألمانية ورئيسة EPP Women دورس باك، وبرغاميني، وبوشماوي، ومديرة العلاقات الدولية في Reagan House غينتاري ناركيفيسيوتي. وتناولت الحلقة الثانية موضوع انخراط المرأة في مجال العمل الإنساني، وتحدثت المشاركات عن أدوارهن في مجالات البيئة، التعليم، والأطفال وغيرها، وحاورهن الزميل ريكاردو كرم.

وتحدثت في الحلقة اسكندر وطلال وجنبلاط ونائب رئيس والمدير العام BLC Bank نديم كسار. وتطرقت الحلقة الثالثة الى انخراط النساء في عالم التكنولوجيا. تحدثت فيها مساعدة مدير عام BLC bank، وسوكي فولر، ورانيا شميطلي وميليسا جون رولي.

وادار النقاش غسان تلحوق.

أما اللاجئة السابقة وأول مرشحة لرئاسة الصومال فادومو دايب، فقد تحدثت عن تجربتها حيث حاورها الزميل ريكاردو كرم. 

ولفتت رئيسة مجلس الإدارة والرئيسة التنفيذية لـFrance Medias Monde ماري كريستين ساراغوس الى تجربتها، وحاورها زياد مخول. 

أما الفقرة الأخيرة، فكانت مع نساء مقاتلات وناجيات من الصراع في العراق أدلين بشهادتهن حول معاناتهن وحالات الرعب والاضطهاد التي مررن بها. وقد حاورهن الزميل بسام أبو زيد.

وتحدثت بافرين أوسو عن وقائع اختطافها وفتيات يازيديات أخريات من قبل «داعش» حيث تعرضن لشتى أشكال العنف واغتصبن وسلبن كراماتهن وأحلامهن. وأشارت لوما بادي الى مركز تأهيل الهاربات من عنف «داعش». 

ولفتت الكابتن في البشمركة مزدا رشيد الى أن «النساء الكرديات تقاومن الديكتاتوريات في المنطقة منذ عقود».
