SOLIDA has been active since 1996 in the struggle against arbitrary detention, enforced disappearance and the impunity of those perpetrating gross human violations.

L'orient le jour - Quelle alternative au système du garant au Liban ?, September 05, 2017

Chandra*, une employée de maison sri-lankaise, venue au Liban pour améliorer les conditions de vie des siens, a été expulsée il y a quelques mois, après un an passé au service d'une famille libanaise. Privée de nourriture par ses employeurs chez qui elle logeait, elle a refusé de renouveler son contrat pour une année de plus, comme prévu. « Mes patrons me disaient d'acheter à manger avec mon salaire. Ils me donnaient juste du pain et de l'eau. À la fin du mois, il ne me restait plus rien à envoyer à ma famille », confie-t-elle. Cette mère de famille aurait voulu rester au pays du Cèdre et changer d'employeur, car sa famille est dans le besoin. La jeune femme doit de plus rembourser la dette qu'elle a contractée au Sri Lanka auprès d'un agent de recrutement. Mais elle s'est vu opposer un refus catégorique de son patron et garant qui a gardé son passeport sous clé, refusant de la libérer au bénéfice d'un autre garant. Il a même exigé qu'elle aille au terme de son année de service, afin d'amortir les frais de recrutement, de permis de travail et de séjour. Reconduite alors à l'aéroport où son permis de séjour a été annulé, la jeune femme n'a eu d'autre choix que de rentrer chez elle, sans le moindre sou, pour se retrouver au chômage.
Chandra est une des nombreuses victimes du système du garant (sponsor, ou kafil), victime de travail forcé, de salaire amputé, de privation de nourriture, de chantage aussi. Elle est aussi victime de l'absence de législation pour la protéger en cas d'abus de la part de ses employeurs, à l'instar de la main-d'œuvre domestique.

Maîtres de leur propre destin
Deux expertes de l'Organisation internationale du travail (OIT) à Beyrouth, Sophia Kagan, conseillère technique en chef, et Zeina Mezher, coordinatrice nationale du programme Travailler en liberté, se penchent pour L'Orient-Le Jour sur une alternative au système du garant au Liban, afin de réduire la vulnérabilité et le trafic humain.
Idéalement, les employées de maison doivent être « couvertes par le code du travail ou par une loi qui reconnaît et protège leur statut de travailleuses », assurent les expertes. Leur embauche devrait se dérouler « sur base d'une offre de travail claire », comportant le salaire, les droits et les devoirs, le congé hebdomadaire... Elles devraient être « maîtres de leur propre destin », autrement dit « être libres de choisir leur lieu de résidence (chez leur employeur ou non), de changer de travail comme n'importe quel employé et d'effectuer elles-mêmes leurs formalités de séjour auprès des autorités ». Il est donc nécessaire « qu'une alternative soit trouvée au modèle de résidence chez l'employeur », d'autant qu'« aucun texte de loi n'impose à l'employée de maison étrangère de résider au domicile de son employeur ». Quant au « paiement du salaire, il devrait être soumis à un mécanisme de protection, compte tenu que 40 % des employeurs admettent ne pas payer à temps leur employée de maison », notent-elles. De plus, et afin de protéger les employeurs en cas de départ volontaire ou de fuite de leur travailleuse migrante, « une assurance de contrat pourrait être introduite, accordant une compensation à l'employeur lésé ».

Réticence d'employeurs
« Abolir le système du garant ? Jamais ! Il faudrait au contraire le préserver, mais l'accommoder pour le rendre compatible avec le respect des droits des travailleuses domestiques », soutient de son côté un employeur, qui requiert l'anonymat. « Compte tenu que ces femmes sont très pauvres et souvent ignorantes, elles n'ont pas les moyens financiers de vivre seules et risquent d'être entraînées dans des réseaux de prostitution », s'inquiète-t-il. Même refus de la part d'une employeuse : « Les nouvelles technologies aidant, une bonne partie des employées de maison savent ce qui les attend avant d'arriver au Liban. Certaines ont même discuté au préalable de leurs conditions d'embauche avec leur employeur. Elles savent qu'elles logeront sur leur lieu de travail et l'acceptent, car elles n'ont pas les moyens d'assumer un loyer », soutient-elle. Cette employeuse reconnaît toutefois que « la maltraitance est un problème » auquel il faut impérativement trouver une solution.
Le Liban n'est pas signataire de la convention 189 de l'OIT sur les travailleuses et travailleurs domestiques datant de 2011. Son code du travail exclut le travail domestique. Le pays a toutefois ratifié les deux conventions fondamentales contraignantes de l'organisation onusienne sur le travail forcé. Il est donc dans l'obligation de mettre un terme au travail forcé sur son sol. « Conscientes de la nécessité de changer les choses », les autorités promettent régulièrement de se pencher sur le dossier. Mais il est à parier que le système du garant ne sera pas aboli de sitôt, cette pratique ayant été implantée il y a plusieurs décennies par la Sûreté générale dans une volonté de contrôler la main-d'œuvre étrangère.
« Un projet concernant le processus de recrutement devrait en revanche voir le jour », révèlent les expertes. Fruit d'une collaboration entre les autorités libanaises et l'OIT, ce « système d'évaluation des agences, par e-gouvernance, serait basé sur le respect des droits des employées de maison migrantes ». Le cas échéant, ce serait un pas de taille vers un processus de recrutement plus transparent, qui pousserait employeurs et employées à devenir actifs à ce niveau. Car on ne peut espérer de changement pour les droits de la main-d'œuvre domestique au Liban que pas à pas.

The Daily Star - Ethiopian worker commits suicide in south Lebanon, June 30, 2017

An Ethiopian domestic worker threw herself off the balcony of her employment agency Thursday. Lebanese Red Cross workers collected her body and security forces opened an investigation to determine the cause of the woman’s suicide, a security source told The Daily Star. In 2007, a Human Rights Watch report estimated domestic workers in Lebanon – who commonly face abuse and exploitation – were dying at a rate of more than one per week. Earlier this month, another Ethiopian domestic worker was found dead, hanging from a tree branch in the south Lebanon town of Blida.

Al Akhbar- Lebanon deporting migrant workers with kids, April 26 , 2017

21 عاملة منزلية مُهاجرة، على الأقل، رحَّلهنَّ الأمن العام اللبناني منذ صيف 2016، وفق ما كشفه تقرير صدر أمس عن «هيومن رايتس ووتش». يُشير التقرير إلى عمليات اعتقال وترحيل تتعرّض لها العاملات المهاجرات بسبب إنجابهن أطفالاً في لبنان، مُسلِّطاً الضوء على انتهاك حق الحياة الأسرية للعاملات.
ويُصوّب التقرير على القرار الإداري المُتخّذ من قبل الأمن العام اللبناني، والمتعلّق بمنع العاملات من الإنجاب في لبنان عبر الامتناع عن تجديد إقامتهن الطويلة الأمد وإقامة أبنائهن.
تنقل المُنظّمة في هذا الصدد عن مؤسسة «إنسان»، أن السلطات اللبنانية رحّلت على الأقل 21 عاملة لديهن أطفال منذ صيف 2016. أما ذريعة السلطات اللبنانية، فهي أن العاملات «لم يكنّ يسكنّ لدى أصحاب عملهن، أو لم يكن من المفترض أن يُنجبن في لبنان»، في انتهاك فاضح لحق العاملات في الحياة الأسرية. ترى نائبة مديرة قسم الشرق الأوسط في «هيومن رايتس ووتش»، لما فقيه، أن العمل في لبنان لا يعني حرمان هؤلاء النسوة الحق في تأسيس أسرة، مُشيرةً إلى أن عمليات الترحيل هذه «تُسبّب اضطرابات في الحياة الأسرية (...) وهي بمثابة عقاب للعاملات من دون سبب».
هذا الأمر يتقاطع وشهادات ثلاث عاملات منزليات مهاجرات لديهن أطفال جرى ترحيلهن. هذه الشهادات سلطت الضوء على الأثر النفسي الكبير و«المُدمّر» على حياتهن، بدءاً من منعهن من العمل وفصلهن عن عائلتهن، وصولاً إلى توقيف تعليم أطفالهن. الجدير ذكره أن العاملات، شأنهن شأن الكثير من العاملات الأخريات، عشن في لبنان منذ عقود مع أطفالهن، قبل أن تقرر السلطات اللبنانية ترحيلهن ومنعهن من العيش في لبنان.
مثلاً، مونيكا عملت في لبنان لأكثر منذ 20 عاماً، اعتقلت أوائل عام 2017 ورُحِّلت مع ابنتها البالغة من العمر 16 عاماً. تقول اليوم لـ «هيومن رايتس ووتش»، إن حياتها باتت صعبة، وإن «تدبّر الطعام في الهند، بلدها، صار صعباً أيضاً. ليس لدينا عمل. وابنتي ليست في المدرسة».

يجب عدم التعامل مع إنجاب طفل في لبنان على أنه جريمة

بدورها تتساءل كوماري، وهي عاملة منزلية مهاجرة عملت في لبنان لمدة 30 عاماً واحتجزت في كانون الأول الماضي: «ماذا فعلنا؟ هل سرقنا؟ هل قتلنا؟»، مُشيرة إلى أنها عملت وزوجها كي تضع أطفالها في المدرسة في لبنان.
بحسب التقرير، توقفت عمليات الاعتقال وترحيل العاملات بنحو لافت في صيف 2015، «لكن يبدو أنها استؤنفت صيف 2016، حيث استدعيت عشرات العاملات المنزليات الوافدات مع الأطفال إلى مكاتب الأمن العام، ثم احتُجزن أو حُرمن تجديد الإقامة». وعندما راسلت المنظمة مديرية الأمن العام اللبناني للوقوف على هذه الإجراءات، ردّت الأخيرة بالقول: «المديرية العامة للأمن العام لم تُرحِّل أي عاملة في الخدمة المنزلية لديها طفل/أطفال في لبنان وهي ترغب في اصطحابه/م معها (..)، ولكن في ما يتعلق بإنجاب العاملة المنزلية الوافدة في لبنان، فإن هذه المسألة يصعب أن تتحقق دون سلسلة من المخالفات للقوانين والأنظمة». وأضافت المُديرية: «إنّ التمادي في مخالفة القوانين المرعية الإجراء، في أي بلد كان، سترتد نتيجته الحتمية على فاعله». لم يكن هذا البيان مفهوماً بالنسبة إلى المنظمة التي عاودت مراسلة المديرية، طالبة توضيح مقصدها، إلا أن الأخيرة لم تعاود بدورها الإجابة عن مراسلة المنظمة. من هنا، طالبت المنظّمة الأمن العام اللبناني بـ«نشر سياسته الحالية في ما يتعلّق بالعاملات المنزليات الوافدات اللاتي لديهن أطفال». وذكّرت المنظّمة إقدام السلطات اللبنانية في السابق على ترحيل عاملات منزليات لأسباب «تبدو تعسفية»، مُستذكرة حادثة ترحيل العاملة النيبالية سوجانا رانا، عضوة نقابة العاملات والعمال في الخدمة المنزلية.
كذلك ذكّرت كيف أنها (المنظمة) كانت قد خلصت عام 2010 إلى أن القضاء اللبناني «لا يُحاسب أصحاب العمل عن الانتهاكات التي تتعرّض لها العاملات»، وأنها خلصت عام 2008 أيضاً إلى أن عاملة واحدة تنتحر أسبوعياً في لبنان، وأن محاولة الفرار تكون السبب الرئيسي وراء الانتحار. انطلقت من سرد هذه الوقائع لتشير إلى الواقع التعسفي الذي تعيشه العاملات المنزليات ولتطالب الحكومة اللبنانية بالامتثال لالتزاماتها الدولية «بضمان أن يأخذ الأمن العام المصالح العائلية والمصالح الفضلى للطفل بالاعتبار قبل رفض تجديد الإقامة للعاملات أو لأطفالهن أو النظر في طردهم»، مُشيرة إلى أن لبنان ملزم بموجب المادة 23 من «العهد الدولي الخاص بالحقوق المدنية والسياسية» باحترام حقوق الرجل والمرأة في سنّ الزواج بالزواج وتأسيس عائلة. بدورها قالت فقيه إنّ «على السلطات اللبنانية التوقف فوراً عن ترحيل أو احتجاز عاملات المنازل المهاجرات لإنجابهن أطفالاً في لبنان. ويجب عدم التعامل مع إنجاب طفل في لبنان على أنه جريمة والسماح للناس الذين يأتون إلى لبنان لرعاية المواطنين اللبنانيين لسنوات، بأن يكون لهم عائلات أيضاً».

BEIRUT: After a lull throughout most of 2015 and 2016, General Security has resumed deporting foreign domestic workers who have had children in Lebanon, Human Rights Watch reported Tuesday. Since last summer, Lebanese authorities have reportedly detained at least 21 migrant domestic workers with children, claiming that the workers had given birth in the country, were not living with their employers or both.
“We have been receiving a lot of cases like this recently,” Roula Hamati, a researcher at the migrant rights advocacy group Insan Association told The Daily Star.
According to a Human Rights Watch statement, none of the detained women had violated the technical rules or terms of their visas by working for multiple employers.
When contacted for comment, a source at General Security would not discuss the allegation that the directorate is deporting workers purely on the basis of having had a child while in Lebanon. However, he noted that there were many rules that currently govern how foreign workers are allowed to live in the country
Moreover, the source dismissed the severity of the allegation, claiming that most domestic workers come to Lebanon alone. “I don’t think it’s a big problem,” the source said. “If they are married, they will come alone. They will leave the children with others in their home country, with their husband or family.”
The source also noted that, in their opinion, Lebanese families would be unlikely to continue to sponsor migrant workers with children. “In that situation they would be responsible for feeding and paying for more people.”
Human Rights Watch reported that in a statement sent to them last week, General Security said that while they would not deport domestic workers who brought children with them, giving birth to a child in Lebanon would, for a migrant domestic worker, “be difficult to achieve without violating many laws and regulations.”
In a previous interview with The Daily Star, General Security head Maj. Gen. Abbas Ibrahim expressed similar sentiments. “There is a law and a system in Lebanon and there are residency conditions for foreigners,” he said. “It is our duty to deport anyone who violates these conditions.”
But according to Bassam Khawaja, a Lebanon researcher at Human Rights Watch, there is little information available as to why exactly General Security restarted deportations of this particular category of workers. The legal authority security forces are acting under is also unclear and General Security has not disclosed the exact nature of the infraction.
“Part of it comes from a mentality where there is an enormous amount of control exerted over domestic workers’ lives,” Khawaja told The Daily Star – even in instances where there is no legal obligation to do so. “Employers feel like they have the authority to have control over fundamental life decisions – children, relationships, family,” Khawaja said.
He highlighted examples, including the de-facto requirement that domestic workers live in the houses of their employers, despite the fact that there is no law requiring them to do so. “General Security enforces that requirement,” he said.
Insan’s Hamati corroborated the strange legal territory that many domestic workers find themselves in. “These are not laws. There’s nothing in the law that says domestic workers can’t have kids in Lebanon,” she said. “This was all done in a private way. General Security told us that there was a directive to deport people, but the law does not require that they do that.”
Regardless of the legality of the situation, Khawaja said, the effects of enforcement have been dramatic. “This is really destructive for people’s lives on a fundamental level,” he said. “Kids are out of school, families are split up and people are out of work. There’s an enormous amount of pain and sadness, really for nothing.”

The Daily Star- Lebanon extradites domestic worker rights organizer: HRW, December 14 , 2016

BEIRUT: Lebanese authorities deported over the weekend a migrant domestic worker’s rights activist, Human Rights Watch said.
Sujana Rana, a Nepalese domestic worker, was been arrested on November 30 at her employer’s house by General Security for questioning about her activism for the rights of domestic workers in Lebanon, the rights organization said in a statement issued Wednesday.
“[It’s] a shortsighted move that will undermine the fight for equal rights in Lebanon,” HRW said.
Lebanese authorities later arrested a second Nepalese migrant domestic worker, Roja Limbu, on December 5. Both were denied access to a lawyer.
Limbu, according to HRW, remains in detention.
HRW and several other rights organizations denounced the move and called on authorities to both workers to appeal their deportation.
Rana and Limbu are members of the domestic workers’ union in Lebanon and have legal status and work authorization. The union operates informally as a forum for advocacy of migrant domestic workers rights after the Labor Ministry in 2015 refused to recognize the union.
Lebanon has an estimated 250,000 migrant domestic workers.
Reports by HRW and other organizations have found that the majority of domestic workers in Lebanon have been subjected to illegal practices such as having their passports confiscated by their employers and not receiving any time off.
Several reports have also indicated that foreign domestic workers suffer from inadequate salaries, lack of basic worker’s rights, physical abuse and isolation, which in extreme cases have led to domestic workers taking their own lives.
The relationship between migrant domestic workers and the employer is controlled by a sponsorship system, known as kafala.
The system ties the worker's residence permit to one specific employer or sponsor in Lebanon.
It has been long criticized by activists, who argue that it encourages inequality and opens the door to abuse.

BEIRUT: In an attempt to improve relations between domestic workers and employers and help cut the widespread abuse of live-in help in Lebanon, a new social organization opened last month to bring both parties to the table. “We’re not here to say the whole idea of domestic work is wrong. Fine, we need it and we value the help, but let’s make ... it comfortable,” Leena Ksaifi, founder of social enterprise Equip, explained. The initiative seeks to “professionalize” and ensure “positive employment relationships” between domestic workers and employers. “We know that abuse [of domestic workers] is widespread, we know it is common for domestic workers to terminate contracts, but [at Equip] we never dichotomize domestic workers and employers into good or bad,” Ksaifi said.
Domestic workers in Lebanon face widespread abuse and many die while in employment. The Ethiopian Embassy Sunday received the remains of two of their nationals who died from carbon monoxide poisoning, state media reported. A third worker was found alive, but in a critical condition and was admitted to the Notre Dame Maritime Hospital in Jbeil for treatment.
Domestic workers are often employed in slave-like conditions, and many have their passports confiscated, work with few breaks or days off, and have pay withheld. Those who leave abusive employers face an uphill battle for justice, pay owed, or the cost to return to their country of origin. Several countries have barred their citizens seeking employment in Lebanon.
To help improve relations between domestic workers and employers, Equip offers services such as document management, worker orientation, dispute mediation and organized outings. The latter, Ksaifi said, is essential as it allows workers to enjoy their freedom while easing fears many employers have that their live-in worker may run away.
Ksaifi, a former consultant for the International Labor Organization, wrote her master’s thesis on migrant worker abuse in Lebanon. While doing research, Ksaifi noticed “a gap in work by organizations to reach out and involve two [major] stakeholders [recruitment agencies and employers].” While many organizations offer support for workers who have suffered abuse, Ksaifi found that few entities work to pre-emptively prevent abuse taking place.
“This is the gap Equip is trying to fill,” she explained. With a team of “community leaders” consisting of veteran migrant workers and Lebanese nationals, Equip aims to tackle the widespread problem, attempting to implement new social norms without pointing blame.
Since its launch, Equip’s clientele has mostly been “young and open-minded,” eager to find a solution to their problems. “People are paying thousands of dollars to recruitment agencies to find a live-in worker, but at the end of the day they only have luck and chance to ensure a good relationship,” Ksaifi explained.
While she did admit some initial limitations to the project, she expressed hope that it can facilitate a cultural shift in worker-employer relationships. “People who are coming to us aren’t going to be the ones who [repeatedly] abuse their live-in helper. They’re the ones who want [sustainable] solutions.” But Ksaifi hopes Equip will be the “go-to” center for recruitment agencies when their clients begin to face problems.
Although new, she said they have had good feedback from several agencies they have approached, though not all have been interested in the services offered. “I don’t think this organization would be useful for us,” a representative from recruitment agency Hasnaa Services told The Daily Star. The representative said that they have their own policy for conflict resolution, a high-retention rate of placed domestic workers, and added that it provides temporary housing for domestic workers who have been “rejected” by employers.
Ksaifi explained that this is not the case for many recruitment agencies in the country. “Many agencies just lock domestic workers in their offices while they find them a new home,” she said. In a recent crackdown on substandard recruiters, Lebanon’s Labor Ministry canceled the licenses of 171 domestic-worker agencies and suspended 23 others.
Equip’s attempts to improve the relationships between employers and domestic workers reflects Ksaifi’s broader goals of introducing new norms into Lebanese society. “We keep talking about how Lebanon needs to change ... let us be the change, and let the change start in our homes.”

The Daily Star- Ethiopian Embassy in Beirut receives bodies of two nationals, December 03 , 2016

BEIRUT: The Ethiopian Embassy received the bodies of two of its nationals who died earlier in the day from carbon monoxide poisoning in north of Beirut, state media reported Saturday.
Civil Defense medics earlier had taken the bodies to Bouar public hospital, but they were turned away. Private hospitals in the area also would not accept the women's bodies.
A third worker was found alive but in critical condition, however, and was admitted to Notre Dame Maritime Hospital in Jbeil for treatment.
Police and a forensic expert arrived at the scene to conduct an investigation.

The Daily Star- Companies sacked more than 100 employees: Lebanon Labor Ministry, December 02 , 2016

BEIRUT: The Labor Ministry Friday said that around 100 employees working at Lebanon-based companies were at risk of losing their jobs due to the deteriorating financial situation.
The ministry said six companies informed the ministry of their intentions to lay off 38 employees, citing deteriorating financial and economic circumstances.
The Danish Refugee Council also told the ministry that it planned to terminate the contracts of 60 employees, including 45 Lebanese, 14 Palestinians and a Syrian.
Another company said its financial situation had forced it to fire four of its employees, all of whom had been working there for more than 10 years. The company refused to enter a compromise with the ministry that guarantees the rights of its fired employees, the ministry statement said.
According to Article 50, section C of the Labor Law, employers are required to give one month's notice before firing an employee if they have worked for three years. Employers are required to give two months' notice if the employee has worked between three and six years, three months if their employment lasted between six and 12 years and four months if they have been employed for more than 12 years.
The ministry reiterated a warning to companies and institutions in Lebanon from firing Lebanese employees in favor of foreign workers, in particular Syrians.
Refugees and foreign workers tend to accept significantly lower wages than Lebanese citizens.
In August, the Labor Ministry announced that it would take stricter measures against forced layoffs to replace Lebanese with foreigners.
The ministry previously announced that violating companies will be fined up to LL2,500,000 ($1,659), up from the previous LL250,000 penalty. They must pay the fine within 15 days or face additional charges.
Around 10,000 Lebanese nationals have been forced from their jobs and were replaced with "foreigners" over the past year, according to caretaker Labor Minister Sejaan Azzi

5 أمتار مربعة هي متوسط المساحة التي يظن المهندسون المعماريون والعائلات اللبنانية أنها تكفي لتقطن فيها عاملة في الخدمة المنزلية. هكذا، يترجم هؤلاء عنصريتهم الهندسية تجاه العمال الأجانب، وتحديداً العاملات في الخدمة المنزلية، بحيث يتم "رميهنّ" في غرف منعزلة، ضيقة وخالية من النوافذ كانت بالأساس مخصصة لأن تكون غرف تخزين أو غرف غسيل، وبالتالي غير مؤهلة للسكن.
التصميم الهندسي لغرف العاملات في المشاريع التي تُبنى حالياً، ينطوي على عنصرية مخيفة تعكس معاني جدية في تعزيز نبذ هذه الفئة، وهذه الهندسة العنصرية ترتكز على قانون البناء اللبناني الذي يجسّد، عبر ممارسات معينة في مجال العمارة اللبنانية المعاصرة، مظاهر ملموسة من العنصرية المؤسساتية ضد عاملات المنازل الأجنبيات.

التصميم الهندسي لغرف العاملات ينطوي على عنصرية مخيفة
فإقصاء عاملات المنازل من قانون العمل ينعكس بإقصائهنّ أيضاً من الحصول على مساحات سكنية لائقة ضمن فئة واسعة من المباني المخصصة للسكن، وفق ما ينطلق منه المهندس المعماري باسم سعد في دراسة له بعنوان "5 أمتار مربعة لغرفة عاملة المنزل: العنصرية اللبنانية والنوع الاجتماعي في العمارة ــ فشل الهندسة المعمارية". تتعمق دراسة سعد بالحالة اللبنانية لسببين أساسيين هما: أولاً أن حصة الفرد من المساحة تعتبر من أدنى المعدلات في العالم، وثانياً قانون البناء النيوليبرالي الذي يتعمد تغليب المصلحة المادية للمطور العقاري على حساب نوعية بيئة البناء. فالمباني السكنية الخاصة و"الفيلات" البورجوازية هي "مواقع أساسية لمزيج واقعي من الذوق المحلي والحد الأقصى من استغلال مساحة الأرض، مع خلفية من قانون عنصري، ينتج منها مساحات سكن للعمال والعاملات تكون في أحسن الأحوال دون المستوى المطلوب، وغالباً ما تكون ظالمة".
تظهر الخرائط التي أخذها سعد من مشروعين سكنيين لا يزالان قيد البناء، نموذجين متباعدين من الممارسات. الأول يمثل النموذج "السخي" الذي يعدّ، للأسف، أفضل سيناريو حالي يمكن للعاملة أن تتطلع إليه في المشاريع المشيدة حديثاً، حيث قام المهندس بتوفير غرفة بمساحة 5.2 أمتار مربعة مع نافذة لائقة، من أصل 187 متراً مربعاً أي ما يقارب 2.87% فقط من مساحة الشقة.أمّا الحالة الثانية فتشكل أفضل مثال توضيحي للتصميم غير الإنساني الذي "يتفنن" بإخفاء غرف العمال عن الأنظار قدر الإمكان. نتحدث هنا عن ممر مؤدّ إلى غرفة العاملة، مغلق بأبواب عند طرفيه، يصل إلى غرفة الغسيل ويليها غرفة العاملة، أي ليس إلى غرفة العاملة مباشرة. جدار غرفة الغسيل ينحرف الى الداخل من أجل إفساح المجال لنافذة غير مباشرة لغرفة العاملة بمساحة تقل عن 50 سنتمتراً. تبلغ مساحة الغرفة 5.2 أمتار مربعة من أصل 531 متراً مربعاً أي أقل من 1% من مساحة البناء! هذه الحالة بالذات هي، بأي شكل من الأشكال، وضع شاذ، لكنها تلتزم بالاتفاقيات اللبنانية الرسمية الحالية، وفق الدراسة.
فالمعماريون والمطورون والعملاء يرون أن المساحات السكنية المخصصة لعاملات المنازل تنتمي الى "فئة العناصر ذات صلة الخدمة غير الجمالية في التصميم التي يجب أن تكون مخبأة بذكاء وراء عدة طبقات من الهندسة المعمارية لضمان أن يتم تقديمها على أنها غير واضحة ومعزولة قدر الإمكان". وعليه، انطلاقاً من مفهوم فوكو لـ"الهيتيروتوبيا" أو النبذ، تثبت هذه الدراسة أن غرف عاملات المنازل تعتبر مجموعة فرعية من "النبذ المنحرف"، أو بمعنى أكثر تبسيطاً، تعتبر المساحات السكنية المخصصة لعمال المنازل مساحات منبوذة للأفراد الذين ينحرف سلوكهم عن السلوك المتعارف عليه في الوحدة التي يوجدون فيها، وفي هذه الحالة نتحدث عن الأسر اللبنانية التي تنتمي إلى الطبقة المتوسطة.
يصف سعد في دراسته كيف أن العاملة "توضع في هذا الموقع الهش، ما يعطيها بشكل تلقائي وضعية منحرفة بمجرد تحديد معايير ثقافية مختلفة. ثم يوضع هذا "الجسم الغريب" في غرف مخصصة له، صُمّمت بعد الأخذ بالاعتبار هوية وطبقة الشخص الذي سيعيش فيها. المسار المعقد الذي يقود الى غرف العاملات عبر المطبخ وغرف الغسيل، والممرات الضيقة، يفصلهنّ بشكل لا لبس فيه عن الحالة العامة للسكان وعن كونهنّ أشخاصاً كاملين، ويرفقهنّ كملاحق لمناطق الخدمة".
قانون بناء عنصري
الإطار القانوني للعنصرية الهندسية يتجسّد وفق سعد في قانون البناء الذي يحتوي على عدة بنود تتعلق بسكن عاملات المنازل، أولها أن القانون "يشير إلى مساكن عاملات المنازل بتسمية "غرف للخدم" ويذهب أبعد من ذلك عبر التحدث عن "الخدم" بصفة المؤنث".

كذلك تندرج غرف عاملات المنازل في القانون مع مجموعة من النصوص التي تتحدث عن غرف التخزين وغرف الغسيل التي هي في المقام الأول غير مصممة لاحتواء الناس لفترات طويلة من الزمن. الغرض الأساسي من هذا الجمع، كما تشرح الدراسة، هو ترسيم الخطوط الدقيقة لأنواع الغرف التي لا تؤثر في النسبة العامة للاستثمار وذلك للسماح للمطورين بزيادة مساحات الغرف التي تضيف القيمة السوقية. ونتيجة لذلك، يوجد بند في القانون يحدد المساحة القصوى لغرف العمال ولكل هذه الأنواع من الغرف (التخزين، الغسيل..) بـ 8 أمتار مربعة.
تحدد الدراسة هدفاً آخر لهذا الجمع، وهو إعفاء هذه الغرف من موجب وجود نوافذ مفتوحة أي لا عوائق أمامها، وهنا يصبح القانون مشكلة فاقعة عندما ينص صراحة على أن الغرف المصممة للسكن البشري يجب أن يكون فيها نوافذ من دون عوائق، بعدما كان قد استثنى في الفقرة السابقة غرف عمال وعاملات المنازل من هذه الفئة!
هذه الاتجاهات المعمارية يصعب مواجهتها بسبب الممارسات الراسخة، والطبيعة المحددة من الفعل المعماري، والعمر الطبيعي للمباني. وعليه، يجب الاعتراف بآليات القهر التي يخلقها المطورون والعملاء والمهندسون المعماريون وإدراجها ضمن الجهود المبذولة لمكافحة العنصرية وإصلاح القوانين. التوصيف الدقيق لغرف العاملات يستنتجه سعد في ختام دراسته: كهوف داخل المنازل!

BEIRUT: The licenses of 171 domestic worker recruitment agencies were revoked Tuesday after Lebanon’s Labor Ministry launched a nationwide crackdown, investigating the methods and practices of agencies.
A further 23 agencies were temporarily suspended as a result of the ongoing investigation.
“This profession deals with humans and not the trade of items,” caretaker Labor Minister Sejaan Azzi said in a statement Tuesday.
The move comes as part of a campaign by Azzi to raise the quality of Lebanon’s agencies to meet international standards.
The 23 temporarily suspended agencies have been given three months to meet legal requirements.
The ministry called on the Union of Domestic Worker Recruitment Agencies to abide by the law and deal with domestic workers in a humanitarian manner, holding it responsible for any violations.
It also called on employers to treat domestic workers in a respectful manner, and to fully safeguard their rights.
“The problems are mainly with the illegal agencies that do not belong to the syndicate,” the statement said.
The ministry has received many complaints from domestic workers about how they are treated by their employers, as well as from households employing domestic workers.
Due to the high number of complaints, Azzi formed an advisory body to study the situation of the agencies. Following case studies and supervision, the advisory body presented the report to Azzi with a number of recommendations.
Lebanon has more than 700 licensed domestic worker recruitment agencies, but a Labor Ministry statement Tuesday said that just 441 meet legal standards.
Suicide among domestic worker is common with around one death a week reported in Lebanon, some countries have banned their citizens from working in Lebanon.
Recruitment offices have come under increased scrutiny in recent years for violating labor laws and exploiting the ‘kafala’ system that governs the status of foreign domestic workers who are brought into the country under the sponsorship of a Lebanese employer.

BEIRUT: A domestic worker hung herself in the Iqlim al-Kharroub town of Al-Burjain Friday in an apparent suicide, the state-run National News Agency reported. The Ethiopian worker, born in 1992, was found dead at the house of her employer F.K. Security forces arrived at the scene and opened an investigation. A coroner examined the body and declared the death a suicide. The incident comes after another migrant domestic worker died Monday at her employer’s home.

على الرغم من الشروط القانونية الدنيا المفروضة على أصحاب العمل، لا يَمنح إلا نصفهم يوم عطلةٍ أسبوعياً للعاملة المنزلية، ومن بين هؤلاء، لا يمنح إلا نصفهم العاملة حرية الذهاب أينما تشاء في ذلك اليوم.

وفي لبنان، 20 في المائة من أصحاب العمل يحبسون العاملات المنزليات المهاجرات داخل المنزل .

وعلى الرغم من أن القانون يحظر اقتطاع رسوم مرتفعة لوكالات التوظيف من العاملة، ويقول 40 في المائة من أصحاب العمل إنهم يقومون بذلك رغم أن أجور أغلب العاملات المنزليات المهاجرات متدنية، إذ يتقاضى 35 في المائة منهن أقل من 200 دولار شهرياً، في حين أن أكثر من 40 في المائة من أصحاب العمل لا يدفعون رواتب العمال بانتظامٍ في نهاية كل شهر.

69 في المائة من أصحاب العمل يوفرون غرفة نومٍ خاصة للعاملة، مع وجود فوارق كبيرة في هذه النسبة تبعاً لجنسياتهن. فعلى سبيل المثال، تتمتع 38 في المائة فقط من العاملات البنغلادشيات بغرفةٍ خاصة، فيما تنام الباقيات في المطبخ أو الشرفة أو غرفة المعيشة أو أي جزءٍ آخر من المنزل.هذه الخلاصات أكدتها دراسةٌ أجرتها منظمة العمل الدولية والجامعة الأمريكية في بيروت على أصحاب عملٍ تعمل لديهم عاملات منزليات مهاجرات عن انتشار انتهاكات حقوق العاملات المنزليات، لاسيما فيما يتعلق بعدم دفع أجورهن بانتظامٍ وعدم منحهن يوم راحةٍ كاملاً وحرمانهن من مغادرة المنزل.

ويتولى عدد من المختصين في معهد عصام فارس في الجامعة الأمريكية هذا الأسبوع مناقشة نتائج الدراسة التي استندت إلى مسحٍ شمل 1200 صاحب عملٍ تعمل لديهم عاملات منزليات مهاجرات، إضافة لثلاثين مقابلة معمقة أجريت في مراكز سكانية رئيسية في لبنان. وتكمل الدراسة الجديدة مسحاً سابقاً جرى عام 2015 على 1500 عاملة منزلية مهاجرة مقيمة في منزل صاحب العمل. وبناءً على مناقشاتٍ مكثفة مع المشاركين في الحدث، ستضع منظمة العمل الدولية والجامعة الأمريكية في بيروت توصيات التقرير على أن تُنشر في حينه.

Al diyar- Ethiopian worker raped and trying to commit suicide, September 21 , 2016

بتاريخ 8 /8/2016 ،دخل عامل لبناني لاجراء اعماله الترميمية ،داخل احدى المنازل وقام باغتصاب فتاة إثيوبية تعمل في المنزل الذي يقيم فيه شخصان مسنان ، وذلك عبر استدراج خادمة المنزل إلى الطابق العلوي وارغامها بالقوة على ممارسة الجنس،الامر الذي أدى بها بعد عملية الاغتصاب إلى محاولة الانتحار.

هذا الجرم الوحشي بحق ضحية اجنبية تعمل كخادمة في لبنان لاعالة اهلها ،كان للقضاء اللبناني الحكم الأولي العادل والصارم من جهة أنصاف الخادمة بعد لجوئها إلى النيابة العامة وتقديمها شكوى وقد تم توقيف المعتدي ،ومؤخرا صدر قرار ظني من قبل القاضية سمرندا نصار ،يتضمن ادعاء على العامل اللبناني بجرم المنصوص عنه في المادة 503 من قانون العقوبات (الاغتصاب ).
هذا القرار الصادر عن القاضية نصار أتى عادلا من جهة الاستماع إلى شهادة خادمة منزل أجنبية تروي عملية اغتصاب تعرضت لها من قبل عامل لبناني أثناء ممارسة عملها في المنزل ،كما تم الأخذ بعين الاعتبار الأزمة النفسية التي وقعت بها الخادمة بعد اغتصابها.
القاضية نصار أثبتت وقوف القضاء اللبناني إلى جانب الحلقة الأضعف،ما يعزز الثقة بقانون يحمي العامل الأجنبي حتى لو كان المدعى عليه ومرتكب الجريمة يحمل الجنسية اللبنانية.

كثرت في الآونة الأخيرة الدراسات حول الانتهاكات التي يتعرّض لها العمّال الأجانب في أماكن العمل، من عدم دفع الأجور إلى حجز وثائق السفر وفرض قيود على الحركة والتنقل والحياة الشخصية وصولاً إلى العنف الجسدي والمعنوي والتخويف والخداع. لم تكن التقارير والمعلومات التي فاضت بها الدراسات يوماً من نسج الخيال، إلا أنه كان ولا يزال من الصعب تصديقها، أو الإقرار بأنها تحدث فعلاً.
بالأمس، رفعت منظمة العمل الدولية الستار عن دراسة جديدة في هذا الإطار قدّمتها في «معهد عصام فارس» في الجامعة الأميركية في بيروت. حملت الدراسة عنوان «حقوق العمال المنزليين المهاجرين واقتصاد الرعاية في لبنان»، وجاءت ضمن برنامج «العمل بحريّة» الذي يتبنى نهجاً متكاملاً يهدف إلى الحدّ من ضعف النساء والفتيات الأجانب وحمايتهن من الوقوع ضحايا الاتجار بالبشر.
أقرّت الدراسة التي انطوت نتائجها على معطيات خطيرة، بوجود نوع من السخرة والاستعباد في نظام العمل في الدول العربية ولاسيما الأردن ولبنان.
كشفت منظمة العمل الدولية أن 12.3 مليوناً مما يقارب الـ21 مليون شخصٍ ضحايا العمل القسري والاتجار بالبشر موجودون في بلدان آسيا، مشيرةً إلى أن حوالي 55 في المئة من هؤلاء هم من النساء والفتيات. وأوضحت الدراسة أن العمّال الأجانب يتوزعون بكثافة في لبنان بين بيروت (50 في المئة) وجونية وجبيل (25 في المئة) وصيدا (25 في المئة)، وتتراوح أعمار النسبة الأكبر منهم ما بين 31 و40 عاماً (24.7 في المئة) وما بين 41 و50 عاماً (24.5 في المئة)، كما أن نسبة الإناث من بينهم تفوق نسبة الذكور (1.019 عاملة مقابل 181 عاملاً).
يأتي العمّال المهاجرون إلى لبنان من إثيوبيا بالدرجة الأولى بنسبة 42.1 في المئة، تليها 26.8 في المئة من بنغلادش و11.5 في المئة من الفيليبين. إلا أنهم يخضعون لظروف عمل قاسية ونظام كفالة مهين، يُجرّدهم من كافة حقوقهم ويجعل من عملهم أقرب إلى الاستعباد، وذلك في ظلّ مباركةٍ رسمية تُعفي أرباب العمل من أنواع المساءلة كافة.
وكشفت الدراسة أن 78.3 في المئة من أصحاب العمل يحصلون على نسخة من عقد العمل الذي يوقّع مع مكتب استقدام العمّال الأجانب، في حين أن 18.2 في المئة فقط من عمّال يحصلون عليه أو يطلعون على تفاصيله. فضلاً عن الفهم الخاطئ لمجمل بنود «نظام الكفالة» المجحف بحق العمّال، والذي اعتبره 57.5 من أصحاب العمل يدافع عن حقوقهم مقابل 29.9 في المئة وجدوا أنه يُلقي اللوم والمسؤولية الكاملة في الحفاظ على حياة العامل/ة على عاتقهم.
ويعتقد 43.6 في المئة من أصحاب العمل أن العقد يُجيز لهم «الاحتفاظ» بالعاملة لمدة ثلاث سنوات، في حين أن العمل به يتوقف بعد مرور عامٍ على بدء عمل العامل/ة.
وبحسب الدراسة فإن أكثر ما يُعاني منه العمّال هو غياب الجهة الضامنة والمدافعة عن حقوقهم، ما يجعلهم عرضة للاستغلال والعبودية بالأشكال كافة. كما أن 24 في المئة من أصحاب العمل لا يدفعون الراتب الشهري للعاملة داخل المنزل إلا عند سؤالها عنه، و14 في المئة يمتنعون عن الدفع نهائياً إلى حين انتهاء مدّة العقد معها. أما عن قيمة الراتب الشهري فحدّث ولا حرج. إذ أظهرت الدراسة أن 36 في المئة من العاملات يحصلن على أجرٍ لا تتعدّى قيمته 150 و199 دولاراً، و42 في المئة يتراوح أجرهن ما بين 200 و299 دولاراً، و14 في المئة يتراوح أجرهن بين 300 و399 دولاراً.
تلك الدراسة التي وجد فيها المحامي نزار صاغية من «المفكرة القانوينة» باباً لتقديم إخبارات متتالية إلى النيابات العامة ومطالبتها التحرك لإنصاف العاملات والعمال الأجانب، معتبراً أنها «دليلٌ قاطع على وجود نظام استعباد وسخرة في لبنان»، دفعت ممثلة وزارة العمل جومانة حيمور إلى الانسحاب من القاعة. اعترفت الأخيرة بكل خفة واستهتار بأن «الوزراة غير معنية بما يتم عرضه»، متذرعةً بأن «في البلاد أولويات، والحاضر على طاولة الوزارة الآن هو همّ النزوح السوري».
ما أدلت به ممثلة وزير العمل ربما يُثير امتعاض وزير الخارجية جبران باسيل، إذ هناك من بدأ يُنافسه في العنصرية والفوقيّة!
أرقام مهينة
أظهرت دراسة «حقوق العمال المنزليين المهاجرين واقتصاد الرعاية في لبنان» الصادرة عن منظمة العمل الدولية أنه يجري إلزام العاملات والعمال بالعمل ساعات إضافية من دون أي بدلٍ مادي يُذكر.
ووفق الدراسة، فإن 42 في المئة من العاملات يعملن 8 ساعات يومياً، مقابل 37 في المئة يعملن ما بين 8 و10 ساعات يومياً، و8 في المئة يعملن ما بين 10 و12 ساعة يومياً، و14 في المئة يعملن من 12 إلى 14 ساعة يومياً.
يُضاف إلى ذلك أن جزءاً كبيراً من أصحاب العمل يرفض الاعتراف بحق العاملة في الحصول على يوم عطلة، إذ وفق الدراسة فإن 57.3 في المئة من العاملات يعملن سبعة أيام متواصلة في الأسبوع. وفي حال سمح لها صاحب العمل بيوم راحة يمنعها من الخروج من المنزل (25 في المئة من العاملات ممنوعات من قضاء العطلة خارج منازل مخدوميهم)، بالإضافة إلى أن بعض أصحاب العمل يُقيّدن حريّة العاملة لدرجة اللجوء إلى إقفال الأبواب عليهن عند خروج العائلة من المنزل.
وحتى داخل المنزل لا تحظى العاملة بمعاملة لائقة، إذ إن 14 في المئة منهن يُرغَمن على النوم في غرفة الجلوس، و5 في المئة يخلدن إلى النوم داخل المطبخ، و4 في المئة ينمن في غرفة نوم الأطفال و4 في المئة على الشرفة.

BEIRUT: Labor Minister Sejaan Azzi has revealed that some 10,000 Lebanese laborers have been forced out of their jobs and have been replaced by foreign employees, mainly Syrians. In an interview with LBCI Saturday, Azzi blamed companies for the replacement of Lebanese workers.
“There is a huge, frightening case of firing Lebanese workers,” Azzi said. “The main reason [for their dismissal] is not due to the economic situation, but rather because Lebanese employees are being replaced by foreigners,” he added, referring to Syrian refugees.
The labor minister added that some companies were deliberately creating unfavorable circumstances for their Lebanese employees in an attempt to force them to submit their resignations. Azzi warned that his ministry would be referring companies replacing Lebanese workers with foreigners to the judicial authorities.
Azzi’s statements came a day after the Labor Ministry issued a statement warning of a crackdown against unlicensed enterprises and cautioning company bosses against replacing Lebanese workers with Syrians.
The statement named multiple unlicensed private sector companies, the majority of which were based in the Bekaa Valley area of Baalbek-Hermel and in Akkar in the north.

The ministry warned that it would work with the Internal Security Forces to find companies that were firing Lebanese employees to hire Syrians. Some 1.1 million Syrian refugees have escaped their war-ravaged homes in hopes of a safe-haven in Lebanon. Due to their precarious circumstances, they often accept much lower wages than their Lebanese counterparts.

L'orient le jour- Le ministère du Travail appelle à respecter les droits des employées de maison, July 16 , 2016

Le ministère du Travail a appelé hier les personnes qui ont recours au service des employées de maison à respecter les droits de ces dernières sous peine d'être traduites en justice.
« Le ministère du Travail rappelle à ceux qui ont engagé ou qui désirent engager une employée de maison qu'il est nécessaire de se conformer aux principes des droits de l'homme et aux lois en vigueur, notamment en assurant aux employées des conditions de travail dignes et une protection face aux dangers auxquels elles pourraient être confrontées », pouvait-on lire dans un communiqué publié par le ministère du Travail. « Le ministère accorde une grande importance au comportement des employeurs à l'égard des employées de maison qui vivent sous leur toit. Il n'hésitera pas à prendre les mesures nécessaires à l'encontre de ceux qui dérogent au respect des droits de l'homme », ajoute le texte.
 Épinglé il y a quelques jours par Human Rights Watch qui dénonce la poursuite de la pratique des examens anaux sur les homosexuels, le Liban tente de redorer son image en matière de droits de l'homme, surtout que de nombreux abus à l'encontre des employées de maison sont enregistrés dans le pays, en plus d'un large nombre de suicides de ces dernières.
Sur un autre plan, le ministre du Travail, Sejaan Azzi, a reçu le coordonnateur spécial adjoint des Nations unies pour le Liban, Philippe Lazzarini, avec qui il a passé en revue la situation générale des réfugiés syriens au Liban. M. Lazzarini a informé M. Azzi des plans mis en place par le Haut-Commissariat pour les réfugiés dans le but de venir en aide aux pays qui subissent le poids des déplacés syriens.

Anna Fernando struts down the black-and-white tiles of a trendy coffee shop in the Lebanese capital, dressed in high heels and a strapless ball gown of caramel gauze ribbons.

The 43-year-old left her native Sri Lanka 21 years ago to work as a maid in Lebanon, determined to provide her children with better opportunities in life than her own.

On her day off this weekend, she joined a dozen other domestic workers at a modeling show in central Beirut organized by local NGO Insan, Arabic for "human being."

"Even if I work like a maid, I'm a human being," Anna says backstage, her eyes thick with mascara before her name is called to show off the work of young Lebanese designers.

Sunday's fashion show is part of an effort to humanize an estimated 250,000 foreign domestic workers who toil in the kitchens and living rooms of Lebanese families.

Now in its fourth year, the show aims to give participants the opportunity to be seen as something other than the hired help.

"In Lebanese society, they live like all other women when they're not at work," says Randa Dirani, one of the organizers.

Rights groups often accuse Lebanon and Gulf states of racist and degrading treatment of migrant domestic workers, who are often referred to simply as "servants" or "Sri Lankans", regardless of their actual nationality.

- 'Not only domestic workers' -

Most overseas workers work under a restrictive sponsorship system called "kafala" that leaves them dependent on their employer's goodwill and unable to escape abusive work relationships.

Domestic workers are not protected by Lebanese labor law, despite the efforts of a new union begun for them early last year with the support of the country's federation of labor unions.

"At this fashion show we want to tell all these people we are not only domestic workers," Sumy Khan from Bangladesh says.

The 22-year-old with short hair and tattoos says she would have loved to have studied journalism at home in Bangladesh, but that she had to leave two years ago to support her family.

As she paraded down the catwalk in a short cream-and-white jumpsuit between Lebanese and foreigners huddled along its edge, cameras in hand, her friends whooped and clapped in support.

The fashion show is just one of several civil society initiatives that seeks to combat often discriminatory and exploitative attitudes towards domestic workers.

Last year, a domestic help agency in Lebanon put out an ad on Mother's Day that was slammed by activists as racist and wildly dehumanizing.

"For Mother's Day indulge Ur Mom & offer her a housekeeper. Special offer on Kenyan & Ethiopian nationalities for a period of 10 days," read a text message sent to thousands of mobile phone users and subsequently picked up by media.

The American University of Beirut last year surveyed 1,200 employers in Lebanon on their views of domestic workers, and Lebanese rights group Kafa has turned the results into an online campaign.

"Fifty-one percent of Lebanese women think (their) domestic worker is not trustworthy -- although she takes care of their children," goes one line.

- 'Now a migrant chef' -

Standing out among the models on Sunday, Alix Lenoir, a 20-year-old Franco-Lebanese student of industrial design, says she decided to join to connect with other participants.

"I think it's a shame that these women in our society in Lebanon have had a little of their confidence taken away from them," she says.

"When they go out, they go out among themselves -- not with other people."

By the end of the evening, Lenoir is hugging one of her fellow models -- 18-year-old Iman Bachir, the daughter of migrant workers from Sudan -- and promising to meet up soon.

Fernando says her sacrifice of living away from her family for two decades has paid off.

Today, her 21-year-old daughter is studying pharmacology and her 22-year-old son is about to graduate as an army officer in Sri Lanka.

And she is starting up a small catering business.

"People love Sri Lankan food. It's delicious, full of spices, and very good for you," reads her business card, on which her name sits in a circle of fresh herbs, chillies and spices.

She cooks Sri Lankan, Indian and Nepali dishes, the card says, and Lebanon-based foodies can order fluffy rice and fragrant curries by phone, via email or Facebook.

"I'm now a migrant chef," she says.

مسيرات حقوقية ومطلبية في بيروت بمناسبة عيد العمال

لم تكن مسيرة الاحتفال بعيد العمال الذي يصادف في الأول من أيار هذا العام كما الأعوام السابقة. فقد تميزت هذه المسيرة التي دعا إليها الاتحاد الوطني لنقابات العمال والمستخدمين في لبنان، والحزب الشيوعي بمشاركة الأمين العام الجديد للحزب، حنا غريب الذي تقدم المتظاهرين وأسهم حضوره بتأمين حشد كبير على خلاف الأعوام السابقة.

ولعل مشاركة النقابي العتيق الذي أعاد الوهج والزخم للحركة النقابية، شكل دافعاً لعموم الناس للنزول الى الشارع والمشاركة في مسيرة الشيوعي ورفع شعارات حملت مطالبهم عالياً. وقد أعاد انتخاب غريب لمنصب الامين العام للحزب الشيوعي الأمل للشيوعيين في إحداث تغيير داخل صفوف حزبهم عسى ان يعود له دوره ومكانته على الساحة السياسية اللبنانية.

اذاً منذ الساعة العاشرة من صباح الأحد 1/5/2016 بدأ تجمع الجماهير امام مركز الاتحاد الوطني لنقابات العمال والمستخدمين في لبنان. اللون الاحمر كان طاغياً على المشهدية. ومع ذلك لم يكن من الصعوبة ملاحظة تجمعات للعاملات المنزليات المنضويين تحت نقابة العاملات في الخدمة المنزلية في الاتحاد الوطني لنقابات العمال والمستخدمين. كذلك كانت مشاركة ملحوظة للجنة الدفاع عن حقوق المستأجرين في لبنان، واللقاء النقابي التشاوري، والتيار النقابي المستقل.




مظاهرة حمراء من الكولا الى رياض الصلح

من منطقة الكولا مروراً بكورنيش المزرعة وشارع مار الياس وصولا الى اشارة سبيرز ومنها عبر النفق وصولاً الى ساحة رياض الصلح، سار الآلآف رافعين شعاراتهم المطلبية ومنها: "تعزيز التعليم الرسمي مدخل رئيس لدولة المواطنة"، "سلسلة رتب ورواتب عادلة"، "استقلالية العمل النقابي في محاربة الفساد"، "إلغاء بنود باريس"، "الوطن يتهاوى بالرشاوى"، "يا عمال لبنان اتحدوا، انتفضوا ضد ظلم الطبقة السياسية". كذلك كانت شعارات رفعتها العاملات في الخدمة المنزلية ومنها: "نعم للتصديق على الاتفاقيات الدولية لحقوق عاملات الخدمة المنزلية 87 و189"، "الحق بزيارة الطبيب عندما نكون مرضى"، "الحق بيوم عطلة".

المفارقة وانه بينما كانت العاملات المنزليات يعبرن مع اليافطات، لمحت عاملة تعبر من تحت جسر الكولا وهي ترتدي المريول، حاملة أغراض ربة عملها التي كانت تسير قربها وترمق العاملات بنظرة ازدراء. وعند المرور ببرج الغزال نحو رياض الصلح استقبلت المشاركين شاحنات تنقل النفايات قتلت الجو بالروائح الكريهة، الأمر الذي أعطى دوافع مضاعفة لأهمية هذه المسيرة المطلبية والحقوقية.

وفي ساحة رياض الصلح كانت كلمات في المناسبة استهلها كاسترو عبدالله، رئيس الاتحاد الوطني لنقابات العمال والمستخدمين مشيراً الى ان 30% من الشعب اللبناني يعيش تحت خط الفقر وبالكاد يستطيع تأمين الغذاء والدواء والسكن والمستشفى والحياة الكريمة". واعتبر أن أمل لبنان وخلاصة يكون في عماله ومعلميه وشبابه: "أنتم من تستطيعون إخراجه من أزمته التي تعمقت بفعل سياسات الحكومات المتعاقبة، الأمر الذي أدى إلى زيادة الدين العام الذي تخطى كل الحدود، في ظل غياب كل المؤسسات الدستورية، وإلى تفاقم الفقر والبطالة، خاصة بين الشباب والنساء. فشبابنا اليوم ليس أمامهم سوى أبواب الهجرة والاغتراب"،داعياً الى الاتحاد من أجل استعادة حقوقنا من تلك الطغمة التي تدمر الوطن وتذبح أبناءه لزيادة أرباحها، ومن أجل بناء دولة الديمقراطية والرعاية الاجتماعية".

أما كلمة التيار النقابي المستقل فألقتها بهية بعلبكي معتبرة أن الأول من أيار هو محطة لنضال من أجل:

- "اقرار سلسلة رتب ورواتب عادلة معدلة تعطي الجميع 121% على الأقل.

- حماية الحريات النقابية بتطبيق الاتفاقية الدولية 87 بكامل بنودها حول الحريات النقابية، وانشاء نقابات حرة ومستقلة بعيداً عن تدخلات السلطة وأدواتها.

- إقرار حق التنظيم النقابي لموظفي القطاع العام بتعديل المرسوم الاشتراعي رقم 112 تاريخ 12/6/1959 تطبيقاً ايضاً لبنود التوصية الدولية بشأن حقوق المعلمين.

- إلغاء بنود باريس حيث قالت "يريدون إعادة إحياء مشاريع مؤتمر باريس 3 من التعاقد الوظيفي ووقف التوظيف في الملاك الدائم ومد اليد الى التقاعد وإعتماد الضرائب غير المباشرة التي تطالنا وتطال أمثالنا من الفقراء وذوي الدخل المحدود".

- محاربة الفساد والمفسدين الذين جعلوا لبناننا بلد العلم والإشعاع مزبلة الشرق كل ما فيه غير مطابق إلا لمواصفات الفساد والمفسدين ولطمع جشع الوقحين الذين لا تهمهم الا المحاصصة ونهب مقدرات الدولة".

وطلبت من هيئة التنسيق النقابية "ان تضع خطة تحرك تصعيدية متواصلة مترابطة بحيث تكون مؤثرة، وان لا تركن الى الوعود العرقوبية، وان تعود دائما الى القواعد التي يحاولون تيئيسها بالتراجعات المتكررة وبنهج انتظار المكرمات من هذا الطرف السياسي او ذاك".

ولأن عيد العمال لا يكتمل دونهم كانت كلمة للنيبالية روجامايا ليمبو بإسم "نقابة العاملات في الخدمة المنزلية في الاتحاد الوطني لنقابات العمال والمستخدمين قالت فيها: "رغم ان قانون العمل اللبناني لا يعترف ولا يحمي مهنتنا، ويتركنا تحت وطأة نظام الكفالة، ولكن نحن هنا اليوم لاننا اخترنا واخذنا القرار بالمشي مع العمال اللبنانيين للمطالبة بالتوقيع على اتفاقية منظمة العمل الدولية عن العمل اللائق لعمال الخدمة المنزلية، الاتفاقية 189 لاننا نواجه نفس ظروف الحياة والمشاكل ونعاني مثل العمال اللبنانيين، وكلنا لدينا حقوق".

بدورها تحدثت رئيسة اتحاد المقعدين اللبنانيين سيلفانا اللقيس مثنية على "المشهد المتنوع والموحد حول غاية واحدة وهي العدالة الاجتماعية"، داعية الى تكريسه في الانتخابات البلدية المقبلة. وقالت كلمة بإسم "15% من عدد سكان لبنان المنسيين الى اليوم من كل أجندة اجتماعية قطاعية أم عامة. ونعتبر إما شأن اجتماعي أو صحي أو طبي ولكن هذا غير صحيح. جئنا لنطالب بفك القيود عنا، نحن مواطنون ممنوعون من كافة حقوقنا الاساسية".

وتابعت: "انتظرنا كثيراً، وبقينا على لائحة الانتظار. انتهت الحرب فاعتبرنا انه جاء دورنا لندخل في النظام. ما نطالب به هو حقنا في التنقل بحرية دون عوائق". وشددت على انه: "لا يعد انساناً ولا نقابياً ولا مناضلاً كل شخص يضع برنامجه دون ان يأخذ بعين الاعتبار حقوق الأشخاص المعوقين".




غريب نحو تعزيز استقلالية الحركة النقابية نهجا وروحا

أما في كلمته كأمين عام للحزب الشيوعي فقد أكد حنا غريب على "متابعة المسيرة من اجل بناء دولة مدنية، علمانية ديمقراطية، دولة مقاومة ودولة للرعاية الاجتماعية". وشدد على "توحيد النضال الوطني والنقابي للطبقة العاملة بكل مكوناتها، من أجراء نظاميين وغير نظاميين في القطاع الخاص، ومن موظفين واساتذة ومعلمين واداريين ومتعاقدين ومتقاعدين ومياومين في القطاع العام. ومعهم كل الفئات الاجتماعية الفقيرة وما دون المتوسطة في المدن والأرياف بمن فيهم مزارعو التبغ، والجمهور العريض من الشباب والنساء والعاملون لحسابهم والمتعطلون من العمل، ومعهم خريجو الجامعات والمثقفون والفنانون والإعلاميون، وفئات المهن الحرة، من اجل تحصيل الأجر العادل والضمانات الاجتماعية الفعلية وخدمات الصحة والتعليم، والنقل العام والسكن وشبكات الأمان الاجتماعي. ودعا الى "ربط كل الحراكات والمبادرات من الحراك النقابي بقيادة اللقاء النقابي التشاوري الى الحراك الشعبي ومجموعاته الشبابية والطلابية على تنوعها، الى الحراك البلدي، الى الحراك السياسي في "مواطنات ومواطنون في دولة" من اجل تحقيق هذا الهدف".

وعن الانتخابات البلدية لفت غريب الى ان "الشيوعي" يخوض المعركة الانتخابية "على اساس سياسي تنموي في المدن الرئيسية والبلدات كافة ضد القوى الطبقية المهيمنة، والثنائيات الطائفية المختلفة، تعبيراً عن المصالح السياسية والاقتصادية والاجتماعية الحيوية للفئات الشعبية التي نسعى إلى تمثيلها".




وأكد في معرض نضال الحزب المتدرج من أجل التغيير الديمقراطي والعلماني في البلاد على:

- "ضرورة تعديل قانون الانتخاب النيابي في اتجاه قانون يعتمد النسبية خارج القيد الطائفي على أساس لبنان دائرة انتخابية واحدة.

- اعتماد قانون مدني موحد للأحوال الشخصية يحرر المواطن من قرار المؤسسة الدينية.

- استحداث قانون لمفهوم الاقامة يعتق اللبنانيين المقيمين من استمرار الخضوع لسجلات النفوس المحكومة بنتائج الاحصاء السكاني الوحيد المنفذ عام 1932.

- إقرار قانون عصري للامركزية الادارية، فضلا عن إقرار كل التشريعات الآيلة الى تحقيق المساواة الكاملة بين المرأة والرجل، بما في ذلك حق المرأة في إعطاء الجنسية لأولادها".

وختم قائلاً: "في الأول من ايار يجدد الحزب الشيوعي اللبناني موقفه الداعي الى تعزيز استقلالية الحركة النقابية نهجاً وروحاً في ممارسته اليومية. وهو يحيي الجهود النقابية التي تبذل في هذا الإطار من قبل المكونات النقابية كافة، ومنها على وجه الخصوص تلك المنضوية إلى إطار اللقاء النقابي التشاوري، التي تعمل جاهدة لملء الفراغ النقابي الحاصل في البلاد وتحقيق المطالب الاجتماعية لأصحاب الحقوق وبناء دولة الرعاية الإجتماعية".

ومن ضمن المشاركين في المسيرة تحدث جهاد اسماعيل من اتحاد المقعدين اللبنانيين قائلاً: "نشارك في مسيرة الاحتفال بعيد العمال حتى نطالب بحقوقنا ولكي نطالب بوظائف تليق بنا وبمقدراتنا وكي تطبق 3% بناء للقانون 220/2000 ويتم تطبيق هذه الكوتا فوراً وان تكون الوظائف ليس كما يشاء المسؤولين وانما وفق ما نص القانون". 

أما "ألسي" من أثيوبيا فعبرت عن سعادتها بالمشاركة في هذه المسيرة وقالت: "ان الأول من أيار هو عيد لجميع العمال ومنهن العاملات المنزليات. نحن اسسنا نقابة في العام الماضي واتحادنا ضمن هذه النقابة سيعود بالخير علينا في الايام المقبلة". 




احتفال للعاملات المنزليات في الحمرا

على ان مسيرة "الحزب الشيوعي" لم تكن الوحيدة التي شهدها الأول من أيار. فقد احتفل قسم آخر من عاملات المنازل في لبنان بعيد العمال، بمسيرة مطلبية انطلقت عند الساعة الثانية عشر ظهراً من كنيسة مار يوسف في مونو، وصولا إلى ساحة كنيسة مار فرنسيس في شارع الحمرا، حيث شاركن بمهرجان ثقافي وسوق تجاري نظمته عاملات من جاليات مختلفة أعضاء في نقابة عاملات الخدمة المنزلية في الاتحاد الوطني لنقابات العمال والمستخدمين بالتعاون مع مجموعة من المنظمات والجمعيات المدنية؛ حركة مناهضة العنصرية، منظمة كفى عنفا واستغلالا، كاريتاس لبنان- مركز الأجانب، مؤسسة إنسان، المركز اللبناني لحقوق الإنسان، مؤسسة عامل الدولية، ومركز المهاجر الافريقي- الآسيوي. 

قسمت الباحة الى طاولات فعرضت كل جالية ما يرمز الى بلدها من لباس ومأكل ومشرب فتهافت على المعرض اللبنانييون قبل غيرهم. أما في الوسط فقد وضع مسرح صغير قدمت عليه كل جالية رقصة خاصة ببلدها وسط تصفيق حار من الحضور.

وعن مشاركتها في المعرض قالت ماريتاس من الفيليبين: "نحن كل نهار أحد نقوم ببيع منتجاتنا هنا، وذلك من أجل تحقيق مدخول إضافي لنا. نبيع أطعمة وحلي وملابس خاصة في الفيليبين. كذلك بعض العاملات اللواتي يمنعن من طهي طعامنا الخاص او الخروج من المنزل تأتي صديقاتهن الى هنا ويقمن بشراء الأغراض لهن".

يذكر ان هذا الاحتفال يجري للعام السابع على التوالي، وقد ارادت العاملات هذا العام التشديد على ضرورة "تصديق الدولة اللبنانية على اتفاقية منظمة العمل الدولية رقم 189 المتعلقة بظروف العمل اللائق لعاملات المنازل التي دخلت حيز التنفيذ في 5 أيلول 2013".

وعن مشاركتها بالاحتفال قالت ايتافراويكا من أثيوبيا: "أشارك اليوم بإحتفال عيد العمال للمطالبة بحقوقنا ومنها إلغاء نظام الكفالة. كذلك نريد ان نعيش في هذا البلد مثل باقي الناس ودون عنصرية".

وفي حديث "للمفكرة القانونية" قالت منسقة برنامج عاملات المنازل في "منظمة كفى" ناي الراعي: "لقد اختارت العاملات في هذا العام التركيز على تصديق الدولة اللبنانية على اتفاقية منظمة العمل الدولية رقم 189 المتعلقة بظروف العمل اللائق لعاملات المنازل. فهذه المعاهدة تنظم العمل على نحو تحمي العاملات من الاستغلال والعنف. وعلى سبيل المثال فهي تصر على:




- "ان يكون عملهن بين 8 و10 ساعات في اليوم.

- ان يكون لديهن الحق في الاحتفاظ بجواز سفرهن. وان يكون لديهن غرفة نومهن الخاصة.

- الحق في نهار راحة في الاسبوع وساعات راحة في اليوم.

- الحق في الوصول الى العدالة والمحاكم.

- كذلك تنص هذه المعاهدة على ضرورة مراقبة عمل مكاتب استقدام العاملات.

- المطالب كثيرة ولكن عنوانها الأبرز هو تصديق هذه المعاهدة التي صوتت عليها الحكومة ولكنها لم تصدق عليها ولم تضعها حيز التنفيذ".

ولفتت الراعي الى ان "تصديق لبنان على هذه المعاهدة يلزم الدولة اللبنانية بالكثير من الأمور ومنها تغيير نظام الكفالة والتي هي مشكلة العاملات الأكبر التي تقيدهم بشخص واحد هو صاحب العمل الذي يصبح اسمه موجود على كل أوراقهم الرسمية وبالتالي لا يمكنهم استبداله على نحو شبه مطلق. وهذه العلاقة الحصرية تفتح المجال امام أصحاب العمل نحو انتهاك الكثير من حقوق العاملات. كذلك سيتوجب على الدولة اللبنانية ان تراقب عمل مكاتب استقدام العاملات التي تخضع حالياً للرقابة اللازمة".

وبالسؤال ان كانت "كفى" قد لحظت تحسناً في ظروف عمل ومعيشة العاملات خلال السنوات المنصرمة أجابت: "هناك تحسن ما، الا انه لم يحصل على مستوى سياسات الدولة والأنظمة وهو ما نتطلع لرؤيته. ولكن الذي يحدث ان العاملات بدأن بإكتساب القدرة على التعبير عن انفسهن وأحد الأمثلة أنهن قمن بإنشاء نقابة لهن. بتن يخضن مسيرات تعبر عن مطالبهن. وبات بمقدورهن الكلام عما يحصل معهن وهذا يعد بصيص أمل لهن".

عاملات المنازل في لبنان يطالبن بالتصديق على اتفاقية منظمة العمل الدولية




وكالة أنباء العمال العرب:احتفلت عاملات المنازل المهاجرات في لبنان بعيد العمال، بمسيرة مطلبية انطلقت من كنيسة مار يوسف في مونو، وصولا إلى ساحة كنيسة مار فرنسيس في شارع الحمرا، حيث احتفلن بمهرجان ثقافي وسوق تجاري نظمتهما عاملات ناشطات من جاليات مختلفة وعاملات أعضاء في نقابة عاملات المنازل التي تأسست

في كانون الثاني من العام 2015. وشارك في هذا التحرك ناشطون في هيئات المجتمع المدني وداعمون لحقوق العاملات.

وذكر عدد من المشاركات في المسيرة بمطالب العاملات المهاجرات وعاملات المنازل في لبنان، وأبرزها: تصديق الدولة اللبنانية على اتفاقية منظمة العمل الدولية رقم 189 المتعلقة بظروف العمل اللائق لعاملات المنازل التي دخلت حيز التنفيذ في 5 أيلول 2013، إلغاء نظام الكفالة، إيجاد بديل عن رابط المسؤولية الحصرية التي تقيد وجود عاملات المنازل المهاجرات القانوني بصاحب عمل واحد، توفير إمكانية أن تنهي العاملة علاقة عمل استغلالية، إعطاء عاملات المنازل المهاجرات حقوق العمل الأساسية مثل: فسخ عقد العمل، غيير صاحب العمل، يوم عطلة خارج المنزل، تحديد ساعات العمل والراحة، والحق في الحد الأدنى للأجور، مراقبة ظروف عمل العاملات داخل المنازل والمحاسبة القانونية لأصحاب العمل الذين ينتهكون حقوق العاملة، مراقبة أعمال مكاتب الاستقدام وسلوكها مع العاملات المهاجرات ومراجعة آليات الاستقدام والتوظيف، وتسهيل وصول العمال المهاجرين والعاملات المهاجرات إلى الخدمات القانونية.

وقد شارك في تنظيم المسيرة والاحتفال: حركة مناهضة العنصرية، منظمة كفى عنفا واستغلالا، كاريتاس لبنان-مركز الأجانب، مؤسسة إنسان، المركز اللبناني لحقوق الإنسان، مؤسسة عامل الدولية، ومركز المهاجر الافريقي- الآسيوي.

The Daily Star - Domestic worker throws herself off balcony north of Beirut, April 20, 2016



An Ethiopian maid was critically wounded Wednesday after she threw herself off a balcony in the city of Jbeil, north of Beirut.

The state-run National News Agency said that the incident took place at the home of her employers in Jebil's Kasuba neighborhood.

Internal Security Forces have opened an investigation into the incident.
