SOLIDA has been active since 1996 in the struggle against arbitrary detention, enforced disappearance and the impunity of those perpetrating gross human violations.

Change and Reform bloc MP Ibrahim Kanaan told LBCI Tuesday that the arrest of the Lebanese youths for defaming President Michel Sleiman on Facebook is not legally justified and should not have happened.
First Judge of Beirut Ghassan Oueidat issued indictments on Tuesday against three people over the charges.
“The matter does not deserve such reaction. It would be dangerous to assault the freedom of expression,” Kanaan said.
The MP demanded the three youths be released.

Beating different parts of the body, crushing toes, pulling out hair or nails, and exposing inmates to the screams of other detainees being tortured. These are just a few of the practices to which inmates can be subject in Lebanon’s main interrogation centers, which include Tripoli’s al-Qubba detention center, Zahle’s Palais de Justice, Beirut’s Hobeish police station, Roumieh Prison and the Military Intelligence Unit of the Defense Ministry.
According to Marie Daunay, president of the Centre Libanais des Droits Humains (CLDH), although Lebanon ratified the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) in October of 2000, few if any of its stipulations are actually implemented. What happens behind closed doors has left victims of torture both physically and emotionally scarred, and human rights advocates are eager to voice their anger.
As such, last Friday, a day before the International Day to support Victims of Torture on June 26, several NGOs led by the CLDH marched down the streets of Nejmeh Square toward parliament. Despite a small turnout, the group consisted of mostly 15 to 20 NGO representatives who joined hands to form a “human chain in support of the victims of torture,” participants loudly decried the theoretically illegal practice. Theoretically, only because despite being technically bound by Article 7 of the CAT, Lebanon has its own penal code, which does not criminalize torture explicitly. “Crimes are rather evaluated according to the consequences on the individual, and the penal code includes just about everything but the term ‘torture’,” said Daunay.
Lebanese officials are convinced of the efficacy of torture, which at the moment is still very much engrained in the system, noted Daunay. “It seems almost cultural,” she said, “as if Arab states feel their pride is compromised if they fail to find a culprit, so they condemn people unjustly.” Unsurprisingly, many detainees are forced to confess to crimes they have not committed. According to a 2003 Amnesty International report, Dr. Muhammed Khaled, who endured days of torture as a detainee at the Ministry of Defense back in 2000, claimed interrogators also threatened to rape his wife if he did not sign certain papers.

Daunay recalled when CLDH, at the time known as SOLIDA, first released its report on the practice of torture in 2006. The day before, their offices were raided. “We were being followed by cars; there were even some intrusions into employees’ homes.” Yet, ironically, when compared to the rest of the region, Daunay said Lebanon is slightly better off, specifically because NGOs have more freedom to express themselves.
Despite room to vent, most demonstrations, like last Friday’s, are small, which offsets their impact. “It is not easy to mobilize civil society here,” said Sofia Palandri from the Italian human rights organization COSV during the rally on Friday. “Participants are usually foreigners, many from NGOs, because Lebanese society is very individualistic and caught up in protecting its own sect.” About half of the protesters at the march were international.
Despite challenges, Wadih al-Asmar, secretary general of the CLDH, says there have been efforts to make a change. He pointed to a global decrease in the practice of torture in police headquarters and commended the efforts of certain Lebanese cabinet members, namely Interior Minister Ziad Baroud and Justice Minister Ibrahim Najjar, insisting their attempts have come within their personal capacity. The problem lies in the system, he said, and changing the system requires a new law in parliament.
Saadedine Shatila, from the Swiss-based human rights organization Al-Karama also acknowledges timid although present efforts by the state. He noted that Lebanon signed the Optional Protocol to the UN Convention against Torture (OPCAT), which stipulates that the government must conduct regular visits to detention centers in an effort to stop the practice. An official proposal was submitted to the Ministry of Justice on September 30. However, governmental action since then has come to a halt. Human Rights Watch reported back in December that the country missed the deadline to set up a national institution to prevent torture. The watchdog added that Lebanon is more than eight years behind on submitting a relevant report to the UN, as required by the CAT.
If Lebanon has failed in prevention, it has certainly not offered any type of initiative to compensate for damages and false condemnations. “We only receive support from embassies, international NGOs, the UN Fund for Victims of Torture and maybe a few hospitals,” said Manal Najem from the Centre Nassim, which intervenes to help torture victims, providing them with medical, psychological and legal assistance. “We help both direct and indirect victims,” said Najem, who is one of the social workers. “In fact, the wives of men who are detained and tortured are those who suffer the most, as they are left with the burden of providing both affection and financial support to their children.” According to Najem, the women benefit tremendously from routine soubhiyehs (morning gatherings over coffee) at the center, where they find mutual comfort and can express worries freely.
Besides private donors, the European Union has been essential in helping NGOs in their research. The EU, along with the Netherlands Embassy and Pax Christi International, gave the Association Libanaise pour l’Éducation et la Formation (ALEF), which monitors human rights in Lebanon, almost 200,000 Euros to implement a prevention and monitoring project. The resulting report found that some detainees did not even survive the ill treatment they received in certain prisons. Another finding was that Lebanon extradites many of its refugees to countries where they are at risk of being tortured. The EU’s Centre Restart, which is similar in its operations to Centre Nassim, provides relief for 250 victims of torture.

Ultimately, it seems that like in most areas of national concern, despite efforts to change the system, tangible governmental action is lagging. While human rights organizations reiterated their call in a joint public statement issued last Saturday, they can only hope the cabinet will someday take concrete measures, beginning with an official condemnation of torture in the country’s penal code.

BEIRUT: The Court of Publications charged a man Tuesday with slander against the Military Tribunal. The court fined Ahmad Fahed al-Ayoubi LL6 million for slander against the tribunal during a television interview, in which he criticized the tribunal and the way it was prosecuting radical groups. He described the tribunal as “the graveyard of justice” and said it postponed the trials of arrested Islamists. The court considered Ayoubi’s remarks an insult to the tribunal as they undermined its power and the power of its judges. – The Daily Star

Daily Star - Court charges 2 men with harming Prince Alwaleed - June 30,2010

BEIRUT: The Court of Publications charged two men Tuesday with causing harm to Saudi Prince Alwaleed Bin Talal. Shadi Ali Faqih and Nadim Asaad Abdo were fined LL10 million for damages aimed at the prince through a book they planned to publish about the royal’s political and economic life. The court considered that the two men gathered information from people close to the prince in order to make financial profit. The judgment said they tricked the people they interviewed into thinking a book would be released in order to gather scandalous information about Prince Alwaleed. – The Daily Star

واقعتان اثنتان اعترف الضابط في الجيش اللبناني المقدم الركن شهيد تومية بحصولهما، واللتان شكلتا منطلقاً لبدء تعامله مع المخابرات الإسرائيلية وعملائها.
ورغم اعترافه بالواقعتين، غير ان تومية لم يقرّ بما استتبعهما من إعطائه معلومات وإحداثيات عسكرية سرية، أفضيا خلال حرب تموز الى قصف موقعين للجيش أدى الى استشهاد عسكريين.
فمن معبر باتر الى فرنسا، شكل المدعو مارون السويدي صلة الوصل بين تومية والمخابرات الإسرائيلية، لكن الضابط الموقوف أكد في معرض استجوابه أمس أمام المحكمة العسكرية الدائمة بأنه لم يكن يعلم ان مارون هو عميل، على الرغم من أن كل الدلالات التي أظهرها مارون من جهاز اتصال وحبر سري وغيره، تشير الى ذلك.
ويضع تومية علاقته بمارون طوال فترة لا بأس بها امتدت لنحو أكثر من عشرين عاماً في خانة الصداقة حيث راح مارون يغدق عليه بالمال، قال عنه تومية انه المال الذي سُرق منه في فرنسا، فيما كان تومية يعطيه كماً من المعلومات وصفت بالسرية.
وإذا كان تومية قد بدا على مدى ساعة ونصف من الوقت الذي استغرقه استجوابه، سوياً ولكنه لم يتذكر أموراً أساسية كأسماء أولاده وقسم الولاء للوطن، فإنه كما موكليه المحاميان بدوي أبو ديب وجوزف مخايل، حرصوا على إظهار مرض يعاني منه تومية منذ أكثر من 20 عاماً، وهو مرض الانفصام في الشخصية الذي يدفعه الى أمور غير سوية، فكاد ان يحوّل القضية من استجواب في جرم التعامل الى مسألة طبية.
وبلباس مدني مثل الضابط تومية أمام المحكمة برئاسة العميد الركن نزار خليل وعضوية المستشار المدني القاضي داني الزعني وبحضور ممثل النيابة العامة القاضي فادي عقيقي.
في مستهل الجلسة أصرّ المحامي مخايل على استجواب موكله بعد ايداع المحكمة التقرير الذي وضعه طبيب السجن عن حالته النفسية، وطلب ممثل النيابة العامة السير بالمحاكمة، فيما قررت المحكمة التأكيد على قرارها السابق تكليف طبيب السجن الكشف عن الحالة الصحية والنفسية للمتهم وإيداعها التقرير.
وباستجوابه افاد تومية انه استجوب أولياً وهو معصوب العينين، وعندما طلب الإطلاع على إفادته، رأى فيها أخطاء كثيرة وأموراً لم يقلها. وقال: افادتي غير صحيحة لاني لست عميلاً".
وعن افادته أمام قاضي التحقيق قال تومية بأنه كان يعاني من اضطراب نفسي وهو مصاب بمرض وراثي ويتناول أدوية منذ أكثر من 20 عاماً.
وأفاد بأنه أثناء خدمته في الجيش مع العماد ميشال عون أصيب بعدة انفجارات، كما تعرض للخطف أكثر من مرة من قبل السوريين.
وبسؤاله يقول تومية عن الواقعة الأولى التي حصلت معه انه أثناء خدمته في الجنوب عام 1991، ضلّ الطريق مع عسكرييه، عند معبر باتر، فأوقفوا لدى حاجز لميليشيا لحد، وعندما عاد أفاد مسؤوليه بما حصل معه وعوقب على ذلك.
ويضيف تومية، انه حينها تعرف على مارون السويدي الذي كان من عداد جيش عون وعندما انهزم التحق بجيش لحد، وعمل في تهريب الدخان.
وعن الواقعة الثانية حول سفره الى فرنسا قال تومية: لا أذكر في أي عام سافرت، انما اخبرني مارون انه يريد ان يعرّفني على السياحة وقابلته هناك، انما أثناء وجودي في فرنسا تعرضت لحادث سلب وكان السالبون أصدقاء مارون، حيث كان بحوزتي حوالى 20 أو30 ألف دولار لاني كنت أريد شراء سيارة".
أضاف: "قصدت البوليس والسفارة اللبنانية، ثم سلمني مارون مبلغاً من المال للعودة الى بيروت، وأفدت رؤسائي بما حصل معي".
وبسؤاله قال تومية ان مارون لم يطلب منه مقابلة أي ضابط إسرائيلي في فرنسا، انما كان برفقته شخص يدعى أوهانس وهو مهندس من برج حمود ويعمل أيضاً في تهريب الدخان.
ونفى تومية اعترافه السابق بالذهاب الى السفارة الإسرائيلية في فرنسا، موضحاً انه سافر مرتين، وفي المرة الثانية، تم خطفه على الطريق أثناء ذهابه الى الفندق حيث كان مارون بانتظاره، وهناك يضيف تومية، علّمه مارون على كيفية الكتابة بالحبر السري كي يتواصل معه لافادته عن عمليات تهريب الدخان والمازوت.
وعما ذكره من تفاصيل في افادته السابقة حول سفره الى إسرائيل قال تومية، ان ذلك غير صحيح وان علاقتي كانت بمارون فقط.
وتحدث تومية، كاشفاً عن ان مارون أرسل له جهاز إرسال وضعه في سيارة مستأجرة كانت موجودة في موقف مطار رفيق الحريري الدولي، وكان مفتاح السيارة ملصقاً على الدفاع الخلفي، فأخذ الجهاز ووضعه في غرفة نومه. وعن نوعية الرسائل التي كان يرسلها الى مارون افاد تومية انها أخبار عشوائية من الصحف والمجلات وما كان يحصل معه ومع اخوته من حوادث.
وأضاف ان مارون طلب منه ان يجري تشكيله على المعابر الجنوبية أو في الشمال بهدف تهريب الدخان.
وقال عن حقيبة سلمت اليه في باريس انها كانت تحوي حبراً سرياً للرسائل، خشية من مكتب مكافحة التهريب وزوده بعنوان في قبرص لإرسال الرسائل اليه، وأضاف تومية انه كان يكتب بالحبر السري بشكل عادي، اخباراً تتعلق بموقعه في الجيش واخبارا عن حوادث امنية وتهريب الدخان ومكافحة الارهاب، وقال إن مارون نبّه عليه عدم معرفة أحد "بالكومود".
وسئل عن المعلومات التي أرسلها حول رون أراد والاسيرين الإسرائيليين فقال تومية: لا أعرف شيئاً عن الموضوع أو عن حزب الله.
وسئل: لكنك ذكرت في رسائلك ان آراد لا يزال على قيد الحياة وهناك احتمالان إما عنده حزب الله أو لدى الإيرانيين فأجاب: هذه معلومات خيالية وغير صحيحة.
وعما ذكره عن الأسيرين من انه تم نقلهما بسيارة بيك آب قال: هذه معلومات أخذتها من الصحف والمجلات ولم أرسلها الى أحد.
وأفاد تومية ان مارون أرسل له جهازاً آخر بعد تعطّل الجهاز الأول، وذلك بواسطة بريد ميت زرعه في بلدة بيت كساب. وقال: وعدني مارون أن يعيد إليّ المال الذي سرق مني، وردّ منه بواسطة البريد الميت حوالي 20 ألفاً.
ورداً على سؤال قال تومية انه تابع دورة كومبيوتر مع عدد من الضباط لكنه لا يذكر ما إذا كان منصور دياب من بينهم.
وتحدث عن حصوله على بريد ميت يحوي قرصين مدمجين لم يستعملها، الاول لغسل المعلومات والثاني لتشفير الرسائل.
وعن معلومات أعطاها عن ضباط الجيش وعناوينهم قال تومية: غير صحيح، أنا كنت أكتب بمجلة الجيش "للتفتيش" عن ضغوط كوني كنت أعيش شخصيتين.
وعن معلومات تتعلق بتشكيلات وخطط عسكرية ووثائق سرية، قال توميه ان حاسوبه يحوي الكثير من المعلومات المدنية منها والثقافية وغيرها، وانما لم يزود بها مارون.
أضاف: لدي هواية في جمع المعلومات في الكمبيوتر وكنت استحصل عليها من الانترنيت.
وعن سبب خوفه بعد كشف شبكات التجسس قال توميه: اني أعاني من انفصام في الشخصية. وأضاف: ان مارون طلب في الفترة الأخيرة تلف الرسائل والاجهزة ورميها في البحر انما لم أفعل ذلك وكنت بصدد أن أسلمهم الى القيادة.
وأكد تومية اكثر من مرة خلال استجوابه ان سبب تواصله مع مارون هو استرجاع ماله المسروق. وقال أرسل لي مارون قرصاً مدمجاً يحوي صوراً جوية انما لم افتحه، ولم اقدم على تحديد أي احداثيات على الخريطة.
وبسؤاله عن أحداث نهر البارد قال تومية: كنت أتواصل مع مارون كأي شخص لبناني في الخارج يتواصل مع أصدقائه في لبنان، وان المعلومات حول فتح الاسلام موجودة أصلاً في الصحف.
وقال: لم أكن أعلم ان مارون يتعامل مع الاسرائيليين، وأخبرني عندما أوقفت لدى ميليشيا لحد انه تركه وطلب في مساعدته في تهريب الدخان.
وعن سبب اعترافه بالذهاب الى اسرائيل واخضاعه لدورات قال انه ذكر ذلك في التحقيق الاولي بناء على رغبة المحقق.
وحول الرسائل التي أرسلها الى مارون تتعلق باحداثيات معينة قال تومية ان مارون لم يطلب منه معلومات عن كنائس ومساجد انما فعل ذلك من باب التسلية والراحة النفسية، وأضاف: أنا أسمع من وقت لآخر أصوات شيطان تلاحقني.
وسئل عن معلومات ضبطت في جهازه تتعلق بالجيش قال عنها تومية انه لم يرسلها الى مارون، انما كان يتحدث معه احاديث عن أمور تحصل في لبنان.
وعن واقعة تعرض قائد اللواء 12 للقصف في حرب تموز واستشهاد مرافقه قال تومية، انه أدخل الى حاسوبه بعد انتهاء الحرب موجزاً عن الحوادث، وأضاف انه اثناءها كان يخدم في صور وكان مريضاً جداً وطلب نقله عدة مرات.
وعن زيارة قائد الجيش للجنوب قال تومية ان احداً أخبره بذلك نافياً ان يكون قد زود مارون معلومات عنها وعن رقم السيارة التي كانت تقل القائد.
وأفاد انه كان ينوي ترك الجيش بعد بلوغه سن التقاعد غير ان مارون طلب منه ان يبقى لمساعدته على المعابر.
وطرحت على تومية أسئلة عديدة تتعلق بمعلومات ذات صلة بالجيش ضبطت على جهازه، فأجاب عنها بأنه لم يرسلها الى مارون انما كان يجمعها بشكل عشوائي، وأفاد انه تابع دورة أركان في الأردن وحل أخيراً.
وقال: "لست متعاملاً ولا يمكن ان أفعل فأنا ضابط واخوتي السبعة كذلك، وولاؤنا للجيش وللوطن فقط".
وسئل عن معلومات زود بها مارون عن رادار عسكري في وجه الحجر، نفى تومية ذلك، وقال انه لا يعرف ما اذا كان تعرض المكان للقصف في حرب تموز.
وقال رداً على سؤال، لدي سبعة أولاد وكدت أتسبب بقتل زوجتي بسبب مرضي، وأنا لا أريد شيئاً سوى العودة الى عائلتي.
وعن سبب هروبه من الدورية أثناء توقيفه أفاد توميه انه تخيّل شيطاناً يلاحقه.
وفي رده على أسئلة النيابة العامة أفاد بأنه لا يذكر قسم اليمين الذي أداه لدى تخرجه بسبب مرضه، ولدى سؤاله عن اسماء أولاده، ذكر تومية اسم ثلاثة منهم ثم صمت قليلاً ليعود ويقول ان طفله الصغير ولد اثناء وجوده في السجن.
وفي رده على اسئلة الدفاع قال تومية ان المعلومات التي اعطاها لمارون كانت على سبيل المحادثة وبهدف استرجاع ماله. وأضاف ان مرضه يدفعه الى قول ما لا يجب قوله وفعل ما لا يجب ان يفعله.
وهنا أبرز المحامي أبو ديب بعض الأفعال التي قام بها تومية تدل على انفصام في شخصيته، وطلبت النيابة العامة اخراجها من الملف، كما أبرز والد تومية تقريراً طبياً يبين الحالة النفسية فقررت المحكمة ضم الطلبين الى الأساس، ورفعت الجلسة الى 19 تموز المقبل لتقديم الدفاع لائحة بشهوده.

ميرزا: توقيفات «الفايسبوك» قانونية

تفاعلت قضية توقيف النيابة العامة التمييزية لـ 3 شبّان مشبته فيهم بـ«القدح والذم والتحقير» في حقّ رئيس الجمهورية، العماد ميشال سليمان، وذلك عبر الإنترنت وتحديداً عبر موقع الـ«فايسبوك». فبعدما توجّه النائب نبيل نقولا إلى ستراسبورغ، للقاء وفد من البرلمانيّين الأوروبيّين والبحث معهم في القضية المذكورة، دعت جمعية «إعلاميون ضد العنف» الأجهزة القضائية المختصة إلى «إطلاق سراح المحتجزين الـ3، ووقف التعقّبات في حقّ آخرين».
اتصلت «الأخبار» بالمدّعي العام لدى محكمة التمييز القاضي سعيد ميرزا، وسألته عن الحيثيات القانونية التي تتيح توقيف الشبّان الثلاثة وملاحقة آخرين. استغرب ميرزا «الضجة» المثارة حول الموضوع، لأنّ هناك «جرماً جزائيّاً قد وقع، حيث جرى التطاول على رئيس الجمهورية، ونعته بأوصاف غير مسموح بها في القانون». ولكن علامَ استند القضاء في التوقيفات، وما هو النص القانوني الذي يتيح ذلك في مثل هذه الحالات؟ علماً بأنّ مسألة الإنترنت لا تزال مدار اجتهاد قانوني بين القضاة، إذ لا نصّ صريحاً يحدّد ما إذا كان الإنترنت وسيلة إعلامية مرئية، أو مسموعة، أو مقروءة، وبالتالي كيف يُحدَّد ما إذا كان يُطبّق عليه قانون المطبوعات أو قوانين أخرى؟ رفض القاضي ميرزا مناقشة هذا الموضوع في الإعلام، لكنه أشار إلى أنّ «بإمكان المتضرّرين والمحتجّين التقدم بدفوع شكلية إذا أرادوا ذلك، وفي كل الأحوال أقول إنّ التوقيف لو لم يكن قانونياً مئة بالمئة لما أقدمت عليه».
بإمكان البعض الدخول إلى الإنترنت بأسماء وهميّة وعناوين افتراضية
وعن دعوة النائب نقولا رئيس الجمهورية السابق إميل لحود إلى الادّعاء أمام القضاء، على كل من توجّه إليه بالإساءة في المرحلة السابقة، وعن دعوته القضاء إلى أن يكون «عادلاً وغير استنسابي»، لفت القاضي ميرزا إلى ضرورة تذكّر التوقيفات التي حصلت في الماضي إبّان عهد الرئيس لحود، ومنها توقيف الزميل زاهي وهبي، بسبب كتابته مقالاً حمل عنوان «فخامة القاتل».
تجدر الإشارة إلى أنه منذ الإعلان عن توقيف الشبّان الـ3، بدأ عدد كبير من الأشخاص على «الفايسبوك»، وسواه من المواقع الإلكترونية بالمزايدة في «التحدّي والاستعداد للإمعان في الشتم»، بحسب ما ورد في رسالة وصلت إلى «الأخبار». ويسأل بعض المتابعين، ماذا لو عمد مئات الآلاف من الأشخاص على الإنترنت إلى «ذمّ» الرئيس، أو أيّ مسؤول آخر، هل سيوقفهم القضاء جميعاً؟ رفض ميرزا «الخوض في تفاصيل هذه المسألة، حيث يُدرس كل شيء في حينه». وفي هذا الإطار، لفت أحد الخبراء التقنيّين في مجال الإنترنت إلى «صعوبة بالغة» قد يواجهها القضاء أو الأجهزة الأمنية في تحديد الهويات الحقيقيّة للأشخاص على الإنترنت، لكون البعض يتّخذ أسماءً مستعارة، إضافةً إلى وجود تقنيات تخوّل من يريد الدخول إلى الإنترنت أن لا يُظهر عنوان اشتراكه (IP)، أو يمكنه أن يكون في لبنان مثلاً ويظهر أنّ اتصاله بالشبكة آتٍ من بلد آخر، مع عنوان افتراضي.
يُشار إلى أنّ الشابّ خضر س. كانت قد أوقفته مديرية الاستخبارات في الجيش، حسب قوله دون أن تُعلن أيّ جهة رسمية ذلك، في منتصف شهر آذار الماضي، على خلفية «تعرّضه بالإساءة إلى رئيس الجمهورية» على مدوّنته الإلكترونية، قبل أن يُطلق سراحه، ويُهدد بإحالته على القضاء.

BEIRUT: The Special Tribunal for Lebanon announced Tuesday it will hold a public hearing to allow former head of the General Security, who was detained over the killing of former Premier Rafik Hariri, to challenge the court.

Lebanon's ambassador to the U.N. Nawaf Salam urged all states to respect international law saying the force of law and not the law of force, which Lebanon supports, guarantees respect for human rights and equality among states.
Salam made his comment on Tuesday during a Security Council open debate on the rule of law.

To maintain peace and security, it was unlawful to use military option to deter and punish, and, as such, the ambassador welcomed the International Tribunal on the Law of the Sea, the International Court of Justice and other such bodies that contributed to the peaceful resolution of disputes.

However, he noted the selective application of certain rules, which threatened to render meaningless the concept of rule of law. One example were rulings directed at Israeli practices, where the Jewish state had annexed territories of other states, built settlements and committed transgressions against holy sites and engaged in acts of collective punishment and siege.

It had also made threats of war against Lebanon and committed daily violations of the country's sovereignty by land, sea and air, Salam told the Council.

He questioned why certain resolutions were implemented and others ignored, and why sanctions were announced against some but not others.

He noted that equality among states was one of the pillars of the international system, adding that the Council's credibility remained in question so long as there was no review of its structure or methods of work.

Still, Salam welcomed the Council's efforts to include the protection of civilians in its mandates and the need to uphold international humanitarian law. He welcomed its steps to create international and mixed tribunals to prosecute those who committed grave crimes, and looked forward to the activation of the Special Tribunal for Lebanon to restore justice to the victims, without politicization.

June 30, 2010 -The National - The Hariri tribunal is so inept, it almost seems deliberate

Last Updated: June 30. 2010 6:14PM UAE / June 30. 2010 2:14PM GMT Recently, one of the men arrested in the investigation of the 2005 assassination of Lebanon’s former prime minister, Rafiq Hariri, pursued a revealing legal manoeuvre. He demanded that the special tribunal set up by the United Nations a year ago to try those suspected of the murder show him the evidence used to arrest him.

The man is Jamil alSayyed, the former head of Lebanon’s General Security directorate and one of four generals arrested on the advice of United Nations investigators a few months after the Hariri murder. Mr al Sayyed spent four years behind bars, until he was released last year along with his colleagues by the tribunal prosecutor, Daniel Bellemare, because there was not enough evidence to indict them. Mr al Sayyed’s request shows how onetime suspects are now willing to take the tribunal on, largely because it has lost all momentum.


Mr al Sayyed’s innocence is a matter of conjecture. He was a main cog in the Syrian-dominated security network in Lebanon during the time Damascus ruled directly over the country. It was this network that investigators believe was behind Mr Hariri’s killing. The detention of Mr al Sayyed and his associates was repeatedly reconfirmed by the body set up to investigate the killing, the United Nations International Independent Investigation Commission (UNIIIC), whose last head was Mr Bellemare, before he became tribunal prosecutor. Yet it is also true that the investigators did not turn their suspicions about Mr al Sayyed into indictable offences. Therein lies the tribunal’s difficulties.


Five years after the Hariri assassination, we are nowhere closer to seeing the guilty accused. Back in 2005, the decision of the UN Security Council to set up an investigation of the Hariri killing was an innovation. It was the first time that the international organisation had looked into a political assassination, the rationale being that this would help deter such crimes in the future. UNIIIC was set up, and its first commissioner was Detlev Mehlis, a German judge who had investigated high-profile terrorist crimes in former West Berlin, including the 1986 LaBelle discotheque bombing.


Mr Mehlis had no doubt that the Hariri assassination was ordered by Syria, even if Lebanese individuals or groups also participated in the operation. His team began a police investigation, and interviewed Syrian officials and intelligence officers inside Syria and abroad. On the eve of his departure in December 2005, Mr Mehlis even recommended to his successor, the Belgian judge Serge Brammertz, that he arrest the former head of Syria’s military intelligence apparatus in Lebanon.


Mr Brammertz never did so. In fact he arrested no one during his two-year tenure. While this may have been because one of Mr Mehlis’ witnesses appeared unreliable, there were far deeper problems in the Belgian’s investigation. He cut back on police officers and added analysts. Analyses can address details of a crime, but only a police investigation, which entails taking suspects into custody and using their testimonies to unravel the decision-making hierarchy, can identify the guilty. In fact, Mr Brammertz did not investigate much at all before handing over to Mr Bellemare.


Was this intentional on Mr Brammertz’s part? I contacted him in April of last year for a book I was writing to give him an opportunity to respond to my criticisms of his work. I also wanted him to reply to allegations levelled at him by Mr Mehlis in an interview I conducted with the German for The Wall Street Journal. Mr Brammertz declined. However, it was difficult not to notice that his appointment after serving on the Special Tribunal for Lebanon – namely, as prosecutor for the International Criminal Tribunal for the former Yugoslavia – was a promotion by the UN, even though his performance in Beirut hardly merited such an accolade.


Perhaps that was precisely what the UN liked in Mr Brammertz. As Mr Mehlis later recalled, when he met Kofi Annan before starting his mission, the UN secretary-general told him that “he did not want another trouble spot”. Mr Mehlis did not oblige. He raised the heat on Syria and although he received Security Council backing, which strengthened his mandate, the UN bureaucracy must have winced at the tensions resulting from these confrontations.


Mr Bellemare has been a different kettle of fish. A Canadian judge, he had no experience of terrorist crimes when he came in. His tenure as commissioner, then as prosecutor, has produced little apparent progress. He seems to have information pointing to on-the-ground involvement by Hizbollah in Mr Hariri’s elimination, but two key questions remain: Does Mr Bellemare have enough to indict? And if he does, who will the prosecutor point the finger at, low-level operatives or higher-level decision-makers, including Syrian officials?


For now, we can only speculate. However, there seems less and less doubt that the two-year tenure of Mr Brammertz damaged the prosecution’s case, perhaps fatally. Mr Bellemare also discredited the tribunal by awaiting its formation before releasing the four generals, when, aware that there would be no indictments, he could have requested that the Lebanese authorities do so earlier.

Worst of all, key figures have left the tribunal one after the other, including Mr Bellemare’s chief investigator and two registrars. This implied, at the very least, that these individuals did not expect indictments in the foreseeable future; but in several specific cases the exits also hinted at Mr Bellemare’s managerial shortcomings.


Indictments may come later this year, but it seems doubtful, given what we know, that those who ordered the assassination will be charged. The zeal with which the tribunal’s president, Antonio Cassese, has pressed for this deadline indicates he is putting pressure on Mr Bellemare. Mr Cassese knows that the tribunal’s funding is closely tied to signs of genuine progress. He is right to be worried.

An MP with the March 14 coalition said media exaggeration of the latest arrest of an Alfa employee on suspicion of spying for Israel was an attempt aimed at causing confusion in the investigation into the assassination of former PM Rafik Hariri.
"It also targets the credibility of the investigations" conducted by police officer Wissan Eid in the Hariri murder case before his assassination.
Eid, Lebanese Internal Security Forces senior terrorism investigator, was assassinated Jan. 25, 2008.
At the time of assassination, Eid was also top Lebanese investigator into the Hariri murder.
"There is an attempt to exaggerate the issue of the (Alfa) detainee to discredit all reports" issued by the U.N. Committee investigating Hariri's assassination "and to signal that the probe may have been manipulated," the March 14 lawmaker said in remarks published Wednesday by Ad-Diyar newspaper.

Le juge de la mise en état du Tribunal spécial pour le Liban, Daniel Fransen, a enfin tranché : le 13 juillet prochain, à 15h, il entendra successivement le procureur, Daniel Bellemare, et le requérant, Jamil Sayyed, pendant 20 minutes dans la salle d'audience du TSL, en vue de prendre une décision relative à la requête déposée par l'ancien directeur de la Sûreté. Ce dernier avait demandé « la remise des éléments de preuve relatifs aux crimes de dénonciations calomnieuses et de détention arbitraire », dont il avait été victime.
La décision du juge de la mise en état est d'autant plus intéressante qu'elle vient contredire l'avis émis par le procureur, qui dans sa dernière réplique avait estimé que « tenir une audience sur des questions strictement légales de compétence et de qualité à agir n'est pas nécessaire », soulignant en outre que « le requérant avait déjà eu toute l'opportunité de présenter ses arguments au travers d'une procédure publique de dépôt d'écritures ». M. Bellemare avait également indiqué que le fait de reprendre oralement les mêmes arguments préalablement énoncés par écrit par M. Sayyed « serait contraire aux exigences d'une bonne administration de la justice ».
Tel n'est pas, semble-t-il, l'avis de Daniel Fransen qui, en ordonnant la tenue d'une audience publique, justifie sa décision par le fait qu'il « est dans l'intérêt de la justice d'organiser une audience au cours de laquelle le requérant et le procureur auront la possibilité de mettre en exergue ou de préciser oralement certains points fondamentaux de leurs argumentations sur la compétence du tribunal et la qualité du requérant à comparaître en justice. La tenue d'une audience publique constitue également une opportunité pour le juge de la mise en état d'obtenir du requérant et du procureur certaines précisions ou éclaircissements en lien », précise encore le juge qui fait cependant remarquer que le requérant « ne dispose pas d'un droit absolu à faire valoir ses prétentions oralement devant le tribunal ».
Après avoir entendu les arguments qui seront respectivement présentés par l'un et l'autre, Daniel Fransen leur posera toutes les questions qu'« il estimera utiles ».
Le juge de la mise en état devra ensuite statuer sur sa compétence à se prononcer sur la demande de M. Sayyed relative aux éléments de preuve, ainsi que sur la qualité de l'officier à ester en justice auprès du TSL. En cas de réponse affirmative à ces deux questions, il devra examiner la requête dans le fond.
Rappelons qu'une correspondance écrite avait eu lieu entre les trois parties au cours des trois derniers mois dans laquelle M. Bellemare avait réfuté, dans la forme, la demande de M. Sayyed, arguant que ce dernier n'étant ni accusé ni victime, il n'a pas par conséquent qualité à s'adresser au TSL. Qui plus est, avait avancé M. Bellemare qui s'était abstenu de se prononcer sur le fond de l'affaire, le TSL, qui est un tribunal d'exception, ne saurait être compétent puisque sa mission est limitée par son statut qui l'autorise à se pencher sur la seule affaire de l'assassinat de Rafic Hariri. M. Sayyed devait bien entendu prouver le contraire et motiver sa demande dans la forme aussi bien que dans le fond.

قرّر القاضي فرانسين تحديد موعد الجلسة العلنية الثانية للمحكمة الدولية الخاصة بجريمة اغتيال الرئيس رفيق الحريري. وكما الجلسة الأولى، تتناول هذه الجلسة قضية إعادة الحقوق الأساسية للواء جميل السيّد. الجلسة الأولى فكّت احتجازه، فهل تُسهم الجلسة الثانية في محاسبة المسؤولين عن ذلك الاحتجاز؟

دانيال فرانسين، قاضي الإجراءات التمهيدية في المحكمة الدولية الخاصة بجريمة اغتيال الرئيس رفيق الحريري، خالف موقف المدعي العام الدولي دانيال بلمار، مثبّتاً سلطته عبر إصداره أمراً قضائياً بعقد جلسة علنية في قضية طلب اللواء الركن جميل السيّد تسليمه مستندات تحتفظ فيها المحكمة في قضية اعتقاله التعسّفي.
الجلسة العلنية للمحكمة الدولية ستعقد في 13 تمّوز المقبل الساعة الثالثة بعد الظهر في مقرّ المحكمة في لايتسكندام (لاهاي). أصدر فرانسين أمراً بذلك يوم الجمعة الفائت وجّهه إلى بلمار وإلى رئيس مكتب الدفاع فرانسوا رو وإلى الوكيل القانوني للواء السيد المحامي أكرم عازوري.
ودعا فرانسين رئيس قلم المحكمة هيرمان فون هيبل إلى اتخاذ الإجراءات الآتية بحسب قواعد الإجراءات والأدلة (139):
1ـــــ إعداد وحفظ محضر كامل ودقیق لجمیع الإجراءات، بما في ذلك التسجیل الصوتي أو التدوین أو التسجیل بالفیدیو.
2ـــــ حفظ جمیع الأدلة المادیة المقدمة أثناء الإجراءات، والمحافظة عليها.
3ـــــ دراسة احتمال منح الإذن لغیر رئیس قلم المحكمة بالتقاط صور للمحاكمة أو إجراء تسجیلات فیدیو أو تسجیلات صوتیة.
وقرّر القاضي البلجيكي تقسيم مجريات الجلسة إلى قسمين: يمنح بداية كلّ من اللواء السيد والمدعي العام بلمار عشرين دقيقة لتقديم وجهتي نظرهما، ومن ثمّ يطرح القاضي أسئلة على الفريقين بخصوص القضية.

وافق فرانسين بلمار رأيه في أن السيّد حصل على الفرص الكافية للتعبير الخطي عن موقفه
عرض القاضي فرانسين في نصّ قراره مواقف الفريقين في فقرتين جاء فيهما أن السيد عدّ طلبه من قاضي الإجراءات التمهيدية عقد جلسة علنية لشرح موقفه حقاً من حقوقه الأساسية بحسب الفقه القانوني الدولي. كذلك أشار السيد إلى أن عقد جلسة علنية يدحض «إجراءات العدالة السرّية التي لا تخضع للتدقيق المعلن وضمانة شفافية الإجراءات العدلية». ويتابع فرانسين نقلاً عن السيد قوله إن عدم عقد جلسة علنية يعني حرمان السيّد حقّاً أساسياً يتمتّع به في التعبير أمام القضاء عن موقفه «بالصوت الحي».
أما المدعي العام فرأى، بحسب فرانسين، أن «عقد جلسة علنية لبحث قضايا قضائية بحتة» غير ضروري. فبحسب بلمار، لقد مُنح السيد الفرص الكافية لتقديم وجهات نظره من خلال تبادل خطي وعلني. وبالتالي فإن بلمار يرى أن «إعطاء السيد فرصة التعبير عن المواقف التي كان قد عبّر عنها خطّياً مناقض لمتطلّبات الإدارة القضائية الجيدة» (permettre au Requérant de faire valoir oralement des arguments qu’il a déjà énoncés par écrit serait contraire aux exigences d’une bonne administration de la justice).
فرانسين شاطر بلمار لكن...
يوافق فرانسين بلمار رأيه في حصول السيّد على الفرص الكافية للتعبير الخطي عن موقفه (الفقرة 7)، لكنه يعود ليذكر في الفقرة التي تلي ذلك أنه «نظراً للظروف الخاصة للقضية ولأهمية الأسئلة التي تطرح من خلالها، يرى قاضي الإجراءات التمهيدية أن في مصلحة العدالة تنظيم جلسة علنية» (Cela étant, compte tenu des circonstances particulières de la présente affaire et de l’importance des questions qu’elle soulève, le Juge de la mise en état estime qu’il est dans l’intérêt de la justice d’organiser une audience). ويضيف أن الجلسة ستمنحه فرصة حصوله على بعض التوضيحات أو الإضاءات تخصّ مثلاً «القوانين المرعية الإجراء الخاصة بالتعاون القضائي الدولي».
خيبة لبلمار وفريقه
كان بلمار قد ذكر في كتاب جوابي على طلب السيد، في 23 حزيران الفائت، أن عقد جلسة كهذه علنية «غير مناسب» وحسم المدعي العام بأن الجلسة العلنية «لن تزيد من فهم قاضي الإجراءات التمهيدية لما تقدّم» It would not enlighten the Pre-Trial) Judge’s understanding of the Applicant’s submissions). وأصرّ بلمار في كتابه على أن فرانسين «مطّلع اطلاعاً كاملاً من خلال المراسلات الخطية الدسمة التي وصلته، وبإمكانه اتخاذ قرار بناءً على ذلك»is fully briefed, based on the) exhaustive written submissions he received, to pronounce on the issues). ولم يتوقّف بلمار عند هذا الحدّ، بل رأى في الفقرة الـ13، أن عقد الجلسة «لا يحبّذ التوفير القضائي» (judicial economy). فبدا أن عقد الجلسة بالنسبة إلى بلمار مضيعة للوقت ولموارد المحكمة. إذ ختم كلامه عن ذلك قائلاً إن عقد جلسة علنية «لن يساعد على توضيح القضية» ولن يكون لمصلحة السيّد، وبالتالي أشار بوضوح إلى «وجوب رفض طلب عقد جلسة علنية» (The Applicant’s request for a hearing should be denied).

بُعيد الجلسة الاولى التي عقدتها المحكمة الدولية في نيسان 2009 والتي أمر خلالها القاضي دانيال فرانسين فكّ احتجاز الضباط الاربعة، علت أصوات بعض القانونيين والسياسيين والاعلاميين في لبنان والعالم تقول إن قرار فرانسين كاف للحسم بأن المحكمة غير مسيّسة وبأنها تتمتّع بالصدقية. واليوم بعد صدور قرار فرانسين المخالف لموقف بلمار يُتوقّع أن يتكرّر تعالي تلك الاصوات. غير أن مطلقي تلك الأصوات قد يستفيدون من معرفة أن في إصلاح الأخطاء إيجابية يفترض أن تُثمّن ولكن كان يفترض تجنّب وقوع تلك الأخطاء منذ البداية. ويفترض كذلك التعويض للمتضرّرين. وليس في كلّ ذلك ضمانة لعدم تكرارها وبالتالي فلا حسم في موضوع الصدقية المستحقّة.

في 17 آذار 2010 وجّه اللواء جميل السيد بواسطة محاميه أكرم عازوري كتاباً الى رئيس المحكمة القاضي أنطونيو كاسيزي طلب فيه تسليمه مستندات ودلائل تتعلّق باعتقاله التعسّفي.
وفي 15 نيسان أحال الرئيس كاسيزي الطلب الى قاضي الإجراءات التمهيدية دانيال فرانسين ليقوم اولاً بتحديد الصلاحية القانونية في النظر في هذه القضية، وثانياً، بدراسة معمّقة للطلب إذا حسمت قضية الاختصاص. في 21 نيسان حدّد القاضي فرانسين البرنامج الزمني لتقديم كلّ من السيد والمدعي العام دانيال بلمار موقفهما. وطبقاً لذلك البرنامج تقدّم السيد بكتاب شرح فيه موقفه في 12 أيار وردّ عليه بلمار في 2 حزيران فعاد السيد وردّ على الردّ في 17 حزيران وأخيراً تقدّم بلمار بكتاب في 23 حزيران.

جلسة لاهاي لبحث قضيّة شهود الزور: كشف الخلل واجب لا إنجاز

قرار قاضي الإجراءات التمهيدية فرانسين عقد جلسة علنية يتواجه فيها المدعي اللواء جميل السيد مع المدعي العام في المحكمة دانيال بلمار، سيكون له تأثيره على أمور كثيرة تخص المحكمة. صحيح أن بإمكان رئيس الجلسة تجاهل الكثير من المطالب، إلا أن الأمر يظل في حدود التقديرات. ذلك أن ما يمكن المحكمة أن تخرج به من هذه المداولات ينحصر في خيارات محدودة، بينها:
أولاً: أن إقرار حقه الحصول على ما يعتبره ملفات وأدلة تخص الشهود الزور الذين أعلن الادعاء العام مباشرة أو من خلال ناطقين باسمه عدم أهليتهم في ملفاته، سوف يعقبه قرار بتسليم السيد هذه الملفات وهذه الأدلة، وهي تتيح له بقدر كبير إكمال ما هو لديه ولدى وكلاء الضباط الأربعة، ما يتيح عملياً الوصول الى إطلاق عملية محاكمة الشهود الزور ومن يقف خلفهم حتى لو قررت المحكمة أن الأمر ليس اختصاصها.
ثانياً: أن رفض المحكمة الأخذ بالأسباب التي يقدمها السيد طلباً لهذه المعلومات، سوف يقود الى اعتبار الأدلة جزءاً من التحقيق أو من سريته، وهو ما يعيد ملف هؤلاء الى المحكمة حكماً، ما يؤدي الى إلغاء قرار عدم الاختصاص، ما يمكّن السيد من طلب محاكمة هؤلاء أمام المحكمة نفسها.
ثالثاً: أن تقبل المحكمة طلبات السيد وتطلب من المدعي العام تقديم ما لديه من أدلة إليه، وأن تعطي بلمار في الوقت نفسه هامش الاستنساب في اختيار ما يريد أن يعطيه للسيد من لائحة مطالبه. وهو سوف يتطلب جولة ثانية من المقاضاة والدفاع وخلافه، ولن يكون بمقدور المحكمة تحت أي طائل التسويف في هذا الملف وهي التي تحتاج الى ما يعزز الثقة بها لا ما يزيد من الشكوك.
في هذا السياق، ثمة اعتقاد بأن مجرد موافقة قاضي الأمور التمهيدية عقد الجلسة العلنية في 13 تموز المقبل، قد يستهدف الوصول الى أمور أخرى. أي إنه قبل بعقد الجلسة وقد يحكم لمصلحة بلمار. وهو يكون قد أعطى انطباعاً عن رغبته في التعاون وإفساح المجال أمام الجهات المتضررة للتعبير عن رأيها وإثارة قضاياها. وهو يستهدف عملياً الحصول على صدقية وشرعية مهنية وأخلاقية لتحصين المحكمة كإطار عام، ما يسهل على المدعي العام الوصول الى قرار اتهامي يتردّد بقوة أنه سياسي بامتياز.
ولذلك، فإن النجاح في إلزام بلمار من خلال المحكمة نفسها العودة الى ملف الشهود الزور يجب ألا يقتصر على الإطار العام، بمعنى أن الموضوع هنا ليس نجاح جميل السيد في الحصول على قرار بعقد جلسة علنية، ولا بأن يثير موضوع الشهود الزور أمام هيئة قضائية عليا، بل إن الموضوع هو العمل بجدية على اعتبار محاكمة الشهود الزور شرطاً إلزامياً للعبور نحو تحقيقات سليمة من جميع النواحي، ولا سيما أن التحقيقات الجارية الآن مع مواطنين لبنانيين لهم انتماءات سياسية مختلفة، بينها ما يتصل بحزب الله، إنما تشير الى أن في فريق المدعي العام محققين يملكون معلومات من دون إثباتات، لا بل إنهم يقدمون معطيات مبنية على بناء هش، جرى ترتيبه أو تركيبه في ليل.
وفي هذا السياق لم يتوقف الفريق اللصيق بالرئيس سعد الحريري عن الحديث عن «أن مسار الأمور يتجه صوب الظن بمجموعة عناصر من حزب الله بالوقوف خلف عملية الاغتيال». ويضيف هؤلاء تقديراتهم بأن قيادة حزب الله لن تبادر الى رد فعل قد يجعلها في قفص الاتهام
الغرب لا يعرف أنه يحمّل نفسه مسؤوليّة خطوة قد توقعه في الفخّ
الشعبي، وخصوصاً أن الحريري نفسه عرض على قيادة الحزب أن يخرج هو إلى اللبنانيين ويعلن أن المتهمين بالقتل مجموعة ضالة لا قيادة ولا رعاية لها، لا في قيادة حزب الله ولا عند الشيعة.
بعيداً عن سذاجة الحريري وأصحاب هذه النظرية العبقرية، فإن الأمر برمّته يعود الى الدائرة السياسية الإقليمية والدولية التي تتولى إدارة أعمال فريق المحققين في المحكمة، وخصوصاً بعدما أظهرت المعلومات المسرّبة أن جل ما يعرفه محققو بلمار، هو ما كان قد قدّمته إليهم على كتب معلومات أجهزةٌ أمنية، بينها قوى الأمن الداخلي في لبنان وبعض الأجهزة العربية والإسرائيلية. ولم يتجاوز جهد فريق بلمار حدود درس التقاطعات وخلافه.
ولذلك، فإن قرار قيادة حزب الله التعاون مع المحكمة الدولية وفريق الادعاء فيها، لا يمكن تحويله الى رصيد في مصلحة المحكمة أو الادعاء العام فيها. بل على العكس، فإن تعاون الحزب ينطلق من حسابات تعود الى الداخل اللبناني وإلى مناخ شعبي وسياسي يناسب المقاومة ويوفر لها حصانة إضافية. وبالتالي، فإن الحزب كان واضحاً في مراسلاته مع المعنيين بالتحقيق في المحكمة وفي القضاء اللبناني ولدى جهات خارجية أخرى، بأنه ليس في موقع منح أحد براءة عن الجرائم التي ارتكبت بحق مواطنين لبنانيين بناءً على مشروع سياسي، وأن الحزب لا يتعامل مع المحكمة على أساس أنها جهة موثوقة، الأمر الذي يعيدنا الى نقطة الصفر وإلى لحظة الخطر.
صحيح أن بمقدور المدعي العام اتهام من يشاء من دون التوقف عند أي اعتبارات سياسية. لكن الأصح أن من يتعامل مع ملف بهذه الحساسية بهذه الطريقة هو واحد من اثنين: إما شخص مخبول يجب تنحيته ومحاسبته، وإما عميل يمثّل مصالح أعداء المقاومة ولبنان، وبالتالي وجبت مواجهته ومعاقبته. وهو أمر في حالة لبنان، يتجاوز الأشخاص والهيئات ويلامس مصالح الدول الكبرى.

Daily Star - Lebanon Special Tribunal to let Sayyed challenge court in public hearing

BEIRUT: The Special Tribunal for Lebanon announced Tuesday it will hold a public hearing to allow former head of the General Security, who was detained over the killing of former Premier Rafik Hariri, to challenge the court.
Jamil al-Sayyed filed a request in March for access to investigation files to prove his assertion that he had been the victim of slander and was arbitrarily detained from 2005-09.
Sayyed and the prosecutor will each have 20 minutes in the hearing on July 13 to present their arguments to the court, said judge Daniel Fransen in a ruling dated June 25.
The Lebanese general was placed in temporary detention on August 30, 2005, on an arrest warrant issued by a Lebanese judge. The UN tribunal ordered his release along with three other generals on April 29, 2009.
The head of the STL said last month that it could file charges by the end of the year. – AFP

Les services secrets de l'armée ont confirmé hier l'arrestation d'un technicien de l'opérateur de téléphonie mobile alfa, accusé de collaboration avec Israël. L'employé, appelé Charbel Q., né en 1954, natif de Almane, Chouf, a été écroué le 24 juin. Toujours selon le communiqué, il a avoué avoir collaboré avec le Mossad israélien depuis 1996. Il est soupçonné d'avoir surveillé, pour le compte de l'ennemi, certaines lignes durant la guerre de 2006, tout comme il était capable de neutraliser ou de faire fonctionner tout poste émetteur. Il pouvait faire de même pour la programmation des lignes, étant donné qu'il était un passage obligé pour toutes les opérations de communication de la compagnie, selon les informations divulguées.
Actuellement, les autorités tentent de découvrir d'éventuels complices au collaborateur. Les experts estiment que le technicien d'alfa aurait pu constituer un réseau à lui tout seul ou faire partie d'un réseau plus étendu. C'est en coopérant avec une ou plusieurs autres personnes que Charbel aurait pu avoir accès aux écoutes et aux enregistrements.

Trois jeunes aounistes arrêtés pour diffamation contre Sleiman sur Facebook

C'est une première au Liban ! Trois jeunes aounistes ont été arrêtés pour diffamation contre le président de la République pour des opinions exprimées sur... Facebook. Hier, cette affaire soulevait de nombreuses questions sur la nature de l'intervention de l'État sur Internet.
Le procureur général près la Cour de cassation, le juge Saïd Mirza, a ordonné hier l'arrestation de trois personnes accusées de diffamation contre le président de la République Michel Sleiman sur Facebook. Selon notre chroniqueuse judiciaire Claudette Sarkis, les trois jeunes hommes sont Naïm Georges Hanna (27 ans), Antoine Youssef Ramia (29 ans) et Chebel Rajeh Qassab (27 ans), ils feraient partie du mouvement aouniste et leur dossier a été transféré au parquet. Le juge Mirza a également émis un avis de recherche et d'amener à l'encontre d'un quatrième homme, Ahmad Ali Chouman, sur base des mêmes accusations.
Interrogé par notre chroniqueuse judiciaire, le juge Mirza a précisé qu'il est de ses prérogatives d'initier une action « spontanément », suivant le code pénal et la loi des imprimés, en cas de calomnie contre le président de la République. « Je ne suis proche d'aucune partie ni d'aucune personne, a-t-il assuré. C'est suivant ma seule appréciation que je décide de saisir le parquet. Il est de mon devoir d'agir quand le président de la République est attaqué, et j'ai lu des propos très durs (sur Facebook) à son encontre. »
Pour sa part, le bureau du ministre de la Justice Ibrahim Najjar a publié un communiqué dans lequel il estime que « ce qui a été écrit dans certains médias fait l'amalgame, d'une part, entre les libertés de presse, de parole et d'expression politique, qu'il faut préserver et, d'autre part, entre les crimes liés à la diffamation et à la calomnie, notamment celles qui touchent le chef de l'État ». « Les écrits, les qualificatifs et les termes peu convenables, diffusés sur Internet, sont passibles de poursuites et de sanctions, dans les cas où les règles de la loi sur les imprimés s'appliqueraient, ajoute le texte. La liberté des médias au Liban et dans tout pays civilisé atteint ses limites quand son contenu n'est que pure calomnie et vise à saper l'institution du président de la République, le chef de l'État ». Le communiqué précise que dans ce cas, « il était des prérogatives du juge concerné d'agir spontanément pour poursuivre les contrevenants, les faire arrêter et les transférer devant le tribunal compétent ».
Par ailleurs, une vague de protestations pouvait d'ores et déjà être constatée sur le réseau social Facebook hier. Des groupes se sont formés pour protester contre les arrestations et appeler le chef de l'État à mettre un terme aux poursuites.
Le député Nabil Nicolas s'est étonné de cette vague d'arrestations arbitraires contre des étudiants et des jeunes pour leur « crime de s'être exprimés librement ». « Le juge Mirza ferait mieux de lutter contre le vrai crime, quand des victimes non armées tombent sous les balles de tueurs, ou alors contre le fléau de la drogue qui sévit dans notre société », a-t-il poursuivi. Tout en réaffirmant son attachement à la protection de la présidence de la République, il a appelé le chef de l'État à « intervenir immédiatement pour que ces jeunes rentrent chez eux, suivant le principe de liberté que leur assure la Constitution ». Le député a déclaré qu'il allait suivre personnellement le cas de ces jeunes hommes jusqu'à leur libération.

Civil-rights groups call for end to practice of torture

BEIRUT: A collection of anti-torture and arbitrary detention civil society groups have joined forces in denouncing the continuation of torture and calling on the Government to eradicate the practice.
“We would like to call on the government of Lebanon to demonstrate their firm opposition to torture and other forms of ill-treatment,” read the joint statement issued Saturday. “To condemn these practices unreservedly and to make clear to all members of the security forces that torture and ill-treatment are not tolerated.”
The statement, endorsed by Amnesty International and six domestic NGOs, is timed to coincide with International Day for the Support of the Victims of Torture.
“In Lebanon, torture and other cruel, inhuman or degrading treatment or punishment are still resorted to by state security officers and non-state actors,” the statement said.
“[Such acts are] condemned by the international community as an offence to human dignity and prohibited in all circumstances under international law.”
Lebanon ratified the UN Convention against Torture (CAT) in 2000 and the Optional Protocol to the UN Convention of Torture (OPCAT) in December 2008.
Under OPCAT guidelines, new signatories are given one-year to set up a National Preventative Mechanism (NPM), an independent body with the right to inspect detention centers without prior notification.
In June 2009 a committee was formed by Justice Minister Ibrahim Najjar to propose the introduction of the NPM. Despite submitting a draft law to the minister in September it remains to be established.
As part of its CAT commitments, the government is also obliged to produce a state report detailing the situation in the country – a step it has thus far failed to take.
“This process is too slow and the state report should be issued at once,” said Darine al-Hage, director of civil rights group ALEF-Act for Human Rights, one of signatories.
Article 401 of the Lebanese Penal Code prohibits torture, stipulating that anyone who “severely beats someone with the desire to obtain a confession about a crime or information regarding it will be imprisoned from three months to three years.”
Human-rights groups, however, say the law is too vague.
“Even more appalling is the failure of the state to investigate reported cases, to protect victims and to prosecute perpetrators,” the anti-torture statement states.
“The fact is that there are various reported cases of torture but no perpetrators are brought to justice,” said Hage. “Reports of torture show us that it is easy to resort to violence.”

Lebanon arrests three for alleged Facebook defamation of Sleiman

BEIRUT : Lebanon arrested on Monday three people who allegedly used the social networking website Facebook to slander President Michel Sleiman, a judicial source said.
“General prosecutor Saeed Mirza ordered the arrest of Naim George Hanna, 27, Antoine Youssef Ramia, 29, and Shebel Rajeh Qasab, 27, after authorities interrogated them on charges of libel, slander and defamation against the president on Facebook,“ the source told AFP on condition of anonymity.
Mirza also issued a warrant for the arrest of a fourth Lebanese, Ahmad Ali Shuman, on the same charges.
By law, Lebanon’s general prosecutor must take action in any case of libel, slander or defamation against the president or any “sister state” of Lebanon regardless of whether a plaintiff comes forward to press charges.
The Justice Ministry said the case met the requirements for a defamation lawsuit, adding “media freedom in Lebanon and any civilized country reaches its limits when the content is pure slander and aims at undermining the head of state.
“The inappropriate comments published on websites are subject to prosecution and punishment as they meet the requirements for litigation as stipulated in the media law and penal code,” the statement said.

«عميل الاتصالات»: اليد الإسرائيلية تمسك بشبكة الخلوي في لبنان

فَتح «كتاب» تفكيك شبكات التجسس الإسرائيلية في لبنان، الأوراق على فصول أمنية جديدة، مع تمكن مخابرات الجيش اللبناني من تسجيل انجاز نوعي جديد في مواجهة «أدمغة الأمن والاستخباراتي الإسرائيلي»، عبر توقيف الموظف في شركة «ألفا» العميل شربل ق. لتكتمل فصول بدأت بتوقيف «المقاوم» و«الفدائي» علي الجراح وشقيقه يوسف مرورا بأكثر من 120 عميلا تهاووا الواحد تلو الآخر، طوال العامين الأخيرين، على ايدي الأجهزة العسكرية والأمنـية اللبنانية. وبدا من خلال هذه الشـبكات أن اسـرائيل لم توفر لا القطاع المصرفي ولا الـسلك العسكري أو الأمني، كما بعض الدوائر القريبة من مناخ المقاومـة، في حالات معينة، لكن يبقى الانجاز الأكبر في محاولة قطع أيدي وآذان «الموساد» في قطاع الاتصالات.
وفي حين يصنف توقيف «عميل الاتصالات» سبقاً أمنيا في سياق الحرب المخابراتية المفتوحة، من شأنه غرس شوكة أمنية في خاصرة الإسرائيلي التي تنزف يوماً تلو الآخر، إلا أنه يكرّس علامات استفهام عدة حول انكشاف البلد أمنياً، خصوصاً على مستوى شبكات الاتصالات، حيث لم تقتصر مهام شربل ق. على التنصت فحسب، بل أسهمت في مشاركة العدو بالبيانات المتعلقة بمستخدمي الشركة الخلوية عبر منظمة متشعبة الأبعاد، خاصة بعد اعترافه بزرع برمجيات وشرائح الكترونية خاصة تم تزويده بها من قبل الاسرائيليين، في محطات الارسال بحيث تصبح امكانية التلاعب بقاعدة البيانات والمعلومات أكثر سهولة من قبل الجانب الاسرائيلي.
وقد تلقت دوائر استخبارات العدو الإسرائيلي، بتوقيف شربل ق. «ضربة قاصمة جديدة» على صعيد تفكيك الشبكات المتعاملة معها، والمنتشرة في مختلف أرجاء وقطاعات المجتمع اللبناني، حيث يتبيّن تباعاً مستوى «الانجاز غير المسبوق»، الذي حققه الجيش اللبناني بإلقائه القبض على واحد من «أهم واخطر عملاء الحلقة الجهنمية» التي يسـتمر العدو في تطويق أعنـاق اللبنانيين بها منذ عقود طويلة.
وتبرز فرادة هذا الانجاز النوعي، في التمكّن من الكشف عن نوع جديد من الاختراقات الخطيرة جداً للأمن اللبناني، مرتبط هذه المرة بـ «قطاع الاتصالات الخلوية في لبنان»، بعد اختراقات أمنية مماثلة، سبق أن أميط اللثام عنها مؤخرا سواء في القطاع المصرفي، أو على صعيد بعض المواقع داخل الأجهزة الأمنية والعسكرية الرسمية..
ورغم عدم غرابة استهداف العدو قطاع الاتصالات الحيوي جدا، شأنه في ذلك، شأن محاولاته المستمرة في اختراق واستهداف كل مفاصل الأمن اللبناني.. إلا أنّ حجم التطور التكنولوجي الهائل، وما يفرضه من تزايد في مستوى الاعتماد على وسائل الاتصال الحديثة في الحياة اليومية، يرفع من مستوى اهتمام العدو في اختراق هذا القطاع الحساس.. وبالتالي، البحث عن تجنيد شرائح واسعة من العاملين في حقل الاتصالات، مع التركيز على تجنيد ذوي اختصاصات فنية عالية ومحددة، تؤمن له تحقيق وتنفيذ برامجه ومخططاته العدائية.
هذا الواقع ينطبق أكثر ما ينطبق على تجنيد شربل ق. حيث تُبيّن معطيات التحقيقات الأولية المتوفرة أنّ العميل المذكور يعتبر من أبرز الموظفين الفنيين في شركة «الفا»(«سيليس سابقاً»)، وقد سبق له أن شغل فيها مناصب رفيعة منذ تأسيسها في العام 1994، وهو يتولى اليوم مسؤولية في احد الأقسام الفنية الأساسية التابعة للشركة (قسم البث الراديوي والإرسال Radio and Transmission)، ويدير فريقاً من المهندسين المتخصصين.
وبذلك، يعد مجال عمل شربل، من المجالات الهامة جدا للمخابرات الإسرائيلية على صعيد اختراق منظومة الهاتف الخلوي واتاحة المجال أمامها للتلاعب، بالمعطيات الفنية في الشركة وخصوصاً القسم الذي يعمل فيه العميل. وهي بحسب أوساط خبيرة، تعتبر معطيات ذات طبيعة حساسة للغاية في عالم الاتصالات.
من هنا، فإنّ عملية توقيف «عميل الاتصالات»، وبالنظر إلى المهام الوظيفية التي يشغلها في الشركة، تُظهر أنّ اصطياده، هو انجاز ثمين جداً، من شأنه الإضاءة على «فصول مذهلة»، عن المستوى الذي تضطلع به مخابرات العدو من حيث إمكان سيطرتها وقدرتها على التحكم بمنظومة شبكة اتصالات الهاتف الخلوي في لبنان.. ومعها، يبدو أنّ كل مستخدمي هذه الشبكة، على امتداد سنوات طويلة، كانوا عرضة لممارسات أمنية خطيرة، وتعدّ مباشر على أدق تفاصيل حياتهم، من قبل العدو الإسرائيلي، من خلال هواتفهم النقالة. ومن بين هذه التعديات:
1- كشف الشبكة الخلوية العائدة للشركة بالكامل امام الاسرائيلي، معلوماتياً وفيزيائياً، من خلال المعطيات التي قدّمها العميل المذكور للعدو، حول كل تفصيل فنّي ذي صلة بالشبكة، وقيامه بتثبيت أجهزة ومعدات فنية على الشبكة، تتيح لمخابرات العدو الحصول على بيانات حركة الاتصالات، وتوفير القدرة لها لتنفيذ عمليات تنصت واسعة ومركّزة على كل الخطوط الهاتفية التابعة للشركة، والحصول على ناتج كل حركة الاتصالات العائدة لهذه الارقام (الناتج الصوتي)، وخزنها لدى الاسرائيلي.
2- تمكين العدو من تتبع ورصد الاشخاص والاهداف التي يعمل عليها، بالاعتماد على حركة الهاتف الخلوي. ولهذه الخدمة، أهمية خاصة بالنسبة الى العدو على صعيد ملاحقة ومتابعة ومراقبة واستهداف من يشاء.
3- ما يزيد من حجم المخاطر المترتبة، بالإضافة الى ما تقدم، أنّ العدو بما يمتلكه من إمكانات تكنولوجية رائدة ومتطورة للغاية في عالم الاتصالات، اصبح بمقدوره ليس فقط التنصت على مستخدمي الهاتف الخلوي وتتبع تحركاتهم، بل انه باستفادته من البيانات والسجلات الفنية للهاتف الخلوي، التي كان يتزوّد بها، عبر عميله في شركة الاتصالات، وقيام هذا العميل بتحديث وتوفير هذه البيانات لمشغليه الاسرائيليين بشكل دوري، على مدى سنوات عمالته، من شأن ذلك كله، تمكين العدو من السيطرة على حركة الاتصالات في الشركة والتلاعب بها، بما يخدم أهدافه ومخططاته.
4- يتضح أيضاً، أنّ أهم ما وفّره «عميل الاتصالات»، لمشغليه الإسرائيليين، هو «الكودات والأرقام السرية» الخاصة بتشغيل ومراقبة وصيانة محطات وخلايا الاتصال المنتشرة في جميع المناطق اللبنانية، فضلا عن نطاق إشراف وتغطية هذه المحطات، وكل ما يطرأ عليها من تحديث أو تعديل، بالإضافة إلى «الأرقام والكودات»، الخاصة بكل هاتف خلوي مستخدم موجود على شبكة الفا.
ومع اعتراف شربل ق. بقيامه بزرع برمجيات وشرائح الكترونية خاصة، زوّده بها الاسرائيلي، في محطات الارسال العائدة للشركة المشغّلة، تصبح إمكانية التلاعب في بيانات الاتصال لأي من هذه الخطوط، أكثر سهولة بالنسبة إلى خبراء الاتصالات التابعين للمخابرات الإسرائيلية.. إذ يمكن، والحال هذه، لخبراء العدو القيام بتعديل أي من هذه البيانات لحظة قراءتها أو ورودها من المحطات، وفقا للشروط التي يضعها المبرمج.
كما يمكن، بفضل حصول خبراء العدو على «مفاتيح الدخول» الخاصة بالبيانات السرية للخطوط الهاتفية المستخدمة، تنفيذ عمليات اتصالات وهمية، من أي خط موجود على الشبكة، وإظهار وجود اتصالات قام بها الرقم الأصلي، بدون أن يكون حامل هذا الرقم قام بذلك فعلا..
وعليه، فإنّ العنوان الأساسي، للدور الذي أدّاه «عميل الاتصالات» في خدمة مشغليه الإسرائيليين، يتركز حول مستوى الاختراق، الذي وفره العميل المذكور، لخبراء العدو في تمكينهم من الولوج إلى محطات البث والإرسال، والى مراكز التحكم العائدة لشركة الهاتف الخلوي، مع كل «الداتا» التي تحويها.. مع ما يعنيه ذلك من اتاحة الامكانية للإسرائيلي لـ «إثبات أو محو» أي جزء من هذه المعطيات أو ما يتعلق بها..
وفي هذا السياق، يمكن القول ان الامساك بهذا العميل، من قبل الجيش والكشف عن «المهمات الخطيرة» التي كان يؤديها للعدو الاسرائيلي على صعيد اختراق قطاع الاتصالات في لبنان، هما مؤشر على وجود استهدافات كثيرة أخرى يمارسها العدو ضد هذا القطاع، قد تكون أشد فداحة بمخاطرها، مما نشهده.
في هذا السياق، ثمة أسئلة عدة تطرح أبرزها:
- الى أي مدى بلغ حجم التخريب والتلاعب اللذين يضطلع بهما العدو داخل قطاع الاتصالات الخلوية وسواها في لبنان؟
- ما هو مستوى «المخاطر والتهديدات الكارثية»، المحدقة بأمن اللبنانيين واتصالاتهم وتحركاتهم اليومية؟
- من يضمن سلامة وأمن استخدام الشبكات الهاتفية الخلوية او الثابتة، بعد الكشف عن قدرة مخابرات العدو، على التحكم بكل البيانات وخصوصية الاتصالات وسريتها، وما يتعلق بها من الناحية الفنية؟
- هل باستطاعة أحد إجابة المواطنين اللبنانيين عن الإجراءات المطلوب اتخاذها، لمنع الإسرائيلي من أن يصبح شريكا ومتدخلا بخصوصيات كل مواطن، يستخدم هاتفاً خلوياً في لبنان؟
- أين دور الجهات الرسمية المعنية (من مجلس النواب، وتحديدا لجنة الاعلام والاتصالات النيابية الى الحكومة، وتحديدا وزارة الاتصالات، والهيئة الناظمة للاتصالات)، في مراقبة عمل شركات الهاتف الخلوي وحماية امن اللبنانيين وامن المسؤولين عن أمن اللبنانيين والبلد، والذين هم حكماً، ليسوا بمأمن من متابعة العدو الإسرائيلي لكل ما يرتبط بهم؟
- الا ينذر ما تكشّف من أمر افتضاح «عميل الاتصالات»، أنّ اليد الإسرائيلية تطبق فعلا او تكاد، على كل شبكات الاتصال في لبنان؟

Alfa exec leaked sensitive data to Mossad - report

BEIRUT: A senior executive at mobile telecom firm Alfa has been providing sensitive information to the Mossad since 1996, As-Safir newspaper reported on Monday.
The man identified as “Charbel K.,” who occupies a sensitive post in Alfa, was arrested Thursday night while heading back home from work, added the newspaper.
The 56-year-old Lebanese, who hails from the Chouf village of Alman, was detained after being watched by members of the Lebanese Army Intelligence Directory on suspicions of collaborating with Israel.
Also, the operation was carried out in coordination with Lebanese Army Commander General Jean Kahwaji and the prosecutor’s office.
As-Safir quoted some employees in Alfa as saying that Charbel was responsible for the BTS section which enabled him to control more than 650 Alfa telecommunication stations across Lebanon.
During primary investigations with Charbel, he confessed that he had been dealing with the Mossad since 1996.
He admitted that Israeli authorities had ordered him to place, in all stations belonging to the firm,technical devices which enabled the Mossad to control the whole process of Alfa cellular communications.
According to As-Safir, Charbel rendered valuable services to Mossad during Israel’s summer 2006 war against Lebanon, including wiretapping on the cellular calls of several individuals
Given his sensitive post, Charbel could watch and trace the movement of any Alfa subscriber along with determining his phone number, address and personal information.
Security forces are trying to determine whether the suspect had any partners or whether he was a member of a wider spying network.
Following Charbel’s confessions, a unit from the Lebanese Army Intelligence Directory raided the headquarters of Alfa in the Furn al-Shebbak neighborhood Friday, confiscating Charbel’s personal computer, along with documents from his car and office.
Communication devices possessed by the Alfa executive were also withheld and are being examined by technicians from the Lebanese Army.
In remarks published by As-Safir Monday, Telecommunications Minister Charbel Nahhas said he heard of the arrest via media outlets.
Nahhas said he contacted Alfa to ask why it hadn’t informed him that Charbel had been apprehended, conveying his feelings that members of the Alfa staff were “confused.”
Nahhas said the detainee had been working for a long time in the telecommunications sector, noting that he had been an employee at Cellis, one of the two firms previously operating cellular telecommunications in Lebanon.
Charbel was on the Telecommunications Ministry’s staff before assuming his responsibilities at Cellis, said Nahhas.
The minister added that he was interested in the issue because there was a contract signed between the Lebanese state and Alfa, “and we want to make sure the parties we are dealing with are resilient and not infiltrated [by the Mossad].”
On Monday, Army Command issued a statement announcing that a person identified as “Ch. K,” had been arrested on suspicion of collaborating with Israel, adding that the detainee was being interrogated by concerned judiciary.
According to the National News Agency, Head of Media and Telecommunications Parliamentary committee, Bint Jbeil MP Hassan Fadlallah, also a Hizbullah official, will hold a news conference on Tuesday during which he will touch on the arrest of Charbel.
Separately, head of the Progressive Socialist Party MP Walid Jumblatt urged Lebanese security agencies to step up their efforts, saying: “This Israeli infiltration in the Lebanese society requires taking immediate and swift measures.” – The Daily Star

جنبلاط يضم صوته إلى نصر الله: فلتعلّق المشانق للعملاء
جاسوس «ألفا» يوفر لإسرائيل التلاعب ببيانات الشبكة
تردّدت أصداء الانجاز الأمني المتمثل في اصطياد عميل «الموساد» الموظف في شركة «الفا» (شربل ق.)، لليوم الثاني على التوالي، بالتوازي مع استنفار أمني لمواجهة هذا الانكشاف الأمني الخطير، فيما لم يصدر أي موقف لا عن الحكومة ولا عن المجلس النيابي ازاء عنوان أمني بهذا الحجم، وهو الأمر الذي حدا برئيس «اللقاء الديموقراطي» النائب وليد جنبلاط أن يضمّ صوته الى صوت الأمين العام لـ«حزب الله» السيد حسن نصرالله بالدعوة الى تعليق المشانق للعملاء الموقوفين، الذين بلغ عددهم نحو 120 عميلاً، بينهم 56 عميلاً قيد المحاكمة والبعض قيد التحقيق، فيما صدرت أحكام قضائية بحق آخرين ابرزهم العميل محمود رافع الذي صدر حكم بإعدامه لمشاركته في جريمة اغتيال الأخوين مجذوب في صيدا.
وغداة توقيف شربل، تحولت وزارة الدفاع وتحديداً مديرية المخابرات الى خلية نحل، وقد صدر بيان رسمي بتوقيف شربل فيما نوّه قائد الجيش العماد جان قهوجي بالانجاز الذي حققته مديرية المخابرات داعياً العسكريين الى اليقظة والحذر من أجل منع العدو من تحقيق اختراقات في الجسم اللبناني وبالتالي تهديد الأمن الوطني.
وسجل انعقاد سلسلة اجتماعات بين مديرية المخابرات في الجيش اللبناني وكبار المسؤولين في وزارة الاتصالات، ترافقت مع استدعاء وزير الاتصالات شربل نحاس ممثلين عن شركتي الهاتف الخلوي، وطلبه اليهم توفير كل التسهيلات اللازمة التقنية والفنية وكل ما من شأنه مساعدة التحقيق القضائي والعسكري في هذه القضية التي تمس الأمن الوطني وأمن كل مواطن لبناني.
وحسب التحقيقات الأولية، اعترف شربل ق. بقيامه بزرع برمجيات وشرائح الكترونية خاصة، زوّده بها الاسرائيلي، في محطات الارسال العائدة للشركة المشغّلة («الفا»)، بحيث تصبح إمكانية التلاعب في بيانات الاتصال لأي من الخطوط، أكثر سهولة بالنسبة إلى خبراء الاتصالات التابعين للمخابرات الإسرائيلية.. إذ يمكن والحال هذه، لخبراء العدو القيام بتعديل أي من هذه البيانات لحظة قراءتها أو ورودها من المحطات، وفقاً للشروط التي يضعها المبرمج.
وحسب الخبراء، يمكن بفضل حصول خبراء العدو على «مفاتيح الدخول» الخاصة بالبيانات السرية للخطوط الهاتفية المستخدمة، تنفيذ عمليات اتصالات وهمية، من أي خط موجود على الشبكة، وإظهار وجود اتصالات قام بها الرقم الأصلي، دون أن يكون حامل هذا الرقم قام بذلك فعلاً.
وقد بيّنت معطيات التحقيقات الأولية أنّ شربل سبق له أن شغل مناصب مهمة منذ تأسيس شركة «الفا» («سيليس» سابقاً) في العام 1994، وكان يتولى لحظة توقيفه مسؤولية في احد الأقسام الفنية الأساسية التابعة للشركة (قسم البث الراديوي والإرسال ـ Radio and Transmission)، ويدير فريقاً من المهندسين المتخصصين.
وحسب الخبراء في عالم الاتصالات، يُعدّ مجال عمل شربل، من المجالات الهامة جداً للمخابرات الإسرائيلية على صعيد اختراق منظومة الهاتف الخلوي واتاحة المجال أمامها للتلاعب، بالمعطيات الفنية في الشركة وخصوصاً القسم الذي يعمل فيه.
ويشير الخبراء الى أن شربل يستطيع من خلال موقعه توفير الآتي:
أولاً، كشف الشبكة الخلوية العائدة للشركة بالكامل امام الاسرائيلي، معلوماتياً وفيزيائياً، من خلال المعطيات التي قدّمها حول كل تفصيل فنّي ذي صلة بالشبكة، وقيامه بتثبيت أجهزة ومعدات فنية على الشبكة، تتيح لمخابرات العدو الحصول على بيانات حركة الاتصالات، وتوفير القدرة لها لتنفيذ عمليات تنصت واسعة ومركّزة على كل الخطوط الهاتفية التابعة للشركة، والحصول على ناتج كل حركة الاتصالات العائدة لهذه الأرقام (الناتج الصوتي)، وخزنها لدى الاسرائيلي.
ثانياً، تمكين العدو من تتبع ورصد الاشخاص والاهداف التي يعمل عليها، بالاعتماد على حركة الهاتف الخلوي.
ثالثاً، يوفر امكانية للعدو ليس للتنصت على مستخدمي الهاتف الخلوي وتتبع تحركاتهم وحسب، بل أنّه باستفادته من البيانات والسجلات الفنية للهاتف الخلوي، التي كان يتزوّد بها، عبر عميله في شركة الاتصالات، وقيام هذا العميل بتحديث وتوفير هذه البيانات لمشغليه الاسرائيليين بشكل دوري، على مدى سنوات عمالته، من شأن ذلك كله، تمكين العدو من السيطرة على حركة الاتصالات في الشركة والتلاعب بها، بما يخدم أهدافه ومخططاته.
رابعاً، يتضح أيضاً، أنّ أهم ما وفّره «عميل الاتصالات»، لمشغليه الإسرائيليين، هو «الكودات» والأرقام السرية الخاصة بتشغيل ومراقبة، وصيانة محطات وخلايا الاتصال المنتشرة في جميع المناطق اللبنانية، فضلاً عن نطاق إشراف وتغطية هذه المحطات، وكل ما يطرأ عليها من تحديث أو تعديل. بالإضافة إلى الأرقام و«الكودات»، الخاصة بكل هاتف خلوي، على شبكة «الفا».
ومن المتوقع أن تتركز التحقيقات اعتباراً من اليوم مع شربل حول ما اذا كان وحده يشكل شبكة أم أنه ينتمي الى شبكة مترابطة تضم آخرين، أم ينتمي الى شبكة عنقودية غير مترابطة.
من جهته، رفض وزير الاتصالات شربل نحاس الدخول في تفاصيل الاتصالات التي تمت مع قيادة الجيش، الا انه اكد ان هذا الموضوع الخطير قيد المتابعة مع الجهات المعنية. كما شدّد على التعاون معها بما يخدم الوصول الى الحقائق. وقال لـ«السفير» إن هذا الموضوع حساس، «ولنترك التحقيق يأخذ مجراه».
جنبلاط لـ«السفير»:
أخشى اغتيالات جديدة
الى ذلك، برز موقف لافت للانتباه للنائب وليد جنبلاط، دعا فيه الى التصدي لظاهرة العملاء المزروعين في البلد. وقال لـ«السفير» إن شبكات العملاء مزروعة اينما كان، والبلد مكشوف أمنياً، والخوف من ان تحصل عمليات اغتيالات جديدة تؤدي بالبلد الى الكارثة.
واكد جنبلاط ان تلك الشبكات تستدعي استنفاراً داخلياً شاملاً وعلى كل المستويات «وقد آن الاوان للضرب بيد من حديد وصولاً الى اعدام العملاء، فخلال الحرب العالمية الثانية عانت بعض الدول الاوروبية ومنها فرنسا من العملاء، وبعد الحرب تم إعدام اكثر من عشرة آلاف عميل او متعامل، بينما بعد تحرير الجنوب اللبناني في العام 2000 لم تحصل أي ضربة كف بحق العملاء، بل العكس تم إخضاعهم لمحاكمات وأحكام مهذبة».
وقال جنبلاط «الآن وبعد التجربة التي عشناها، والعملاء الذين ينبتون، اعتقد ان الإعدام هو افضل رادع».
وقال جنبلاط لـ«السفير» ان الخروق الاسرائيلية المتمادية للسيادة اللبنانية «لم تتوقف كما الشبكات التجسسية والدخول الاسرائيلي الى عمق النسيج اللبناني، وكل ذلك يتطلب اتخاذ إجراءات سريعة. وفي موازاة تلك المخاطر، تبقى المقاومة هي الاحتياط الاستراتيجي للدفاع عن لبنان، ولذلك يجب أن تتوقف نظريات الاستعجال والإلحــاح في موضوع السلاح، فهذا أمر خطــير يخدم شعار التحييد المرفــوض. وقال إن المقاومة هي سلاح احتــياطي، ويجب أن يستفيد منها العرب والمسلمون لأننا ما زلنا في بداية الطريق».

29 عامــاً علــى اعتقــال عبد اللــه عليــان

لم تفقد عائلة عبد الله خليل عليان وبعد تسعة وعشرين عاما على اعتقاله من امام منزله في بلدة البياض جنوب صور من قبل المخابرات الاسرائيلــية وعناصر ميلشيات سعد حداد الامل، من استمرار بقائه على قيد الحياة.
ويعزز امل العائلة، بحسب نجله حسن، المعلومات التي أكدها اكثر من اسير محرر في العام 1993 حول وجود والده في السجون الاسرائيلية وعدد من الوثائق التي تملكها العائلة من الصليب الاحمر الدولي الذي كان زاره في العام 1981 في مركز تل النحاس الذي كان يخضع لسيطرة ميلشيات سعد حداد، ومقابلة والدته ووالده في المكان عينه مرات عدة.
ولمناسبة ذكــرى اعتــقال عليان أقامت الجمعية اللبنانية للأســرى والمعتــقلين احتفالاً في مركز باسل الأسد الثــقافي في صور بحضور مسؤول منطقة الجنوب في حزب الله الشيخ نبيل قــاووق ورئيس الجمعية الشيخ عطا الله حمود وقائمــقام صور حسين قبلان وعوائل الاسرى ورجال دين وحــشد من الأهالي.
وطالب قاووق في كلمة ألقاها بالمناسبة الحكومة اللبنانية «بأن تتبنى قضية الأسرى والمفقودين اللبنانيين وأن تأخذها إلى مجلس الأمن وعواصم العالم»، مستغرباً كيف أن عواصم العالم تهتم بـ«رون أراد» أو «جلعاد شاليط» فيما «لا نسمع كلمة عن أسرانا والمفقودين».
وأكد «أن قضية الأسرى والمفقودين هي ملف مفتوح لن يغلق إلا بعودة كل الأسرى والمعتقلين اللبنانيين وهي أولوية بالنسبة لحزب الله وألا تهاون فيها»، مشيراً إلى أن هذه القضية تبقى في إطار المتابعة اليومية للمقاومة وقال: «إن حزب الله ملتزم بقضية الأسرى والمفقودين ومدرك لكافة مسؤولياته تجاه هذه القضية الوطنية». وقال :«نحن على ثقة بأننا سنصل إلى اليوم الذي نحرر فيه كل أسرانا من السجون الإسرائيلية»...
بدوره ناشد حمــود كل البلدان العــربية القيام بتحرك جاد ومســؤول بالتعــاون والتنسيق مع المؤسسات الانسانــية والدولية لإعداد أساطــيل وســفن وبواخــر تنــطلق من كل أرجاء العالم الحر لإطلاق حملة دولية عنوانها «الحرية لأسرانا في سجون الاحتلال الصهيوني».
وناشد نجل عليان، حسن، المجتمع الدولي والهيئات الإنســانية العــمل على الإفــراج عن والده بأسرع وقت لإعادته الى أهلـه ووطنه.
وفي ختام الحفل سلّم الشيخ قاووق زوجة الأسير عليان «الحاجة خديجة البردان» درع الحرية.

هددوا خلالها بقتل عسكري
فتح محاكمة 6 موقوفين بإحداث شغب في "رومية"
قررت المحكمة العسكرية الدائمة برئاسة العميد الركن نزار خليل وعضوية المستشار المدني القاضي حسن شحرور وبحضور ممثل النيابة العامة القاضي فادي عقيقي إعادة فتح محاكمة ستة موقوفين اتهموا بالقيام بأعمال شغب داخل سجن رومية في التاسع من آب من العام الماضي ومعاملة قوى الأمن بالشدة، وحجز حرية أحدهم وتهديده بالقتل واضرام النار في مبنى السجن.
واستدعت المحكمة الى جلسة تعقدها في 18 تشرين الاول المقبل عدداً من الشهود لسماع افاداتهم حول الحادثة الموقوف فيها كل من فوزي شحرور وحسين مطر ومحمد مطر ومحمود كما، والسوري خالد مرعي والأردني نصر أبو صيام، فيما يحاكم غيابياً علي وحسن حوماني.
وكان المتهمون وأبرزهم شحرور قد نفوا التعرض لأي عسكري أو تهديده بالقتل، كما نفوا مشاركتهم في أعمال شغب، او اضرام النار في مبنى السجن باستثناء السوري خالد مرعي الذي أقرّ بإحراق فراشه فقط لانه وضع في سجن انفرادي مدة ستة أشهر.
وأجمع الموقوفون على ان حوالى ثلاثماية سجين قد شاركوا بأعمال الشغب ورد احدهم فوزي شحرور سبب اتهامهم بالذات في القضية الى كونهم ليس لديهم أية وساطة أو مسؤول لدرء الأمر عنهم.
وعن سبب ادلائهم في التحقيقات الاولية باعترافات صريحة حول مشاركتهم في حجز أحد العسكريين وتهديده بالقتل واضرام النار في السجن، تراجعوا جميعهم عن تلك الاعترافات وقال احدهم الأردني نصر أبو صيام المحكوم 19 عاماً بجرم محاولة قتل، انهم زجوا باسمه في القضية لان هناك عصابة في السجن.
وكانت المحكمة قد استمعت خلال الجلسة الى افادة صلاح عز الدين الموقوف بجرم الافلاس الاحتيالي وإصدار شيكات دون رصيد بملايين الدولارات، ومخالفة قانون النقد والتسليف، وذلك بعدما افاد فوزي شحرور في جلسة سابقة ان عز الدين عمل على إعادة تصليح ما تم تخريبه خلال احداث الشغب في السجن، فأفاد عز الدين بعد حلفه اليمين القانونية انه تاجر ولا يعرف أياً من المدعى عليهم. وعن حادثة الشغب قال: انا أوقفت في 15 أيلول 2009 بينما الحادثة حصلت قبل ذلك في التاسع من آب من العام نفسه ولم أكن حينها موقوفاً.
وصرّح شحرور انه تعرّف على صلاح عز الدين اثناء سوقه الى المحاكم وان الأخير موقوف مع ابن عمه زنزانة واحدة.
وبعد غان طلب ممثل النيابة العامة القاضي فادي عقيقي تطبيق مواد الاتهام بحق المتهمين ترافع وكلاؤهم فطلب وكيل شحرور المحامي عادل حوماني كف التعقبات عن موكله واستطراداً إعلان براءته والا منحه أسباباً تخفيفية بالاكتفاء بمدة توقيفه. كما طلبت وكيلة حسين مطر ومحمد مطر نضال عواد البراءة لموكليها. كذلك طلبت المحامية بلسم الياس عن محمود كما والمحامية سميرة المقداد عن خالد مرعي والمحامي حسين نعمة عن نصر أبو صيام البراءة لموكليهم.
وسئل المتهمون عن كلامهم الاخير فطلبوا جميعاً البراءة.
وكانت المحكمة قد قررت في مستهل الجلسة محاكمة علي وحسن حوماني بالصورة الغيابية بعدما تبين ان الأول تبلغ علناً موعد الجلسة والثاني بواسطة والدته.

أوقف مكتب مكافحة جرائم المعلوماتية، بناء لإشارة النيابة العامة التمييزية ثلاثة شبان، لإقدامهم على نشر صور لرئيس الجمهورية العماد ميشال سليمان عبر موقع "الفايس بوك"، وكتابة عبارات تحتها مسيئة الى رئيس الجمهورية وتشكل قدحاً وذماً وتحقيراً بحقه.
وأحال النائب العام التمييزي القاضي سعيد ميرزا الى النيابات العامة بحسب الصلاحية كلاً من الموقوفين نعيم جورج حنا (27 عاماً) وأنطوان يوسف رميا (29 عاماً) وشبل راجح قصب (27 عاماً)، لإجراء المقتضى القانوني بحقهم في ضوء التحقيقات الأولية التي أجراها معهم قسم المباحث الجنائية المركزية.
كما صدر عن النيابة العامة التمييزية بلاغ بحث وتحر بحق أحمد علي شومان في القضية عينها.
وفي هذا السياق اصدر مكتب وزير العدل ابراهيم نجار التوضيح التالي: "بعد استيضاح الجهات القضائية المختصة تبين أن ما ورد في بعض وسائل الإعلام والتصريحات يخلط ويمزج بين الحريات الإعلامية والقولية والسياسية التي لا بد من صونها من جهة وبين جرائم القدح والذم ولا سيما تلك التي تهدف إلى تحقير رئيس الدولة من جهة ثانية.
واشار الى ان الكتابات والأوصاف والنعوت والتعبير غير اللائق بما فيه النشر على مواقع الإنترنت يقع تحت طائلة الملاحقة والعقاب عندما تتوفر الشروط المنصوص عنها في قانون المطبوعات وقانون العقوبات.
ولفت الى ان الحريات الإعلامية تجد حدا في لبنان وفي الدول المتحضرة عندما يشتمل مضمونها على القدح والذم والتحقير والإتهام الباطل الذي يسعى فاعله من خلاله إلى النيل من سمعة رئيس الدولة.
ورأى ان هذه الوضعية القانونية المعمول بها في كل البلدان التي شرعت قوانين العقوبات قد وضعت حدا لا يمكن تجاوزه ليفصل بين الحريات المسموح التعاطي بها وبين ما يشكل خروجا كاملا عن الاصول والقواعد الأخلاقية والسياسية والقانونية، لذلك كان من صلاحيات القضاء المختص التحرك تلقائيا لملاحقة المتجاوزين وتوقيفهم وإحالتهم على المراجع المختصة وفقا للأصول".
من جهته استغرب عضو "تكتل" التغيير والاصلاح" النائب نبيل نقولا في بيان امس مسلسل التوقيفات الاعتباطية الذي انطلق منذ اسبوع وتوج اليوم بإصدار مذكرات توقيف بحق عدد من طلاب الجامعات والشباب لارتكابهم جريمة التعبير عن الرأي التي كفلتها المادة 13 من الدستور اللبناني، مؤكداً "متابعة الموضوع حتى اطلاق هؤلاء المعتقلين وصون الدستور وحماية القوانين".

جب جنين: إضراب 21 سجيناً عن الطعام
لم تنته المعاناة التي يقاسيها المهاجرون الأجانب الموقوفون في السجون اللبنانية والمنتهية مدّة محكوميتهم، وخصوصاً أولئك الموقوفون بتهمة دخول الأراضي اللبنانية خلسة. فرغم أصوات الجمعيات الأهلية التي ترتفع بين حين وآخر منادية بإنهاء السجن التعسفي اللاإنساني الممارس بحق هؤلاء من دون أي وجه حق، لا تزال المأساة مستمرّة وفق وتيرتها المعهودة لتسطّر في كل يوم خرقاً لمعاهدات حماية حقوق الإنسان التي وقّع عليها لبنان. من هذا المنطلق ورفضاً لاستمرار هذه المعاناة، بدأ نحو 21 سجيناً من نزلاء سجن جب جنين من التابعية السودانية والمصرية إضراباً عن الطعام يوم السبت الفائت احتجاجاً على استمرار احتجازهم رغم انتهاء محكوميتهم المتفاوتة بين شهر وثلاثة أشهر، من دون ترحيلهم الى بلادهم. وفي هذا الإطار، يذكر مسؤول أمني لـ«الأخبار» أنها المرّة الأولى التي يحصل فيها إضراب احتجاجي جماعي، لافتاً الى أن حالات الإضراب كانت تُختصر بشكلها الفردي على حالة أو حالتين ضمن السجن. ويشير المسؤول المذكور الى أن إضراب عدد من الموقوفين لا يتعدّى كونه شكلياً، لكنه لا ينفي أن هناك عدداً لا بأس به منهم مضربون عن الطعام بالفعل. وهو يؤكد في المقابل أن معظم هؤلاء انتهت مدة محكوميتهم، لكن الأمن العام لم يتسلّمهم بعد، مشيراً الى أن المشكلة تكمن في عدم وجود ميزانية مخصّصة لتحمّل تكاليف سفر هؤلاء. في المقلب الآخر، يبرز موقف الأمين العام للمركز اللبناني لحقوق الإنسان وديع الأسمر الذي يرى أن هناك مسؤولية مشتركة تتقاسمها الدولة اللبنانية وسفارات المهاجرين. ويلفت الأسمر الى أن هناك تقاذفاً للمسؤولية بين الطرفين، فسفارات هؤلاء تتنصّل من مسؤوليتها في تأمين تكاليف سفر رعاياها، ملقية باللوم على الدولة اللبنانية التي تُبقيهم في سجونها. وفي هذا الإطار، يشرح الأمين العام للمركز اللبناني لحقوق الإنسان عملية حسابية بسيطة تُظهر الخسارة المادية التي تتكبّدها الدولة اللبنانية من إبقاء المهاجرين في مراكز الاحتجاز. فبحسب الأسمر، تتكلّف الدولة اللبنانية مبلغ عشرة آلاف ليرة لبنانية يومياً عن كل سجين. ويلفت الأسمر الى أن التكلفة اليومية إذا ما احتسبت على مدى شهرين، فإنها ستوفر تكاليف السفر لجميع هؤلاء.
وعلمت «الأخبار» أن أربعة موقوفين مصريين أنهو إضرابهم، فيما لا تزال المفاوضات مستمرّة مع الباقين الذين يخضعون للمراقبة اليومية بانتظار التوصّل الى اتفاق.

June 29, 2010 - Now Lebanon - Sayyed to challenge STL over past detention at public hearing

The Special Tribunal for Lebanon (STL) said Tuesday it will hold a public hearing to allow Brigadier General Jamil as-Sayyed to challenge the court over his detention for alleged involvement in the murder of former Prime Minister Rafik Hariri.

Sayyed was the chief of General Security at the time of Hariri’s 2005 assassination.

Sayyed filed a request in March for access to court investigation files in order to prove the claim he was the victim of slander and arbitrarily detained from 2005 to 2009.

The public hearing is scheduled for July 13. Sayyed and the prosecutor will each have 20 minutes to present their arguments to the court, said STL pre-trial Judge Daniel Fransen in a ruling dated June 25.

The former General Security chief was placed in temporary detention on August 30, 2005 on an arrest warrant issued by a Lebanese judge.

The STL ordered his release along with three other generals on April 29, 2009.

The tribunal was set up by a UN Security Council resolution in 2007 to find and try suspects involved in Hariri’s murder.

In its first annual report published in March, the STL announced investigators were getting closer to identifying the suicide bomber who carried out the attack.

BEIRUT — A UN tribunal probing the 2005 murder of Lebanese ex-premier Rafiq Hariri said Tuesday it will hold a public hearing to allow a general who was detained over the killing to challenge the court.

Lebanese General Jamil el-Sayed filed a request in March for access to court investigation files in order to prove his assertion that he had been the victim of slander and was arbitrarily detained from 2005 to 2009.

The Hariri murder has been widely blamed on Syria, a main backer of Hezbollah, although Damascus has roundly denied involvement.

A UN commission of inquiry had said it had evidence to implicate Syrian and Lebanese intelligence services prior to the tribunal's formation, but there are currently no suspects in custody.

The head of the UN tribunal said last month that it could file charges by the end of the year.

The paper said that the suspect’s job enabled him to have access to information few other employees have.

Telecommunications Minister Charbel Nahhas denied that the army intelligence had arrested a key employee at the mobile telephone network operator Alfa on charges of spying for Israel, as had been reported in Lebanese media on Sunday.
"Last Thursday, a technician who works for the Alfa company was arrested by the security services," the minister told Agence France Presse on Sunday.
"An investigation has been opened into possible collaboration (between the person) and Israel," Nahhas said.
The military intelligence directorate of the Lebanese Army has arrested the head of the transmission and broadcast department of Alfa -- one of the two operating GSM networks in Lebanon – on charges of providing Israel with sensitive information that can harm Lebanon's national security, Ad-Diyar newspaper reported Sunday.
Lebanon has arrested more than 70 people since launching a major crackdown in April 2009 against suspected Israeli spy networks, including security force members with equipment for monitoring communications.
Israel has not commented on the arrests.
Lebanon and Israel remain technically in a state of war, and convicted spies face life in prison with hard labor or the death penalty if found guilty of contributing to Lebanese loss of life.(Naharnet-AFP)

Un technicien travaillant pour le compte de l'opérateur de réseau mobile Alfa et soupçonné de collaboration avec l'État hébreu a été arrêté par les services de sécurité, a affirmé hier à l'AFP le ministre des Télécommunications, Charbel Nahas.
« Jeudi dernier, un technicien qui travaille pour la compagnie Alfa a été arrêté par les services de sécurité », a indiqué M. Nahas.
« Une enquête a été ouverte concernant une éventuelle collaboration (entre cette personne) et Israël », a précisé le ministre, sans autre précision.
Il a nié des informations relayées hier par les médias libanais selon lesquelles le suspect était un employé important au sein de la compagnie Alfa. « L'enquête se poursuit », a-t-il souligné.
Le quotidien ad-Diyar a indiqué hier que les services de renseignements de l'armée avaient arrêté jeudi le chef du département de transmission de la compagnie Alfa, sans le nommer. Selon le journal, ce dernier était chargé par Israël de lui transmettre des informations « sensibles, liées à la sécurité nationale » du Liban.
En avril 2009, les autorités libanaises avaient lancé une vaste opération contre les réseaux d'espionnage israéliens présumés. Plus de 70 personnes ont été arrêtées, dont des policiers et des membres des forces de sécurité équipés de matériels de surveillance et de communication dernier cri.
Israël n'a fait aucun commentaire sur ces arrestations.

BEIRUT: Lebanese security authorities have arrested a senior executive at state-owned mobile telecom firm Alfa on suspicion of spying for Israel, security sources said on Sunday.
“Army intelligence officials are questioning him. They have also arrested another ‘valuable catch,’” one of the sources told Reuters, without elaborating.
The army has refused to comment. No one was available at Alfa to comment.
Lebanese newspaper Ad-Diyar said army intelligence had arrested Alfa’s head of transmissions and broadcasting with the charge of “supplying Israel with sensitive information that harm Lebanese national security.”
Ad-Diyar, which did not mention a source, said the executive was detained on Thursday and army intelligence officials were questioning him to find out who else had been working with him.
“His job is a sensitive position because he is able to access information that few others can get,” Ad-Diyar said.
The sources did not identify the suspect’s name to Reuters and Ad-Diyar only released his initials as “S. K.”
Lebanon began a wave of arrests in April 2009 as part of an espionage investigation in which dozens of people have been arrested on suspicion of spying for Israel. A retired brigadier general of the General Security directorate was among the high profile detentions. More than 20 people have been formally charged.
Earlier this week a Palestinian refugee was also arrested.
Telecommunications in Lebanon are a sensitive issue. Politicians in the past have accused each other of eavesdropping on telephone calls.
In 2008, the government of Prime Minister Fouad Siniora had accused Hizbullah in 2008 of violating Lebanon’s sovereignty by operating a private telecommunications network, an accusation that in part sparked street fighting and brought the country to the brink of civil war.
Israel has not commented on any of the arrests.
Hizbullah, which fought a war with Israel in 2006, has called for the death penalty for all suspects convicted of spying for Israel.
Senior Lebanese security officials have said the arrests dealt a major blow to Israel’s spying networks in Lebanon and that many of the suspects played key roles in identifying Hizbullah targets that were bombed during the 2006 war.
Other suspects have been charged with monitoring senior Hizbullah officials. A Lebanese arrested on suspicion of spying for Israel confessed in March to having helped in the assassination of a Hizbullah commander in 2004. – Reuters

مع توقيف العميل (شربل ق.)، يتبين أن الإسرائيليين لم ولن يوقفوا «استثماراتهم»، لا على صعيد تجنيد العملاء والشبكات ولا من خلال تركيزهم، خاصة بعد التحرير في العام ألفين، على قطاع الاتصالات الحيوي جداً، وهو الأمر الذي يطرح علامات استفهام كبيرة حول حجم العملاء المزروعين في هذا القطاع، سواء في الشركات الخاصة أو حتى في بعض المؤسسات الرسمية، في الشبكة الخلوية أم في الشبكة الثابتة؟
يطرح هذا الموضوع، أيضاً، اسئلة كبيرة حول اشخاص آخرين أوقفوا وكانوا يتاجرون بالخطوط أو حول قضية فتحت وسرعان ما أقفلت وهي قضية محطة الباروك التي كان الإسرائيليون من خلالها يتحكمون بـ«داتا» المعلومات في قطاع الانترنت.
أيضاً يصبح السؤال مشروعاً حول حقيقة الدور الذي لعبته المديرة التنفيذية لشركة «الفا» الهولندية انيكي بوتر التي تمكنت من الفرار من لبنان في نهاية عام 2007 قبل ساعات من تنفيذ أمر إلقاء القبض عليها...
في التفاصيل، أظهرت الاعترافات الأولية للموظف في شركة «ألفا» شربل ق. ليس
تعامله مع «الموساد» الإسرائيلي وحسب، بل فداحة الأعمال التي قام بها طيلة 14 سنة من التعامل مع الإسرائيليين، من خلال وظيفته في قطاع الاتصالات، سواء في الشركة التي كان يعمل فيها حتى لحظة توقيفه مساء يوم الخميس الماضي أو قبلها في وزارة الاتصالات، وهو الأمر الذي جعل مراجع أمنية لبنانية تؤكد لـ«السفير» أننا أمام أكثر من صيد ثمين لا بل نحن أمام كنز ثمين جداً من حيث الخدمات والمعلومات التي كان يقدمها طوال هذه السنوات للإسرائيليين.
وفي التفاصيل، أن مديرية المخابرات في الجيش اللبناني، وبناءً على معلومات أولية تقاطعت من غير مصدر، تمكنت من تحقيق إنجاز أمني من خلال رصدها المدعو شربل ق. وهو من مواليد عام 1954 علمان ـ الشوف، وعندما باتت تملك أدلة حول تعامله، قررت بالتنسيق مع قائد الجيش اللبناني العماد جان قهوجي، ومع النيابة العامة، توقيفه، حيث سارع الى الاعتراف بتعامله مع «الموساد» الإسرائيلي منذ العام 1996.
وعلى الفور، أعطت النيابة العامة إذنا لمديرية المخابرات في الجيش بمداهمة مبنى شركة «الفا» في الشيفروليه في فرن الشباك صباح يوم الجمعة الماضي، وتمت مصادرة جهاز الكومبيوتر الذي كان شربل يستخدمه، كما تمت مصادرة وثائق من سيارته ومكتبه، بالإضافة الى وسائل للاتصال يجري فحصها حالياً من قبل فنيين في الجيش اللبناني.
وقد أظهرت التحقيقات الأولية مع شربل أنه ومن خلال موقعه الحساس جداً في شركة «ألفا» مكّن العدو الاسرائيلي من الدخول الى شبكة الاتصالات الخلوية والتنصت ورصد أشخاص، وهو الأمر الذي جعله يقدم خلال «حرب تموز» 2006 خدمات لا توصف للإسرائيليين، كونه كان يستطيع تحديد مكان وجود أي شخص حامل لخط «ألفا» على كل الأراضي اللبنانية وكذلك الوصول الى الأسماء والأرقام والعناوين والسيَر الشخصية الخ... فضلاً عما كان يتيحه له تحكمه الفني بالإرسال والترددات من تقديمه.
ما هو الموقع الذي كان يشغله شربل في «ألفا»؟
يقول موظفون في الشركة إن شربل كان مسؤولاً عن قسم الـ«بي تي اس» (BTS)، وهو القسم الذي تمر به المرحلة الأولى من كل الاتصالات عبر هذه الشركة، ومنه يمكن التحكم بأكثر من 650 محطة إرسال تابعة للشركة المذكورة في جميع المناطق اللبنانية، كونه هو القاعدة التي تتولى توصيلهم ببعضهم البعض، ويستطيع من خلال عمله أن يحدد موقع أي خط على هذه الشبكة، ليس في منطقة وحسب بل في أضيق نطاق ممكن (مجمع سكني)، وكان يستطيع أن يعرف من أي «ريليه» يأخذ الخط نفسه الإرسال، ذلك أنه كلما تحرك حامل الخط من منطقة الى أخرى تتغير المحطة التي تؤمن له الإرسال، حتى ولو لم يكن يجري محادثة.
وقد أظهرت التحقيقات الأولية مع شربل أن الإسرائيلي كلفه بزرع أجهزة فنية في كل المحطات التابعة للشركة، ومن خلالها أمكن تزويد الإسرائيليين بالترددات التي تعمل عليها المحطات المذكورة، الأمر الذي يجعل الاسرائيلي قادراً على التحكم بكل مسار عملية الاتصالات الخلوية في الشركة المذكورة، لا بل «يمكن القول إن «الموساد» الإسرائيلي أصبح له شبه سيطرة فنية على شركة «ألفا» بفضل شربل والأدوار الفنية التي كان يقوم بها ضمن «مسرح عمله الفضفاض» على حد تعبير مصادر أمنية لبنانية.
ويحاول المحققون الوصول الى معرفة من هم شركاء شربل في هذه العملية، ذلك أن أكثر من خبير فني أشار الى أن الموقوف ربما يكون شبكة بحد ذاتها وربما يكون جزءاً من منظومة أو شبكة أكبر... والسبب أن شربل بمقدوره الوصول الى التنصت والتسجيلات إذا كان شريكاً مع شخص آخر، أو اشخاص آخرين، وهناك ترجيحات بأنه استطاع التنصت على خطوط معينة خلال «حرب تموز»، مثلما كان بمقدوره تعطيل أي هوائي إرسال وكذلك تشغيله، فضلاً عن برمجة الخطوط، كونه كان معبراً إلزامياً لكل عملية الاتصالات في الشركة المذكورة.
وقال وزير الاتصالات شربل نحاس لـ«السفير» إنه عرف باكتشاف المشتبه به من خلال وسائل الإعلام، لافتاً الانتباه الى انه جرى الاستفسار حول الامر من شركة «ألفا» التي أكدت نبأ توقيف الموظف يوم الخميس الماضي، فأبلغناها بأننا نستغرب عدم مبادرتها الى إطلاعنا على الموضوع في حينه، مشيراً الى انه لاحظ أن الشركة مربكة.
وأوضح نحاس أن الموظف الموقوف قديم في هذا القطاع، ويمارس عمله منذ أيام شركة «سيليس»، وكان في السابق موظفاً في وزارة الاتصالات، مشيراً الى انه ليس من موظفي الصف الأول في شركة «ألفا» (أي ليس مديراً)، بل هو تقني (رئيس قسم)، من دون ان يعني ذلك التقليل من أهمية المعلومات التي ربما يكون قد حصل عليها.
وقال نحاس إنه يهتم بالموضوع من زاوية ان هناك عقد إدارة بين الدولة اللبنانية وشركة «ألفا»، ونحن يهمنا ان تكون الجهات التي نتعاطى معها محصنة وغير مخترقة.
الاستحقاق النفطي
الى ذلك، تنعقد اليوم اللجان النيابية المشتركة برئاسة الرئيس نبيه بري للبحث في اقتراح القانون المقدم من النائب علي حسن خليل حول الموارد النفطية في لبنان، ويُفترض أن تكون الاتصالات السياسية التي سبقت انعقاد الجلسة قد أسفرت عن تأمين مظلة حماية لها، نصاباً ومجريات.
وقال بري لـ«السفير» إن اللجان ستباشر في درس الاقتراح، من دون ان يعني ذلك أي تضارب مع عمل الحكومة، مشيراً الى انه متى أنجزت الحكومة مشروع القانون حول التنقيب عن النفط نضمه الى الاقتراح، وإذا وُجدت نقاط تباين او تناقض بين الطرحين، فإن اللجان المشتركة تعمل على التوفيق بينها للخروج في نهاية المطاف بصيغة واحدة.
وإذ أوضح بري ان الاتصالات التي تمت خلال الأيام الماضية ساهمت في تأمين أجواء إيجابية لجلسة اليوم وأنه تبلغ بأن لا نية بمقاطعتها من أحد، كرر التأكيد انه في حال جرى تطيير النصاب مرة أخرى، فإنه سيعاود الدعوة الى جلسات أخرى للجان، لأنه من غير المقبول ان نستمر في تضييع الوقت بينما العدو الإسرائيلي باشر في الإجراءات العملانية للتنقيب عن النفط.
وشدد وزير الطاقة جبران باسيل لـ«السفير» على تكامل عمل السلطتين التشريعية والتنفيذية من أجل الخروج بمشروع موحد، مشيراً الى وجود اتفاق مع رئيسي المجلس والحكومة على عقد جلسة اللجان وأن تحصل مناقشة تكمل روحية ما بدأته الحكومة، على أن تنعقد اللجنة الوزارية المعنية يوم غد، مشدداً على أهمية الخروج بتصور لبناني موحد لهذا الموضوع الاستراتيجي «الا اذا كانت هناك نيات مبيتة بالتعطيل وهو ما ستبينه الأيام المقبلة».
